(C) SUMMARY.  In a September 24 meeting with Defense\r\nSecretary Gotobhaya Rajapaksa on the margins of the UN\r\nGeneral Assembly, SCA A\/S Robert Blake stressed the urgent\r\nimportance of resettling as many internally displaced persons\r\n(IDPs) as possible and providing them freedom of movement,\r\nand the urgency of beginning a political reconciliation\r\nprocess with the Tamil community, if we are to make progress\r\nin strengthening U.S.-Sri Lanka relations.  Key to\r\nreconciliation is identifying an accountability process to\r\nhelp address past human rights abuses and potential\r\nviolations of international law that may have transpired\r\nduring the final stages of the military conflict with the\r\nTamil Tigers (LTTE), Blake pressed. \r\n\r\n\u00b6<\/a>3.  (C) Rajapaksa underlined his personal commitment to\r\nstrengthening relations with the U.S.  He said the Government\r\nof Sri Lanka (GSL) is committed to resettling as many IDPs to\r\ntheir villages as quickly as possible, arguing that it is in\r\nthe government's political and security interests to do so,\r\nbut the process is slowed by a lack of funding and demining\r\nequipment, inadequate infrastructure and housing in\r\nconflict-affected areas, and the continued presence of LTTE\r\nin the IDP camps.  He maintained that people can leave the\r\ncamps and regretted the perception that they are detained.\r\nHe argued that people in the camps have nowhere else to go\r\nand have chosen to stay.  He pointed to the Eastern Province\r\nas an example of a successful resettlement effort which, he\r\nstressed, took up to nine months.  It has only been three\r\nmonths since the end of war, he emphasized.  He sought to\r\nassure Blake of President Rajapaksa,s commitment to\r\npolitical reconciliation, but argued that the President\r\nneeded to be cautious of political opponents who will seek to\r\nportray him as selling out the nation after the Army,s\r\nsacrifice and hard-won victory.  Accountability \"commissions\"\r\nat this stage, he told Blake, would tear the country apart,\r\nrather than promote reconciliation.  END SUMMARY. \r\n\r\n-----------\r\nIDP RETURNS\r\n----------- \r\n\r\n\u00b6<\/a>4.  (C) Blake underscored the importance of resettling as\r\nmany IDPs as quickly as possible, noting that a number of\r\nGSL-announced deadlines had lapsed.  Rajapaksa said that he\r\nand the President believe that the sooner IDPs are resettled,\r\nthe better.  That's why the government's plans have been so\r\nambitious.  The camps are difficult to control security-wise\r\n-- LTTE combatants easily hide in them -- and breed political\r\nresentment, he contended.  The President wants these people's\r\npolitical support.  Screening for former LTTE could more\r\neasily take place in villages.  The GSL knows who most of the\r\nhard-core LTTE are and could easily monitor them. \r\n\r\n\u00b6<\/a>5.  (C) The biggest problem, according to Rajapaksa, is\r\nfinancial.  For example, Justice Minister Moragoda, who is in \r\n\r\nSTATE 00100197  002 OF 004 \r\n\r\nSUBJECT: SCA ASSISTANT SECRETARY BLAKE'S SEPTEMBER 24,\r\n2009 MEETING WITH SRI LANKAN DEFENSE SECRETARY GOTABHAYA\r\nRAJAPAK\r\ncharge of rehabilitation of former LTTE combatants, is keen\r\nto press ahead on this effort.  The GSL has provided staff\r\nand developed with the International Organization for\r\nMigration (IOM) a strategy for rehabilitation that emphasizes\r\nlivelihood training, but still lacks the resources to build\r\nthe centers and the housing required.  (NOTE:  State\/USAID\r\nhas proposed to DOD using a significant portion of the\r\napproximately $10 million in DOD-provided 1207 funding for\r\npost-conflict stabilization in northern Sri Lanka (about $10\r\nmillion) on   IOM-implemented projects that support the\r\nrehabilitation of former LTTE and pro-government paramilitary\r\ncombatants and former child soldiers, building on similar\r\nwork in the East.  END NOTE.) \r\n\r\n\u00b6<\/a>6.  (C) Blake recalled that, as Ambassador, he told GSL\r\nofficials that the U.S. would have difficulty funding the\r\nlong-term presence of IDPs in camps; it would be perceived as\r\nsupporting incarceration.  Rajapaksa stressed that it had\r\nbeen only three months; in the East, the first batch of IDP\r\nreturns did not take place for nine months.  Blake pointed to\r\nthe barbed wire around the camp as evidence that camp\r\nresidents could not leave.  Rajapaksa disputed that\r\nassessment.  The barbed wire, he said, could be removed.  The\r\ncamps are not closed.  Eight thousand camp residents have\r\ndisappeared and people are free to leave, for example, to go\r\nto the hospital or shopping in Vavuniya city (Department\r\nwould appreciate Embassy Colombo's assessment of whether this\r\nis true).  The reality, he argued, is that these people have\r\nno place to go.  The government offered the elderly the\r\nopportunity to leave, but they chose to remain.  Likewise,\r\n45,000 IDPs from Jaffna Peninsula have chosen to remain in\r\nthe camps because there is no housing on Jaffna.  Basic\r\ninfrastructure and housing in conflict-affected areas in the\r\nNorth have been completely destroyed, Rajapaksa maintained,\r\nthough electricity provision is underway and irrigation\r\nreconstruction is commencing.  Family and friends are not, in\r\nmost cases, a viable option; it is a significant financial\r\nburden for a poor family to take on even one person. \r\n\r\n---------\r\nDE-MINING\r\n--------- \r\n\r\n\u00b6<\/a>7.  (C) Rajapaksa surmised that if the GSL was to allow IDPs\r\nto go wherever they wanted, there would be significant\r\ncasualties from landmines.  Blake said the U.S. could\r\nconsider doing more to assist in the demining area, if\r\nfreedom of movement is assured.  Rajapaksa said that many\r\npromises from the international community of demining\r\nassistance have not been fulfilled.  The military alone\r\nsuccessfully de-mined seventy percent of the East.  He asked\r\nthat the U.S. provide demining equipment to the government\r\ndirectly and demand accountability.  He suggested the Embassy\r\ncould create a mechanism to ensure such accountability.  He\r\nquestioned the utility of the demining assistance the U.S.\r\nhas provided to NGOs that were not, he said, working\r\nproductively.  A\/S Blake reiterated that assurances on\r\nfreedom of movement would help us make the case for\r\nadditional assistance, and suggested removing the barbed wire\r\nand allowing the press to witness it and free movement of\r\ncamp residents. \r\n\r\n-----------------------\r\nPOLITICAL RECONCILIATION\r\n----------------------- \r\n\r\n\u00b6<\/a>8.  (C) Blake questioned why President Rajapaksa announced\r\nhis intent to delay steps on devolution until after\r\npresidential and parliamentary elections in spring 2010, when\r\nopposition political parties are so weak.  Progress on this\r\narea would net Tamil votes that could more than offset any\r\nloss of support from nationalists, whereas continued delay in\r\nannouncing political reconciliation efforts would further\r\ndiminish the President's Tamil support.  Rajapaksa reiterated \r\n\r\nSTATE 00100197  003 OF 004 \r\n\r\nSUBJECT: SCA ASSISTANT SECRETARY BLAKE'S SEPTEMBER 24,\r\n2009 MEETING WITH SRI LANKAN DEFENSE SECRETARY GOTABHAYA\r\nRAJAPAK\r\nthat the President wants Tamil votes and said his party\r\nexpects to win them in the Eastern Province.  The President\r\nknew he would lose in Vavuniya municipality to the opposition\r\nTamil National Alliance, so soon after the fighting, but was\r\nokay with that.  The President's concern is that the\r\nnationalist People,s Liberation Front (JVP) has tried to\r\ndestabilize the government by suggesting that the President\r\naims to sacrifice the hard-won victory of the Army.  He\r\nattributed rumors about Chief of Defense Staff Fonseka's\r\npresidential candidacy to these machinations. \r\n\r\n\u00b6<\/a>9.  (C) Rajapaksa said the President was committed to\r\ndevolution, but that the 13th Amendment would require\r\nadjustment before it could be implemented.  Right now, police\r\nauthority would devolve to the Chief Minister; and the only\r\nTamil Chief Minister would be in the Northern Province.\r\nChief Ministers have no national or international\r\nobligations; the GSL wants more Tamil-speaking representation\r\namong the police. \r\n\r\n\u00b6<\/a>10.  (C) What is most important, said Blake, is that everyone\r\nshould feel that they are equal as Sri Lankans and share the\r\nsame rights.  That is not the case right now for Tamils.\r\nRajapaksa blamed the LTTE, and pointed again to the East\r\nwhere there is \"full freedom.\"  He urged A\/S Blake to have\r\nconfidence in the GSL.  He regretted that there was too much\r\n\"speculation, talking and shouting.\"  We know the situation\r\nis not perfect, he said.  \"The conflict was long and hard,\"\r\nand society has benefitted greatly from the LTTE's defeat.\r\nRajapaksa pleaded that he had not received the credit he\r\ndeserved for disarming the LTTE cadres and the\r\nparamilitaries.  He has outlawed ransom payments and\r\nthreatened to prosecute anyone who pays bribes or ransom.\r\nThe government wants people, even former hardcore LTTE, to\r\nlive a normal life.  Blake suggested that the GSL engage the\r\nTamil diaspora community, which could provide financial\r\nresources for reconstruction in the north, if the GSL can\r\nconvince them of iyts good intentions.  He suggested that the\r\nGSL consider starting a non-profit organization that could\r\nreceive contributions from overseas for reconstruction and\r\nrehabilitation.  Rajapaksa told Blake that the GSL has\r\nstarted reaching out to Tamils in Colombo; Ambassador\r\nWickramasuriya said the Embassy has begun to do so in the\r\nU.S. as well.  \"People who want to settle problems are not\r\naggressive,\" Rajapaksa said. \r\n\r\n--------------\r\nACCOUNTABILITY\r\n-------------- \r\n\r\n\u00b6<\/a>11.  (C) Blake said that the report requested by Congress on\r\npotential violations of international humanitarian law and\r\ncrimes against humanity committed during the final stages of\r\nthe conflict is expected to be released in mid to late\r\nOctober.  It is secondary source reporting and we will make\r\nsure it is identified as such, Blake said.  However, part of\r\npolitical reconciliation is identifying an accountability\r\nprocess to deal with past human rights abuses and look at\r\nwhat occurred in the final stages of the war.  Rajapaksa\r\nresponded that commissions like these are going to tear the\r\npeople apart, suggesting that LTTE supporters would exploit\r\nthe process.  He said the government did a lot to control\r\nwide-scale abuses, such as those, he implied, that had\r\noccurred in the past.  Mass rape and village massacres did\r\nnot occur during the GSL's campaign, and he pointed again to\r\nthe positive overall experience in the Eastern Province.  In\r\nthat case, said Blake, the GSL had nothing to fear from a\r\nnational dialogue and reconciliation.  Rajapaksa said the\r\ngovernment is committed to winning hearts and minds, but it\r\nhas only been three months since the end of fighting. \r\n\r\n---------------------------------\r\nBUILDING U.S.-SRI LANKA RELATIONS\r\n--------------------------------- \r\n\r\nSTATE 00100197  004 OF 004 \r\n\r\n\u00b6<\/a>12.
