Otherwise, accountability has not been a high-profile issue &#8212; including for Tamils in Sri Lanka. While Tamils have told us they would like to see some form of accountability, they have been pragmatic in what they can expect and have focused instead on securing greater rights and freedoms, resolving the IDP question, and improving economic prospects in the war-ravaged and former LTTE-occupied areas. Indeed, while they wanted to keep the issue alive for possible future action, Tamil politicians with whom we spoke in Colombo, Jaffna, and elsewhere said now was not time and that pushing hard on the issue would make them \u2018vulnerable.\u2019\u201d the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=US+Embassy+Colombo&amp;x=5&amp;y=5\">US Embassy Colombo<\/a><\/span> informed Washington.<\/strong><\/p>\n<div id=\"attachment_36353\" style=\"width: 242px\" class=\"wp-caption alignleft\"><a href=\"http:\/\/www.colombotelegraph.com\/index.php\/wikileaks-dont-push-sri-lanka-towards-burma-like-isolation-american-ambassador-butenis\/patricia-a-butenis1-colombo-telegraph\/\" rel=\"attachment wp-att-36353\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-36353\" class=\"size-full wp-image-36353\" title=\"patricia-a-butenis1-colombo-telegraph\" src=\"http:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2011\/11\/patricia-a-butenis1-colombo-telegraph.jpg\" alt=\"\" width=\"232\" height=\"203\" \/><\/a><p id=\"caption-attachment-36353\" class=\"wp-caption-text\">Patricia Butenis<\/p><\/div>\n<p>A Leaked \u2018Secret\u2019 US diplomatic cable, dated January 15, 2010, updated the Secretary of State regarding the accountability for alleged crimes committed by GSL troops and officials during the war and the Tamil perspective of the accountability issue.The <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/\">Colombo Telegraph<\/a><\/span> found the related leaked cable from the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/index.php\/category\/wikileaks\/\">WikiLeaks<\/a><\/span> database. The cable is classified and signed by the US Ambassador to Colombo <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Patricia+Butenis&amp;x=6&amp;y=5\">Patricia Butenis<\/a><\/span>.<\/p>\n<p>The US ambassador wrote; \u201cThese tentative steps notwithstanding, accountability has not been a high-profile issue in the presidential election &#8212; other than President Rajapaksa&#8217;s promises personally to stand up to any international power or body that would try to prosecute Sri Lankan war heroes. While regrettable, the lack of attention to accountability is not surprising. There are no examples we know of a regime undertaking wholesale investigations of its own troops or senior officials for war crimes while that regime or government remained in power. In Sri Lanka this is further complicated by the fact that responsibility for many of the alleged crimes rests with the country&#8217;s senior civilian and military leadership, including President <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Mahinda+Rajapaksa&amp;x=3&amp;y=6\">Rajapaksa<\/a><\/span> and his <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Gotabaya+Rajapaksa&amp;x=6&amp;y=6\">brothers<\/a><\/span> and opposition candidate General <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Sarath+Fonseka&amp;x=11&amp;y=3\">Fonseka<\/a><\/span>.\u201d<\/p>\n<p>Placing a comment Butenis wrote; \u201cAccountability is clearly an issue of importance for the ultimate political and moral health of Sri Lankan society. There is an obvious split, however, between the Tamil diaspora and Tamils in Sri Lanka on how and when to address the issue. While we understand the former would like to see the issue as an immediate top-priority issue, most Tamils in Sri Lanka appear to think it is both unrealistic and counter-productive to push the issue too aggressively now. While Tamil leaders are very vocal and committed to national reconciliation and creating a political system more equitable to all ethnic communities, they believe themselves vulnerable to political or even physical attack if they raise the issue of accountability publicly, and common Tamils appear focused on more immediate economic and social concerns. A few have suggested to us that while they cannot address the issue, they would like to see the international community push it. (S) Accountability for alleged crimes committed by GSL\r\ntroops and officials during the war is the most difficult\r\nissue on our bilateral agenda.  (NOTE: Both the State\r\nDepartment Report to Congress on Incidents during the\r\nConflict and the widely read report by the University\r\nTeachers for Human Rights (Jaffna) also detailed many\r\nincidents of alleged crimes perpetrated by the LTTE.  Most of\r\nthe LTTE leadership was killed at the end of the war, leaving\r\nfew to be held responsible for those crimes.  The Government\r\nof Sri Lanka (GSL) is holding thousands of mid- and\r\nlower-level ex-LTTE combatants for future rehabilitation\r\nand\/or criminal prosecution.  It is unclear whether any such\r\nprosecutions will meet international standards.  END NOTE.)\r\nThere have been some tentative steps on accountability on the\r\nGSL side.  Soon after the appearance of the State Department\r\nreport, President Rajapaksa announced the formation of an\r\nexperts' committee to examine the report and to provide him\r\nwith recommendations on dealing with the allegations.  At the\r\nend of the year, the president extended the deadline for the\r\ncommittee's recommendations from December 31 until April.\r\nFor his part, General Fonseka has spoken publicly of the need\r\nfor a new deal with the Tamils and other minorities.\r\nPrivately, his campaign manager told the Ambassador that\r\nFonseka had ordered the opposition campaign to begin work\r\nplanning a \"truth and reconciliation\" commission (ref B). \r\n\r\n\u00b63. (S) These tentative steps notwithstanding, accountability\r\nhas not been a high-profile issue in the presidential\r\nelection -- other than President Rajapaksa's promises\r\npersonally to stand up to any international power or body\r\nthat would try to prosecute Sri Lankan war heroes.  While\r\nregrettable, the lack of attention to accountability is not\r\nsurprising.  There are no examples we know of a regime\r\nundertaking wholesale investigations of its own troops or\r\nsenior officials for war crimes while that regime or\r\ngovernment remained in power. (S) For different reasons, of course, accountability also\r\nhas not been a top priority for most Tamils in Sri Lanka.\r\nWhile Tamils have told us they would like to see some form of\r\naccountability, they have been pragmatic in what they can\r\nexpect and have focused instead on securing greater rights\r\nand freedoms, resolving the IDP question, and improving\r\neconomic prospects in the war-ravaged and former\r\nLTTE-occupied areas. (S) The one prominent Tamil who has spoken publicly on the\r\nissue is Tamil National Alliance (TNA) MP, self-proclaimed\r\npresidential candidate, and Prabhakaran relative M.K.\r\nSivajilingam.  Breaking from both the TNA mainstream and the\r\npro-government Tamil groups, he launched his campaign because\r\nhe believed neither the government nor the opposition was\r\nadequately addressing Tamil issues.  Sivajilingam has focused\r\non creating a de-centralized federal structure in Sri Lanka\r\nwith separate prime ministers for the Sinhalese and Tamils,\r\nbut he also has spoken about accountability, demanding an\r\ninternational inquiry to get justice for the deaths and\r\nsuffering of the Tamil people. \r\n\r\n\u00b66. (S) Other Tamil politicians have not made public\r\nstatements on accountability and are generally more pragmatic\r\nin their thinking.  In our multiple recent discussions with\r\nTNA leader R. Sampanthan, he said he believed accountability\r\nwas important and he welcomed the international community's\r\n-- especially the diaspora's -- interest in the issue.  But\r\nSampanthan was realistic about the dim prospects for any Sri\r\nLankan government to take up the issue.  Granting that\r\ngovernments in power do not investigate their own, Sampanthan\r\nnevertheless said it was important to the health of the\r\nnation to get the truth out.  While he believed the Tamil\r\ncommunity was \"vulnerable\" on the issue and said he would not\r\ndiscuss \"war crimes\" per se in parliament for fear of\r\nretaliation, Sampanthan would emphasize the importance of\r\npeople knowing the truth about what happened during the war.\r\nWe also have asked Sampanthan repeatedly for his ideas on an\r\naccountability mechanism that would be credible to Tamils and\r\npossible within the current political context, but he has not\r\nbeen able to provide such a model. \r\n\r\n\u00b67. (S) Mano Ganesan, MP and leader of the ethnic Tamil\r\nDemocratic People's Front (DPF), is a Colombo-based Tamil who\r\ncounts as supporters many of the well-educated, long-term\r\nColombo and Western Province resident Tamils, and was an\r\nearly supporter of Fonseka.  The general made promises that\r\nconvinced him that if Fonseka were to win, ethnic\r\nreconciliation issues would then be decided by parliament,\r\nnot the Executive President.  On accountability, Ganesan told\r\nus that while the issue was significant -- and Fonseka could\r\neven end up implicated -- accountability was a divisive issue\r\nand the focus now had to be on uniting to rid the country of\r\nthe Rajapaksas. \r\n\r\n\u00b68. (S) TNA MP Pathmini Sithamparanathan told us in\r\nmid-December that the true story of what happened in the\r\nfinal weeks of the war would not go away and would come out\r\neventually, but she also said now was not the time for war\r\ncrimes-type investigations.  Finally, on a recent trip to\r\nJaffna, PolOff found that local politicians did not raise\r\naccountability for events at the end of the war as an issue\r\nof immediate concern, focusing instead on current\r\nbread-and-butter issues, such as IDP releases, concerns about\r\nSinhala emigration to traditional Tamil regions, and \r\n\r\nCOLOMBO 00000032  003.2 OF 003 \r\n\r\nre-developing the local economy. \r\n\r\nCOMMENT\r\n------- \r\n\r\n\u00b69.
