Rights Activist, Nagananda Kodituwakku<\/span><\/a>, has taken President Maithripala Sirisena to task for permitting MPs to sell their tax free car permits, which has resulted in a massive loss of revenue to the government, amounting to over Rs. 30 million per each vehicle, as the car importers have been permitted to import the luxury cars free from any duty, the Colombo Telegraph learns.<\/p>\n

These permits were issued to MPs at their request to perform their work more effectively with the new vehicles provided to them for the benefit of the public, however this has turned out to be a farce, as these permits have been sold, and not used for the intended cause.<\/p>\n

In the Notice served on President Sirisena<\/span><\/a>, activist Kodituwakku noted that even though he has already reported this abuse to the Corruption Commission, the Commission had refused to investigate this abuse, citing that the loss caused to the government by this abuse had been \u2018resulted from the government policy\u2019 and therefore the Commission will not inquire into the fraud.<\/p>\n

It further states that when the refusal of the Corruption Commission to enforce the law against this organized fraud, a mandatory order against the Corruption Commission was requested by the Supreme Court, the Court too was of the same view<\/span><\/a> as the Corruption Commission, thereby allowing the corrupt MPs to have a field day at the expense of the innocent citizens.<\/p>\n

Therefore, Kodituwakku informed Sirisena that he is under duty to intervene in this regard forthwith to stop this daylight robbery of public funds, incurring a huge loss of tax revenue running into billions to the government, which is grossly improper and unreasonable as the poor gullible citizens have been burdened with huge tax of various nature imposed on almost all essential commodities including hospital bills.<\/p>\n

Since the constitutional immunity afforded to the President (Article 35) has been removed by the 19th Amendment, the activist has notified Sirisena that in the event the President fails to address this gross abuse of public funds appropriately, which affords one selected section of the society, the MPs, a privileged treatment, whilst the common citizen is treated differently, the President\u2019s failure to enforce the Rule of Law as per his constitutional oath, would be challenged in the Supreme Court, that is under duty to uphold, protect and foster the judicial power of the people without any fear or favor.<\/p>\n
