Navaratnam<\/p><\/div>\n<p>As I have mentioned in <a href=\"https:\/\/www.colombotelegraph.com\/index.php\/prez-gotabaya-virtually-tells-the-tamils-et-al-go-to-hell\/\"><span style=\"color: #ff6600;\">my previous piece<\/span><\/a> <i>( Colombo Telegraph<\/i>, 10 April 2020),<span class=\"Apple-converted-space\">\u00a0<\/span>commenting on the Presidential pardon granted to convict <a href=\"https:\/\/www.colombotelegraph.com\/?s=Sunil+Ratnayake\"><span style=\"color: #ff6600;\">Sunil Ratnayake<\/span><\/a>, Justice<span class=\"Apple-converted-space\">\u00a0<\/span>Minister Nimal Siripala had said, \u201ct<i>he final decision is with the President. He can<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>overrule anything. He has the <\/i><b><i>absolute power<\/i><\/b><i> to grant pardon, no one can question<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>him<\/i>\u201d. The Minister had added that <i>the constitutionally mandated procedure for the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>pardon was followed<\/i>. (<b>The<\/b> <b>Hindu, 27 March 2020<\/b>).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>Misconception<\/b><\/span><\/p>\n<p>Evidently, under Art. 34 (1) of the Constitution, the President has the power to<span class=\"Apple-converted-space\">\u00a0<\/span>grant pardon; but the Minister\u2019s claim that the President has the <i>absolute<\/i> power<span class=\"Apple-converted-space\">\u00a0<\/span>to pardon the convict is a misconception. The relevant provisions are:<\/p>\n<p>34. (1) <i>The President may in the case of any offender convicted of any offence in<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>any court within the Republic of Sri Lanka \u2013(a) grant a pardon, either free or<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>subject to lawful conditions; <\/i>(b) grant any respite\u2026\u2026&#8230;, (c)\u2026\u2026\u2026(d) \u2026\u2026\u201d etc.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>And, there is a proviso to Article 34.(1) , which reads as follows:\u00a0\u201c<i>Provided that where any offender shall have been condemned to suffer death by<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>the sentence of any court, the President shall cause a report to be made to him by<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>the Judge who tried the case and shall forward such report to the Attorney<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>General with instructions that after the Attorney-General has advised thereon,\u00a0<\/i><i>the report shall be sent together with the Attorney-General\u2019s advice to the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>Minister in charge of the subject of Justice, who shall forward the report with his<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>recommendation to the President<\/i>.<\/p>\n<p><span style=\"color: #ff6600;\"><b>On whose initiative?<\/b><\/span><\/p>\n<p>On whose initiative does the pardon process begin? Typically, it should be on an<span class=\"Apple-converted-space\">\u00a0<\/span>application filed by the offender\/convict, personally or by proxy.<span class=\"Apple-converted-space\">\u00a0 <\/span>In the case of<span class=\"Apple-converted-space\">\u00a0<\/span>convict <i>Sunil Ratnayake<\/i> President could not have, in the exercise of his powers<span class=\"Apple-converted-space\">\u00a0<\/span>under 34.(1), granted pardon, <i>ex mero motu<\/i>, of his own accord, without a written<span class=\"Apple-converted-space\">\u00a0<\/span>request from the convict (or from someone legally acting for him) seeking such<span class=\"Apple-converted-space\">\u00a0<\/span>pardon.<span class=\"Apple-converted-space\">\u00a0<\/span>It appears that there is no express provision either in the Constitution or<span class=\"Apple-converted-space\">\u00a0<\/span>in any other written law in Sri Lanka stipulating such requirement.<span class=\"Apple-converted-space\">\u00a0<\/span>Nonetheless,<span class=\"Apple-converted-space\">\u00a0<\/span>filing such paperwork is necessarily implicit in the legislative scheme, and Article<span class=\"Apple-converted-space\">\u00a0<\/span>34.(1) may be so read and understood. ( <i>It would be helpful, If<span class=\"Apple-converted-space\">\u00a0<\/span><\/i>any <i>legal academic<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>or professional with sufficient knowledge could clarify this point<\/i>).<span class=\"Apple-converted-space\">\u00a0<\/span>Thus, the<span class=\"Apple-converted-space\">\u00a0<\/span>paperwork, must include the Application for pardon with supporting documents.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>In terms of the proviso, (upon receipt of the application by the President\u2019s<span class=\"Apple-converted-space\">\u00a0<\/span>office), it is mandated that certain actions must be taken in a certain order\u00a0or manner, prior to the grant (or refusal) of pardon by the President. Those\u00a0are prior conditions to be satisfied and the auxiliary verb is <i>\u201cShall\u201d.<\/i><b> <\/b><span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>Breach of procedural<span class=\"Apple-converted-space\">\u00a0 <\/span>justice<\/b><\/span><\/p>\n<p>The mandated procedure is not a maze of meaningless rituals. It is a replica<span class=\"Apple-converted-space\">\u00a0<\/span>of the pardon process provided for in a number of countries, with Common Law<span class=\"Apple-converted-space\">\u00a0<\/span>or Continental legal systems. And, the procedure is intended to initiate and direct<span class=\"Apple-converted-space\">\u00a0<\/span>the necessary investigations at different levels and prepare the reports and<span class=\"Apple-converted-space\">\u00a0<\/span>recommendation for the President to act on. Investigations about what?<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>There are relevant factors to be examined or considered before deciding whether<span class=\"Apple-converted-space\">\u00a0<\/span>to grant\/refuse a pardon, viz: nature and circumstances of the offence, applicant\u2019s<span class=\"Apple-converted-space\">\u00a0<\/span>post-conviction conduct, acceptance of responsibility for his criminal conduct,<span class=\"Apple-converted-space\">\u00a0<\/span>remorse, atonement, involvement in other criminal activity, impact of the crime<span class=\"Apple-converted-space\">\u00a0<\/span>on the victim(s) etc.<\/p>\n<p>Did President Gotabaya follow the mandated procedure -and take the prescribed\u00a0steps spelt out under the proviso to 34(1) &#8211; before granting pardon to the convict? <span class=\"Apple-converted-space\">\u00a0<\/span>Justice Minister\u2019s blanket statement that \u201c<i>the constitutionally mandated<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>procedure for the pardon was followed<\/i>\u201d is not conclusive on the issue. It is a<span class=\"Apple-converted-space\">\u00a0<\/span>matter of procedural fairness which entails acting fairly in decision making.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>According to legal academics, procedural justice accentuates four principles, 1)<span class=\"Apple-converted-space\">\u00a0<\/span>being fair in processes, 2) being transparent in actions, 3) providing opportunity<span class=\"Apple-converted-space\">\u00a0<\/span>for voice, and 4) being impartial in decision making.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>Transparency<span class=\"Apple-converted-space\">\u00a0 <\/span>International\u2019s concern<\/b><\/span><\/p>\n<p>It is in this context that <i>Transparency International Sri Lanka<\/i> (TISL) has called<span class=\"Apple-converted-space\">\u00a0<\/span>upon the Presidential Secretariat to make public the following documents as<span class=\"Apple-converted-space\">\u00a0<\/span>regards the presidential pardon granted to the convict in <i>Mirusuvil massacre<\/i> case:<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>1. Report of the Trial Judge, (2) Advice of the Attorney General, and (3)<span class=\"Apple-converted-space\">\u00a0<\/span>Recommendation of the Justice Minister. (Alluding as well to President Sirisena\u2019s<span class=\"Apple-converted-space\">\u00a0<\/span>offer of pardon to murder convict Jude Jayamaha in Nov.2019), TISL Director<span class=\"Apple-converted-space\">\u00a0\u00a0<\/span>Asoka Obeyesekere said, \u201c<i>in two instances in the recent past, we have witnessed<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>the powers of presidential pardon being exercised without the disclosure of the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>information to substantiate these<\/i> <i>pardons. This trend of executive action<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>potentially subverting judicial process is very disturbing as it will cause the public<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>to lose faith in the judiciary as the arbiters of justice under the law\u201d.<span class=\"Apple-converted-space\">\u00a0<\/span><\/i> <em>(The Island)<\/em><\/p>\n<p><span style=\"color: #ff6600;\"><b>01 April 2020 \u2013<\/b><b> \u201c<\/b><b><i>Presidential pardon for convict: TISL calls for documents.<\/i>\u201d<\/b>\u00a0<b><i>Ex post facto exercise?<\/i><\/b><\/span><\/p>\n<p>Even if one buys into the Minister\u2019s dubious assertion that President Gotabaya<span class=\"Apple-converted-space\">\u00a0Rajapaksa\u00a0<\/span>had observed the \u201c<i>constitutionally mandated procedure<\/i>\u201d for granting pardon,<span class=\"Apple-converted-space\">\u00a0<\/span>in<span class=\"Apple-converted-space\">\u00a0<\/span>a sense, it sounds like an <i>ex post facto exercise<\/i> and a farce at that. Because,<span class=\"Apple-converted-space\">\u00a0<\/span>absolving the criminals in uniform was Gotabaya\u2019s election pledge. He had<span class=\"Apple-converted-space\">\u00a0<\/span>already, in Oct. 2019, decided to grant pardon to all \u201c<i>war heroes<\/i>\u201d and had also<span class=\"Apple-converted-space\">\u00a0<\/span>followed up with a public declaration to that effect. (Be that as it may, let me get<span class=\"Apple-converted-space\">\u00a0<\/span>back to the main issue).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>Legal battle<\/b><\/span><\/p>\n<p>It behoves us to ensure that justice is done to the hapless victims of Mirusuvil<span class=\"Apple-converted-space\">\u00a0<\/span>massacre. We must urgently launch a legal battle to stop the rampaging<span class=\"Apple-converted-space\">\u00a0<\/span>Rajapaksas in their tracks before they could commit further aggression against the<span class=\"Apple-converted-space\">\u00a0<\/span>Rule of Law and present it as a <i>fait accompli<\/i>. In this venture, let us enlist the active<span class=\"Apple-converted-space\">\u00a0<\/span>support and collaboration of enlightened liberals and progressive sections of the<span class=\"Apple-converted-space\">\u00a0<\/span>civil society. Justice Minister\u2019s casual bravado that \u201c<i>the final decision is with the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>President. He can overrule anything. He has the absolute power to grant pardon,<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>no one can question him<\/i>\u201d sounds simplistic. President Gotabaya cannot be<span class=\"Apple-converted-space\">\u00a0<\/span>allowed to ride roughshod over the judiciary.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>Who has standing<\/b>?<\/span><\/p>\n<p>Victims\u2019 families have the <i>locus standi<\/i> to initiate the judicial process in Court and<span class=\"Apple-converted-space\">\u00a0<\/span>challenge the Presidential decision \u2013 and have it quashed. Equally, as the issues<span class=\"Apple-converted-space\">\u00a0<\/span>involve human rights, fundamental rights and other broader issues of public<span class=\"Apple-converted-space\">\u00a0<\/span>interest, any serious public interest litigant has the standing to invoke the<span class=\"Apple-converted-space\">\u00a0<\/span>jurisdiction of the superior Courts in Sri Lanka and obtain legal remedy. Multi-pronged attacks against the Presidential decision may be launched by way of an<span class=\"Apple-converted-space\">\u00a0<\/span>application for Judicial Review, seeking the issue of a Writ of<i> Certiorari<\/i> and\/or a<span class=\"Apple-converted-space\">\u00a0<\/span>Fundamental Rights Application under Article 126 of the Constitution.<span class=\"Apple-converted-space\">\u00a0<\/span>Domestic jurisprudence touching on the Executive\u2019s pardon power is in a fledgling<span class=\"Apple-converted-space\">\u00a0<\/span>stage \u2013 just evolving. We may be guided by the principles as enunciated by<span class=\"Apple-converted-space\">\u00a0<\/span>eminent judges and jurists in other jurisdictions. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>UK<span class=\"Apple-converted-space\">\u00a0 <\/span>legal regime<\/b><\/span><\/p>\n<p>In the UK, pardoning power, historically known as the Sovereign\u2019s prerogative<span class=\"Apple-converted-space\">\u00a0<\/span>power of mercy, is exercised by the Queen on the advice of the Secretary of the<span class=\"Apple-converted-space\">\u00a0<\/span>State for Justice (earlier, the Home Secretary). In <b><i>Regina v Secretary of State for<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/b><b><i>the Home Department Ex Parte Bentley<\/i><\/b><i>: QBD 8 Jul 1993<\/i>, the High Court (Queen\u2019s<span class=\"Apple-converted-space\">\u00a0<\/span>Bench Division) held that the prerogative power of mercy may be reviewed on the<span class=\"Apple-converted-space\">\u00a0<\/span>grounds similar to those on which the exercise of statutory powers is reviewed,<span class=\"Apple-converted-space\">\u00a0<\/span>namely for <i>illegality, irrationality and procedural impropriety<\/i>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>USA \u2013 Rationale of the pardon power<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/span><\/p>\n<p>Celebrated Justice Holmes of the US Supreme Court had, in the case of <b><i>Biddle v.<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/b><b><i>Perovich<\/i><\/b><span class=\"Apple-converted-space\">\u00a0<\/span>(274 US 480, 486 (1927), set out the rationale of the pardon power as<span class=\"Apple-converted-space\">\u00a0<\/span>follows: &#8220;<i>A pardon in our days is not a private act of grace from an individual<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>happening to possess power. It is a part of the constitutional scheme. When<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>granted, it is the determination of the ultimate authority that the public welfare<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>will be better served by inflicting less than what the judgment fixed.<\/i>&#8221;<\/p>\n<p>In the US, the Congress and the Courts do not have much leeway in<span class=\"Apple-converted-space\">\u00a0<\/span>circumscribing the Presidential power to pardon. Nonetheless, where pardon is<span class=\"Apple-converted-space\">\u00a0<\/span>granted (or denied) in violation of \u2018equal protection principles\u2019 (by discriminating<span class=\"Apple-converted-space\">\u00a0<\/span>on the basis of race or gender), or \u2018due process protections\u2019 in the Constitution, they are grounds to challenge the President\u2019s pardon by way of judicial review.<\/p>\n<p>Though a sop, there is space for a sliver of relief to the victims of Federal crimes in<span class=\"Apple-converted-space\">\u00a0<\/span>the US, in that, there is a mandatory waiting period of five years after the date of<span class=\"Apple-converted-space\">\u00a0<\/span>conviction before an Application (Petition) for Presidential pardon can be filed by<span class=\"Apple-converted-space\">\u00a0<\/span>(or on behalf of) the convict. Further, the family members of any victim of a crime<span class=\"Apple-converted-space\">\u00a0<\/span>for which Applicant\/Petitioner was sentenced to death may file a request to make<span class=\"Apple-converted-space\">\u00a0<\/span>an oral statement to the Office of the Pardon Attorney (which handles the Pardon<span class=\"Apple-converted-space\">\u00a0<\/span>Petitions addressed to President) opposing the grant of pardon. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>It may be noted that in the case of \u201cwar hero\u201d Sunil Ratnayake, convicted on 25<span class=\"Apple-converted-space\">\u00a0<\/span>June 2015, not even five years had elapsed before a \u2018bleeding heart\u2019 President<span class=\"Apple-converted-space\">\u00a0<\/span>Gotabaya rushed to pardon the brutal murderer &#8211; whilst the powerless and<span class=\"Apple-converted-space\">\u00a0<\/span>voiceless families of the victims have been condemned to a cruel life of eternal<span class=\"Apple-converted-space\">\u00a0<\/span>grief and bereavement.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>India<span class=\"Apple-converted-space\">\u00a0<\/span>vs. Sri Lanka<\/b><\/span><\/p>\n<p>Before looking at the watershed rulings made by the Supreme Court of India on<span class=\"Apple-converted-space\">\u00a0<\/span>the exercise of Presidential pardon, it may not be out of context to examine the<span class=\"Apple-converted-space\">\u00a0<\/span>contrasts in shades and style with that of Sri Lankan system. In Sri Lanka, the<span class=\"Apple-converted-space\">\u00a0<\/span>President is directly-elected by the voters.<span class=\"Apple-converted-space\">\u00a0<\/span>President Gotabaya is not an apolitical<span class=\"Apple-converted-space\">\u00a0<\/span>idealist; but a passionate politician thriving on ultra-Sinhala Buddhist nationalistic<span class=\"Apple-converted-space\">\u00a0<\/span>militarism. Gotabaya, the grantor of pardon, and the grantee, convict Sunil<span class=\"Apple-converted-space\">\u00a0<\/span>Ratnayake, have a symbiotic relationship &#8211; not an arm\u2019s length relationship.<span class=\"Apple-converted-space\">\u00a0<\/span>Incidentally, Lt. Col. Gotabaya had previously served as the second-in-command<span class=\"Apple-converted-space\">\u00a0<\/span>of the 1st Battalion, Gajaba Regiment, to which the killer belonged when he<span class=\"Apple-converted-space\">\u00a0<\/span>committed the massacre. The Justice Minister, who has a vital role to play in the<span class=\"Apple-converted-space\">\u00a0<\/span>process is Gotabaya\u2019s own hand-picked appointee for the job. There is absolutely<span class=\"Apple-converted-space\">\u00a0<\/span>no integrity, impartiality or probity in the pardon regime in Sri Lanka.<\/p>\n<p>On the other hand, Indian Presidents are not directly elected by the voters.<span class=\"Apple-converted-space\">\u00a0<\/span>They are elected by an electoral college (consisting of M.Ps and Members of the<span class=\"Apple-converted-space\">\u00a0<\/span>Legislative Assemblies of the States and the Union Territories). Most of them,<span class=\"Apple-converted-space\">\u00a0<\/span>beginning with the first President Dr. Rajendra Prasad, have been illustrious men<span class=\"Apple-converted-space\">\u00a0<\/span>of letters, great scholars, scientists and prominent educationists \u2013 Dr. Sarvepalli<span class=\"Apple-converted-space\">\u00a0<\/span>Radhakrishnan, Dr. Zakir Husain and Dr. Abdul kalam, to name only a few.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><span style=\"color: #ff6600;\"><b>India \u2013 catena of cases<\/b><\/span><\/p>\n<p>Articles 72 and 161 of the Indian Constitution provides for the pardoning power,<span class=\"Apple-converted-space\">\u00a0<\/span>respectively, of the President and the State Governors. Supreme Court of India<span class=\"Apple-converted-space\">\u00a0<\/span>has ruled in successive cases that the power could be exercised by the President<span class=\"Apple-converted-space\">\u00a0<\/span>or the Governor only on the advice of the Central or State Governments. Neither<span class=\"Apple-converted-space\">\u00a0<\/span>can exercise the power of pardon on his\/her own without consulting the<span class=\"Apple-converted-space\">\u00a0<\/span>respective government. (Ref: <b><i>Maru Ram v. Union of India<\/i><\/b> (1981);<b><i> Dhananjoy<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/b><b><i>Chatterjee alias Dhana v State of West Bengal and others<\/i><\/b> (1994).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>There has been an ongoing debate on the availability and scope of judicial review<span class=\"Apple-converted-space\">\u00a0<\/span>in regard to the President\u2019s (and Governor\u2019s) power to grant pardon &#8211; with mixed<span class=\"Apple-converted-space\">\u00a0<\/span>messages and conflicting opinions.<\/p>\n<p>In the case of <b><i>Kehar Singh and Another v. Union of India<\/i><\/b>,(1989)<span class=\"Apple-converted-space\">\u00a0 <\/span>Kehar Singh was<span class=\"Apple-converted-space\">\u00a0<\/span>one of the convicts under death sentence for his role as a co-conspirator in the<span class=\"Apple-converted-space\">\u00a0<\/span>assassination of Indian Prime Minister Indira Gandhi. Kehar Singh\u2019s petition for<span class=\"Apple-converted-space\">\u00a0<\/span>Presidential pardon, filed by his son, was rejected.<span class=\"Apple-converted-space\">\u00a0 <\/span>One of the issues addressed\u00a0by the Supreme Court was the failure of the Minister to inform the convict\u2019s son\u00a0of his right to seek judicial review of the President\u2019s refusal. Minister\u2019s omission<span class=\"Apple-converted-space\">\u00a0<\/span>attracted a spate of criticism from legal academics. (Vide- <b>Hindu, 23 Nov.2012<span class=\"Apple-converted-space\">\u00a0 <\/span>&#8211;<\/b><\/p>\n<p><span style=\"color: #ff6600;\"><b>\u201c<i>An act of constitutional impropriety\u201d<\/i><\/b><\/span>\u00a0<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>In <b>Swaran Singh vs State of Uttar Pradesh<\/b> (1998) Supreme Court said,<span class=\"Apple-converted-space\">\u00a0<\/span>&#8220;W<i>e cannot accept the rigid contention\u2026\u2026\u2026\u2026 that this court has no power to<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>touch the order passed by the Governor under Article 161 of the Constitution. If<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>such power was exercised arbitrarily, mala fide or in absolute disregard of the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>finer canons of the constitutionalism, the by-product order cannot get the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>approval of law and in such cases, the judicial hand must be stretched to it<\/i>.&#8221;<\/p>\n<p><span style=\"color: #ff6600;\"><b>Landmark judgment<\/b><\/span><\/p>\n<p>Supreme Court\u2019s landmark judgment in <b><i>Epuru Sudhakar &amp; Another vs Govt. of\u00a0<\/i><\/b><b><i>A.P. &amp; Others<\/i><\/b> (2006) has resolved any ambivalence as to<b><i> <\/i><\/b>the Court\u2019s authority to<span class=\"Apple-converted-space\">\u00a0<\/span>review the exercise of President\u2019s \/ Governor\u2019s pardon power under the Indian<span class=\"Apple-converted-space\">\u00a0<\/span>Constitution. The apex court has held as follows:<\/p>\n<p>\u201c<i>The position, therefore, is undeniable that judicial review of the order of the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>President or the Governor under Article 72 or Article 161, as the case may be, is<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>available and their orders can be impugned on the following grounds:<\/i><\/p>\n<p><i>(a) that the order has been passed without application of mind; (b) that the order<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>is mala fide; (c) that the order has been passed on extraneous or wholly irrelevant<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>considerations; (d) that relevant materials have been kept out of consideration;\u00a0<\/i><i>(e) that the order suffers from arbitrariness.<\/i>\u201d<\/p>\n<p>Renowned jurist Soli Sorabjee (Former AG of India), participating as <i>Amicus Curiae<\/i><span class=\"Apple-converted-space\">\u00a0<\/span>in the proceedings<i>, <\/i>had eminently insisted on the desirability of giving reasons in<span class=\"Apple-converted-space\">\u00a0<\/span>the order granting pardon\/remission. (An essential element which is abysmally<span class=\"Apple-converted-space\">\u00a0<\/span>missing in Gotabaya\u2019s order)<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>In sum, President Gotabaya\u2019s order granting pardon to the convict Sunil\u00a0Ratnayake has, procedurally and substantively, all the egregious errors which<span class=\"Apple-converted-space\">\u00a0<\/span>invite judicial intervention.<\/p>\n<p><span style=\"color: #ff6600;\"><b>Victims Protection Act<\/b><\/span><\/p>\n<p>The provisions of <i>\u2018<\/i><b><i>Assistance to and Protection of Victims of Crimes &amp; Witnesses<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><\/b><b><i>Act No. 4 of 2015<\/i><\/b><i>\u2019 <\/i>(hereinafter referred to as \u201c<i>Victims Protection Act<\/i>\u201d) can be<span class=\"Apple-converted-space\">\u00a0<\/span>effectively availed of to attack Gotabaya\u2019s Presidential pardon on another front.\u00a0<i>Victims Protection Act, 2015<\/i> was not there at the time of Mirusuvil massacre; but\u00a0was there when Gotabaya granted pardon to the killer. Gotabaya\u2019s egregious<span class=\"Apple-converted-space\">\u00a0<\/span>abuse of pardoning power, as provided in Art. 34(1) of the constitution, flies in<span class=\"Apple-converted-space\">\u00a0<\/span>the face of the benign provisions of the <i>Victims Protection Act<\/i> and defies the law<span class=\"Apple-converted-space\">\u00a0<\/span>in letter and in spirit. He has made a mockery of the lofty ideals presented as the objects of the said legislation. Notably, under \u201c<i>Rights and Entitlements of the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>Victims of Crime <\/i>\u2026\u2026\u201d, adverting to victims of crimes where the offender is seeking<span class=\"Apple-converted-space\">\u00a0<\/span>a pardon, it is provided in Section 3 of the Act, <i>inter alia<\/i>, as follows:<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p><i>\u201c3. A victim of crime shall have the right :\u2014<\/i><\/p>\n<p><i>(a)\u2026\u2026(b)\u2026.. (c)\u2026..(d)\u2026\u2026(q) in the event of any person in authority considering the\u00a0<\/i><i>grant of a pardon or remission of sentence imposed on any person convicted of<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>having committed an offence, to receive notice thereof and submit through the<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>Authority to the person granting such pardon or remission, the manner in which<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>the offence committed had impacted on his life including his body, state of mind,<span class=\"Apple-converted-space\">\u00a0<\/span><\/i><i>employment, profession or occupation, income, quality of life, property and any\u00a0<\/i><i>other aspects concerning his life.\u201d<\/i><\/p>\n<p><span style=\"color: #ff6600;\"><b>Victim on the run !<\/b><\/span><\/p>\n<p>Did the Presidential office ever care to contact any of the relatives of the victims<span class=\"Apple-converted-space\">\u00a0<\/span>of Mirusuvil massacre, before offering a pardon to the killer? There is only one<span class=\"Apple-converted-space\">\u00a0<\/span>traumatized survivor of the Mirusuvil atrocity, who had put his life on line and<span class=\"Apple-converted-space\">\u00a0<\/span>testified at the Trial-at-Bar. Who knows?
