{"id":186113,"date":"2018-01-06T04:43:28","date_gmt":"2018-01-05T23:13:28","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=186113"},"modified":"2018-01-09T00:11:22","modified_gmt":"2018-01-08T18:41:22","slug":"has-bond-commission-cleared-pm-of-any-involvement","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/has-bond-commission-cleared-pm-of-any-involvement\/","title":{"rendered":"Has Bond Commission \u2018Cleared\u2019 PM Of Any \u2018Involvement\u2019?"},"content":{"rendered":"<p class=\"p2\"><span class=\"s2\"><b>By\u00a0<\/b><\/span><span class=\"s2\"><b><a href=\"https:\/\/www.colombotelegraph.com\/?s=Amrit+Muttukumaru+\">Amrit Muttukumaru<\/a> &#8211;<\/b><\/span><\/p>\n<div id=\"attachment_142887\" style=\"width: 154px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/04\/Amrit-Muttukumaru.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-142887\" class=\"size-thumbnail wp-image-142887\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/04\/Amrit-Muttukumaru-144x150.jpg\" alt=\"\" width=\"144\" height=\"150\" \/><\/a><p id=\"caption-attachment-142887\" class=\"wp-caption-text\">Amrit Muttukumaru<\/p><\/div>\n<p class=\"p4\"><span class=\"s2\">Although we the commoners have to await the Bond Commission Report being placed in the public domain prior to commenting whether there is a silver lining for our beloved country wallowing in the mire of virtual unrestrained corruption, Cabinet Minister <\/span><span class=\"s3\">Faizer Mustapha has <a href=\"http:\/\/www.dailymirror.lk\/article\/Commission-clears-PM-Minister-Musthapha-143366.html\">affirmed<\/a>:<\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">\u201cBond Commission had clearly said that there was no involvement whatsoever by Prime Minister Ranil Wickremesinghe in the bond controversy.\u201d<\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">This is preposterous since at the core of the alleged Bond Scam are the following indisputable facts:<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><b>Core of Bond Scam<\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">1) \u2018Conflict of interest&#8217; arising from then Central Bank Governor<i> <\/i>Arjuna Mahendran\u2019s son-in-law, Arjun Aloysius &#8211; owning\/controlling PTL (Perpetual Treasuries Limited) &#8211; a Primary Dealer. <\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">2) Arjuna Mahendran &#8211; a foreign national being handpicked for the position of Governor, Central Bank of Sri Lanka (CBSL) by the Prime Minister although aware of the \u2018Conflict of interest\u2019. The PM himself confirmed this in his affidavit and while testifying before the PCoI.<\/span><\/p>\n<p class=\"p8\"><span class=\"s3\">3) <\/span><span class=\"s2\">The CBSL the issuing agency for Treasury Bonds which normally falls under the Ministry of Finance being brought under the purview of the Prime Minister.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">4) The PM continued to have Mahendran as CBSL Governor although he was aware that Mahendran had reneged on his \u2018assurance\u2019 to him that his son-in-law (Arjun Aloysius) will sever all links with PTL prior to his appointment as CBSL Governor.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">5) The PM robustly defended and endorsed Mahendran for a second term despite the widespread perception of Mahendran\u2019s role in the alleged Bond Scam.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">6) Being fully confident on the propriety of the issuance of Bonds, the PM robustly defended the same in Parliament despite the evidence that subsequently transpired before the PCoI.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">7) During his testimony at the Bond Commission the PM stated: \u201cMr. Aloysius did say to me he need bit of time to dispose his share holding to get good price. (shares of Perpetual Treasuries Ltd or shares he held in other entity in the name of PTL). I met him (Aloysius) at one or two parties, and there he told me that he was pursuing his interests in Mendis distilleries.\u201d<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">What is at issue is the integrity of the CBSL. How can the PM who is also responsible for the CBSL even consider a \u201cbit of time\u201d to resolve a \u2018conflict of interest\u2019 concerning the Governor and that too articulated \u201cat one or two parties\u201d?<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\"><b>Other Issues<\/b><\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">1) R. Paskaralingam is Senior Advisor to the Prime Minister. <\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">It was revealed by the Chairmen and senior officials concerned of the Bank of Ceylon, People\u2019s Bank and National Savings Bank during their testimony at the PCoI that then Finance Minister <a href=\"https:\/\/www.colombotelegraph.com\/?s=Ravi+Karunanayake\">Ravi Karunanayake<\/a> had \u2018instructed\u2019 them at two meetings convened by him in March 2016 \u201cto make bids at the treasury bond auctions at lower interest (yield) rates\u201d resulting in their respective banks being deprived of \u2018substantial profits\u2019. It was alleged during their testimony that these \u2018instructions\u2019 were given in the presence of the PM\u2019s <\/span><span class=\"s2\">Senior Advisor, R. Paskaralingam.<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">The PM in his affidavit denied any knowledge of such meetings and in his testimony also denied any knowledge of his Senior Advisor attending such meetings. If indeed Mr. Paskaralingam attended these meetings, would it not have been SOLELY in his capacity as Senior Advisor to the PM? Is there not a major management failure in this respect? <\/span><span class=\"s3\">Surely the country does not need the services of McKinsey &amp; Company\u00a0to arrive at this conclusion!<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">Those who testified included: Chairman, Bank of Ceylon<\/span><span class=\"s3\"><i> <\/i>(Ronald<i>\u00a0<\/i>Perera)<i>,<\/i> Chairman, People\u2019s Bank (<\/span><span class=\"s2\">Hemasiri Fernando) and Chairman, National Savings Bank <i>(<\/i><\/span><span class=\"s3\">Aswin<i>\u00a0<\/i>de Silva)<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">2) Dr. <\/span><span class=\"s3\">Harsha de Silva is Deputy Minister, Ministry of National Policies and Economic Affairs where the Prime Minister is the Minister in charge. <\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">On his role in the <\/span><span class=\"s2\">controversial \u2018footnotes\u2019 saga in the alleged Treasury Bond scam, <\/span><span class=\"s3\"> \u2018<a href=\"http:\/\/www.sundaytimes.lk\/161030\/columns\/the-dramatic-bond-issue-how-cope-went-beyond-bioscope-215374.html\"><em>The Sunday Times<\/em><\/a>\u2019 of 30 October 2016 reported as follows:<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><i>\u201cAs is clear, the thrust of these footnotes is to make clear that Mahendran has not been responsible of any impropriety.<\/i><\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><i>The UNP is confident that it can, through the documentation Deputy Minister Harsha de Silva has received, prove its case that its man Arjuna Mahendran is not to blame.\u201d<\/i><\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">Response to Journalist on \u2018Footnotes\u2019<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><i> <\/i>\u201cMinister do you at any point now regret the footnotes on that COPE report? Going by what is being revealed now, do you regret it or was there a lack of information at that point?\u201d<\/span><\/p>\n<p class=\"p7\"><span class=\"s3\">Watch his response from<\/span><span class=\"s2\"> (21:25:40) \u2013 what does it indicate?<\/span><\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/hL0p8o580K4\" width=\"900\" height=\"500\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p class=\"p4\"><span class=\"s3\">Although requested, to date <\/span><span class=\"s2\">Dr. <\/span><span class=\"s3\">de Silva has not clarified this position. <\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">3)<i> <\/i>Ms. Rosy Senanayake is Deputy Chief of Staff in the Prime Minister\u2019s \u2018Core Team\u2019 at \u2018Temple Trees\u2019.<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">It <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/bond-scam-rosy-uses-pm-privileges-does-a-ravi-k\/\">was alleged at the Bond Commission that COPE documents<\/a> relating to PTL CEO Kasun Palisena\u2019s <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/bond-scam-rosy-uses-pm-privileges-does-a-ravi-k\/\">testimony was given<\/a> to <i>\u2018PTL owner\u2019<\/i> Arjun Aloysius by <i>\u201cRosy\u2019s son\u201d<\/i> identified as <i>\u201cKanishka Senanayake\u201d<\/i>.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">This has been denied by Ms. Senanayake on the grounds she was not a COPE member after the August 2015 parliamentary elections. Does not the question arise whether in her capacity as \u2018Deputy Chief of Staff\u2019 in the PM\u2019s \u2018core team\u2019 she would have access to COPE reports? Although requested, to date she has not clarified this position. <\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><b>Unusual Decisions<\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">Despite all this, did not the PCoI take some unusual decisions in regard to the PM?<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">1) Unlike in the case of other witnesses, the PM was given questions in advance by the PCoI <\/span><span class=\"s3\">to enable him to provide answers by way of affidavit.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">2) Unlike in the case of other witnesses, the PCoI decided to invite the AG himself who wasn\u2019t involved in the investigation up to that point to personally lead evidence for the first time.\u00a0Up to this time, Messrs. Dappula de Livera and Yasantha Kodagoda &#8211; Senior Additional Solicitor General and Additional Solicitor General respectively lead evidence.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">3) Unlike in the case of other witnesses which included former Finance Minister Ravi Karunanayake who were grilled by Messrs. Dappula de Livera and Yasantha Kodagoda, limited questions were posed to the PM. The PM was at the PCoI reportedly for less than an hour to clarify matters arising from his affidavit<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">4) Much is being made that the PM \u2018volunteered&#8217; to come before the PCoI although \u2018not summoned&#8217; like the other witnesses. The media has even reported that PCoI Chairman \u2013 K. T. Chitrasiri (Supreme Court Judge)<span class=\"Apple-converted-space\">\u00a0 <\/span><\/span><span class=\"s2\">\u201cemphasised that the question of compelling PM Wickremesinghe to appear before the commission had never arisen\u201d.<span class=\"Apple-converted-space\">\u00a0 <\/span>I respectfully ask (i) in view of the facts and circumstances should not the PM have been \u2018summoned\u2019 like the other witnesses? (ii) if not why? (iii) what does this indicate?<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\"><b>Conclusion<\/b><\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">In the above context, if <\/span><span class=\"s2\">Cabinet Minister <\/span><span class=\"s3\">Faizer Mustapha\u2019s assertion:<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">\u201cBond Commission had clearly said that there was no involvement whatsoever by Prime Minister Ranil Wickremesinghe in the bond controversy\u201d is factual,<span class=\"Apple-converted-space\">\u00a0 <\/span>this in conjunction with the appalling state of governance, terrible corruption in high places and impunity clearly indicates the presence of a \u2018Deep State\u2019. It needs emphasis the PCoI is a \u2018Presidential Commission\u2019 in which two of its three members are sitting Supreme Court judges.<\/span><\/p>\n<p class=\"p4\"><span class=\"s2\">A consequence of this are the \u2018<\/span><span class=\"s3\">fly-by-night\u2019 FDIs the country is attracting in recent times which include some who were even nabbed at the airport with undeclared cash. The only exception are the controversial Chinese investments which are largely driven by geo-political considerations.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">After nearly 70 years of independence the country has come to such a sorry pass that we have to suffer the ignominy of: <\/span><\/p>\n<p class=\"p10\"><span class=\"s2\"><i>\u201c<\/i>The US State Department\u201d reportedly fielding \u201ca Resident Legal Advisor in Colombo to provide anti-corruption and asset recovery training and also support the Commission to Investigate Allegations of Bribery and Corruption (CIABOC)\u201d<\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">It is noted that when the PM came before the Bond Commission to testify as its last witness, he was \u201caccompanied by his attorney President&#8217;s Counsel Faiz Mustapha\u201d who is the father of the said Cabinet Minister, <\/span><span class=\"s3\">Faizer Mustapha.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p> [&hellip;]<\/p>\n","protected":false},"author":163,"featured_media":142887,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3,46,8],"tags":[],"class_list":["post-186113","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-colombotelegraph","category-constitutional-reforms","category-editorial"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.3 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Has Bond Commission \u2018Cleared\u2019 PM Of Any \u2018Involvement\u2019?
