{"id":181055,"date":"2017-08-13T23:26:01","date_gmt":"2017-08-13T17:56:01","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=181055"},"modified":"2017-08-18T01:24:55","modified_gmt":"2017-08-17T19:54:55","slug":"is-time-running-out-for-constitutional-reform","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/is-time-running-out-for-constitutional-reform\/","title":{"rendered":"Is Time Running Out For Constitutional Reform?"},"content":{"rendered":"<p class=\"p1\"><b>By <a href=\"https:\/\/www.colombotelegraph.com\/?s=Javid+Yusuf\">Javid Yusuf<\/a> &#8211;<\/b><\/p>\n<div id=\"attachment_81046\" style=\"width: 110px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/04\/Javid-Yusuf.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-81046\" class=\"size-full wp-image-81046\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/04\/Javid-Yusuf.jpg\" alt=\"\" width=\"100\" height=\"100\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/04\/Javid-Yusuf.jpg 100w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/04\/Javid-Yusuf-50x50.jpg 50w\" sizes=\"auto, (max-width: 100px) 100vw, 100px\" \/><\/a><p id=\"caption-attachment-81046\" class=\"wp-caption-text\">Javid Yusuf<\/p><\/div>\n<p class=\"p3\"><span class=\"s1\">One of the most compelling items on the National Agenda currently is the question of<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/www.colombotelegraph.com\/?s=Constitutional+Reform\">Constitutional Reform<\/a>.<span class=\"Apple-converted-space\">\u00a0<\/span>And the most critical aspect of the Constitutional Reform process<span class=\"Apple-converted-space\">\u00a0 <\/span>must necessarily be the issue of the <a href=\"https:\/\/www.colombotelegraph.com\/?s=Executive+Presidency\">Executive Presidency<\/a>.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">After a near 40 year experience with this all powerful institution there is general consensus that the institution must be reformed and the Executive Presidency abolished.<span class=\"Apple-converted-space\">\u00a0<\/span>Yet there are some<span class=\"Apple-converted-space\">\u00a0 <\/span>who argue to retain this institution. While there are some who genuinely believe, albeit in the face of evidence to the contrary, that a centralised form of governance is beneficial to the country, the more vocal of the proponents of the Executive Presidency do so with vested interests.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The central premise of the call for the abolishing of the Executive Presidency is based on the need to democratize the structure of the State. Sovereignity in the Sri Lankan Constitution resides in the people and the concept of an all powerful Executive is at complete variance with the people\u2019s sovereignity<span class=\"Apple-converted-space\">\u00a0 <\/span>as it isolates itself from the sovereign people. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The founder of the<span class=\"Apple-converted-space\">\u00a0<\/span><a href=\"https:\/\/www.colombotelegraph.com\/?s=1978+Constitution\">1978 Constitution<\/a> J.R. \u00a0Jayewerdene<span class=\"Apple-converted-space\">\u00a0<\/span>justified the Executive Presidency on the basis that<span class=\"Apple-converted-space\">\u00a0<\/span>\u201cit would not be subject to the whims and fancies of Parliament.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span>Given that Parliament comprises<span class=\"Apple-converted-space\">\u00a0<\/span>the representatives of the people what this means is that the Institution of<span class=\"Apple-converted-space\">\u00a0 <\/span>the Executive Presidency<span class=\"Apple-converted-space\">\u00a0<\/span>is insulated from the will of the people which is therefore<span class=\"Apple-converted-space\">\u00a0<\/span>the antithesis of democracy.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The dangers of a Presidential form of Government were highlighted by far sighted leaders of this country well before it was<span class=\"Apple-converted-space\">\u00a0 <\/span>enacted in the 1978 Constitution. Dudley Senanayake opposed<span class=\"Apple-converted-space\">\u00a0 <\/span>it when it was first suggested. Dr. N.M. Perera<span class=\"Apple-converted-space\">\u00a0 <\/span>and Dr. Colvin R. de Silva vehemently argued against it and pointed out the negative impact it would have on the country when<span class=\"Apple-converted-space\">\u00a0 <\/span>the 1978 Constitution was being drafted. <\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">When the <a href=\"https:\/\/www.colombotelegraph.com\/?s=1972+Constitution\">1972 Constitution<\/a> was being formulated by Mrs. Sirimavo Bandaranaike\u2019s Government, J.R. Jayewerdene<span class=\"Apple-converted-space\">\u00a0 <\/span>proposed that the Executive Presidency be included in the new Constitution<span class=\"Apple-converted-space\">\u00a0 <\/span>but<span class=\"Apple-converted-space\">\u00a0 <\/span>the SLFP Leader vetoed the idea stating that such an institution did not suit Sri Lanka. This despite the fact that she would have been the<span class=\"Apple-converted-space\">\u00a0 <\/span>first beneficiary of the Executive Presidency which would have clothed her with virtually unlimited powers.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Over three decades after Sri Lanka\u2019s unhappy experience<span class=\"Apple-converted-space\">\u00a0 <\/span>with the Executive Presidency<span class=\"Apple-converted-space\">\u00a0 <\/span>the Venerable Maduluwawe Sobitha Thera launched the National Movement for Social Justice and relentlessly campaigned for the abolition of the Executive Presidency. His tireless effort culminated<span class=\"Apple-converted-space\">\u00a0 <\/span>in the victory of President Maithripala Sirisena at the Presidential<span class=\"Apple-converted-space\">\u00a0<\/span>Elections of<span class=\"Apple-converted-space\">\u00a0<\/span>January 8, 2015 whose campaign was primarily based on the platform of aboliishing<span class=\"Apple-converted-space\">\u00a0 <\/span>the Executive Presidency.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Two and a half years after the change<span class=\"Apple-converted-space\">\u00a0<\/span>of Government<span class=\"Apple-converted-space\">\u00a0 <\/span>the Constitution Reform process<span class=\"Apple-converted-space\">\u00a0<\/span>is in danger of being derailed with still no end in sight. According to the resolution setting up the Constitutional Assembly the next step in the process is for the report of the Steering Committee to be presented to the Constitutional Assembly for debate and discussion. Although it was scheduled to be placed<span class=\"Apple-converted-space\">\u00a0 <\/span>before the Constitutional Assembly in January this year it has been delayed<span class=\"Apple-converted-space\">\u00a0 <\/span>reportedly due to the SLFP<span class=\"Apple-converted-space\">\u00a0<\/span>segment in the Government dragging its feet in submitting its proposals.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The Constitutional Assembly resolution envisages that once the Steering Committee report is discussed in the Consitutional Assembly it will be sent<span class=\"Apple-converted-space\">\u00a0 <\/span>back to the Steering Committee to incorporate the suggestions made in the debate. Thereafter the Steering Committee will prepare a draft<span class=\"Apple-converted-space\">\u00a0 <\/span>of the proposed Constitution which will be debated in the Constitutional Assembly. After approval by the Constitutional Assembly the draft will be submitted to the Cabinet and after its approval will thereafter be submitted to Parliament. After<span class=\"Apple-converted-space\">\u00a0 <\/span>approval<span class=\"Apple-converted-space\">\u00a0 <\/span>by Parliament<span class=\"Apple-converted-space\">\u00a0 <\/span>it will inevitably have to be submitted to the people at a referendum.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">At the pace at which the Constitution reform process has been moving the above steps will take us at least into the end of next<span class=\"Apple-converted-space\">\u00a0 <\/span>year. With local Government Elections and Provincial Council Elections scheduled for next year and the election for President (if not abolished) slated for 2019 the chances of success with regard to Constitution making are becoming increasingly remote.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">From the noises that the Joint Opposition are making<span class=\"Apple-converted-space\">\u00a0<\/span>it is crystal clear that they will make every effort to block Constitution reform by raising the bogeys of danger to Budddhism and division of the country. The SLFP segment of the Government too<span class=\"Apple-converted-space\">\u00a0<\/span>does not have its heart in the process as evidenced by the continued<span class=\"Apple-converted-space\">\u00a0 <\/span>delay in submitting its proposals. Some of them are determined to protect the Executive Presidency and have openly claimed that President Mathripala Sirisena must listen to the wishes of the SLFP Central Committee even if it meant going against the mandate he received at the January 2015 Election.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">A<span class=\"Apple-converted-space\">\u00a0 <\/span>clear insight into the thinking of the SLFPers in Government<span class=\"Apple-converted-space\">\u00a0<\/span>can be seen when reading an interview given by Minister S. B. Dissanayake to the Nation newspaper of July 16, 2017.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">To the question<span class=\"Apple-converted-space\">\u00a0<\/span>whether the new<span class=\"Apple-converted-space\">\u00a0 <\/span>Constitution is not being given priority he says: \u201c Nothing is happening in this regard. We will put things as told by the Mahanayakes<span class=\"Apple-converted-space\">\u00a0 <\/span>of the three<span class=\"Apple-converted-space\">\u00a0 <\/span>Nikayas (sects). As the SLFP it is our decision that nothing in the present Constitution should be changed. However, even though we discuss about a new Constitution our priority is in relation to Electoral system reforms, the 20<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"><span class=\"Apple-converted-space\">\u00a0 <\/span>amendment to the Constitution.We voted in favour of the 19<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> amendment to the Constitution because it was promised<span class=\"Apple-converted-space\">\u00a0 <\/span>that electoral reforms in the form of the 20<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> amendment would be brought. Yet to this day the 20<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> amendment has not been brought.<span class=\"Apple-converted-space\">\u00a0<\/span>Therefore our priority is the<span class=\"Apple-converted-space\">\u00a0 <\/span>20<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\"> amendment. \u201c<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">When Minister S. B. Dissanyake<span class=\"Apple-converted-space\">\u00a0<\/span>stated in his interview<span class=\"Apple-converted-space\">\u00a0 <\/span>that the next SLFP Presidential candidate would be Mathripala Sirisena<span class=\"Apple-converted-space\">\u00a0<\/span>it was pointed out to him that President Sirisena<span class=\"Apple-converted-space\">\u00a0<\/span>had stated that the 2015 Presidential Election would be the only time he would contest for the Presidency. Mr. Dissanayake\u2019s<span class=\"Apple-converted-space\">\u00a0<\/span>response was<span class=\"Apple-converted-space\">\u00a0<\/span>interesting:<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">\u201cHe stated such before he took over the Chairmanship of the SLFP. Therefore such is not applicable to us. We are the ones who decide our party\u2019s candidates. It is the party that decides. If the Party decides<span class=\"Apple-converted-space\">\u00a0<\/span>the President will because he is someone who loves the party and is someone who rose in rank along with the Party. He will not turn his back on the Party\u2019s decision.\u201d<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Translated it means that even if the decision of the Party (which essentially means those who supported<span class=\"Apple-converted-space\">\u00a0 <\/span>Mahinda Rajapaksa at the last Presidential election ) is to go against the Peoples\u2019 mandate , President Sirisena has to oblige.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Further insight into the thinking of SLFPers<span class=\"Apple-converted-space\">\u00a0<\/span>in Government<span class=\"Apple-converted-space\">\u00a0 <\/span>is evidenced<span class=\"Apple-converted-space\">\u00a0 <\/span>by the actions of Ministers Susil Premajayanth and<span class=\"Apple-converted-space\">\u00a0<\/span>Faiszer Mustapha when they objected to the presence of Dr. Jayampathi Wickremaratne<span class=\"Apple-converted-space\">\u00a0<\/span>who had been invited to explain the Constitution making<span class=\"Apple-converted-space\">\u00a0 <\/span>process to the SLFP group in Government a few months ago. Dr. Jayampathi<span class=\"Apple-converted-space\">\u00a0<\/span>who is leading the process was the best person to dispel any doubts or clarify all matters regarding the process. However taking into consideration the totality of the approach of the SLFP ers in Government<span class=\"Apple-converted-space\">\u00a0<\/span>the attitude of these two Ministers was not surprising.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Minister Susil<span class=\"Apple-converted-space\">\u00a0<\/span>Premajayanth had backed<span class=\"Apple-converted-space\">\u00a0<\/span>Mahinda Rajapaksa<span class=\"Apple-converted-space\">\u00a0<\/span>at the last Presidential Elections while Faiszer Mustapha<span class=\"Apple-converted-space\">\u00a0<\/span>had spent several days in Singapore at the tail end of the campaign<span class=\"Apple-converted-space\">\u00a0<\/span>and returned<span class=\"Apple-converted-space\">\u00a0 <\/span>and crossed over a few days before the Elections only after making sure that the wind was blowing<span class=\"Apple-converted-space\">\u00a0 <\/span>in favour of Maithripala Sirisena<span class=\"Apple-converted-space\">\u00a0<\/span>and that he was now<span class=\"Apple-converted-space\">\u00a0 <\/span>the front runner. Not surprisingly therefore both of them therefore have<span class=\"Apple-converted-space\">\u00a0<\/span>no commitment or loyalty to President Sirisena\u2019s pledges to the country.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">It is therefore paramount<span class=\"Apple-converted-space\">\u00a0 <\/span>that the government moves to fast track<span class=\"Apple-converted-space\">\u00a0 <\/span>the Constitutional<span class=\"Apple-converted-space\">\u00a0 <\/span>Reform process and without any further delay<span class=\"Apple-converted-space\">\u00a0 <\/span>produce a draft<span class=\"Apple-converted-space\">\u00a0 <\/span>which can be discussed and<span class=\"Apple-converted-space\">\u00a0<\/span>adopted before the end of the year. Otherwise<span class=\"Apple-converted-space\">\u00a0 <\/span>this too may end up as another of<span class=\"Apple-converted-space\">\u00a0 <\/span>Sri Lanka\u2019s long list of lost opportunities.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">If one looks back at our past experiences of Constitution making one will notice a clear pattern.<span class=\"Apple-converted-space\">\u00a0 <\/span>In the two previous processes that succeeded the 1972 Constitution was enacted within two years of the United Front<span class=\"Apple-converted-space\">\u00a0 <\/span>Government assuming office while the 1978 Constitution was enacted one year of the UNP<span class=\"Apple-converted-space\">\u00a0 <\/span>assuming office in 1977.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The Constitution reform process that failed was Chandrika Bandaranaike Kumaratunge\u2019s process<span class=\"Apple-converted-space\">\u00a0 <\/span>which started in 1994 and was aborted in 2000 despite a concurrent and vigorous<span class=\"Apple-converted-space\">\u00a0 <\/span>media campaign to educate the masses<span class=\"Apple-converted-space\">\u00a0 <\/span>which is sadly lacking in the case of the present Government.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The bright spot in the present Constitutional reform process is the flexibility of the Tamil National Alliance and the principled<span class=\"Apple-converted-space\">\u00a0<\/span>stand of the Janatha Vimukthi Peramuna who despite their differences with the Government<span class=\"Apple-converted-space\">\u00a0 <\/span>have committed to support the process. The silence of the Muslim Parties is<span class=\"Apple-converted-space\">\u00a0 <\/span>deafening with not a word to indicate their stand on the subject or to influence the process.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">The Government including the President and Prime Minister need to act fast to achieve the goals of the Yahapalanaya<span class=\"Apple-converted-space\">\u00a0<\/span>administration with special emphasis on<span class=\"Apple-converted-space\">\u00a0 <\/span>the abolition of<span class=\"Apple-converted-space\">\u00a0 <\/span>the Executive presidency, Electoral reforms and devolution of power.
