\u2018Fire and fury\u2019<\/b><\/span><\/p>\n

UNHRC – 46<\/span>th<\/sup><\/span> session at Geneva had drawn to its close four weeks ago. Yet, the <\/span>virulent attacks unleashed, initially, against the UN-HR Chief Ms. Michelle <\/span>Bachelet and the UK-led sponsors, and lately, against an expanded list of <\/span>\u2018enemies\u2019 (including countries which had voted for the Resolution plus others <\/span>who had abstained from voting) still continue unabated with the same intensity. <\/span>Apparently, the latest salvo of recriminations on the subject has been fired by <\/span>Public Security Minister Sarath Weerasekera ( Daily Mirror, 20 April 2021 \u2013 <\/span>\u201cGeneva -the misconceptions \u2026\u2026.\u201d) <\/i>In the run-up to the D-day at Geneva, when <\/span>discerning sections of the <\/i>citizenry were despairing that this country had got to <\/span>this sorry pass, frantically fishing for friends at Geneva, the ultra-nationalists, <\/span>rehashing their bellicose rhetoric, had ganged up on the global West \u2013 <\/span>threatening to unleash \u2018fire and fury\u2019 (Trump style, vis-\u00e0-vis North Korea). <\/span><\/p>\n

Pseudo-patriots<\/b><\/span><\/p>\n

Pseudo-patriots had closed ranks in a show of tribal solidarity. The most <\/span>vituperative among them were the tribal journalists \u2013 viz. columnists, <\/span>commentors and other nondescript scribblers. They had started trashing\u00a0 <\/span>Ms. <\/span>Bachelet\u2019s Report on Sri Lanka (A\/HRC\/46\/20) even before the report officially <\/span>entered the public domain. Mediascape in Sri Lanka had since been saturated <\/span>with their nasty narratives on the subject, couched in ethno-fascist vocabulary <\/span>vilifying the Tamil people.<\/span><\/p>\n

Quest for Justice<\/b><\/span><\/p>\n

In the post-Mullivaikkal milieu, aside from certain international advocacy groups, <\/span>ethnic Tamils have led the collective cry and have largely been the dominant <\/span>voices in the persistent quest for international justice at Geneva \u2013 although some <\/span>enlightened liberals from the ethnic majority have empathized with the Tamil <\/span>pursuit of justice. But happily, this time around, even some sections of the Sinhala <\/span>and Muslim political activists have articulated their qualified support for the <\/span>Geneva agenda on Sri Lanka. There are reasons for this change \u2013 factors which <\/span>have even shifted the focus of the new Resolution: This time, the main thrust is <\/span>not on war crimes; the Resolution has taken note of some ongoing abuses in <\/span>Rajapaksas regime; Muslim minorities and sections of the Sinhala people also <\/span>have been directly hit and hurt by an abusive\/oppressive administration; small <\/span>pockets of progressives from among the intelligentsia wanted to arrest this trend. <\/span><\/p>\n

In any event, when all’s said and done, it has been business as usual for the <\/span>dominant ultra-nationalists who call the shots in a depraved domain – the <\/span>mediascape. Some representative samples of their discourses may be revealing: <\/span><\/p>\n

Dr. Laksiri Fernando<\/b><\/span><\/p>\n

Dr. Laksiri Fernando\u2019s series of articles \u2013 diatribes, discharged in rapid succession <\/span>against Ms. Bachelet \/UNHRC\/UK-led Core Group\/Amnesty International and <\/span>other \u2018enemies\u2019 confirmed his credentials as a closet-racist from Down Under. His <\/span>latest piece is a loser\u2019s lamentation:\u00a0 <\/span>(CT, 08 April 2021 -\u201cAfter Geneva Resolution: <\/i><\/a><\/span><\/span>What Next?<\/span>\u201d<\/i> ). In fact, Geneva proceedings touching on Sri Lanka have had a <\/span>laxative effect on the bowels of many a member of the SB literati.\u00a0<\/span><\/p>\n

Lest we forget, Laksiri had been one of the fair-weather friends of the Rajapaksas. <\/span>Close on the heels of the Mullivaikal massacre of Tamil civilians in May 2009, and <\/span>when Rajapaksas were basking in the glory of the war victory and gloating over <\/span>their triumph, it was Laksiri\u00a0 <\/span>who, as member of the Colombo University Senate, <\/span>on 29<\/span>th<\/sup><\/span> May 2009, initiated the move to decorate the \u2018learned\u2019 Rajapaksa <\/span>brothers, Mahinda and Gotabaya, with honorary Doctorate degrees \u2013 LL.D and <\/span>D.Sc degrees, respectively. <\/span><\/p>\n

Sublime to ridiculous!<\/b><\/span><\/p>\n

BTW: There was a time when a cr\u00e8me de la cr\u00e8me<\/i> of intellectual giants and <\/span>scholars par excellence of the calibre of Dr. Gamini Corea, Dr. C.G. Weeramantry, <\/span>Justice Mark Fernando et al<\/i> were the recipients of honorary\u00a0 <\/span>Doctorates from the <\/span>Colombo University.!. O tempora! O mores!<\/i>\u00a0 <\/span>From the sublime to the ridiculous. <\/span>But, there is another facet of this funny story. In 2015, Laksiri sought to revoke <\/span>the honorary degrees of the two Rajapaksa siblings.\u00a0 <\/span>(Colombo Telegraph, 11 Oct. <\/span>2015 \u2013 \u201cI propose to revoke doctorates from GR & MR<\/i><\/a><\/span>\u201c )<\/span><\/p>\n

Volte-face <\/b><\/span><\/p>\n

Interestingly, in seeking to revoke Rajapaksas\u2019 honorary degrees, one of the <\/span>reasons cited by Laksiri was as follows: \u201cThere are <\/i>credible allegations of gross <\/i><\/b><\/span>human rights violations at the last stages of the war under their command<\/i><\/b>.\u201d<\/span>(Colombo Telegraph \u2013 ibid<\/i><\/b>). Perusing his articles carrying brazen denial of the war <\/span>crimes and broadsides against the HR Chief\u2019s report and recommendations, it beg <\/span>the question – what is it that this gentleman is denying and disputing now?. And <\/span>why this complete volte-face<\/i>? <\/span><\/p>\n

Aberrations<\/b><\/span><\/p>\n

Getting back to Laksiri\u2019s aberrations, he has lunged at Ms. Michelle Bachelet <\/span>snarling and breathing fire and brimstone:<\/span> \u201cI can be very clear and blunt. The <\/i><\/span>Office of the UN High Commissioner for Human Rights is going in the <\/i><\/span>authoritarian and dictatorial direction preaching others to be democratic and <\/i><\/span>justiciable <\/i>(Sic). This is very clear from the Report\u2026\u2026. In February 2009, Castro <\/i><\/span>called her part of the \u2018fascist and vengeful Chilean oligarchy\u2019 \u201d<\/i><\/span>(Commenting on Ms.Bachelet\u2019s\u00a0 <\/span>recommendations to GoSL) \u201c\u2026\u2026 Who is this <\/i><\/span>High Commissioner dictating terms for a \u2018vision for Sri Lanka\u2019 giving the <\/i><\/span>impression that the country has no efforts to be \u2018inclusive\u2019 or \u2018pluralistic\u2019? <\/i>I will <\/i><\/b><\/span>explain to you who she is later<\/i><\/b>.\u201d (Sounds like goons\u2019 gutter lingo ?)<\/span><\/p>\n

HRCSL Chairperson<\/b><\/span><\/p>\n

\u201cIn December 2020, the President proceeded with the appointment of new <\/i><\/span>members to the HRCSL, including a former Minister as chairperson. The High <\/i><\/span>Commissioner is concerned that the new appointment process undermines the <\/i><\/span>credibility and independence of the Commission.\u201d <\/i><\/span><\/p>\n

\u201c\u2026. the comedy is that the High Commissioner who makes this<\/i> (sic) observations <\/i><\/span>or accusations herself is not just a former Minister but a former President of a <\/i><\/span>country, Chile (2006-2010 and 2014-2018)<\/i>.<\/span> (Colombo Telegraph,17 Feb.2021 –<\/b>\u00a0<\/span>\u201cAuthoritarian & Hypocritical recommendations of the UN High Commissioner\u2026.<\/a><\/span>\u201d) <\/i><\/span><\/p>\n

The comedy lies in the cockeyed \u2018chalk and cheese\u2019 comparison of this academic. <\/span>Doesn\u2019t Laksiri see the fundamental difference? Human rights issues which come <\/span>within the purview of HRCSL\/Chairperson Jagath Balasuriya\u00a0<\/span>(Rajapakses\u2019 relative, <\/span>Mahinda\u2019s former Minister &\u00a0 <\/span>SLPP Organiser of Kegalle) are critical issues arising <\/span>within the\u00a0 <\/span>territorial and jurisdictional confines of Sri Lanka. The Resolution that\u00a0<\/span>was under deliberation at the UNHRC 46<\/span>th<\/sup><\/span> session was not concerned with Chile.! <\/span><\/p>\n

Revelations!<\/b><\/span><\/p>\n

Perhaps, the following\u00a0 <\/span>features about\u00a0 <\/span>Ms. Bachelet\u2019s personal\/public life may <\/span>be the details which Laksiri offered to expose when he first said: \u201cI will explain to <\/i><\/span>you who she is later.<\/i>\u201d (Colombo Telegraph \u2013 ibid<\/i>). Evidently, there is nothing <\/span>particularly shocking or sensational about Ms. Bachelet\u2019s profile. Any serious <\/span>student of contemporary history would appreciate that a host of celebrated rebel <\/span>leaders\/revolutionaries – Yasser Arafat to Nelson Mandela included – have had <\/span>traces of similar traits\/track record.\u00a0 <\/span>Now, let\u2019s see\u00a0 <\/span>Laksiri\u2019s\u00a0 <\/span>\u2018revelations\u2019 ! :<\/span>\u201cShe is utterly political. As a Minster of Defense (2002-2004) she is known to have <\/i><\/span>wearing sometimes a military cloak and a cap. In her fairly young days (1985-<\/i><\/span>1987) she was alleged to have connections with the Manuel Rodriguez Patriotic <\/i><\/span>Front, \u2018an armed group that among other activities attempted to assassinate <\/i><\/span>Pinochet in 1986.\u2019 During her Presidency she was known to have tried to preach <\/i><\/span>and dictate terms to other Latin American countries\u2026\u201d<\/i>(Colombo Telegraph-ibid<\/i>)<\/span><\/p>\n

Dr. Mervyn Silva<\/b><\/span><\/p>\n

In seeking to denigrate Madame Bachelet Dr. Laksiri Fernando\u2019s\u00a0 <\/span>diction and tone <\/span>are reminiscent of the crude remarks of another \u2018doctoral degree-holder\u2019 vis-\u00e0-vis <\/span>a former UN Human Rights Commissioner. In August 2013 during HR Chief Navi <\/span>Pillay\u2019s official visit to Sri Lanka on the invitation of Mahinda government, Minister <\/span>Mervyn Silva, addressing a public meeting at Maradana, Colombo offered to marry <\/span>the visiting Human Rights Chief. Far from being indignant, the local media was quite <\/span>amused at the antics of Mervyn Silva. A week later, at a press briefing Minister <\/span>Alahapperuma apologized to Ms. Navi Pillay. ( <\/b>DailyFT, 5 Sept.2013 \u2013 \u201cDulles <\/i><\/span>apologises for Mervyn\u2019s proposal to Pillay<\/i>\u201d). Such boorish behaviour by a State <\/span>Minister towards a UN dignitary would not have impressed observers from civilized <\/span>nations. It is in this backdrop that recently \u2018Daily Mirror\u2019<\/i> had carried a news item <\/span>that the government intended to invite Ms. Bachelet for a visit to Sri Lanka. (Daily <\/span>Mirror, 16 March 2021). Welcome Madame Bachelet! Stay safe in Sri Lanka !.\u00a0<\/span><\/p>\n

But then, Laksiri Fernando prefers an aggressive approach ! : \u201cI recommend <\/i><\/span>the Sri Lanka government to completely prohibit anyone from the OHCHR to step <\/i><\/span>into the country\u201d.<\/i> (per <\/i>Laksiri, Colombo Telegraph, 29 March 2021 –<\/b> \u201cAmnesty <\/i><\/a><\/span><\/span>International\u2019s questionable approach to human rights<\/span>\u201d<\/i>)<\/span><\/p>\n

Jittery about UNHRC<\/b><\/span><\/p>\n

Is it not strange that the mere mention of the name \u2018UNHRC\u2019 has always made Sri <\/span>Lankan rulers jittery. SB helmsmen have always had something to hide from the <\/span>international community and have been furtively pussyfooting around accredited <\/span>international fora. Ms. Bachelet is not the first and only UN-HR Chief who is <\/span>anathema and a persona non grata<\/i> to Sri Lankan rulers. To everyone\u2019s knowledge, <\/span>at least during the past two decades, every other HR Chief who preceded <\/span>Ms. Bachelet and held that office eminently had been vilified by\u00a0 <\/span>Sri Lankan ruling <\/span>cabal and the tribal media\u2013 whether it be Ms. Louise Arbour (2004-2008), Ms. Navi <\/span>Pillay (2008-2014) or Mr. Zeid Raad Al Hussain (2014-2018), they were all excoriated and demonized by Rajapaksas and their loyal subjects. Is it not uncanny, <\/span>if not outrageous? Maybe, the ruling class may not change their stance until\u00a0 <\/span>one <\/span>of their ilk \u2013 say, Sarath\u00a0 <\/span>Weerasekara, Wimal Weerawanse or Udaya Gammanpila <\/span>– assumes the mantle of HR High Commissioner in Geneva.<\/span><\/p>\n

Malinda\u00a0 <\/span>Seneviratne<\/b><\/span><\/p>\n

Malinda Seneviratne is yet another columnist \u2013 a columnist\u00a0<\/i>as well ! \u2013 of the <\/span>Sinhala-Buddhist fascist mold, still smarting under the Geneva fiasco. Lest you may <\/span>forget, Malinda was the proud recipient of a gift of (2) free laptops from President <\/span>Mahinda at a public ceremony in Dec. 2013. He had ever since vowed fealty to the <\/span>Rajapaksas and had remained fiercely \u2018independent\u2019 as a journalist, churning out <\/span>copious stories fomenting ethnic passions and defending war crimes. Of course, the <\/span>poor tax-payers paid for the laptops. To their credit, Ravaya<\/i> News Editor Lasantha <\/span>Ruhunage and Sunday Times <\/i>Editor Sinha Ranatunge had some semblance of <\/span>integrity to spurn Rajapaksa\u2019s offer of free laptops. Freeloading fakirs<\/i> are the <\/span>frontline media warriors mostly fulminating against the Geneva proceedings. <\/span><\/p>\n

\u201cCesspool of bias\u2019\u2019<\/b><\/span><\/p>\n

Malinda\u2019s vitriolic diatribes denouncing the Human Rights agency had<\/span> ad nauseam<\/i> <\/span>used the \u2018cesspool<\/i>\u2019 simile to buttress his arguments. Likewise, other SB journalists <\/span>have cited the 2018 US pullout from the UN agency calling it \u201ca cesspool of political <\/i><\/span>bias<\/i>.\u201d Those were the words of Ms. Nikki Haley, President Donald Trump\u2019s <\/span>Ambassador to UN.\u00a0 <\/span>When snarling at the UNHRC and liberally using Haley\u2019s <\/span>invective, these journalists lose sight of the context in which Trump\u2019s crazy <\/span>administration pulled out of the HR body. The powerful Jewish lobby in the US, <\/span>backing pro-Israel Trump, hated the Human Rights body for its pro-Palestinian <\/span>stance. \u201cHaley also pointed to the continued existence of \u201cagenda item 7\u201d, <\/i><\/span>a permanent fixture on the schedule, exclusively devoted to the discussion of <\/i><\/span>rights violations in the West Bank and Gaza Strip<\/i>.\u201d ( The Guardian, UK, 19 June <\/span>2018 \u2013\u201cUS quits UN human rights council\u2026..\u201d)<\/i> <\/span><\/p>\n

Naseby brouhaha<\/b> <\/span><\/p>\n

Malinda\u2019s latest fusillade is against the UK. (The Island, 11 April 2021 \u2013 \u201cThe British <\/i><\/span>will not learn English\u2026\u2026..<\/i>\u201d). The context?\u00a0 <\/span>UK had<\/span> refused Sri Lanka\u2019s request <\/span>made during the Geneva session for the disclosure of wartime dispatches from the <\/span>High Commission in Colombo. The dispatches were the basis of Lord Naseby\u2019s <\/span>brouhaha about the number of civilian deaths during the final stage of the war and <\/span>he had disputed the casualty figures\u00a0 <\/span>produced by Darusman Report. Naseby had <\/span>frequently visited Sri Lanka as state guest – and had enjoyed the lavish hospitality <\/span>of Rajapaksas. He had thus established a close liaison with the SB lobby. What was <\/span>the response of the British Foreign Office? <\/span><\/p>\n

\u201cThe FCO (Foreign and Commonwealth Office), in its objections filed with the <\/i><\/span>Information Commission, following Lord Naseby\u2019s bid to gain dispatches from <\/i><\/span>Colombo, stated; \u201cLt. Col. Gash was the FCO\u2019s defense attach\u00e9 at the British <\/i><\/span>Commission in Colombo during the closing stages of Sri Lanka\u2019s civil war. Many of <\/i><\/span>his dispatches contain information <\/i>provided directly to him by his contacts in the <\/i><\/b><\/span>Sri Lankan government, the Sri Lankan Army or other military sources<\/i><\/b>\u2026.\u201d <\/span>(Island, <\/i>07 April 2021 – Midweek Review <\/i>by Shamindra Ferdinando). In essence, the <\/span>information was not from independent sources and, therefore, was not conclusive <\/span>evidence. Is it not intriguing that the same scribe Shamindra had, in his story <\/span>published the next day, sanitized the narrative and supressed the material fact <\/span>concerning the precise sources of the information ?: <\/span><\/p>\n

\u201cHowever, when Sri Lanka made the request, the UK asserted that Gash reports <\/i><\/span>couldn\u2019t be taken seriously as he merely reported irregular information <\/i>obtained <\/i><\/b><\/span>from various parties at different times<\/i><\/b>, sources said.<\/i>\u201d (per <\/i>Shamindra, Island, 08 <\/span>April 2021 – \u201cUK rejects Lanka\u2019s request for handing over of Gash dispatches to <\/i><\/span>Geneva<\/i>\u201d)<\/span><\/p>\n

Call for Unity<\/b><\/span><\/p>\n

Commentator Ms. Sanja De Silva Jayatilleka has sought to subvert the very <\/span>substratum of the \u2018Accountability\u2019 process. (CT, 25 March 2021 – \u201cWho\u2019s afraid of <\/i><\/a><\/span><\/span>Accountability?<\/span> \u2026..<\/i>\u201d) Assorted authors of no fixed faith or fidelity have joined the <\/span>fascist fraternity due to an instinctive urge towards tribal loyalty. It is not possible <\/span>for me to delve into and dissect each of those <\/i>\u2018a dime a\u00a0 <\/span>dozen\u2019 write-ups. <\/span>After the Geneva vote, there is clarion call for unity: \u201cRetired Maj. Gen. Chagie <\/i><\/span>Gallage says the country should take a united stand at the Geneva-based United <\/i><\/span>Nations Human Rights Council (UNHRC) or face the consequences<\/i>.\u201d \u2013 (Island, 07 <\/span>April 2021 \u2013<\/span> \u201c<\/span>Geneva challenge: Chagie calls for united stand<\/i>\u201d). Minister Sarath <\/span>Weerasekera says: \u201cThis is the time we all must shed our differences and stand <\/i><\/span>together against this conspiracy<\/i>.\u201d<\/span> (Daily Mirror, 20 April 2021- Ibid <\/i>)<\/span>In response, there is an amalgam of mutually antagonistic parties chorusing a <\/span>common refrain: \u00a0<\/span>We \u201cwould always defend the troops, the war heroes, who have <\/i><\/span>made a great sacrifice during the separatist war<\/i>\u2026\u201d (per<\/i> SJB General Secretary, <\/span>Ranjith Madduma. Sunday Times, 04 April 2021<\/b> \u2013<\/span> \u201c<\/span>Sri Lanka shows appreciation to <\/i><\/span>her \u2018all weather\u2019 friends abroad<\/i>\u201d).<\/span><\/p>\n

Conclusion<\/b><\/span><\/p>\n

If the military men are all sacred cows, beyond reproach and beyond the reach of <\/span>the law, who will account for the multitude of civilians –\u00a0 men, women and\u00a0 <\/span>children – <\/span>massacred by the troops in the \u201cNo-fire Zones\u201d? Who will\u00a0 <\/span>face the penal <\/span>sanctions for the thousands of victims of abduction, torture, sexual savagery and <\/span>disappearance in military-controlled internment camps ? Who will take the fall for <\/span>the hundreds of captive Tamil rebels summarily executed by the armed forces? <\/span>Who will be brought to justice for the slaughter of \u201cWhite Flag\u2019 surrendees? <\/span>The answer is \u2018NONE\u2019.\u00a0 <\/span>Why? They were all Tamils. In the reckoning of the fascist <\/span>fraternity, the victims are vermin. To them, (to use a Nazi phraseology, applied to <\/span>the Jews), the Tamils are their misfortune \u2013 and are unworthy of life !<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
