\u201cFacts are stubborn things, but statistics are pliable.<\/i>\u201d \u2015 Mark Twain\u00a0<\/b>Casualty figure 146,679 \u2013 Evidentiary basis<\/b><\/span> :<\/b><\/span><\/p>\n

On 08 Jan. 2011 the Catholic Diocese of Mannar presented a comprehensive <\/span>Submission to the LLRC. In their submission,\u00a0 <\/span>Bishop Rt. Rev. Dr. Rayappu Joseph, <\/span>Rev. Fr. Victor\u00a0 <\/span>Soosai and Rev. Fr. Xavier Croos, had\u00a0 <\/span>focused , inter alia<\/i>, on the <\/span>Vanni carnage and the casualties. They have said :<\/span><\/p>\n

Extrajudicial killings<\/b><\/span><\/p>\n

\u201cBased on eyewitness testimonies, we believe thousands of people would have <\/i><\/span>been killed in the last five months of war between January \u2013 May 2009\u2026\u2026\u2026.<\/i>\u201d.\u00a0<\/span>\u201cBased on information from the Kachcheris of Mullativu and Killinochi about the <\/i><\/span>population in Vanni in early October 2008 and number of people who came to <\/i><\/span>government controlled areas after that,<\/i> 146,679 people seem to be unaccounted\u00a0\u00a0<\/i><\/b><\/span>for<\/i><\/b>. According to the Kachcheri, <\/i>the population in Vanni was 429,059 in early <\/i><\/b><\/span>part of October 2008<\/i><\/b> \u2026\u2026..According to UN- OCHA update as of 10th July 2009,<\/i> <\/i><\/b><\/span>the total number of people who came out of the Vanni to government controlled <\/i><\/b><\/span>areas after this is estimated to be 282,380. \u201d<\/i><\/b><\/span>Govt.\u00a0 <\/span>tactics<\/b><\/span>:<\/span><\/p>\n

The government had used all possible tactics, including coercion, cajolery and <\/span>manipulation, to get UN agencies and foreign missions in Sri Lanka to cut down on\u00a0<\/span>the war casualty figures. All of them had, willy nilly, complied with the\u00a0government\u00a0<\/span>bidding and cooperated with the regime.\u00a0<\/span>How could the Rajapaksa regime,\u00a0<\/span>which had the gall and temerity to intimidate <\/span>UN and such other agencies, tolerate the nasty noise from\u00a0<\/span>the Tamil clergy? After\u00a0<\/span>all, they are not\u00a0<\/span>members of the privileged Buddhist clergy!<\/p>\n

Bishop faced threats<\/b><\/span><\/p>\n

Pursuant to LLRC submission and seeking clarification on the 146,679 <\/span>unaccounted persons, the Rev. Bishop Rayappu Joseph was interrogated by the <\/span>TID-CID police. It was an attempt to intimidate him and the clergy into silence.\u00a0<\/span>Also, the Rev. Bishop faced threats of harm and harassment from Minister\u00a0Mervyn Silva, the JHU party and the Sinhala media which called him a\u00a0 <\/span>\u2018Tiger\u2019.\u00a0<\/span>During this time, Rajapaksas\u2019 hitmen from the security sector were engaged in\u00a0<\/span>silencing voices of dissent with ghoulish relish.<\/p>\n

Dr. Senewirante\u00a0<\/span>raised\u00a0<\/span>concerns<\/b><\/span><\/p>\n

Dr. Brian Senewiratne of Australia, the doughty champion of the oppressed Tamils <\/span>and other underdogs, had commended the Rev. Bishop\u2019s LLRC presentation as <\/span>\u201c the only document ever published that gives the actual number of people who <\/i><\/span>are<\/i> unaccounted for after the war \u2013 a staggering\u00a0 <\/span>146,679.\u201d<\/i>\u00a0 <\/span>In the same vein, Dr. <\/span>Senewiratne had raised concerns about the safety of the Rev. In the face of menacing threats to the Rev. Bishop, the Christian Solidarity <\/i><\/span>Movement<\/i> (CSM) comprising mostly of priests and nuns from the majority <\/span>community had raised their voice in solidarity with the Rev. Bishop and defended <\/span>his concerns for the Tamil people.\u00a0 <\/span>Indeed, their courage is exemplary\u00a0<\/span>!\u00a0<\/span>( Sunday Leader , 29 Dec. 2012<\/i> \u2013 \u201c Christian Organization Condemns Grilling Of <\/i><\/span>Bishop \u201c<\/i> )<\/span><\/p>\n

Corroborative factors<\/b><\/span><\/p>\n

In response to the UNSG\u2019s (PoE) Report<\/i>, which was critical of the UN\u2019s acts of <\/span>omission and commission during the war,\u00a0 <\/span>Ban Ki-moon appointed an \u2018Internal <\/i><\/span>Review Panel on UN Actions in Sri Lanka<\/i>\u2019.\u00a0 <\/span>The Review Panel\u2019s Report<\/i> dated Nov.\u00a0<\/span>2012 impliedly validates the claim that 146,679 people had remained missing and unaccounted for.<\/p>\n

\u201c46. \u2026\u2026..And, determination of the numbers of people in the Wanni was central <\/i><\/span>to all of this humanitarian action.<\/i>\u00a0 <\/span>A Wanni local government official testified to <\/i><\/b><\/span>the LLRC that during the final stages there had been 360,000 IDPs in her district<\/i><\/b> <\/span>alone<\/i><\/b>. Others who submitted testimony to the Commission quoted estimates of\u00a0<\/i><\/b><\/span>local Government authorities that placed the total population number in <\/i><\/b><\/span>October 2008 at 429,000<\/i><\/b>. Yet national Government authorities in Colombo <\/i><\/b><\/span>insisted that there were no more than about 70,000 people<\/i><\/b>. The UN believed <\/i><\/b><\/span>there were up to 350,000 civilians<\/i><\/b>, \u2026\u2026\u2026\u2026\u2026. and<\/b> used an assistance-planning <\/i><\/b><\/span>figure of 200,000.<\/i><\/b> The reception and registration of almost 280,000 people in IDP <\/i><\/span>internment camps when they left the Wanni is an indication of the scale of <\/i><\/span>inaccuracy in the national Government\u2019s figures.<\/i> The Government\u2019s denial of the\u00a0<\/i><\/b><\/span>real numbers buttressed arguments against increasing humanitarian convoys\u00a0<\/i><\/b>and was later used to rebut reports of high civilian casualties<\/i><\/b>\u2026..\u201d(Vide \u2013 Para.\u00a0<\/i><\/b>46 at Page 18 of the Review Panel\u2019s Report<\/i><\/b>)<\/p>\n

Thus, the UN believed there were up to 350,000 civilians and yet used an <\/span>assistance-planning figure of 200,000. What happened to the remaining 150,000 ? . <\/span><\/p>\n

Journo\u2019s\u00a0 <\/span>query<\/b><\/span><\/p>\n

Journalist Mr.Kusal Perera had raised this query while urging Mr. Ranil <\/span>Wickremesinghe\u00a0 <\/span>(then, Opposition Leader) and Mr. Sampanthan (TNA Leader), to <\/span>demand details of war casualties from Ban Ki-moon. He had pointed out:\u00a0<\/span>\u201c(T)his leaves a massive deficit of 150,000 human lives unaccounted for. It comes <\/i><\/span>also close to the 146,679 people missing and unaccounted for, as submitted by Rt. <\/i><\/span>Rev. Mannar Bishop Dr. Rayappu Joseph to the LLRC.<\/i>\u201d (Colombo Telegraph, 16 <\/i><\/b><\/span>Nov.2012<\/i><\/b> \u2013\u201cDemand Details of War Casualties\u2026\u2026<\/i>..\u201d )<\/span><\/p>\n

Arrest and Detention of Doctors<\/b><\/span><\/p>\n

Direct and circumstantial evidence would disclose that the government had a <\/span>host of horrible crimes to hide and that they sought to terrorize and muzzle the <\/span>witnesses and suppress\u00a0 <\/span>material \/ forensic evidence.\u00a0<\/span>Five Tamil doctors, T. Varatharajah, T. Sathyamurthi, V. Shanmugarajah and two\u00a0<\/span>others\u00a0<\/span>were deeply embedded in the so-called NFZ with multitude of civilians, who were trapped and doomed to be cannon fodder. Risking their own lives amidst carnage and cannon fire, they treated hundreds of severely wounded\u00a0civilians in understaffed, makeshift hospitals. A vile and vengeful government\u00a0<\/span>arrested and detained them, accusing them of giving \u201cfalse information\u201d about\u00a0\u00a0<\/span>the casualties to the media.<\/span><\/p>\n

The\u00a0 <\/span>UTHR(J)<\/i> Report has recounted the bizarre twists in the doctors\u2019 case:\u00a0<\/span>(<\/i>According to ) \u201d A report\u00a0 <\/span>four\u00a0 <\/span>days later \u2026.the doctors were being suspended on\u00a0<\/i>the charge of making exaggerated statements to the international media. <\/i><\/span>Ministry spokesman \u2026\u2026.confirmed that the doctors are being questioned by <\/i><\/span>Military Intelligence. \u2026\u2026<\/i> And said that the \u2018Health Secretary would take <\/i><\/span>disciplinary action against the doctors \u2026\u2026\u201d <\/i><\/span><\/p>\n

\u201cComparing what the doctors said with the impressions conveyed by civilians, <\/i>the\u00a0<\/i><\/b><\/span>figures of dead and injured given by the doctors sound fairly realistic and the\u00a0<\/i><\/b><\/span>forensic evidence from buried bodies should still be possible unless the evidence <\/i><\/b><\/span>has been destroyed. \u2026\u2026.<\/i><\/b>\u201d <\/i>( UTHR (J),\u00a0 <\/span>Spl.Report No.34, 13 Dec. 2009 – <\/i><\/b>vide<\/i>\u00a0 <\/span>3.3<\/i><\/b> )<\/i><\/span><\/p>\n

Diabolic designs exposed<\/b><\/span><\/p>\n

The Agence France-Presse (AFP) <\/i>reported that\u00a0 <\/span>\u201cthe five doctors retracted their <\/i><\/span>claims while in military detention. After recanting, eventually the doctors were <\/i><\/span>reportedly released and given their jobs back \u201c (<\/i>AFP- 5 Apr. 2010<\/i><\/b>).<\/i><\/span><\/p>\n

The circumstances of their arrest, captivity, \u00a0 <\/span>retraction and release had caught <\/span>global media attention and the diabolic designs of a ruthless regime stood <\/span>nakedly exposed.<\/span><\/p>\n

Balachandran\u00a0 <\/span>et al<\/i> committed suicide\u00a0 <\/span>or\u00a0 <\/span>hara-kiri ?<\/b><\/span><\/p>\n

Lord Naseby wants the British Government to acknowledge\u00a0 <\/span>\u201cthat no one in the <\/i><\/span>Sri Lankan Government ever wanted to kill Tamil civilians<\/i>.\u201d<\/span><\/p>\n

Does Lord Naseby suggest that Prabhakaran\u2019s 12-year-old son Balachandran, seen\u00a0<\/span>alive in army custody and was later found lying with five bullet holes in his chest,\u00a0had committed suicide? How did his five bodyguards die? Who raped, ravished <\/span>and killed Isaipriya<\/i> and numerous other captive females ? What happened to host\u00a0<\/span>of other surrendees<\/span> ? How did five Tamil students die on 2 Jan. 2006, at\u00a0<\/span>Trincomalee? How did the 17 Action contre\u00a0 <\/span>La\u00a0 <\/span>Faim<\/i> Aid Workers die on 4 <\/span>Aug. 2006 at Muthur? Who killed 13 civilians in May 2006 at Allaipiddy? Did they <\/span>all commit hara-kiri<\/i> ?. There are hundreds of such horrific incidents and scores of\u00a0<\/span>questions of similar import crying out for answers from you and the likes of you,\u00a0Lord Naseby ! <\/span><\/p>\n

Why\u00a0 <\/span>freeze\u00a0 <\/span>in\u00a0 <\/span>fear?<\/b><\/span><\/p>\n

Lord\u00a0 <\/span>Naseby further urges that the West, in particular the US and UK, \u201cmust <\/i><\/span>remove the threat of war crimes and foreign judges that overhangs and <\/i><\/span>overshadows all Sri Lankans, especially their leaders<\/i>.\u201d<\/span><\/p>\n

If\u00a0 <\/span>Sri Lanka had not committed any war crimes as Naseby asserts, his patrons can\u00a0<\/span>face a probe fairly and squarely and fight it out. Why do they call it a threat and\u00a0why freeze in fear? If they are as white as lily, why flee from foreign judges? <\/span><\/p>\n

Foreign Minister\u00a0 <\/span>in\u00a0 <\/span>dilemma<\/b><\/span>!<\/b><\/span><\/p>\n

The \u2018patriotic\u2019 politicians and media persons had fulminated against the Foreign <\/span>Minister for his initial indifference to Naseby\u2019s revelations.\u00a0<\/span>It is somewhat\u00a0<\/span>na\u00efve of these people to expect\u00a0<\/span>Mr. Tilak Marapana, a veteran professional\u00a0<\/span>with\u00a050-years-of legal training and experience, including his stellar stints as the <\/span>Solicitor General and, later, Attorney-General of the country, to get excited and <\/span>shout\u00a0<\/span>\u201cEureka !\u201d at Lord Naseby\u2019s\u00a0 <\/span>gimmick.!\u00a0 <\/span>Mr. Marapana would have instantly\u00a0<\/span>known the probative value of\u00a0 <\/span>Nasby\u2019s\u00a0 <\/span>dud disclosure.\u00a0<\/span>Then, why did he later say that he wanted to use Naseby\u2019s disclosure as an ace?\u00a0<\/span>What else can he do?\u00a0Mr.Marapana, the politician, had to keep the ghosts in good humour.<\/span><\/p>\n

According to the Island (11 Dec. 2017<\/i><\/b>)<\/i>, Lord\u00a0 <\/span>Naseby is determined to pursue the\u00a0<\/span>matter and ascertain the truth about the actual war casualty figures.<\/p>\n
