The Court of Appeal on November 6, issued an arrest warrant on former\u00a0Editor in Chief of The Sunday Leader Frederica Jansz when she did not\u00a0show in court as summoned to do when a Contempt of Court action filed\u00a0by Thilanga Sumathipala was called.<\/strong><\/p>\n

The Contempt of Court case was filed in 2004 by one time Chairman, Sri\u00a0Lanka Telecom and President for the Board of Control for Sri Lanka\u00a0Cricket, Thilanga Sumathipala against then Sunday Leader Editor
\nLasantha Wickrematunge<\/a><\/span>, journalist Frederica Jansz<\/a><\/span> and publisher Lal Wickrematunge<\/a><\/span>\u00a0for wilfully carrying articles in the Sunday Leader<\/a><\/span>\u00a0newspaper prejudicial to the current court proceedings against\u00a0Sumathipala.<\/p>\n

Petitioner Thilanga Sumathipala<\/a><\/span> in his application stated that the\u00a0articles were published with the cold and calculated intention of\u00a0interfering with the ongoing judicial proceedings and thus creating an\u00a0atmosphere of real and substantial prejudice against him (petitioner)\u00a0subverting the due process of Law and gravely prejudicing the holding\u00a0of a fair trial.<\/p>\n

Sumathipala has maintained that the publication of a series of\u00a0articles, written by Jansz and published during the tenure of Editor\u00a0and the late Lasantha Wickrematunge, \u00a0while there was imminent legal\u00a0proceedings against the petitioner rendered the action sub judice.<\/p>\n

Sumathipala at the time was the second accused in the Magistrate’s\u00a0Court case where he was being charged for aiding and abetting underworld\u00a0figure\u00a0Dhammika\u00a0Amarasinghe to forge a passport in the name of Buddhika Priyashantha\u00a0Godage and aiding and abetting Dhammika Amarasinghe to travel abroad\u00a0using the forged passport. \u00a0Sumathipala, according to the articles\u00a0carried in The Sunday Leader had used cricket board funds to do so.<\/p>\n

Petitioner Thilanga Sumathipala has asked Court to issue a rule on\u00a0Sunday Leader Editor, (now dead) then journalist and later Editor\u00a0Frederica Jansz and Publisher of the Sunday Leader Lal Wickrematunga\u00a0why they should not be punished for contempt of the Magistrate’s Court\u00a0of Colombo and upon failure to show cause to punish the respondents\u00a0for contempt of Court.<\/p>\n

The sensational articles published in the newspaper in 2003 and 2004\u00a0resulted in the sacking of two judges and the murder of the underworld\u00a0figure Dhammika Amarasinghe who was shot dead in the middle of a
\ndistrict court house in Hultsdorf when produced for a judicial\u00a0hearing.<\/p>\n

Colombo Telegraph this week carried the story<\/a><\/span> \u00a0that Frederica Jansz,\u00a0who was sacked from her post as Editor in Chief at The Sunday Leader\u00a0in September this year is learnt to have left Sri Lanka together with\u00a0her two sons having been granted refuge by a powerful nation currently\u00a0pushing to hold the Sri Lankan government accountable for possible war\u00a0crimes and other human right abuses including abuses of media freedoms\u00a0and stifling the press.<\/p>\n

Frederica had since her termination confided to close associates that\u00a0she had been followed home twice by men on motorbikes as well as\u00a0received a threatening phone call.<\/p>\n

Frederica was also facing further litigation initiated by Gotabaya\u00a0Rajapaksa<\/a><\/span> when in July this year following the article \u2018 Gota Goes\u00a0Berserk<\/a><\/span>\u2019 he revived a Contempt of Court action he filed in 2009 and\u00a0had laid by following her giving evidence in the White Flag case.<\/p>\n

Frederica, according to confidantes had said she had been warned by\u00a0her lawyers that there were moves to possibly impound her passport at\u00a0the next court hearing scheduled for later this month. \u00a0She was also
\nfacing a jail term if the case was decided in favour of Gotabaya\u00a0Rajapaksa.<\/p>\n","protected":false},"excerpt":{"rendered":"
