{"id":64424,"date":"2012-12-12T19:03:01","date_gmt":"2012-12-12T19:03:01","guid":{"rendered":"http:\/\/www.colombotelegraph.com\/?p=64424"},"modified":"2012-12-15T12:26:24","modified_gmt":"2012-12-15T12:26:24","slug":"charge-the-jaffna-university-students-detained-in-court-or-release-them-forthwith-futa","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/charge-the-jaffna-university-students-detained-in-court-or-release-them-forthwith-futa\/","title":{"rendered":"Charge The Jaffna University Students Detained In Court Or Release Them Forthwith &#8211; FUTA"},"content":{"rendered":"<p><strong>By <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/\">Colombo Telegraph<\/a><\/span> &#8211;<\/strong><\/p>\n<p><strong>&#8220;Once more we agree with our colleagues in Jaffna that \u2018dragging\u00a0 innocent students through police stations\u00a0 and\u00a0 police\u00a0 cells,\u00a0 as\u00a0 happened\u00a0 in\u00a0 the\u00a0 1970s\u00a0 and\u00a0 1980s,\u00a0 is\u00a0 frightening\u00a0 at\u00a0 the\u00a0 start\u00a0 and\u00a0 then hardens\u00a0 them\u00a0 and\u00a0 breeds\u00a0 contempt\u00a0 for\u00a0 the\u00a0 law\u00a0 and\u00a0 for\u00a0 the\u00a0 officers\u00a0 entrusted\u00a0 to\u00a0 uphold\u00a0 it.\u2019 The country has seen the effects of breeding contempt for the law in several devastating insurgencies in the\u00a0 North\u00a0 as\u00a0 well\u00a0 as\u00a0 the\u00a0 South.\u00a0 Justice\u00a0 must\u00a0 not\u00a0 only\u00a0 be\u00a0 done,\u00a0 but\u00a0 must\u00a0 be\u00a0 seen\u00a0 to\u00a0 be\u00a0 done.\u00a0 A government that deviates from this maxim condemns us all to a bleak future.&#8221; says\u00a0<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=FUTA&amp;x=14&amp;y=5\">Federation of University Teachers\u2019 Associations<\/a><\/span>.<\/strong><\/p>\n<p><a href=\"http:\/\/www.colombotelegraph.com\/index.php\/charge-the-jaffna-university-students-detained-in-court-or-release-them-forthwith-futa-2\/jaffna201-300x242\/\" rel=\"attachment wp-att-64415\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-64415\" title=\"jaffna201-300x242\" src=\"http:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2012\/12\/jaffna201-300x242.jpg\" alt=\"\" width=\"300\" height=\"242\" \/><\/a>&#8220;We demand that the Government must either charge the students detained\u00a0 in court or release them forthwith.&#8221; issuing a statement FUTA media spokesman\u00a0<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Mahim+Mendis&amp;x=6&amp;y=3\">Dr. Mahim Mendis<\/a><\/span> further says.<\/p>\n<p>We publish\u00a0below\u00a0the full text of the\u00a0statement;<\/p>\n<p>While\u00a0 expressing\u00a0concern\u00a0 about\u00a0 the\u00a0 recent\u00a0 beating,\u00a0 harassment\u00a0 and\u00a0 arrests\u00a0 of\u00a0 students\u00a0 in\u00a0 Jaffna, FUTA reminds the authorities of its demands made in the recent protest to keep the universities free of\u00a0 political\u00a0 interference.\u00a0 Not\u00a0 only\u00a0 does\u00a0 this\u00a0 hinder\u00a0 academic\u00a0 enterprise\u00a0 but\u00a0 leads\u00a0 to\u00a0 unrest\u00a0 in\u00a0 our universities.\u00a0 We\u00a0 in\u00a0 particular\u00a0 demanded\u00a0 that\u00a0 the\u00a0 training\u00a0 of\u00a0 new\u00a0 entrants\u00a0 in\u00a0 army\u00a0 camps,\u00a0 which included\u00a0 an\u00a0 ideological\u00a0 component,\u00a0 and\u00a0 the\u00a0 imposition of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Rakna+Lanka+Security+Service&amp;x=9&amp;y=6\">Rakna Lanka Security Service<\/a><\/span> having close association with the Defence Ministry, be rescinded. This\u00a0 mentality\u00a0 has\u00a0 led to a country that spends far more on spying and attempting to control students than on educating them. We see that the\u00a0 regime\u00a0 considers\u00a0 the\u00a0 youth\u00a0 as\u00a0 a\u00a0 force\u00a0 to\u00a0 be\u00a0 feared\u00a0 rather\u00a0 than\u00a0 nurtured\u00a0 for\u00a0 the\u00a0 future\u00a0 of\u00a0 this country.<\/p>\n<p>The young must be given leeway to express their feelings, opinions and visions within the limits of the law. The first condition for this is that the State must be law abiding with a serious commitment to uphold the law. We cannot agree more with our colleagues in Jaffna that \u201cDefault on the part of the\u00a0 Government\u00a0 through\u00a0 continued\u00a0 presence\u00a0 of\u00a0 the\u00a0 military\u00a0 without\u00a0 tangible\u00a0 moves\u00a0 towards\u00a0 a political settlement, has helped the mobilization of youthful feelings to turn [27 th November] into a day of defiance, where its original association becomes less important.\u201d<\/p>\n<p>No\u00a0 laws\u00a0 were\u00a0 broken\u00a0 in\u00a0 lighting\u00a0 flames on that occasion and\u00a0 the army intrusion into halls of residence and separating Tamils from Sinhalese students to subject the\u00a0 former to threat and abuse, is very much to be regretted. The following day\u2019s police attack on a student demonstration carrying placards\u00a0 demanding\u00a0 respect\u00a0 for\u00a0 democratic\u00a0 rights\u00a0 was\u00a0 further\u00a0 exacerbating\u00a0 the\u00a0 first\u00a0 blunder.\u00a0 The arrest\u00a0 of\u00a0 students\u00a0 subsequently\u00a0 under\u00a0 the\u00a0 PTA\u00a0 seems\u00a0 an\u00a0 attempt\u00a0 to\u00a0 find\u00a0 excuses\u00a0 for\u00a0 the Government\u2019s misconduct.<\/p>\n<p>The FUTA fully supports the wish of our colleagues to have in Jaffna University an institution that fosters pluralism, in which it is prepared to help, although the Government\u2019s action was contrary to this aim.<\/p>\n<p>FUTA condemns the use of the PTA to deal with a problem requiring political effort and a political settlement. To set an example in the observance of the rule of law\u00a0 the Government should first set up\u00a0 an\u00a0 inquiry\u00a0 into\u00a0 why\u00a0 the\u00a0 Police\u00a0 brutally\u00a0 assaulted\u00a0 students\u00a0 who\u00a0 were\u00a0 not\u00a0 responsible\u00a0 for\u00a0 any breach of the law.\u00a0 As\u00a0 the\u00a0 Jaffna\u00a0 University community has said\u00a0 in\u00a0 its\u00a0 letter, these arrests were purely vindictive. The fact that a\u00a0 magistrate\u2019s inquiry has not been held into the assault raises questions about the role of the bypassed and intimidated Judiciary in law enforcement.<\/p>\n<p>Against the harshness of the\u00a0 action, we have seen no evidence of anti-state terrorism\u00a0 in\u00a0 Jaffna. Of the nine students detained six\u00a0 have\u00a0 been released. The three students who remain\u00a0 in\u00a0 custody\u00a0 from\u00a0 10th\u00a0 December, the anniversary of the Universal Declaration of Human Rights, are P. Tharshananth, K. Jenemejayan and S. Solomon. Take the case of Tharshananth. He was assaulted with metal rods by\u00a0 persons\u00a0 believed\u00a0 to\u00a0 have\u00a0 security\u00a0 connections\u00a0 on\u00a0 18th\u00a0\u00a0 May\u00a0 2012\u00a0 and\u00a0 was\u00a0 admitted\u00a0 to\u00a0 hospital and treated for head injuries. The occasion was when students planned to observe the anniversary of civilian deaths in Mullivaykkal. Tharshananth was secretary to the University Students\u2019 Union.<\/p>\n<p>If\u00a0 the\u00a0 Government\u00a0 had \u00a0evidence\u00a0 that\u00a0 Tharshananth\u00a0 was\u00a0 involved\u00a0 in\u00a0 terrorist\u00a0 activities,\u00a0 the\u00a0 right thing to do was to arrest him and charge him in court rather than injure him. Further, to suggest that this\u00a0 closely\u00a0 watched,\u00a0 frightened\u00a0 person\u00a0 was\u00a0 involved\u00a0 in\u00a0 terrorist\u00a0 activity\u00a0 between\u00a0 the\u00a0 time\u00a0 he\u00a0 was beaten\u00a0 up\u00a0 and\u00a0 the\u00a0 27th\u00a0\u00a0 of\u00a0 November\u00a0 is\u00a0 hard\u00a0 to\u00a0 believe.\u00a0 His\u00a0 arrest\u00a0 only\u00a0 underscores\u00a0 the\u00a0 vindictive character of the State.
