Dr.\u00a0Indrajit Coomaraswamy who assumed office as CBSL Governor from\u00a03 JULY 2016 must bear SOME responsibility. The <\/span><span class=\"s2\">checkered response of the CBSL particularly in recent times <\/span><span class=\"s1\">to its regulatory obligations has no doubt aided this outcome. <\/span><\/p>\n<p class=\"p6\"><span class=\"s1\">Discerning visitors to Sri Lanka have commented on the mismatch on the one hand of a country with a weak economy and infrastructure <\/span><span class=\"s2\">bending\u00a0over\u00a0backwards<\/span><span class=\"s1\"> for FDIs and financial assistance from multi-lateral agencies and on the other the swanky high-rise apartments and fancy restaurants dotting the city of Colombo with high-end vehicles which would do even a first world country in Europe proud. <\/span><\/p>\n<div id=\"attachment_188197\" style=\"width: 871px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2018\/03\/Typical-Money-Laundering-Scheme.jpeg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-188197\" class=\"wp-image-188197 size-full\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2018\/03\/Typical-Money-Laundering-Scheme.jpeg\" alt=\"\" width=\"861\" height=\"435\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2018\/03\/Typical-Money-Laundering-Scheme.jpeg 861w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2018\/03\/Typical-Money-Laundering-Scheme-300x152.jpeg 300w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2018\/03\/Typical-Money-Laundering-Scheme-768x388.jpeg 768w\" sizes=\"auto, (max-width: 861px) 100vw, 861px\" \/><\/a><p id=\"caption-attachment-188197\" class=\"wp-caption-text\">Image courtesy &#8211; Know Your Customer (KYC)<\/p><\/div>\n<p class=\"p7\"><span class=\"s1\">Crucial issues of governance incidental to the egregious bond scam thrown up by witnesses at the <\/span><span class=\"s2\">Presidential Commission of Inquiry (PCoI)<\/span><span class=\"s1\"> probing the <a href=\"https:\/\/www.colombotelegraph.com\/?s=Bond+Scam+\">issuance of Treasury Bonds<\/a> by the CBSL which include possible tax evasion, money laundering and bank malpractice are not even on the radar of the CBSL. The only exception is the \u2018suspension\u2019 of Pan Asia Bank (PABC) in relation to its \u2018primary dealer\u2019 activities. <\/span><\/p>\n<p class=\"p7\"><span class=\"s3\"><b>Money Laundering \/ Tax Evasion<\/b><\/span><span class=\"s1\"><b>?<\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">What action has CBSL taken in relation to:<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\"><strong>1)<\/strong><b> <\/b><\/span><span class=\"s2\">Kaushitha Rathnaveera, <\/span><span class=\"s1\"> a Senior Dealer of PTL (<a href=\"https:\/\/www.colombotelegraph.com\/?s=Perpetual+Treasuries+Limited\">Perpetual Treasuries Limited<\/a>) disclosing to the PCoI that \u201cmillions\u201d encashed by him were \u201cseveral times\u201d left on \u201cPTL CEO <a href=\"https:\/\/www.colombotelegraph.com\/?s=Kasun+Palisena\">Kasun Palisena<\/a>\u2019s chair\u201d.\u00a0 \u00a0<\/span><\/p>\n<p class=\"p10\"><span class=\"s1\">Nuwan Salgado, Chief Dealer of PTL disclosing to the PCoI that on the \u201cinstructions of PTL CEO Kasun Palisena\u201d he maintained a record of payments to \u201cinformants\u201d code named as \u2018Charlie\u2019, \u2018Tango\u2019 and others.<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\"><strong>2)<\/strong> B.R. Sinniah, Chief Financial Officer of GTLPL (Global Transportation and Logistics Pvt Ltd) said to be controlled by former Finance Minister Ravi Karunanayake\u2019s family in his testimony to the PCoI disclosing:\u00a0\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">\u201cChairman \u2018Lakshmi Kanthan\u2019 who resides in Britain had arrived at the Company on two occasions in February 2016 and 2017 and dumped cash amounting to Rs.145 million in the Chairman\u2019s safe\u201d\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">\u201cit had not been supported by any documentation or receipt issued to Mr. Kanthan neither were there any entries in the GTLPL accounts books regarding these two cash inflows\u201d\u00a0\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\"><strong>3)<\/strong> B.R. Sinniah also telling the PCoI:\u00a0\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">\u201cThe Rs.145 million used in making the initial payment of Rs.16.5 million and thereafter to pay the monthly loan installment of Rs.11 million\u201d for the purchase of the \u2018<\/span><span class=\"s2\">Monarch\u2019\u00a0<\/span><span class=\"s1\">Penthouse in Colombo by a company owned by then Minister <a href=\"https:\/\/www.colombotelegraph.com\/?s=Ravi+Karunanayake\">Ravi Karunanayake<\/a>\u2019s family \u201chas no origin nor has it been accounted for\u201d.<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">Should these not concern the CBSL and the Inland Revenue Department? <\/span><\/p>\n<p class=\"p13\"><span class=\"s3\"><b>PEPs as Bank Directors\u00a0<\/b><\/span><\/p>\n<p class=\"p14\"><span class=\"s1\">Politically Exposed Persons (PEPs) are at the centre of the worldwide efforts for the prevention of money laundering.<\/span><\/p>\n<p class=\"p14\"><span class=\"s1\">The CBSL consistent with international best practice defines PEPs as:<\/span><\/p>\n<p class=\"p6\"><span class=\"s1\"><i>\u201cPEPs are defined as \u201cindividuals in Sri Lanka or abroad who are, or have been, entrusted with prominent public functions\u201d e.g. Heads of State or of government, senior politicians, senior government, judicial or military officials, senior executives of State owned corporations, important political party officials. Business relationships with family members or close associates of PEPs involve reputational risks similar to those with PEPs themselves.\u201d<\/i><\/span><\/p>\n<p class=\"p6\"><span class=\"s1\"><strong>1)<\/strong> Based on this definition it is not difficult to discern there are prominent PEPs in Sri Lanka who are currently \u2018directors\u2019 of banks. One such person is a \u2018man for all seasons\u2019 under successive administrations who is a frequent writer on governance. Others include a banking sector regulator and a senior member of the judiciary who became bank directors soon after retirement. <\/span><\/p>\n<p class=\"p6\"><span class=\"s1\"><strong>2)<\/strong> When even the mere \u201c<i>Opening of accounts\u201d\u00a0<\/i>in banks by PEPs is under scrutiny in Sri Lanka, how could the Director of Bank Supervision advise me there is\u00a0<i>\u201cno restriction for appointments of PEPs as Board members of licensed banks\u201d<\/i>?<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">The Central Bank labored for almost a month to give me this untenable response subsequent to my e-mail of 5 July 2017 to Dr.\u00a0Coomaraswamy.<\/span><\/p>\n<p class=\"p6\"><span class=\"s1\">It must be flagged that although all PEPs are not involved in money laundering or unlawful activities, the high risk they pose cannot be ignored. Laws and guidelines are there for a purpose and must be adhered to. \u00a0\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\"><strong>3)<\/strong> It was revealed at the Bond Commission that B.R. Sinniah was \u201cappointed to the Board of Directors of the BoC in 2015 by the then Finance Minister Ravi Karunanayake for a period of one year\u201d.\u00a0\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">This demonstrates the hopeless situation in Sri Lanka when the Finance Minister himself appoints the Chief Financial Officer of his family controlled company to the Board of Directors of the Bank of Ceylon. <\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">Ravi Karunanayake being a PEP is a no-brainer. B.R. Sinniah too is clearly a PEP as per the CBSL definition which is consistent with international best practice. Under no circumstances is it suggested that Ravi Karunanayake, B.R. Sinniah or all PEPs are engaged in unlawful activities. Nevertheless, the high risk PEPs pose cannot be ignored.<\/span><\/p>\n<p class=\"p7\"><span class=\"s2\">Although <\/span><span class=\"s1\">B.R. Sinniah had ceased being a bank director when<\/span><span class=\"s2\"> Dr.\u00a0Coomaraswamy assumed the position of CBSL governor, the fact of the matter is that under his watch too there are PEPs who are bank directors. <\/span><\/p>\n<p class=\"p7\"><strong><span class=\"s2\">4) <\/span><\/strong><span class=\"s1\">During the tenure of former CBSL Governor &#8211; Nivard Cabraal, his sister Siromi Wickramasinghe &#8211; clearly a PEP was a bank \u2018director\u2019 which included being Chairman of \u2018<i>State owned\u2019 <\/i>entity HDFC Bank (<\/span><span class=\"s2\">Housing Development Finance Corporation).<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">The CBSL is continuing to turn a blind eye to its own guidelines and laws.<span class=\"Apple-converted-space\">\u00a0 <\/span>\u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s3\"><b>Bank Malpractice<\/b><\/span><span class=\"s1\"><b>?<\/b><\/span><\/p>\n<p class=\"p12\"><strong><span class=\"s2\">1)<\/span><\/strong> <span class=\"s2\">A gaping hole in the PCoI report is the \u2018pussyfooting\u2019 on the Bank of Ceylon giving PTL access to Billions of Rupees almost instantly which enabled PTL with the aid of \u201cinside information\u201d to make a \u2018killing\u2019 in the secondary Bond market at the further expense of state institutions which include the hard earned savings of workers in the EPF. <\/span><\/p>\n<p class=\"p7\"><span class=\"s1\"><strong>2)<\/strong> The PCoI report states that at a meeting \u201cconvened\u201d on 28 March 2016 by Ravi Karunanayake then Minister of Finance <i>\u201cthree State Banks had been instructed to place Bids within a specified range of Yield Rates at the Treasury Bond Auction to be held on 29th March 2016 and that, the three State Banks had been given an assurance that, Bids at higher Yield Rates would not be accepted at this Auction.\u201d<\/i><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">The state banks concerned &#8211; Bank of Ceylon, People\u2019s Bank and National Savings Bank<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">adhering to these \u2018instructions\u2019 had significantly benefited PTL financially and resulted in an \u2018opportunity loss\u2019 to the state banks.<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\"><strong>3)<\/strong>\u00a0It was also revealed at the PCoI that Saman Kumara, the then dealer for the EPF at the CBSL had allegedly received a personal loan of Rs. 25 million from PABC when Nimal Perera was Chairman. It is relevant to ascertain whether this loan and its settlement (if any) took place in the ordinary course of banking practice or whether any special privileges were afforded.\u00a0 \u00a0<\/span><\/p>\n<p class=\"p7\"><strong><span class=\"s1\">4)<\/span><\/strong><span class=\"s2\"> Although it was the EPF that by far suffered the major loss due to purchases of Treasury Bonds in the secondary market from PTL, another non-bank financial institution that reportedly took a substantial hit was the Sri Lanka Insurance Corporation (SLIC). <\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">Should these not be of interest to CBSL\u2019s \u2018Bank Supervision\u2019 and \u2018Non-Bank Supervision\u2019 Departments? \u00a0<\/span><\/p>\n<p class=\"p12\"><span class=\"s3\"><b>Alleged HNB Tax Evasion<\/b><\/span><\/p>\n<p class=\"p12\"><span class=\"s2\">After the damning allegations in a website of an alleged tax evasion at HNB Bank was brought to the attention of CBSL Governor,<i> <\/i><\/span><span class=\"s1\">Dr.\u00a0<a href=\"https:\/\/www.colombotelegraph.com\/?s=Indrajit+Coomaraswamy\">Indrajit Coomaraswamy<\/a><\/span><span class=\"s2\"><i> <\/i>on<i> <\/i><\/span><span class=\"s1\">25 September 2017, it took the CBSL 42 days to advise me (i)<i>\u201cCBSL has not carried out any investigations\u201d <\/i>(ii) <i>\u201cthe statements\u201d <\/i>in the article<i> \u201care factually incorrect\u201d<\/i> (iii) \u201c<i>The matter is being brought to the attention of the Inland Revenue Department.\u201d<\/i><\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">The allegations <\/span><span class=\"s2\">include<i>: <\/i><\/span><\/p>\n<p class=\"p12\"><strong><span class=\"s2\">i)<\/span><\/strong><span class=\"s1\"> Some portion of the <\/span><span class=\"s2\"><i>\u201cevaded tax\u201d<\/i> was <i>\u201cdivided between the tax advising company and the officers at the Revenue Department involved\u201d<\/i><\/span><\/p>\n<p class=\"p6\"><span class=\"s2\"><strong>ii)<\/strong><i> \u201cThe current chairman of the bank Rani Jayamaha has also been able to identify the wrongdoing through an internal probe\u201d <\/i>(since then there is another chairman)<\/span><\/p>\n<p class=\"p18\"><span class=\"s1\">It begs the questions:<\/span><\/p>\n<p class=\"p18\"><span class=\"s1\"><strong>1)<\/strong> How <i>\u201cthe statements\u201d <\/i>contained in the article<i> \u201care factually incorrect\u201d<\/i> if <i>\u201cCBSL has not carried out any investigations\u201d<\/i>?<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\"><strong>2)<\/strong> Why it has taken CBSL 42 days (from my initial e-mail of 25 September) to belatedly state <i>\u201cThe matter is being brought to the attention of the Inland Revenue Department.\u201d<\/i>?<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\"><strong>3)<\/strong> Has CBSL brought it <i>\u201cto the attention of the Inland Revenue Department\u201d<\/i> even now? If not why?<\/span><\/p>\n<p class=\"p12\"><span class=\"s1\">Much was expected from incumbent CBSL Governor Dr.\u00a0Coomaraswamy who has been in the saddle for 20 months.<\/span><\/p>\n<p class=\"p19\"><span class=\"s3\"><b>Conclusion<\/b><\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">In the context of the foregoing \u2013 particularly the absence of the POLITICAL WILL to enforce existing laws and regulations on a level playing field, it is downright dangerous to have in the statute book the recently enacted \u2018Foreign Exchange Act, No. 12 of 2017\u2019 which further liberalizes foreign exchange transactions which in effect is conducive for money laundering if people are so inclined.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">The Act inter alia states \u201cThe Central Bank shall as the agent of the Government, be responsible for implementing the provisions of this Act\u201d.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">One would have expected\u00a0Dr.\u00a0Coomaraswamy at the very least to have publicly cautioned the government against the enactment of such an Act.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">Do these not have implications for the integrity of the proposed \u2018Colombo International Financial City\u2019?<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">Dr.\u00a0Coomaraswamy has also failed to respond to the questions posed to him in my e-mail of<i>\u00a0<\/i>30 August 2017 in regard to Sri Lankan citizens allegedly linked to\u00a0offshore companies in tax havens revealed\u00a0in the \u2018Panama Papers\u2019 which include:<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">\u201c<i>Whether the Central Bank of Sri Lanka has investigated the legitimacy of the Sri Lankan accounts in the \u2018Panama Papers\u2019?\u201d<\/i><\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">One of the persons named \u2013 a prominent corporate personality who was a colleague of the CBSL Governor is also Chairman of a Bank.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">The writer is not suggesting or implying that the mere listing of names and entities in tax havens is indicative of wrongdoing. Nevertheless it is incumbent on the CBSL to ascertain legitimacy.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">Tardiness on the part of CBSL does injustice to those who have legitimate accounts.<\/span><\/p>\n<p class=\"p19\"><span class=\"s1\">The CBSL which was at the centre of the egregious Bond Scam (prior to\u00a0Dr.\u00a0Coomaraswamy assuming office)\u00a0definitely requires a thorough clean-up.
