For over a decade, his name has been inextricably linked to a series of high-profile brushes with the law for alleged offenses, most notoriously his alleged incendiary role in inciting ethnic and religious violence, including the devastating 2014 riots in Dharga Town, Aluthgama.

Yet, it was not his alleged hate speech that initially silenced his freedom, but a flagrant act of contempt of court. In 2018, he was sentenced to six years of rigorous imprisonment for aggressively disrupting court proceedings and intimidating Sandya Ekneligoda, the wife of missing journalist Prageeth Ekneligoda. After serving less than a year, he was controversially released under a presidential pardon granted by then-President Maithripala Sirisena in May 2019—a move widely criticized as a political capitulation to nationalist elements. On September 10, 2026, the Supreme Court ruled the pardon arbitrary and unlawful, effectively quashing the executive decree. Following an arrest warrant, he was apprehended at a forest monastery on October 3 and returned to custody to serve out the balance of his term.

When he was subsequently produced before court stripped of his saffron robes and dressed in ordinary prison attire, a familiar seismic tremor rippled through Sri Lanka’s religious establishment. The Mahanayake Theras immediately issued letters of displeasure; his own governing order, the Kotte Sangha Sabha, vehemently asserted that the removal of the robe was exclusively the prerogative of the monastic order, rather than an administrative decision for state prison authorities; and a flurry of legal petitions claimed that a “sacrilege” had been committed against the “symbolic flag of Enlightenment.” A fierce public protest arose over the removal of the robe spearheaded by organized groups of monks, which subsequently escalated into an aggressive, absolute demand for a full presidential pardon and his immediate release from prison, with some monks even threatening dire political consequences for the Government if their demand was not met.

The political opposition and nationalist factions quickly weaponized the event, framing the standard execution of prison regulations as a targeted state onslaught against Buddhism. Yet, the state’s defense remained unyieldingly secular: the law is uniform, and 63 other Buddhist monks currently serving criminal sentences are subject to the exact same rules. To this end, prison authorities clarified that the administrative discretion to allow a convict to wear customary clothing during court transits applies strictly to sentences under three years. For an inmate serving a six-year rigorous term like Gnanasara, the standard prison dress code remains absolute without exception.

What we are witnessing is not a crisis of religious persecution, but a profound sociological phenomenon: the egalitarian shock. It is the fierce, defensive panic that occurs when a heavily privileged, sacred elite is abruptly forced to stand on equal footing with the ordinary citizenry before the secular laws of the land.

This structural clash is not a novel pathology of the modern republic. Exactly 209 years ago, the British colonial administration faced a similar situation during the 1817 Uva-Wellassa Rebellion.

The Kandyans had originally sought the assistance of the British to get rid of their tyrannical king. But after that was accomplished in 1815 and a Treaty was signed (the Kandyan Convention) between the British and the Kandyan chiefs, they wanted the British to leave and return to the Maritime Provinces. Dr. Henry Marshall wrote in his 1846 book Ceylon: A General Description of the Island and Its Inhabitants:

For many reasons, the Kandyans of all grades disliked the English. Differing in race, language, religion, customs, habits, and modes of thinking, the British rule could not but be for a long time highly unpalatable to them… In the administration of justice the English authorities did not recognise any distinction of caste, or any privileged class. They were as ready to hear the complaints of the poor as of the rich, by which the advantages of the wealthy were curtailed, and the long recognised privileges of caste disregarded… [The natives] made no complaint of oppression or misrule, contenting themselves with expressing a wish that we should leave the country.

Quoting the unpublished manuscript notes of Simon Sawers, the Revenue and Judicial Commissioner of Kandy at the time of the rebellion and an expert on native traditions, Marshall further wrote: “…[T]he chiefs and higher classes of the Kandyans were greatly offended at what we called the impartial administration of justice, whereby the privileges and civil distinctions of caste were practically extinguished.”

Governor Robert Brownrigg’s official proclamation of 1818 declaring British sovereignty over the Kandyan provinces blamed the insurrection on factious chiefs seeking to subvert the government and reassert absolute control over the general mass of people, who “by the equal justice of British authority were protected from their avarice or malicious cruelty.”

In his An Account of the Interior of Ceylon, published in 1821, Dr. John Davy, who served as Staff Surgeon and Personal Physician to the Governor from 1816 to 1820, noted that between 1815 and 1817, the Kandyan provinces remained quite tranquil and the terms of the Treaty were adhered to by the British.

He enumerates some of what he calls “the leading circumstances” that made the Kandyans want to throw off the British government, among which was the deep dissatisfaction and offense caused to the elite by the former’s equal treatment of all. The Kandyan chiefs, he writes, though less controlled under the British than under their former king, were yet far from satisfied because “before no one but the king was above them; now, they were inferior to every civilian in our service” and “every officer of our army.” Though officially treated with respect, they considered themselves degraded because, as Davy noted, a common soldier passed a proud Kandyan chief with as little attention as he would a fellow of the lowest caste. Ignorant of the natives’ rigid caste distinctions, most Englishmen treated the high and low castes alike, resulting in unintended offense and provocation. The priests, too, who ‘require[d] respect amounting almost to adoration,’ were deeply offended by the secular mode of British officers entering their temples.

Davy explicitly concluded that “the rebellion was not the effect of oppression or misrule, but of the innate propensities of the people, concealed till they burst out and showed themselves in acts of violence.” Not a single overt act of tyranny or oppression could be charged against the British government. After the rebellion was quelled in 1818, the Kandyan Treaty was modified. Davy opined that this change of system would finally enable the government to ameliorate the condition of the people and improve the state of the country, freed from the shackles of the first Treaty, under which the Kandyan chiefs remained the absolute rulers, old customs hindered progress, and the government “had little power to do good.”

Fast forward to the contemporary crisis, and the sociological landscape remains largely unchanged. The furore over the uniform of Galagoda Aththe Gnanasara Thero lays bare a deeply entrenched pathology within the contemporary Buddhist clergy: the resolute conviction that they exist entirely above the civil law whenever it impinges upon their institutional privileges.

Shielded by Article 9 of the Constitution, the hierarchical establishment operates under the dangerous assumption that the state’s uniform statutory framework must always bow to ancient ecclesiastical codes—effectively demanding a state of dual sovereignty where a piece of cloth confers permanent legal exceptionalism.

Tragically, large sections of the Buddhist laity remain blindly sympathetic to these ideas, actively enabling this clerical overreach. Rather than demanding accountability, the masses have been conditioned by a deep-seated, superstitious awe surrounding the saffron robe. It is precisely this uncritical reverence for an external vestment that has historically allowed, and continues to allow, many a rogue monk to commit misdeeds with societal impunity.

Ultimately, the entire trajectory of these protests reveals the shockingly low religiosity that defines both the modern monastic order and the masses who follow them. True Theravada Buddhism places absolute emphasis on ethical conduct. Yet, by reducing a profound spiritual tradition into a vulgar street battle over a prison dress code, both the agitators and their lay sympathizers have proven that their devotion is purely superficial. They have attached supreme spiritual importance not to the core tenets of peace and justice, but to the external, material symbol of monkhood.

More than two centuries after Simon Sawers, John Davy, and Henry Marshall documented the outrage of the Kandyan chiefs and priests over the loss of feudal deference, Sri Lanka remains trapped in the same spiritual vacuum. The state’s recent capitulation—scrambling to amend prison regulations to restore the robe’s unique exceptionalism even as demands for an absolute executive pardon persist—is the ultimate validation that the psychological landscape of 1817 remains unyielding. Until the nation realizes that the dignity of the Sasana resides in the moral integrity of the individual rather than the privilege of a garment, the rule of law will remain permanently hostage to the theatrical politics of the robe.

"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false

3,8

post-249451","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-colombotelegraph","category-editorial
<!-- This site is optimized with the Yoast SEO plugin v28.7 -
