The President can appoint an acting Chief Justice says former Chief Justice Sarath N. Silva<\/a><\/span>. Under the article 109 (1) the President has this option, therefore Chief Justice Shirani Bandaranayake<\/a><\/span> should think\u00a0 about it and take leave during the impeachment.<\/strong><\/p>\n

Silva made above remarks with\u00a0Sinhala weekly Irida Divaina<\/a><\/em><\/span>\u00a0today.<\/p>\n

Article 109. (1) says; \u00a0If the Chief Justice or the President of the Court of Appeal is temporarily unable to exercise, perform and discharge the powers, duties and functions of his office, by reason of illness, absence from Sri Lanka or any other cause, the President shall appoint another Judge of the Supreme Court, or of the Court of Appeal, as the case may be, to act in the office of Chief Justice, or President of the Court of Appeal, respectively, during such period.<\/p>\n

No one can challenge the clause \u201cany other cause\u201d Silva says.<\/p>\n
