A\u00a0ruling against the Telecommunications Regulatory Commission of Sri Lanka (TRCSL<\/a>) by the\u00a0Right to Information Commission<\/a> under the RTI Act has disclosed that a much sought after spectrum telecommunication frequency had recently been allocated to Mobitel (headed by\u00a0President Maithripala Sirisena’s brother,\u00a0Kumarasinghe Sirisena<\/a>) without open competitive bidding and on ‘an administrative decision.’<\/p>\n

This has come to light in an appeal filed before the RTI Commission by another competitor for the\u00a0spectrum frequency,\u00a0Dialog Axiata.<\/p>\n

The RTI Commission\u00a0directed the TRCSL<\/a>, chaired by the President’s Secretary Austin Fernando,\u00a0to reverse its earlier decision not to release the information<\/p>\n

The Commission\u00a0warned that\u00a0the\u00a0discretion exercised by TRCSL in such actions was\u00a0not unfettered but must be exercised \u2018in accordance with law and subject to the application of the RTI Act, absent a clearly applicable exemption \u2026which overrides the public interest.’ Following the direction, the TRCSL\u00a0released the information to the Commission on 3rd April (last Tuesday).<\/p>\n

In an earlier ruling, information released by the TRCSL\u00a0following an Order issued\u00a0by the\u00a0Commission\u00a0regarding the blocking\u00a0of the Lanka-E-News website indicated that the blocking had taken place after\u00a0the Office of the President had complained against slanderous reports in the website.<\/p>\n

Pointing out\u00a0that\u00a0the complaint submitted by the President\u2019s Office on November 6th, 2017 only brings these news reports\u00a0to the notice of the TRCSL\u00a0and requests that suitable action be taken according to law, the Commission\u00a0ruled that the information requested can legitimately be released under the RTI Act and dismissed the TRCSL argument that ‘national security’ and\u00a0the ‘defence of the State’ required the information to be kept confidential.<\/p>\n","protected":false},"excerpt":{"rendered":"
