{"id":70122,"date":"2013-01-18T20:24:02","date_gmt":"2013-01-18T20:24:02","guid":{"rendered":"http:\/\/www.colombotelegraph.com\/?p=70122"},"modified":"2013-01-23T13:26:41","modified_gmt":"2013-01-23T13:26:41","slug":"impeachment-and-intimidation-law-council-of-australia-urges-australian-government-to-intervene","status":"publish","type":"post","link":"https:\/\/www.colombotelegraph.com\/index.php\/impeachment-and-intimidation-law-council-of-australia-urges-australian-government-to-intervene\/","title":{"rendered":"Impeachment And Intimidation: Law Council of Australia Urges Australian Government To Intervene"},"content":{"rendered":"<p><strong>By <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/\">Colombo Telegraph<\/a><\/span> &#8211;<\/strong><\/p>\n<p><strong>\u201cI am writing to express the Law Council of Australia\u2019s concern regarding reports of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/index.php\/romesh-de-silva-jayampathi-wickramaratne-ma-sumanthiran-and-jc-weliamuna-receive-threatening-letters\/\">threats and intimidation<\/a><\/span> against the legal profession and judiciary in Sri Lanka, and\u00a0 to request that the Australian Government encourage the Sri Lankan Government to respect the important roles that an independent legal profession and the rule of law play in democratic societies. The Law Council is particularly concerned about recent reports that the Sri Lankan President, President <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Mahinda+Rajapaksa&amp;x=4&amp;y=3\">Rajapakse<\/a><\/span>, has dismissed Chief Justice <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.colombotelegraph.com\/?s=Shirani+Bandaranayake&amp;x=6&amp;y=9\">Shirani Bandaranayake<\/a><\/span> based on a process which does not appear to have been conducted in a fair or transparent manner.\u201d the Law Council of Australia writes to the Minister for Foreign Affairs, Bob Carr.<\/strong><\/p>\n<div id=\"attachment_70124\" style=\"width: 310px\" class=\"wp-caption alignleft\"><a href=\"http:\/\/www.colombotelegraph.com\/index.php\/impeachment-and-intimidation-law-council-of-australia-urges-australian-government-to-intervene\/bob-carr-and-mahinda-rajapaksa\/\" rel=\"attachment wp-att-70124\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-70124\" class=\"size-medium wp-image-70124\" title=\"bob-carr and Mahinda Rajapaksa\" src=\"http:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/01\/bob-carr-and-Mahinda-Rajapaksa-300x261.jpg\" alt=\"\" width=\"300\" height=\"261\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/01\/bob-carr-and-Mahinda-Rajapaksa-300x261.jpg 300w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2013\/01\/bob-carr-and-Mahinda-Rajapaksa.jpg 550w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-70124\" class=\"wp-caption-text\">Bob and Rajapaksa | Picture by Sudath Silva<\/p><\/div>\n<p><span style=\"font-size: 13px; line-height: 19px;\">&#8220;The Law Council considers the existence of an independent, impartial and competent judiciary to be an essential component of the rule of law.\u00a0 The Law Council also considers that any impeachment process regarding judges must involve strict observance of the rule of law. Based on the information available to the Law Council, it does not appear that the process that the Sri Lankan Government has relied on to date to impeach the Chief Justice has involved such strict observance.&#8221; wrote\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Joseph J Catanzariti, the president of the\u00a0<\/span><span style=\"font-size: 13px; line-height: 19px;\">Law Council of Australia.<\/span><\/p>\n<p>&#8220;The Law Council is aware that the International Bar Association, the Bar Association of Sri Lanka, the Canadian Bar Association, the International Commission of Jurists, Commonwealth Lawyers\u2019 \u00a0Association, LAWASIA\u00a0 and the Bar Human Rights Committee of England and Wales have expressed concern about the impeachment proceedings against the Chief Justice.
