The cable is classified as \u201cConfidential\u201d signed by\u00a0Robert Blake\u00a0on February 11, 2008.<\/p>\n<p>Ambassador Blake wrote\u00a0\u00a0&#8220;Ambassador met Human Rights Minster Mahinda Samarasinghe on January 25 to discuss a range of U.S. concerns about Sri Lanka&#8217;s human rights situation, including recent incidents. Samarasinghe explained Sri Lanka&#8217;s strategy for engagement with the UN Human Rights Council, emphasizing the GSL&#8217;s resistance to a separate office for the staff of the High Commissioner for Human Rights (OHCHR), but expressing willingness to accept technical assistance for Sri Lanka&#8217;s national Human Rights Commission. Samarasinghe repeated that the\r\ngovernment would not entertain the idea of a separate status\r\nfor the OHCHR, but wanted to talk about the possibility of\r\ntechnical assistance for the national Human Rights\r\nCommission.  He noted that he and Arbour \"have an excellent\r\nrelationship.  She says what she feels she has to say in\r\npublic, and I do the same.\" \r\n\r\n<a id=\"par4\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par4\">\u00b6<\/a>4.  (C) Ambassador reiterated that it was well within the\r\npower of the security forces, who have an iron grip on the\r\nJaffna peninsula, to rein in the groups that are responsible\r\nfor extrajudicial killings, disappearances, and other serious\r\nabuses.  Ambassador noted that the situation in Batticaloa\r\nwas starting to resemble that in Jaffna. \r\n\r\n<a id=\"par5\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par5\">\u00b6<\/a>5.  (C) Ambassador expressed grave concern over the situation\r\nin the East, especially in Batticaloa, where armed groups are\r\npreparing to contest local elections, and extrajudicial\r\nkillings are occurring at the rate of 1-2 per day.    He\r\nurged the GSL to do more to assert control over law and\r\norder, saying that the police were clearly unwilling to\r\nconfront the TMVP (Karuna\/Pillaiyan faction).  Samarasinghe\r\nexpressed surprise, saying he would check with the Red Cross,\r\nbecause he had not seen evidence of this in the numbers the\r\nICRC provides to the government. (Note: the ICRC has\r\nconfirmed to us privately the spike in killings in Batticaloa\r\n- please strictly protect.) \r\n\r\n<a id=\"par6\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par6\">\u00b6<\/a>6.  (C) Ambassador noted that many of the problems Sri Lanka\r\ncontinued to experience with human rights violations, the\r\nlack of accountability and other governance and transparency \r\n\r\nCOLOMBO 00000149  002 OF 002 \r\n\r\nissues were traceable to the GSL's failure to appoint the\r\nConstitutional Council in accordance with the 17th Amendment\r\nto the Constitution (septel to follow).  Since the minority\r\nparties had reached agreement on the composition of the\r\nCommittee, when would the President take action to appoint\r\nit?  Samarasinghe said that the agreement of the JHU had only\r\nbeen obtained in the last few days and the government was\r\nwaiting for the official communication.  He observed that \"a\r\nlot of the flak we are taking would come down\" once the\r\nConstitutional Council and the independent commissions it\r\nappoints were in place.  He argued that the perception that\r\nthe president was deliberately hindering the formation of the\r\nConstitutional Council \"should not be so negative.\" \r\n\r\n<a id=\"par7\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par7\">\u00b6<\/a>7.  (C) Samarasinghe noted that the public inquiry phase had\r\nstarted on the case of the five Tamil youths killed in\r\nTrincomalee (\"Trinco 5\").  He expressed hope that progress\r\nmight also be made on the case of the 17 aid workers\r\nmassacred in Muttur: \"If we can finish that, I'll be a lot\r\nhappier.\"  Ambassador said the U.S. and others would also\r\nwelcome progress in the high-profile cases within the CoI's\r\nambit and inquired about the status of witness protection\r\nlegislation.  Samarasinghe said that the proposal was still\r\nwith the legal draftsman in the Ministry of Justice, after\r\nwhich the bill would go back to the Cabinet of Ministers for\r\napproval. \r\n\r\n<a id=\"par8\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par8\">\u00b6<\/a>8.  (C)  Ambassador asked about the progress of the\r\ninvestigation into the killing of Tamil opposition MP\r\nMaheswaran on January 1 while worshiping in a Hindu Temple.\r\nSamarasinghe pointed out that the President had announced\r\nthat the killer had confessed to being a member of the LTTE.\r\nAmbassador asked about the relevance of a statement by GSL\r\ndefense spokesperson Rambukwella that the suspect had\r\npreviously been a member of the security detail of Social\r\nAffairs Minister Douglas Devananda (also head of the\r\npro-government paramilitary group EPDP).  Samarasinghe could\r\noffer no explanation. \r\n\r\n<a id=\"par9\" href=\"http:\/\/wikileaks.org\/cable\/2008\/02\/08COLOMBO149.html#par9\">\u00b6<\/a>9.  (C) Ambassador then inquired about the recent release on\r\nbail and dismissal of most charges against former Air Force\r\nGroup Captain Nishantha Gajanayake and others who had been\r\narrested for involvement in the abduction and murder of two\r\nSri Lankan Red Cross workers and other \"disappearances,\"\r\nnoting that a senior military official had appeared to post\r\nbail for Gajanakaye.
