{"id":131584,"date":"2014-10-10T00:20:07","date_gmt":"2014-10-09T18:50:07","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=131584"},"modified":"2014-10-10T15:23:05","modified_gmt":"2014-10-10T09:53:05","slug":"four-34-watta-residents-settle-case-against-uda-getting-two-houses-each","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/four-34-watta-residents-settle-case-against-uda-getting-two-houses-each\/","title":{"rendered":"Four \u201c34 Watta\u201d Residents Settle Case Against UDA Getting Two Houses Each"},"content":{"rendered":"<p>The case filed by four residents from \u201c34 Watta\u201d in <a href=\"https:\/\/www.colombotelegraph.com\/?s=Wanathamulla&amp;x=9&amp;y=3\"><span style=\"text-decoration: underline;\">Wanathamulla<\/span><\/a> (CA Writ 283\/2014) against the Urban Development Authority (UDA) and its officials challenging the actions of the UDA ordering them to move from their homes to an alternative location without following proper legal process, was concluded today with terms of settlement reached with the four residents by the UDA being accepted by court.<\/p>\n<div id=\"attachment_47613\" style=\"width: 331px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/07\/Gota-Raja-colombotelegraph.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-47613\" class=\"size-full wp-image-47613\" alt=\"Gotabaya Rajapaksa Secretary, Ministry of Defence and Urban Development \" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/07\/Gota-Raja-colombotelegraph.jpg\" width=\"321\" height=\"269\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/07\/Gota-Raja-colombotelegraph.jpg 321w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/07\/Gota-Raja-colombotelegraph-300x251.jpg 300w\" sizes=\"auto, (max-width: 321px) 100vw, 321px\" \/><\/a><p id=\"caption-attachment-47613\" class=\"wp-caption-text\">Gotabaya Rajapaksa Secretary, Ministry of Defence and Urban Development<\/p><\/div>\n<p>Senior counsel M. A. Sumanthiran with Viran Corea, Bhavani Fonseka, Luwie Ganeshathasan and Subhashini Samaraarachchi instructed by Sunil Watagala appeared for the petitioners. Arjuna Obeyesekere, Deputy Solicitor General appeared for the UDA. The case was heard before Appeal Court Judge Upaly Abeyratne.<\/p>\n<p>After the case was filed, on the suggestion of the Appeal Court, the four residents and the UDA entered into discussions to arrive at a settlement. The parties agreed on a settlement, the terms of which were signed on the 2<sup>nd<\/sup> of October 2014. In terms of the settlement, each of the petitioners are given 2 condominium units valued at Rs. 2,000,000 from \u201cMethsara Uyana\u201d apartment complex. The parties agreed to pay for each such condominium unit a monthly instalment of Rs. 2777.00 (<i>i.e.<\/i> an aggregate of Rs. 5554.00) over a period of 30 years. In addition, the petitioners amicably agreed to make payment of Rs. 50000 per condominium to the Condominium Management Authority in six equal consecutive monthly instalments of Rs. 8333.00 each.<\/p>\n<p>When the case was taken up today (10<sup>th<\/sup> of October 2014), court was informed that the petitioners had indicated that they were agreeable to withdraw their case, subject to the terms of settlement dated 2<sup>nd<\/sup> October 2014 that were filed in court.
