{"id":214211,"date":"2020-10-29T00:01:46","date_gmt":"2020-10-28T18:31:46","guid":{"rendered":"https:\/\/www.colombotelegraph.com\/?p=214211"},"modified":"2020-11-07T20:53:50","modified_gmt":"2020-11-07T15:23:50","slug":"how-to-make-a-legitimate-new-constitution","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/how-to-make-a-legitimate-new-constitution\/","title":{"rendered":"How To Make A Legitimate New Constitution\u00a0"},"content":{"rendered":"<p><span style=\"color: #ff6600;\"><strong>By <a style=\"color: #ff6600;\" href=\"https:\/\/www.colombotelegraph.com\/?s=Rohan+Samarajiva\">Rohan Samarajiva<\/a> &#8211;<\/strong><\/span><\/p>\n<div id=\"attachment_59228\" style=\"width: 160px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/11\/Rohan-Samarajiva.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-59228\" class=\"size-thumbnail wp-image-59228\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/11\/Rohan-Samarajiva-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/11\/Rohan-Samarajiva-150x150.jpg 150w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/11\/Rohan-Samarajiva-50x50.jpg 50w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a><p id=\"caption-attachment-59228\" class=\"wp-caption-text\">Prof. Rohan Samarajiva<\/p><\/div>\n<p>A legitimate Constitution cannot be drafted under opaque conditions in a backroom and approved with the votes of the party in power (and those of a few crossovers).<span class=\"Apple-converted-space\">\u00a0 <\/span>All but the 17<sup>th<\/sup> and 19<sup>th<\/sup> Amendments to the 1978 Constitution lacked legitimacy for this reason.<\/p>\n<p><strong><span style=\"color: #ff6600;\">How Constitutions are Made<\/span><\/strong><\/p>\n<p>There are those who point to the way the US Constitution (the shortest, oldest, and possibly least amended) and the Indian Constitution (the longest and possibly the most amended) were drafted and adopted.<span class=\"Apple-converted-space\">\u00a0<\/span>The drafting and the adoption of the US Constitution took over a year of dedicated work.<span class=\"Apple-converted-space\">\u00a0<\/span>The Indian Constitution took almost three years.<span class=\"Apple-converted-space\">\u00a0<\/span>Persons not members of the then existing legislatures were among those responsible for the drafting.<span class=\"Apple-converted-space\">\u00a0<\/span>Both were adopted in the aftermath of a successful struggle for independence.<span class=\"Apple-converted-space\">\u00a0<\/span>Those modes have limited relevance for Sri Lanka in 2020.<\/p>\n<p>Chile may have some lessons.<span class=\"Apple-converted-space\">\u00a0<\/span>Chile and Sri Lanka (and China a little later) were the first to dismantle state controls hobbling their economies.<span class=\"Apple-converted-space\">\u00a0<\/span>Chile\u2019s Constitution was adopted in 1980 under Augusto Pinochet, ours in 1978 under JR Jayewardene.<span class=\"Apple-converted-space\">\u00a0<\/span>Chile became the richest country in Latin America under the 1980 Constitution, which later governments amended dozens of times. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Since 1990 the economy has grown rapidly, poverty has fallen sharply, and politics have been stable with several peaceful changes of power. Despite significant recent decline from one of the world\u2019s highest levels of inequality as measured by a GINI (where high is bad) of 56 in 1995, Chile is still more unequal than Sri Lanka, which has the highest inequality in South Asia, excluding the Maldives.<\/p>\n<div id=\"attachment_214213\" style=\"width: 909px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2020\/10\/Economic-dats-Chile-and-Sri-Lanka.jpeg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-214213\" class=\" wp-image-214213\" src=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2020\/10\/Economic-dats-Chile-and-Sri-Lanka.jpeg\" alt=\"\" width=\"899\" height=\"166\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2020\/10\/Economic-dats-Chile-and-Sri-Lanka.jpeg 948w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2020\/10\/Economic-dats-Chile-and-Sri-Lanka-300x55.jpeg 300w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2020\/10\/Economic-dats-Chile-and-Sri-Lanka-768x142.jpeg 768w\" sizes=\"auto, (max-width: 899px) 100vw, 899px\" \/><\/a><p id=\"caption-attachment-214213\" class=\"wp-caption-text\">Source: https:\/\/tradingeconomics.com\/<\/p><\/div>\n<p>There is great unhappiness about the Constitution in Chile, expressed in the streets last year.<span class=\"Apple-converted-space\">\u00a0<\/span>For example, when efforts were made to strengthen the consumer-protection agency, by allowing it to impose fines on companies, the Constitutional Tribunal overruled it. Changes to laws on education, policing, mining, and elections require four-sevenths majorities in both houses of Congress.<span class=\"Apple-converted-space\">\u00a0 <\/span>It is a \u201chyperpresidential\u201d Constitution, which gives the president the power to dictate which bills get priority in Congress.<span class=\"Apple-converted-space\">\u00a0<\/span>Members may not propose tax or spending bills.<span class=\"Apple-converted-space\">\u00a0<\/span>Regions cannot raise their own revenues, which concentrates power in the center.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>On October 25th voters went to a referendum to decide on whether drafting the new Constitution should be done by an elected assembly, half of whose members would be women, or by a convention split evenly between elected delegates and members of the legislature.<span class=\"Apple-converted-space\">\u00a0<\/span>The drafting assembly is to be elected in April 2021.<span class=\"Apple-converted-space\">\u00a0<\/span>The option to elect a 155-member constituent assembly with half the members women received overwhelming approval.<\/p>\n<p><strong><span style=\"color: #ff6600;\">Sri Lankan Practice<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/strong><\/p>\n<p>In 2015, the Sri Lankan Parliament formed itself into a Constitutional Assembly. The channel for ideas from those outside the legislature was a Committee on Public Representations headed by Lal Wijenayake, a respected lawyer independent of the two main parties then in power. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>What was promised in the 2019 Saubhagyaye Dakma was: \u201cA Parliamentary Select Committee will be appointed to engage with the people, political leaders, and civil society groups and prepare a new constitution for Sri Lanka.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span>This is yet to be done.<span class=\"Apple-converted-space\">\u00a0<\/span>What has been appointed is a committee of nine lawyers, mostly supporters of the President.<span class=\"Apple-converted-space\">\u00a0<\/span>Another member is to be appointed to represent the Tamils of Indian Origin. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>A bunch of appointed lawyers headed by the man who headed the President\u2019s stonewalling of the legal process prior to his election is completely unacceptable.<span class=\"Apple-converted-space\">\u00a0<\/span>A select committee will at least allow the participation of parties outside the government who will get to decide who their representatives are.<\/p>\n<p><strong><span style=\"color: #ff6600;\">Principal-Agent Theory<\/span><\/strong><\/p>\n<p>It is said that war is too important to be left to the Generals.<span class=\"Apple-converted-space\">\u00a0<\/span>In the same way, Constitutions are too important to be left to the lawyers (as proposed), or to the politicians (as has been mostly the case in Sri Lanka).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>A Constitution sets out \u201cthe rules of the game,\u201d by which the people\u2019s agents must act.<span class=\"Apple-converted-space\">\u00a0<\/span>The people are the Principal.<span class=\"Apple-converted-space\">\u00a0<\/span>The individuals who won the last Presidential and Parliamentary elections are their Agents.<span class=\"Apple-converted-space\">\u00a0<\/span>They are supposed to act on behalf of the People, but they have their own agendas and priorities.<span class=\"Apple-converted-space\">\u00a0<\/span>And they have an informational advantage over the people.<span class=\"Apple-converted-space\">\u00a0<\/span>They engage in politics full time, while the people have to work to keep themselves and their agents clothed and fed.<\/p>\n<p>It would be illogical for the Agents to unilaterally define the \u201crules of the game.\u201d<span class=\"Apple-converted-space\">\u00a0<\/span>The Principal, the people who are not professional politicians, must play a determining role.<span class=\"Apple-converted-space\">\u00a0<\/span>In an ideal world, a Constitution would be made from the bottom up, extracting the rules of governance from the lived experience of the people.<span class=\"Apple-converted-space\">\u00a0<\/span>But this is unrealistic.<\/p>\n<p>As established in 1965 by Mancur Olson in his seminal book, <i>The logic of collective action<\/i>, in public affairs small groups with concentrated interests tend to overwhelm large groups with diffuse interests.<span class=\"Apple-converted-space\">\u00a0<\/span>Politicians, moneyed interests, and even some intellectuals with independent livelihoods can focus their time and resources on specific issues, such as Constitution making.<span class=\"Apple-converted-space\">\u00a0 <\/span>Members of the public must earn a living, care for their children and parents, and do myriad other things.<span class=\"Apple-converted-space\">\u00a0<\/span>They lack the ability to match the focus of those with concentrated interests.<span class=\"Apple-converted-space\">\u00a0<\/span>They also think that someone will look after their interests, leading to the \u201cfree-rider problem.\u201d<\/p>\n<p><strong><span style=\"color: #ff6600;\">Pragmatic Solutions<\/span><\/strong><\/p>\n<p>The 2015 solution of a dedicated committee mandated to seek and organize public representations could be taken as a starting point.<span class=\"Apple-converted-space\">\u00a0<\/span>The documentation that was compiled is available for examination by all.<span class=\"Apple-converted-space\">\u00a0<\/span>Additional material can be solicited using the affordances of the Internet, and not just through newspaper advertisements seeking written submissions addressing pre-defined subject areas.<span class=\"Apple-converted-space\">\u00a0<\/span>Debates can be organized on late-night TV to seed the process. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>But most importantly, the key decisions must be based on consensus and compromise.<span class=\"Apple-converted-space\">\u00a0<\/span>In Chile, all decisions of the Constitutional Assembly require a two thirds majority.<span class=\"Apple-converted-space\">\u00a0<\/span>Because Constitutions are not made to steamroller minorities into submission, it is necessary to ensure that all kinds of constituencies are represented in the Assembly and that those controlling the government do not dominate proceedings. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Because all our elections descend into partisan contests, it may not be advisable to hold elections as the Chileans plan to do.<span class=\"Apple-converted-space\">\u00a0<\/span>Perhaps some kinds of quotas can be agreed upon for political parties, civil society, professional associations and so on with special cross-cutting quotas being enforced to ensure representation of women and persons with disabilities. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>The whole process should be overseen by a respected individual or individuals who forswear political activity for the next five years.<span class=\"Apple-converted-space\">\u00a0<\/span>As in Chile, half the seats in the assembly should be reserved for persons not engaged in active electoral politics.<span class=\"Apple-converted-space\">\u00a0<\/span>The government can assure itself of final control because the half appointed from among legislators will be mostly their representatives.<span class=\"Apple-converted-space\">\u00a0<\/span>These rules should, as in Chile, be approved by a referendum.<span class=\"Apple-converted-space\">\u00a0<\/span>As with all referenda, the most difficult challenge is the framing of the questions.<span class=\"Apple-converted-space\">\u00a0<\/span>That cannot be left to the government alone.<span class=\"Apple-converted-space\">\u00a0<\/span>Perhaps an all-party committee may be able to do a decent job.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>
