{"id":202647,"date":"2019-06-15T15:10:31","date_gmt":"2019-06-15T09:40:31","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=202647"},"modified":"2019-06-17T15:34:25","modified_gmt":"2019-06-17T10:04:25","slug":"is-terrorism-facilitated-by-slumbering-cbsl-new-foreign-exchange-act","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/is-terrorism-facilitated-by-slumbering-cbsl-new-foreign-exchange-act\/","title":{"rendered":"Is Terrorism Facilitated By Slumbering CBSL &#038; New Foreign Exchange Act?"},"content":{"rendered":"<p><b>By\u00a0<\/b><b><a href=\"https:\/\/www.colombotelegraph.com\/?s=Amrit+Muttukumaru\">Amrit Muttukumaru<\/a> &#8211;<\/b><\/p>\n<div id=\"attachment_142887\" style=\"width: 154px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/04\/Amrit-Muttukumaru.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-142887\" class=\"size-thumbnail wp-image-142887\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2015\/04\/Amrit-Muttukumaru-144x150.jpg\" alt=\"\" width=\"144\" height=\"150\" \/><\/a><p id=\"caption-attachment-142887\" class=\"wp-caption-text\">Amrit Muttukumaru<\/p><\/div>\n<p>Sri Lanka is doing its damnedest to prepare a <b>fertile ground<\/b> for terrorism by (i) making minorities particularly Tamils and Muslims feel insecure by being treated as <b>inferior <\/b>to the majority Sinhala-Buddhists who comprise 70% of the population (ii) giving <b>hegemony <\/b>through constitutional measures and tacit government consent to Sinhala &#8211; Buddhists (iii) giving Buddhist clergy undue importance in matters of <b>governance <\/b>(iv) minorities particularly Muslims being subject to hate speech, violence and economic isolation instigated with impunity by extremists (v) nefarious activities of Sinhala-Buddhist and Muslim extremists not being stopped in their tracks due to reasons of <b>vote bank <\/b>politics by both major parties \u2013 SLPP and UNP (vi) although the long-drawn armed conflict with the LTTE came to a\u00a0<b>controversial <\/b>bloody\u00a0end in 2009 in the absence of credible accountability, the <b>root causes<\/b> leading to the conflict have still not been adequately addressed (vii) Reconciliation issues continue to fester.<\/p>\n<p>Terrorism is <b>facilitated <\/b>by money laundering and the trade in illicit drugs being made easier (i) by the new Foreign Exchange Act No. 12 of 2017 effective from 20 November 2017 which repealed the Exchange Control Act No. 24 of 1953 (ii) corruption in high places (iii) nexus between those dealing in money laundering and illicit drugs with key sections of the political leadership, intelligence agencies, law enforcement agencies and financial regulatory agencies.<\/p>\n<p>It has been plausibly argued that the new Foreign Exchange Act No. 12 of 2017 has the potential to encourage and legitimize money laundering.<\/p>\n<p>A <b>precursor<\/b> to this dangerous Foreign Exchange Act is the \u2018invitation\u2019 issued by then Finance Minister Ravi Karunanayake through India\u2019s prestigious publication \u2018<a href=\"https:\/\/www.thehindu.com\/business\/place-your-money-in-sri-lanka\/article7724025.ece\">The Hindu<\/a>\u2019 of 5 October 2015 to <i>\u201cSri Lankans and Indians who had to take back their deposits from banks in Switzerland to place their funds in Sri Lanka\u201d<\/i>. He had further assured that <b><i>\u201cNo questions would be asked\u201d<\/i><\/b>!<\/p>\n<p>In the context of the Act inter alia stating\u00a0<i>\u201cThe Central Bank shall as the agent of the Government, be responsible for implementing the provisions of this Act\u201d<\/i> one would have expected CBSL Governor Dr. Indrajit Coomaraswamy under whose tenure the new Act became effective to have at the very least publicly <b>cautioned <\/b>the government against the enactment of such an Act. Not only has he not done so but more <b>reprehensibly<\/b> he has the audacity to cite this dangerous Act to <b>justify<\/b> CBSL <b>inaction<\/b> on Sri Lankans named in the\u00a0<b>\u2018<a href=\"https:\/\/www.colombotelegraph.com\/?s=Panama+Papers\">Panama Papers<\/a>\u2019<\/b>:<\/p>\n<p><i>\u201cThe time period prescribed by the Foreign Exchange Act No. 12 of 2017 to conclude investigations under ECA expired on 19.05.2018 as stipulated in the Foreign Exchange Act No 12 of 2017. These investigations also lapsed on that date.\u201d<\/i><\/p>\n<p>On CBSL\u2019s inaction on the Sri Lankan names in the \u2018Panama Papers\u2019 he has even cast <b>aspersions <\/b>on the <b>credibility <\/b>of the\u00a0\u00a0<i>\u2018<\/i>International Consortium of Investigative Journalists\u2019 by stating:<\/p>\n<p><i>\u201cAfter conducting the investigation, no information was revealed on investments as published by ICIJ.\u201d\u00a0<\/i><\/p>\n<p>A name included in the\u00a0\u2018Panama Papers\u2019\u00a0is an erstwhile colleague of\u00a0\u00a0CBSL Governor Coomaraswamy on the Director Board of JKH, arguably the country\u2019s most diversified conglomerate with top tier market capitalization.<\/p>\n<p>The\u00a0<b>UPSHOT <\/b>of all this is that in the aftermath of the horrific Easter Sunday carnage, it is reported that security forces have unearthed <b>\u201cassets worth Rs 7 billion\u201d<\/b> attributed to suspects belonging to the National Thowheed Jamath\u00a0(NTJ)\u00a0said to be mainly responsible for the carnage.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><b>Hub for Illicit Drugs?<\/b><\/p>\n<p>Frequent detections of large hauls of heroin, cocaine and other illicit drugs which most likely are the tip of the iceberg would suggest that Sri Lanka has become a\u00a0<b>regional hub<\/b>\u00a0for the trade in illicit drugs in the Asian region. Such an occurrence is only possible under <b>enabling<\/b> conditions which include lax laws which facilitate money laundering\/smuggling and the nexus between sections of the political leadership and bureaucracy with key players in the trade in illicit drugs. Does not the <a href=\"https:\/\/www.reuters.com\/article\/us-sri-lanka-drugtrafficking\/sri-lanka-emerging-as-transit-hub-for-cocaine-smugglers-officials-idUSKCN1BB1FK\">Reuters report<\/a> <b><i>\u201cSri Lanka is becoming a hub for cocaine as it is a risk-free\u00a0location with less legal restrictions\u201d <\/i>confirm<\/b> this position?<\/p>\n<p>The link between money laundering, illicit drugs and funding of terrorism does not require elaboration. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>It is reported that a high profile Sri Lankan\u00a0arrested in Dubai this year for his alleged involvement in the illicit drugs trade has allegedly deposited as much as\u00a0\u00a0<i>\u201cRs.10 billion in 23 bank accounts\u201d<\/i>\u00a0in Sri Lanka and Dubai. Even if half this sum was deposited in Sri Lankan banks, does it not indicate that the CBSL has been in\u00a0<i>\u201cdeep slumber\u201d\u00a0<\/i>in this respect too? One could only speculate as to how many other cases not yet in the public domain have escaped the notice of the CBSL?<\/p>\n<p><b>Questionable FDIs<\/b><\/p>\n<p>It is becoming apparent that for the most part Sri Lanka is only able to attract FDIs mired in controversy. The latest is the \u201c$ 3.85 billion investment for an oil refinery in Hambantota\u201d. One wonders whether this is a replay of the much hyped 2017\u00a0Volkswagen\u00a0vehicle assembly plant in Kuliyapitiya which turned out to be a hoax. Those who hyped the Volkswagen assembly plant are largely the same persons now hyping the purported oil refinery in Hambantota. There was even a\u00a0<i>\u201cground breaking ceremony\u201d<\/i> for the Volkswagen plant.<\/p>\n<p>Even the <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/alleged-money-launderer-lokuwithana-gets-jail-free-card-courtesy-malik-samarawickrama\/\">earlier 2016<b> $<\/b>75 million <b>tyre manufacturing plant <\/b><\/a>in Horana is mired in controversy<span class=\"Apple-converted-space\">\u00a0<\/span>due to its promoter\u2019s alleged involvement in controversial business dealings under the Rajapaksa administration. This case brings into focus the cosy relationship between competing politicians and the raison d&#8217;\u00eatre why competing administrations are reluctant to hold wrongdoers accountable.<\/p>\n<p><b>EAP Group Sale<\/b><\/p>\n<p>The CBSL has failed to disclose whether its claimed <b>\u2018due diligence\u2019<\/b> in regard to the sale of EAP Group companies has considered the <b>damning<\/b> allegations in the news report in \u2018<a href=\"http:\/\/www.sundaytimes.lk\/180603\/news\/296904-296904.html\">The Sunday Times<\/a>\u2019 of 3 June 2018 <b><i>\u201cPurchase of Edirisinghe Group: Investors in a labyrinth of multiple companies\u201d<\/i><\/b>?<b><span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/p>\n<p>In particular CBSL has <b>avoided<\/b> confirming whether there is any truth to the <b>terrible allegation<\/b>:<\/p>\n<p><i>\u201cBut punitive action is being blocked by the Ministry of Finance which has taken from the Customs Department a file containing evidence against the suspects\u201d<\/i><\/p>\n<p>If the CBSL considers the report spurious, why has \u2018The Sunday Times\u2019 not been taken to task?<\/p>\n<p>Mano Tittawella former Chairman, EAP Group is currently Senior Adviser to the Minister of Finance under which falls the CBSL. \u00a0This is the ground reality in Sri Lanka.<\/p>\n<p><b>Bond Scam &amp; Money Laundering<\/b><\/p>\n<p>In the context of the CBSL being the issuing agency for Treasury Bonds, a key recommendation of the report of the Presidential Commission of Inquiry into the <b>Treasury Bond scam <\/b>which is possibly the largest financial scam to hit this country since independence was the <b>forensic audit<\/b> to be carried out by the CBSL.\u00a0\u00a0The report was available in the public domain from\u00a0<b>3 January 2018<\/b>. It is now 17 months since then and the <b>forensic audit<\/b> is still not in the public domain.<span class=\"Apple-converted-space\">\u00a0 <\/span>A reason for the <b>delay<\/b> from Governor Coomaraswamy will be appreciated.<\/p>\n<p><b>Impunity<\/b> is so endemic in Sri Lanka that even crucial issues incidental to the bond scam related to possible\u00a0<b>money laundering<\/b>\u00a0thrown up by witnesses at the Presidential Commission\u00a0\u00a0which include possible tax evasion and PEPs being directors of banks do not appear to be even on the CBSL radar.<\/p>\n<p>We await to see whether the CBSL in its forensic audit will even <b>CONSIDER <\/b>addressing the alleged (i)\u00a0<i>\u201cmillions\u201d\u00a0<\/i>encashed\u00a0<i>\u201cseveral times\u201d<\/i>\u00a0being left on\u00a0<i>\u201cPTL CEO Kasun Palisena\u2019s chair\u201d\u00a0<\/i>(ii) \u201c<i>cash amounting to Rs.145 million\u201d\u00a0<\/i>being \u201c<i>dumped\u201d\u00a0<\/i>without being\u00a0<i>\u201csupported by any documentation\u201d\u00a0<\/i>in the<i>\u00a0\u201cChairman\u2019s safe\u201d<\/i><\/p>\n<p><b>Politically Exposed Persons<\/b><\/p>\n<p>On the subject of\u00a0<b>PEPs<\/b>\u00a0(Politically Exposed Persons)\u00a0\u00a0<b>where else in the world<\/b>\u00a0would (i) a Senior Deputy Governor of the Central Bank soon after retirement be appointed a Director of a leading bank?(ii) a Chief Justice of the Supreme Court soon after retirement be appointed\u00a0\u00a0a Director of a leading bank? (iii) a highly connected PEP previously Chairman of a leading bank be currently Chairman of a <b>competitor <\/b>bank?<\/p>\n<p><b>Thumbs its nose at FATF<\/b><\/p>\n<p>Sri Lanka has virtually thumbed its nose\u00a0at the <b>\u2018Grey List\u2019 <\/b>placed on the country by the FATF (Financial Action Task Force) in <b>November 2017<\/b> following which the EU which considers Sri Lanka\u00a0<b>\u201chigh-risk\u201d<\/b>\u00a0for money laundering issued its\u00a0<b>\u2018Black List\u2019 <\/b>in <b>February 2018<\/b>.<\/p>\n<p>FATF\u00a0recommendations are\u00a0<i>\u201crecognised as the global anti-money laundering (AML) and counter-terrorist financing (CFT) standard.\u201d<\/i><\/p>\n<p>Notwithstanding the FATF in <b>October 2016<\/b>\u00a0putting Sri Lanka on notice that the country will be assessed on its commitment to combat money laundering and in <b>October 2017<\/b> listing the country as having \u2018strategic AML\/CFT deficiencies\u2019, Sri Lanka in <b>callous disregard<\/b> made its\u00a0<b>contentious<\/b>\u00a0Foreign Exchange Act, No. 12 of 2017 further liberalizing capital inflows effective from <b>20 November 2017<\/b>.<\/p>\n<p>While Dr.\u00a0Indrajit Coomaraswamy who has been CBSL Governor since <b>3 July 2016<\/b> for 16 months <b>prior <\/b>to this ruling must bear <b>some responsibility<\/b> (together with former Governors Messrs. Cabraal and Mahendran) he together with Minister of Finance, Mangala Samaraweera\u00a0must bear <b>major responsibility <\/b>for the country <b>continuing<\/b> to be on the Blacklist.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>This writer wishes to place on record the <b>courageous <\/b>stand of Mangala Samaraweera in articulating the imperative to have Sri Lanka as a <b>SECULAR <\/b>State\u00a0in the context of a multi-ethnic and multi-religious country. Sadly he has been <b>viciously criticized<\/b> with no support from any of his Cabinet colleagues or even from the State Minister of Finance, Eran Wickramaratne who hails from a <b>very prominent<\/b> Christian family.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>In the context of little respect for the rule of law, the contentious Foreign Exchange Act No. 12 of 2017<span class=\"Apple-converted-space\">\u00a0 <\/span>and regulatory agencies such as CBSL for the most part being indifferent, is there no danger that the proposed\u00a0<b>\u2018Colombo International Financial City\u2019<\/b>\u00a0with high end <b>casinos <\/b>also reportedly being part of the mix, may\u00a0<b>enhance\u00a0<\/b>Sri Lanka\u2019s image as a premier hub for money laundering in the Asian region?<\/p>\n<p>There is a mismatch on the one hand of a country with a weak economy, poor infrastructure and atrocious governance bending over backwards even for <b>questionable FDIs<\/b> and financial assistance and on the other the swanky high-rise apartments, office blocks, shopping malls and fancy restaurants dotting the city of Colombo with high-end vehicles which would do even a first world country proud. The large Chinese investments are mainly geo-political in nature connected to big power rivalry in the Indian Ocean with its own set of implications.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>At this rate one wonders whether Sri Lanka will <b>ever<\/b> be removed from the EU <b>\u2018Black List\u2019<\/b> and the FATF <b>\u2018Grey List\u2019<\/b>?<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p> [&hellip;]<\/p>\n","protected":false},"author":163,"featured_media":194697,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[3,46,8],"tags":[],"class_list":["post-202647","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-colombotelegraph","category-constitutional-reforms","category-editorial"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.3 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Is Terrorism Facilitated By Slumbering CBSL &amp; New Foreign Exchange Act?
