He is the first Sri Lankan to be honoured with the highest rank in the Army.<\/p>\n<div id=\"attachment_141530\" style=\"width: 310px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/03\/Sarath-Fonseka-.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-141530\" class=\"size-medium wp-image-141530\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/03\/Sarath-Fonseka--300x300.jpg\" alt=\"Fonseka\" width=\"300\" height=\"300\" \/><\/a><p id=\"caption-attachment-141530\" class=\"wp-caption-text\">Fonseka<\/p><\/div>\n<p>&#8220;he was the Army Commander during the war and particularly during the last days and weeks of the war which ended in May 2009. Several independent reports, witnesses and evidences including the report by the UN Panel of Experts have alleged that international human rights and international humanitarian laws were breached during the war and in particular at the end of the war. It is alleged war crimes were committed. The man in charge of the army that&#8217;s accused of all these was General Fonseka.&#8221; Suren Surendiran, the spokesperson of the\u00a0<a href=\"https:\/\/www.colombotelegraph.com\/?s=Global+Tamil+Forum&amp;x=9&amp;y=5\"><span style=\"text-decoration: underline;\">Global Tamil Forum<\/span><\/a> told Colombo Telegraph.<\/p>\n<p>Fonseka <a href=\"http:\/\/en.wikipedia.org\/wiki\/Sarath_Fonseka\">joined<\/a> the Sri Lanka Army in 1970 and served as the Commander of the Army from 6 December 2005 \u2013 15 July 2009. As commander, he oversaw the final phase of the Sri Lankan Civil War, which resulted in the total defeat of the militant Liberation Tigers of Tamil Eelam organisation. He also survived an assassination attempt when an LTTE suicide bomber attacked his motorcade in April 2006. Following the end of the war Fonseka was promoted to a four star rank in the Sri Lanka Army, becoming the first serving officer to hold a four star rank.<\/p>\n<p>In November 2009, Fonseka formally announced his candidature in the 2010 Sri Lankan Presidential Election.\u00a0Following his election defeat, Fonseka was arrested on 8 February 2010, and the government announced he will be court-martialed for committing &#8220;military offences.&#8221; He was found guilty of corrupt military supply deals and sentenced to three years in prison. After serving more than 2 years in prison, Fonseka was released on 21 May 2012. (C) On November 2, Foreign Minister Bogollagama called in<br \/>\nAmbassador regarding reports that the U.S. Department of<br \/>\nHomeland Security had requested that Sri Lankan Chief of<br \/>\nDefense (CHOD) Sarath Fonseka come in for a &#8220;voluntary&#8221;<br \/>\ninterview with the U.S. Immigration and Customs Enforcement<br \/>\noffice in Oklahoma City on November 4. (NOTE: Fonseka is a<br \/>\nLegal Permanent Resident (LPR) in the United States and has<br \/>\nfamily and property in Oklahoma. He currently is in the U.S.<br \/>\nvisiting family and re-establishing his LPR status. END<br \/>\nNOTE.) Bogollagama said the interview was a matter of<br \/>\n&#8220;urgency and relevance&#8221; to the government of Sri Lanka (GSL)<br \/>\nand asked for information to &#8220;help us understand and<br \/>\nformulate a proper reaction.&#8221;<br \/>\n\u00b62. (C) Ambassador recounted recent developments regarding<br \/>\nFonseka, including cancellation of his invitation to attend<br \/>\nthe recent Chiefs of Defense conference in Hawaii due to U.S.<br \/>\nconcerns about his involvement in human-rights violations<br \/>\nduring the conflict with the LTTE. She also explained that<br \/>\nas a green-card holder, Fonseka was required by U.S. law to<br \/>\nconfirm his status as an LPR. But as regards the DHS request<br \/>\nto see Fonseka on November 4, Ambassador said she did not<br \/>\nknow the specific reason for the invitation.<\/p>\n<p>\u00b63. (C) Bogollagama said what concerned the GSL were reports<br \/>\nthat a DHS lawyer had allegedly told Fonseka that the purpose<br \/>\nof the interview was to gather information about the possible<br \/>\ninvolvement in war crimes of SL Defense Secretary (and<br \/>\npresident&#8217;s brother and U.S. citizen) Gotabhaya Rajapaksa.<br \/>\nHe said the GSL was very concerned about using Fonseka as a<br \/>\nsource for &#8220;prying&#8221; into the actions of the government in Sri<br \/>\nLanka and was seeking &#8220;immediate action&#8221; to prevent anything<br \/>\nfurther from happening on November 4. He claimed that their<br \/>\nsources (presumably the law firm Patton Boggs, which embassy<br \/>\nunderstands has been hired to represent the GSL) told them<br \/>\nthat DHS had investigated war crimes in the past.<br \/>\nBogollagama said any questioning of Fonseka about SL<br \/>\n&#8220;official&#8221; information would be frowned upon by the GSL and<br \/>\n&#8220;could seriously impact our relationship.&#8221;<\/p>\n<p>\u00b64. (C) Bogollagama passed to Ambassador an Aide Memoire,<br \/>\nwhich noted that allegations against the defense secretary<br \/>\naffected the vital interests of the GSL and had already<br \/>\noccupied considerable time and attention of both governments<br \/>\nat the highest levels. It noted that the SL president had<br \/>\nformed a panel to consider the matters raised in the U.S.<br \/>\nReport to Congress on Incidents During the Recent Conflict in<br \/>\nSri Lanka and claimed that any information Fonseka had gained<br \/>\nin performance of his official duties had the status of<br \/>\n&#8220;privileged information.&#8221; It closed with a request to the<br \/>\nU.S. State Department to inform DHS that &#8220;there is every<br \/>\nreason for the interview proposed for the 4th November 2009,<br \/>\nto not take place,&#8221; and noted the GSL&#8217;s view that DHS &#8220;should<br \/>\nforthwith desist from any endeavor in this direction.&#8221;<br \/>\n(NOTE: The full text of the Aide Memoire is reproduced in<br \/>\npara 6 below. (C) We do not know how much of the story about DHS&#8217;s<br \/>\nrequest to interview Fonseka is real and how much may have<br \/>\nbeen fabricated by Fonseka himself to score points against<br \/>\nthe Rajapaksas. Whatever the reality, the prospect of U.S.<br \/>\nofficials questioning Fonseka regarding Gotabhaya Rajapaksa&#8217;s<br \/>\nactions during the conflict clearly is of great concern in<br \/>\nColombo and puts the leadership in a tight spot. While the<br \/>\nRajapaksas are keen on eliminating or neutralizing Fonseka as<\/p>\n<p>COLOMBO 00001006 002.2 OF 003<\/p>\n<p>a potential presidential candidate, who could split the<br \/>\nSinghalese vote, they do not have an interest in him being<br \/>\npressured as a war crimes accomplice, who might be willing to<br \/>\nprovide testimony against the Rajapaksas. They would like to<br \/>\nsee Fonseka go quietly into retirement as a war hero who time<br \/>\nhas passed, but the general appears to have other plans. END<br \/>\nCOMMENT.<\/p>\n<p>\u00b66. (SBU) BEGIN TEXT OF AIDE MEMOIRE (grammatical and other<br \/>\nirregularities are preserved from the original):<\/p>\n<p>The assistance of the US State Department is sought<br \/>\nconcerning an unwelcome intervention by the US Department of<br \/>\nHomeland Security (DHS), in a matter of grave concern, that<br \/>\nhas the potential to complicate the existing dialogue between<br \/>\nthe friendly Governments of Sri Lanka and of the United<br \/>\nStates.<\/p>\n<p>The Government of Sri Lanka is informed that Sri Lanka&#8217;s<br \/>\nChief of Defence Staff General Sarath Fonseka who at present<br \/>\nis in the United States, has received a letter calling him<br \/>\nfor an interview with the DHS Immigration and Customs<br \/>\nEnforcement on Wednesday, November 04, 2009 at 3:00 p.m. in<br \/>\nOklahoma City, Oklahoma.<\/p>\n<p>In addition, on the 28th of October, General Fonseka had<br \/>\nreceived a telephone call from a DHS Attorney to the effect<br \/>\nthat the intention behind the request for the interview is to<br \/>\nuse him &#8220;as a source against human rights violations done by<br \/>\nSecretary\/Defence&#8221;. It had been clarified during the<br \/>\ntelephone conversation that the reference to<br \/>\n&#8220;Secretary\/Defence&#8221; relates to Mr. Gotabaya Rajapaksa, the<br \/>\nSecretary of the Ministry of Defence, Public Security, Law<br \/>\nand Order of Sri Lanka.<\/p>\n<p>It is pertinent to recall in this regard that Mr. Gotabaya<br \/>\nRajapaksa&#8217;s duties as Secretary of that Ministry required his<br \/>\ndealing with a situation of a grave onslaught that threatened<br \/>\nthe integrity of Sri Lanka and which was launched by the<br \/>\nLTTE, an organization proscribed by several countries<br \/>\nincluding the United States, for its terrorist activities.<br \/>\nThe allegations therefore leveled against the Sri Lankan<br \/>\nDefence Secretary affect the vital interests of the<br \/>\nGovernment of Sri Lanka and have occupied considerable time<br \/>\nand attention of the respective Governments, at the highest<br \/>\nlevels. In fact, the US Ambassador in Colombo has already<br \/>\nbeen briefed of the decision taken by the President of Sri<br \/>\nLanka to appoint a Panel to consider the matters raised in<br \/>\nthe US Department of State 2009 Report to Congress on<br \/>\nIncidents During the Recent Conflict in Sri Lanka. This<br \/>\ndecision by the President stems from Sri Lanka&#8217;s unbroken<br \/>\ncommitment as a democratic nation to the Rule of Law, under<br \/>\nwhich allegations are first assessed as to whether they<br \/>\npossess any substance meriting further inquiry.<\/p>\n<p>The Chief of Defence Staff is a high level position within<br \/>\nthe Sri Lanka Government. General Fonseka is on an official<br \/>\nvisit on behalf of the Government of Sri Lanka. He traveled<br \/>\nto the United States on a diplomatic passport for prearranged<br \/>\nappointments with senior personalities of the State<br \/>\nDepartment and other US Government Agencies. Moreover,<br \/>\nwhatever General Fonseka may have become aware of during his<br \/>\nservice with the Government of Sri Lanka and in the course of<br \/>\nhis duties, has the status of privileged information. He has<br \/>\nno authority to divulge or share this information with third<br \/>\nparties, without the prior approval and consent of the Sri<br \/>\nLanka authorities.<\/p>\n<p>Given the above, it is hereby requested for the US State<br \/>\nDepartment to inform the Department of Homeland Security that<\/p>\n<p>COLOMBO 00001006 003.2 OF 003<\/p>\n<p>there is every reason for the interview proposed for 4th<br \/>\nNovember 2009, to not take place.
