Hence, why is our mainstream media which \u2018went to town\u2019 on the \u2018Pandora Papers\u2019 reference to <span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.colombotelegraph.com\/?s=Thirukumar+Nadesan\">Thirukumar Nadesan<\/a><\/span> and <span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.colombotelegraph.com\/?s=Nirupama+Rajapaksa\">Nirupama Rajapaksa<\/a><\/span>, <em>fighting shy of<\/em> exposing the more than 60 Sri Lankans names in the 2016 \u2018Panama Papers\u2019 some of whom are movers and shakers in the country\u2019s private sector? Is it because the Nadesan\/Rajapaksa duo styled as the \u2018Power Couple\u2019 are <em>\u2018outsiders\u2019 in relation to the Colombo centric \u2018elite\u2019 circles<\/em>\u00a0or is it because they do not bring any advertising revenue?<\/p>\n<p><em>The world owes a debt of gratitude to the <\/em>International Consortium of Investigative Journalists (ICIJ) for its painstaking work resulting in the landmark \u2018Panama Papers\u2019 and \u2018Pandora Papers\u2019. Its efforts would count for little unless the media in the respective countries honestly continue from where the ICIJ <em>left off.<\/em><\/p>\n<p>The media demanding accountability from Nadesan\/Rajapaksa are doing their <em>damnedest to distance \u2018<\/em>elite\u2019 circles from them.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>Media<\/strong><\/span><\/p>\n<p>The mainstream media which \u2018went to town\u2019 on the Nadesan\/Rajapaksa duo, did not report let alone release in the public domain the <a href=\"https:\/\/www.documentcloud.org\/documents\/21072242-nadesan-letter-to-pm\">\u2018<span style=\"color: #ff6600;\">personal letter<\/span>\u2019<\/a> dated 15 October 2016 written by Nadesan to then Prime Minister Ranil Wickremesinghe which was attached to the \u2018Pandora Papers\u2019. In his letter, Nadesan is \u201cproclaiming his innocence\u201d on the contentious \u201cmansion\u201d allegedly built on his Gampaha property by one of the ruling Rajapaksa siblings &#8211; Basil Rajapaksa who is presently Minister of Finance.<\/p>\n<p>Also ignored by the media is that Wickremesinghe was Cabinet Minister of Industry, Science and Technology during the Ranasinghe Premadasa\u00a0presidency at the time the duo\u2019s \u2018shell\u2019 companies, Pacific Commodities Ltd. and Rosetti Ltd. were set-up. It is alleged that the main source of income of these \u2018shell\u2019 companies is by providing \u201cconsulting\u201d services to the Sri Lanka government \u201cmainly in relation to inward investment into Sri Lanka\u201d.<\/p>\n<p>Ranil Wickremesinghe is the nephew of Ranjit Wijewardene &#8211; owner of <em>Wijeya Newspapers Limited (WNL) which DOMINATES <\/em>the print media in this country. The competitive media not wanting to <em>ruffle <\/em>Wijewardene\u2019s<em> feathers <\/em>have neither exposed Nadesan\u2019s <a href=\"https:\/\/www.documentcloud.org\/documents\/21072242-nadesan-letter-to-pm\">\u2018<span style=\"color: #ff6600;\">personal letter<\/span>\u2019<\/a> to his nephew nor reported that he was Cabinet Minister of Industry when \u2018consulting\u2019 services to the government were allegedly given to \u2018shell\u2019 companies owned by Nadesan.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>Cardinal &amp; WNL<\/strong><\/span><\/p>\n<p>The fear of upsetting WNL is such that <em>let alone the media,<\/em> even the usually loquacious<\/p>\n<p>Cardinal is <em>tongue<\/em>&#8211;<em>tied on seeking <\/em>accountability from Wijewardene\u2019s laid-back son Ruwan for his share of responsibility for the Easter Sunday carnage when he was State Minister of Defense during the ENTIRE period of the 2015-19 Yahapalana government. Are we expected to believe that Ruwan did not have knowledge of the attack even to the extent of Harin Fernando\u2019s hospitalized father?<\/p>\n<p><span style=\"color: #ff6600;\"><strong>SJB &amp; Elites<\/strong><\/span><\/p>\n<p>Similarly, even the main opposition party \u2013 SJB went out of its way to distance \u2018elite\u2019 circles from Nadesan. SJB spokesman &#8211; S.M. Marikkar, when referring in parliament to the past employment of Nadesan, avoided even NAMING the company where he worked. He merely referred to a \u201cfamous Company\u201d (\u2018Daily Mirror\u2019 8 October 2021). Is not this company, Maharaja Organisation (Projects) Ltd. &#8211; a subsidiary of Maharaja Organisation Ltd. \u2013 now Capital Maharaja Group, the owner of the Sirasa\/MTV\/Shakthi television empire?<\/p>\n<p>Apparently no one in parliament even asked for the identity of this \u201cfamous Company\u201d! This is the extent to which even politicians go to curry favour with the media.<\/p>\n<p>Is it not a fact that the Print and TV media empires of <em>Wijeya Newspapers Limited (WNL) and <\/em>the Capital Maharaja Group (CMG) <em>would never have reached their current status if not for state sponsored projects \u2013 particularly from the UNP since 1978? Chief among them is the <\/em>\u2018Mahaweli Project\u2019 &#8211; Randenigala Dam (WNL) and Victoria Dam (CMG). This must be viewed in the context of Thirukumar Nadesan being a former senior employee at the \u201cfamous Company\u201d!<\/p>\n<p><span style=\"color: #ff6600;\"><strong>\u2018Power\u2019 Structure<\/strong><\/span><\/p>\n<p>Nadesan\u2019s \u2018personal letter\u2019 to Wickremesinghe being suppressed by the mainstream media is interesting for another reason as well. It reveals the \u2018power\u2019 structure in this country. Nadesan states in his letter he was \u201cnamed a co-Executor\u201d of the \u201cWill\u201d of the late Anura Bandaranaike who was the brother of former President <em>Chandrika <\/em>Kumaratunga.<\/p>\n<p>The revelations in the \u2018Pandora Papers\u2019 on the Nadesan\/Rajapaksa duo, covers the period 1990 to 2019. It encompasses the executive presidencies of Ranasinghe Premadasa (January 1989 to May 1993), D.B. Wijetunga (May 1993 to November 1994), Chandrika Kumaratunga (November 1994 to November 2005), Mahinda Rajapaksa (November 2005 to January 2015) and Maithripala Sirisena (January 2015 to November 2019). Ranil Wickremesinghe (Prime Minister) had almost equal \u2018power\u2019 under the Sirisena presidency.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>\u2018Power Couple\u2019<\/strong><\/span><\/p>\n<p>While those with their ears to the ground will not be too surprised by the revelations in the \u2018Pandora Papers\u2019, even they will be amazed by the extent of the alleged wealth of the Nadesan\/Rajapaksa duo dubbed as the \u2018Power Couple\u2019 stashed away for concealment in a maze of entities in tax havens.<\/p>\n<p>Their alleged wealth parked in \u2018shell\u2019 companies since 1990 has been estimated \u201cat more than $160 million\u201d in 2011. If found unlawful, it is a scandal of major proportions despite the ICIJ stating it \u201ccouldn\u2019t independently verify the figure\u201d<\/p>\n<p>Due to the wide expos\u00e9 already in the media by commentators for the most part <em>regurgitating what&#8217;s in the <\/em><a href=\"https:\/\/www.icij.org\/investigations\/pandora-papers\/sri-lanka-rajapaksa-family-offshore-wealth-power\/\">\u2018<span style=\"color: #ff6600;\">Pandora Papers<\/span>\u2019<\/a>, there is no necessity for this writer to re-trace what has already been stated other than flag some crucial revelations.<\/p>\n<p>The assets allegedly amassed by the duo apart from cash and securities are said to include 4 luxury apartments &#8211; three in London, one in Sydney, a Dubai-registered asphalt firm and a valuable collection of paintings. The ICIJ alleges that the couple\u2019s art collection is stored in the \u201cGeneva Freeport ultra-secure warehouse complex\u201d which the BBC has described as housing the \u201cgreatest art collection no one can see.\u201d<\/p>\n<p>It is alleged that the main source of income of the duo\u2019s \u2018shell\u2019 companies is providing \u201cconsulting\u201d services to the Sri Lanka government. For example, it is alleged that \u201cPacific Commodities Ltd., would collect millions of dollars,\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/21072235-screen-shot-2021-09-29-at-102845-pm\"><span style=\"color: #ff6600;\">an internal document shows<\/span>,<\/a> advising foreign companies doing business with the Sri Lankan government.\u201d<\/p>\n<p>It is imperative for regulatory agencies in Sri Lanka led by the CBSL (Central Bank of Sri Lanka) to get to the bottom of this and determine the truth under the gaze of public opinion within a timeframe of not more than 3 months. This is perfectly reasonable in the context of the ICIJ already having done most of the \u2018<em>legwork\u2019. This will only happen if the mainstream MEDIA plays its role. I for one am not holding my breath!<\/em><\/p>\n<p><span style=\"color: #ff6600;\"><strong>\u2018Panama Papers\u2019 <\/strong><\/span><\/p>\n<p>While the mere<em> listing of names in tax havens does not necessarily indicate wrongdoing, it is the responsibility of the authorities particularly the CBSL to ascertain legitimacy. Refusal by the CBSL to do so, does injustice to those with legitimate accounts. <\/em><\/p>\n<p>Compared to recent CBSL governors &#8211; <em>Nivard Cabraal and Arjuna Mahendran (Cabraal is once again governor), <\/em>Dr. Indrajit Coomaraswamy is apparently held in high esteem by the Colombo centric business and professional circles. Yet, when this writer urged Dr. Coomaraswamy to determine the legitimacy of offshore accounts\u00a0in tax havens held by Sri Lankans named in the\u00a0\u2018Panama Papers\u2019, he REFUSED to do so by trotting out the shocking excuse:<\/p>\n<p><em style=\"font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">\u201cThe time period prescribed by the Foreign Exchange Act No. 12 of 2017 to conclude investigations under ECA expired on 19.05.2018 as stipulated in the Foreign Exchange Act No 12 of 2017. These investigations also lapsed on that date.\u201d<\/em><\/p>\n<p><em>\u00a0<\/em>If this is so, why did Coomaraswamy AGREE to the new Act which was enacted during his tenure by the Yahapalana government when current SJB stalwart Eran Wickramaratne was\u00a0State Minister of Finance?<\/p>\n<p>A\u00a0precursor\u00a0to the new Act was the \u2018invitation\u2019 issued by then Finance Minister Ravi Karunanayake to\u00a0<em>\u201cSri Lankans and Indians who had to take back their deposits from banks in Switzerland to place their funds in Sri Lanka\u201d<\/em>. \u00a0He had further assured that <span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.thehindu.com\/business\/place-your-money-in-sri-lanka\/article7724025.ece\">\u201cNo questions would be asked\u201d<\/a><\/span>!<\/p>\n<p><span style=\"color: #ff6600;\"><strong>Big Names<\/strong><\/span><\/p>\n<p>Those named in the 2016 \u2018Panama Papers\u2019 include Coomaraswamy\u2019s erstwhile colleague <em>Krishan Balendra<\/em> on the director board of arguably the country\u2019s leading corporate &#8211; <em>John Keells Holdings<\/em> (JKH). Balendra now JKH Chairman, in 2016 was \u2018Executive Director\u2019 and also Chairman, Nations Trust Bank which came under CBSL supervision.<\/p>\n<p>Coomaraswamy was a Board Director of JKH for more than 5 years until his resignation in July 2016 after his appointment as CBSL Governor. Subsequently his sister Radhika was appointed JKH Director.<\/p>\n<p>True to form when the media broke the news on the \u2018Panama Papers\u2019, it IGNORED <em>Krishan Balendra and other prominent names in the corporate sector. <\/em><\/p>\n<p><span style=\"color: #ff6600;\"><strong>New Fortress, Adani &amp; JKH<\/strong><\/span><\/p>\n<p><em>\u00a0<\/em>The protection of \u2018elite\u2019 circles by the mainstream media is reinforced when after \u2018going easy\u2019 after the government allowed India\u2019s Adani Group to have a majority <strong>51%<\/strong> stake in the West Container Terminal (WCT), there is strident opposition to the <em><strong>40%<\/strong><\/em><em> equity allowed to <\/em>US-based<\/p>\n<p><em>New Fortress Energy Inc<\/em>. in the Yugadanavi Power Station. One wonders whether this has anything to do with <em>Balendra\u2019s JKH being given a <\/em>34% stake to partner Adani\u2019s 51% stake? The state owned SLPA has been left with a mere 15% in WCT!<\/p>\n<p>The monopoly allegedly given to \u2018New Fortress\u2019 for the supply of LNG for five years is another matter which has to be resisted.<\/p>\n<p>It is noteworthy that the Build-Operate-Transfer (BOT) agreement for WCT was signed on 30 September 2021 AFTER <em>Balendra\u2019s close relative <\/em>Milinda Moragoda <em>(wife\u2019s half-brother) <\/em>arrived in New Delhi to assume duties as High Commissioner in August 2021. It is also worth noting that although Moragoda\u2019s appointment was approved by Parliament\u2019s High Posts Committee last year (September 2020), he assumed duties after almost one year (August 2021). Such is his unparalleled worth to the country!<\/p>\n<p>Coomaraswamy is presently \u2018Distinguished Fellow\u2019 of the Milinda Moragoda founded \u2018Pathfinder Foundation\u2019.<\/p>\n<p><span style=\"color: #ff6600;\"><strong>Conclusion<\/strong><\/span><\/p>\n<p>It is downright dangerous to give the media both state\/private \u2013 a free pass to operate without \u2018INDEPENDENT\u2019 regulation. It is a myth that the privately owned media is superior to the state owned media.<\/p>\n<p>The \u2018<em>self<\/em>&#8211;<em>regulation\u2019 through the \u2018Press Complaints Commission of Sri Lanka\u2019 (PCCSL) is a farce. For example, <\/em>WNL\u2019s \u2018Sunday Times\u2019 Editor &#8211; <em>Sinha Ratnatunga is also<\/em> Deputy Chairman of the PCCSL.<em> The implication is that you have to complain to Ratnatunga about Ratnatunga!<\/em><\/p>\n<p>Next to the dominant <em>WNL owned by <\/em>Ranjit Wijewardene<em> is <\/em>Upali Newspapers Limited (UNL) founded by his cousin Upali\u00a0<em>Wijewardene now controlled by his widow. <\/em><\/p>\n<p>There is <em>documentary evidence of WNL\u2019s \u2018Daily Mirror\u2019 even \u2018planting\u2019 a non-existent article falsely attributed to the <\/em><strong>\u2018London Times\u2019<\/strong>! <em>At its own whim WNL decides when or not to grant even a \u2018Right of Reply\u2019.<\/em><\/p>\n<p><em>The writer urges WNL to deny any of this.<\/em><\/p>\n<p>Can the public look forward to the media particularly WNL newspapers, exposing <em>on their FRONT pages<\/em> ALL the Sri Lankan names in the \u2018Panama Papers\u2019 and \u2018Pandora Papers\u2019?<\/p>\n<p>We are now informed by our media that the name of <span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"https:\/\/www.colombotelegraph.com\/?s=R.+Paskaralingam\">R. Paskaralingam<\/a><\/span> allegedly appears in the \u2018Pandora Papers\u2019. He was closely associated with UNP leaders mainly &#8211; former President Ranasinghe Premadasa and former Prime Minister, Ranil Wickremesinghe. Are we to assume that the only Sri Lankan names in the \u2018Pandora Papers\u2019 are those of Thirukumar Nadesan, Nirupama Rajapaksa and R. Paskaralingam?<\/p>\n<p>Why is Transparency International Sri Lanka (TISL) only interested in the three names in the \u2018Pandora Papers\u2019 and ignoring the more than 60 names in the \u2018Panama Papers\u2019?<\/p>\n<p><em>Why is it that authorities seeking to \u2018regulate\u2019 social media are for the most part \u2018comfortable\u2019 with the mainstream media?
