{"id":157766,"date":"2016-02-18T17:39:20","date_gmt":"2016-02-18T12:09:20","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=157766"},"modified":"2016-02-18T17:41:57","modified_gmt":"2016-02-18T12:11:57","slug":"cpa-challenges-fonseka-appointment","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/cpa-challenges-fonseka-appointment\/","title":{"rendered":"CPA Challenges Fonseka Appointment"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.colombotelegraph.com\/?s=Centre+for+Policy+Alternatives&amp;x=9&amp;y=4\"><span style=\"text-decoration: underline;\">Centre for Policy Alternatives<\/span><\/a> (CPA) has yesterday filed a Fundamental Rights application challenging the appointment of Field Marshal <a href=\"https:\/\/www.colombotelegraph.com\/?s=Sarath+Fonseka&amp;x=0&amp;y=7\"><span style=\"text-decoration: underline;\">Sarath Fonseka<\/span><\/a> to fill the vacancy created by the death of Mr. M. K. A. D. S. Gunawardana, as a Member of Parliament elected in terms of Article 99A of the Constitution (the National List).<\/p>\n<div id=\"attachment_67603\" style=\"width: 190px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.colombotelegraph.com\/index.php\/cj-ape-miniha-and-the-kiri-pani-rhetoric-of-chintanaya\/saravanamuttu-photo-2\/\" rel=\"attachment wp-att-67603\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-67603\" class=\"size-full wp-image-67603\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/01\/Saravanamuttu-photo.jpg\" alt=\"Dr. Paikiasothy Saravanamuttu\" width=\"180\" height=\"232\" \/><\/a><p id=\"caption-attachment-67603\" class=\"wp-caption-text\">Dr. Paikiasothy Saravanamuttu<\/p><\/div>\n<p>&#8220;CPA\u2019s position is that in terms of Article 99A of the Constitution, only a person whose name was included in the district nomination papers or national list submitted by the relevant political party, is entitled to be nominated to fill such a vacancy.&#8221; the organisation said in a statement.<\/p>\n<p>In its Petition, CPA stated that the appointment of a person as a Member of Parliament contrary to the provisions of the Constitution violates several rights guaranteed under the Constitution and in particular the franchise which is part of the sovereignty of the people.
