A. Sumanthiran<\/a>, has stated the stand of his party and by and large the group of anti Sinhala, anti-Buddhist NGO lobby: \u201cour stand is that there should be a secular constitution where there is no special identification for a single religion, and instead all religions should be given equal status in the country.\u201d<\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">The bone of contention is Article 9: \u201cThe Republic of Sri Lanka shall give to Buddhism the foremost place and accordingly it shall be the duty of the State to protect and foster the Buddha Sasana, while assuring to all religions the rights granted by Articles 10 and 14(1)(e).\u201d<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>These other assurances are as follows:<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Article 10: Every person is entitled to freedom of thought, conscience and religion, including the freedom to have or to adopt a religion or belief of his choice.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Article 14 (1) (e) the freedom, either by himself or in association with others, and either in public or in private, to manifest his religion or belief in worship, observance, practice and teaching.<\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Taken together, Article 9 stands in effect negated.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">What is not noted either in constitution or in rhetoric is the fact that certain religions are invasive simply because the relevant doctrines distinguish between adherent and non-adherent in ways that make for interpretations prompting aggression of one kind of another.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>So the \u2018practice\u2019 element in Article 14 (1) (e) can sanction acts that infringe upon freedoms and general co-existence and can be defended in the name of \u2018religious freedom\u2019.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">There are other things that the secularist lobby deliberately ignores.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span>If secular is the way to go, there cannot be half-way measures.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>You can\u2019t take away the only \u2018privilege\u2019 that Buddhism has (and that too, as pointed out, a mere lip-servicing and nothing more) while being silent on the privileges enjoyed by other religious communities.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Let\u2019s begin with religious holidays. Back in the day, there were 49 \u2018Buddhist\u2019 holidays, 4\u00a0<i>poyas<\/i>\u00a0every month and an extra holiday on the day following Vesak.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>That number was slashed to one-fourth plus one, i.e. 13.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span>Christians, on the other hand, have 54: Sundays, Easter and Christmas.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span>Hindus are grossly underrepresented in comparison, having just Pongal and Mahasivarathri.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Muslims have three official holidays: Idul Fitr, Idul Adha and Milad-un-Nabi.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span>In addition, consider the following:<\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Muslims are given two hours of leave from\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_102370364\"><span class=\"aQJ\">1 pm<\/span><\/span>\u00a0every\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_102370365\"><span class=\"aQJ\">Friday<\/span><\/span>.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>That\u2019s the equivalent of 13 work days if you want to me mathematically clinical about such things.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>During the Ramadan period, Muslims have the privilege of obtaining \u2018special leave\u2019 to take part in prayers.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>A Muslim woman is given leave of four months and ten days in the event her husband dies and three months following divorce.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">We can also add that school terms were arranged so that Christmas fell during a long holiday.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>We can note that Christian schools, although required to finance themselves from 1962, were subsequently accorded public grants (since 1978).\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">There are other \u2018special\u2019 laws that are certainly at odds with the secularist vision, which would indicate a single legal system, for example the Tesavalamai Law and the Kandyan Marriage Law.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>More pernicious by way of contradicting constitutionally guaranteed freedoms would be the Muslim Marriage Law.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Thus, if equality is the objective, then all these should be erased off the constitution along with Articles 9, 10 and 14 (1) (e).<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>That is if we need to separate \u2018state\u2019 and \u2018church\u2019 (or \u2018religion\u2019).<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>What is being proposed is to remove \u2018<a href=\"https:\/\/www.colombotelegraph.com\/?s=Buddhism\">Buddhism<\/a>\u2019 and allow other religions to entrench their already privileged position in the Constitution.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>That\u2019s progressive?<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>That makes for paceful co-existence and reconciliation?\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">The easy answer is \u2018Customary Law\u2019.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Well, if it is about custom then it is also about culture.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>If that is a factor important enough to be considered, then one needs to take note of two reailties: 1) no community, religious or otherwise, has had as overpowering an influence on the history, heritage and culture of this country as Buddhists, and 2) what Article 9 does is but a weak correction of a historical injustice done to Buddhists by the British who arbitrarily abrogated the clause in the Kandyan Convention related to the protection of Buddhism.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">As things stand, religion-wise, this state is chock-full of religion and it\u2019s mostly non-Buddhist.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>And for those like Sumanthiran who are upset by a few innocuous words in a single article, they would do good to reflect on the the pervasive privileges enjoyed by Christians (and theists in general given the overwhelming presence of \u2018God\u2019 in constitutions) in officially \u2018secular\u2019 nations in Europe and of course the status of non-Islamic religions in Quranic states.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">A quick note on devolution is necessary.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>First, the lines (as pointed out by President Sirisena) were the work of British political cartographers and are not drawn from any substantiable historical narrative.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Second, there\u2019s no discussion on whether or not grievances stated warrant devolution (decentralization sorts many if not all issues). Third, demography rebels against devolution as mechanism to resolve grievances (even if they are not stripped of the frills of aspiration and myth-mongering); almost half the Tamils live outside the so-called \u2018traditional homelands\u2019 which, let us note, are also the regions which the archaeological record indicates is the heartland of Buddhism in this island.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span>Fourth, provincial councils as per the 13th Amendment, are veritable white elephants and do little more than groom thugs, miscreants and thieves for higher office.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Throw in enduring Tamil chauvinism\u00a0<i>a la<\/i>\u00a0the mouthings of Northern Province Chief Minister <a href=\"https:\/\/www.colombotelegraph.com\/?s=C.V.+Wigneswaran\">C. V. Wigneswaran<\/a> and devolution is a recipe for abiding conflict.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">Here\u2019s the danger.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>The twin assaults on the majority community could have be deliberate for the simple reason that \u2018compromise\u2019 can be reached, dumping one for the other.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>For example, it could come to a point where one is thrust as bargaining chip to obtain the other, in the give-and-take spirit.\u00a0<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\">What must be remembered is that these are two separate issues.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Both reccomendations smack of subterfuge.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Both are bombs, to use the word in the street.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>Bombs in Parliament which can precipitate much suffering outside.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span>They need to be defused.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0<\/span><\/span><\/p>\n<p class=\"m_3226138088779918887gmail-p1\"><span class=\"m_3226138088779918887gmail-s2\"><i>*Malinda Senevirtatne is a freelance writer.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span><\/i><a href=\"mailto:malindasenevi@gmail.com\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3226138088779918887gmail-s1\"><i>malindasenevi@gmail.com<\/i><\/span><\/a><i>.<span class=\"m_3226138088779918887gmail-Apple-converted-space\">\u00a0\u00a0<\/span><a href=\"http:\/\/www.malindawords.blogspot.com\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/www.malindawords.blogspot.com&amp;source=gmail&amp;ust=1509606894390000&amp;usg=AFQjCNFP4hv0BTew305AUZgX7BetD11VQg\">www.malindawords.blogspot.com<\/a><\/i><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p> [&hellip;]<\/p>\n","protected":false},"author":50,"featured_media":137374,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3,46,8],"tags":[],"class_list":["post-183655","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-colombotelegraph","category-constitutional-reforms","category-editorial"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.3 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Secularism &amp;
