[Colombo Telegraph is being blocked by all internet service providers and mobile networks \u2013 private and state owned \u2013 in Sri Lanka.]<\/p>\n<div id=\"attachment_121732\" style=\"width: 471px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-121732\" class=\" wp-image-121732  \" alt=\"Dhanapala\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2.jpg\" width=\"461\" height=\"259\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2.jpg 1280w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2-300x168.jpg 300w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2-1024x576.jpg 1024w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2014\/03\/Jayantha-Dhanapala2-800x450.jpg 800w\" sizes=\"auto, (max-width: 461px) 100vw, 461px\" \/><\/a><p id=\"caption-attachment-121732\" class=\"wp-caption-text\">Dhanapala<\/p><\/div>\n<p>Dhanapala, one time Under Secretary General, United Nations, was specifically asked to state his position regarding the blocking of Colombo Telegraph given his many media communiques championing the freedom of expression.<\/p>\n<p>Dhanapala, in his communications with Colombo Telegraph uses the word \u2018alleged\u2019, implying that he is not certain if indeed Dialog had blocked Colombo Telegraph.\u00a0 However, our investigations reveal that he had told his friends that he could not access Colombo Telegraph. This was 7-10 days prior to our first communication with him.\u00a0 The use of the word is inexplicable since Colombo Telegraph provided him with the <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/once-again-colombo-telegraph-blocked-dialog-and-etisalat-tamper-dns-responses\/\"><span style=\"text-decoration: underline;\">technical report<\/span><\/a> which clearly shows that Dialog was indeed blocking Colombo Telegraph.\u00a0 Dhanapala has claimed that he is a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.colombotelegraph.com\/index.php\/dialog-board-director-and-friday-forum-member-jayantha-dhanapala-fails-to-stop-ct-blockade-on-dialog-network\/\">regular reader of Colombo T<\/a>elegraph<\/span>.\u00a0 As such it would be strange indeed if he, a Director of Dialog, was using another internet service provider to access the site.<\/p>\n<p>He has explained the long delay to respond by claiming that relevant personnel in the senior management of Dialog had been abroad and therefore, presumably, unable to respond. This is strange considering the fact that Dialog is about fast and easy communications services.\u00a0 It is hard to believe that the said personnel did not enjoy roaming facilities or were uncontactable via text or email.<\/p>\n<p>Dhanapala has taken pains to distance himself from the blocking by pointing to the fact that he is an independent, non-executive director of Dialog.\u00a0 He has intimated to Colombo Telegraph that he had been advised that responding to any external communications on company affairs is the sole responsibility of the Executive Management.\u00a0 He has, accordingly, requested Colombo Telegraph to raise issues with the same.<\/p>\n<p>Colombo Telegraph, however, offers that Dhanapala was advised in all likelihood not by the Executive Management but by <a href=\"https:\/\/www.colombotelegraph.com\/?s=Chandra+Jayaratne&amp;x=8&amp;y=6\"><span style=\"text-decoration: underline;\">Chandra Jayaratne<\/span><\/a>.\u00a0\u00a0 Colombo Telegraph concludes thus considering the fact that Jayaratne, responding to a Colombo Telegraph query on the subject gave the same answer, word-to-word, that Dhanapala gave Colombo Telegraph.\u00a0 It cannot be a coincidence that Dhanapala, breaking a silence of almost a month, uses the same words that Jayaratne uses in an email to Colombo Telegraph, sent within a few hours after Jayaratne sent his observations.<\/p>\n<p>When Colombo Telegraph inquired from Jayaratne whether he had in fact advised Dhanapala, the former did not offer a denial.\u00a0 This leads us to conclude that in Dhanapala has been extremely devious and deceitful in his communications with Colombo Telegraph, all the more disturbing because his conduct does not sit well with his rhetoric with regard to freedom of expression.<\/p>\n<p>Colombo Telegraph reproduces below all relevant communications with both Dhanapala and Jayaratne so the reader can draw his or her own conclusions on the former\u2019s behavior in this matter.<\/p>\n<p>CT\u2019s first communication &#8211; 17<sup>th<\/sup> of February 2014 &#8211;<\/p>\n<p><strong>We asked Dhanapala;<\/strong><\/p>\n<p>I understand you a board of member of the\u00a0Dialog Axiata PLC.<\/p>\n<p>Could you please clarify under what law you are blocking Colombo Telegraph? Please see the technical report below;<\/p>\n<p><a href=\"https:\/\/www.colombotelegraph.com\/index.php\/once-again-colombo-telegraph-blocked-dialog-and-etisalat-tamper-dns-responses\/\">https:\/\/www.colombotelegraph.com\/index.php\/once-again-colombo-telegraph-blocked-dialog-and-etisalat-tamper-dns-responses\/<\/a><\/p>\n<p>Looking forward hear from you at your earliest convenience.<\/p>\n<p>Best<\/p>\n<p><strong>He replied within one hour;<\/strong><\/p>\n<p>Thank you for your email<\/p>\n<p>It is correct that I am a Non-executive Independent Director of Dialog Axiata and \u00a0I am thus uninformed about operational details of the company.<\/p>\n<p>The first information I have had about alleged Dialog interference with the Colombo Telegraph (of which I am a regular reader) was when I read of this in your blog. I will make inquiries about this and let you know what the position of Dialog is on this matter.<\/p>\n<p><strong>We carried this story;<\/strong><\/p>\n<p><a href=\"https:\/\/www.colombotelegraph.com\/?s=Jayantha+Dhanapala&amp;x=10&amp;y=4\">Jayantha Dhanapala<\/a>, a prominent member of the Sri Lankan civil society group, the <a href=\"https:\/\/www.colombotelegraph.com\/?s=Friday+Forum&amp;x=8&amp;y=5\">Friday Forum<\/a>, is a member of the board of directors of Dialog Axiata PLC, Colombo Telegraph learnt.<\/p>\n<p>Dialog one of Sri Lanka\u2019s key telecommunications providers, has been <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/once-again-colombo-telegraph-blocked-dialog-and-etisalat-tamper-dns-responses\/\">surreptitious blocking access<\/a> to Colombo Telegraph, over a period of time. Dhanapala was appointed to the Board of Dialog Axiata PLC on 3rd August, 2007, after serving as Under-Secretary-General of the UNO (1998-2003), among other high posts.<\/p>\n<p>When reached for comment on this matter, Dhanapala stated, via email, nearly three weeks ago now, that, he was \u201cuninformed about operational details of the company.\u201d He went on to say that, \u201cThe first information I have had about alleged Dialog interference with the Colombo Telegraph (of which I am a regular reader) was when I read of this in your blog. I will make inquiries about this and let you know what the position of Dialog is on this matter.\u201d We have not heard from him since.<\/p>\n<p>The Dialog Axiata PLC\u2019s 2013 annual report, however, is clear that: \u201cThe Board has separate and independent access to the Group\u2019s Senior Management\u2026 ..The directors, especially non-executive directors, have access to independent professional advice in the course of fulfilling their responsibilities, at the Company\u2019s expense.\u201d<\/p>\n<p>Dhanapala is an \u201cIndependent, non-executive\u201d director of Dialog, and would in accordance with company policy, have \u201cindependent access to the group\u2019s senior management\u201d, and also \u201cprofessional advice,\u201d on the legal status of the blocking.<\/p>\n<p>When contacted for comment on the \u2018aims and objectives\u2019 of the Friday Forum, a prominent member replied, that, it was committed to supporting the \u201crule of law,\u201d \u201cfreedom of information and expression,\u201d and\u00a0 \u201can independent media.\u201d<\/p>\n<p>While Colombo Telegraph has no direct information of the quantum of compensation Dialog pays Jayantha Dhanapala, the 2013 annual report of lists an amount in excess of 76 million Rupees, as directors compensation for the entire board of 8 members, who meet 7 times a year.<\/p>\n<p><strong>CT asked Chandra Jayaratne in a separate communication;<\/strong><\/p>\n<p>Comment on;<\/p>\n<p>&#8220;Jayantha Dhanapal&#8217;s irresponsible behaviour in Dialog re CT blockade&#8221;<\/p>\n<p><strong>Chnadra replied March 8 ;\u00a0<\/strong><\/p>\n<p>This mail is in response to your request for a comment from me.<\/p>\n<p>I must first make a response regards your assertion reading ; &#8220;Jayantha Dhanapal&#8217;s irresponsible behaviour in Dialog re CT blockade&#8221;<\/p>\n<p>I trust that you will kindly review the following in holding JD to account for any alleged behaviour of Dialog;<\/p>\n<p>1. JD is a non executive director and is not involved in Executive or Operational management of Dialog<\/p>\n<p>2. His responsibility and accountability are determined and limited by Company Law, Articles of Association and best practices of governance and codes of conduct linked to best board room governance practices<\/p>\n<p>3. His role and responsibility is limited to inquire from the\u00a0Executive or Operational management of Dialog any reported issues linked to best principles of Good Governance raised by you<\/p>\n<p>4. Any determinations made by JD following the review of Executive Management responses and leagl and other advise independently obtained, as well as any consequential further review of the alleged issue from a policy, policy implementation and governance perspectives, and follow up actions, must be handled by JD as a non executive director within the board processes and collective decision making of the board<\/p>\n<p>5. Any response to external communications on behalf of a company can be made only by executive management duly authorized by the board as a Company spokesperson<\/p>\n<p>I remain confident that JD will as always, including in relation to this issue, will stand by the best practices of good governance within accepted Codes of Conduct and in line with his unquestioned integrity, high principles and values and uphold his valued commitments as a benchmark civil society leader held with respect by many including myself.<\/p>\n<p>I have no objection to you including above as a response by me<\/p>\n<p>Best Regards<\/p>\n<p>Chandra Jayaratne<\/p>\n<p><strong>Within a few hours Dhanapala ( after nearly a month since his first reply) replied; <span style=\"text-decoration: underline;\"><br \/>\n<\/span><\/strong><\/p>\n<p>I refer to my email of 17 February.<\/p>\n<p>A reply from the Dialog senior management was received by me later than I expected since the relevant personnel were abroad.<\/p>\n<p>I wish to reiterate that I am an Independent non-executive director of Dialog, not engaged in any way in operational level management of the company.<\/p>\n<p>I have been advised that it is the sole responsibility of the Executive Management to respond to any external communications on company affairs.<\/p>\n<p>In view of the foregoing, I have to request you to raise any issues or clarifications you require directly with the Executive Management of Dialog.<\/p>\n<p>Yours sincerely,<\/p>\n<p>Jayantha Dhanapala<\/p>\n<p><strong>The same day we carried a story;<\/strong><\/p>\n<p><em>Jayaratne Says Dhanapala Will Stand By Best Practices, Dhanapala Pussyfoots On Illegal Web Blocking<\/em><\/p>\n<p>In an email to Colombo Telegraph, received a few hours ago, Dialog Axiata PLC Board member, a <a href=\"https:\/\/www.colombotelegraph.com\/?s=Friday+Forum&amp;x=10&amp;y=6\">Friday Forum<\/a>\u2019s key co-signatory, former UN under secretary general <a href=\"https:\/\/www.colombotelegraph.com\/?s=Jayantha+Dhanapala&amp;x=10&amp;y=4\">Jayantha Dhanapala<\/a> has advised that, \u201cit is the sole responsibility of the Executive Management to respond to any external communications on company affairs,\u201d says further that, we should \u201craise any issues or clarifications\u2026\u00a0 directly with the Executive Management of Dialog.\u201d<\/p>\n<p>He does not, it would appear, to have any plans to resign from the Dialog board.<\/p>\n<p>The issue at hand is blocking of internet access to the Colombo Telegraph website, which Dhanapala, has characterized as an \u201callegation.\u201d It has been long established that CT\u2019s website are being blocked by a number of Sri Lankan broadband providers, through uncontradicted tweets by Colombo editors and journalists like <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/selected-tweets-colombo-telegraph-unblocked\/\">BBC\u2019s Charles Havland, Groundviews\u2019 Sanjana Hattotuwa, and Nalaka Gunawardene, as far back at March 30, 2013<\/a>\u00a0and <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/we-are-blocked-but-we-will-not-be-stopped\/\">December 25, 2011<\/a>.\u00a0Further, the US State department human rights <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/sri-lankan-govt-periodically-blocked-colombo-telegraph-in-2013-us-human-rights-report\/\">report for 2013<\/a>, does clearly state that, \u201c The government periodically blocked access to the Colombo Telegraph\u2019s website\u2026\u201d.<\/p>\n<p>Surprisingly, Dhanapala, who is a \u201c<a href=\"https:\/\/www.colombotelegraph.com\/index.php\/dialog-board-director-and-friday-forum-member-jayantha-dhanapala-fails-to-stop-ct-blockade-on-dialog-network\/\">regular reader<\/a>,\u201d of Colombo Telegraph claims he only learned of what he calls an \u201calleged Dialog interference with the Colombo Telegraph.\u201d after reading Colombo Telegraph.<\/p>\n<p>In a much longer communication with Colombo Telegraph, <a href=\"https:\/\/www.colombotelegraph.com\/?s=Chandra+Jayaratne&amp;x=9&amp;y=5\">Chandra Jayaratne<\/a>, former CEO of a major Sri Lankan corporation, chairman of Ceylon Chamber of Commerce, and Friday Forum member stated, \u201cI remain confident that JD [Jayantha Dhanapala] will as always, including in relation to this issue, will stand by the best practices of good governance within accepted Codes of Conduct and in line with his unquestioned integrity, high principles and values and uphold his valued commitments as a benchmark civil society leader held with respect by many including myself.\u201d<\/p>\n<p>However, there seems to be little worth in these statements. Colombo Telegraph maintains that the blocking of its web servers through a variety of surreptitious means, is illegal and unethical. What is at stake is not, who \u201crespond(s) to any external communications on company affairs,\u201d but whether it is ethical member of the board of the company, who advocates freedom of expression and a free and independent media, as a key member of a vocal civil society group to remain in that position.<\/p>\n<p>Civil Society activist group Friday Forum so far has not condemned or issued a statement explaining its stance on <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/unp-demands-mobile-networks-reveal-who-orders-internet-censorship\/\">ongoing\u00a0illegal blocking<\/a> of web-based media.<\/p>\n<p><strong>CT also wrote to Chandra at the same time;<\/strong><\/p>\n<p>Dear Chandra,<\/p>\n<p>Thank you so much for your reply,added it to this followup story;<\/p>\n<p><a href=\"https:\/\/www.colombotelegraph.com\/index.php\/jayaratne-says-dhanapala-will-stand-by-best-practices-dhanapala-pussyfoots-on-illegal-web-blocking\/\">https:\/\/www.colombotelegraph.com\/index.php\/jayaratne-says-dhanapala-will-stand-by-best-practices-dhanapala-pussyfoots-on-illegal-web-blocking\/<\/a><\/p>\n<p>Have you advised JD ?
