The cable was classified as \u201cCONFIDENTIAL\u201d by Ambassador Patricia A. Butenis.<\/p>\n<p>The cable written on 23, December 2009 says \u201cAfter the president\u2019s announcement of the formation of the committee in October, the issue of accountability for possible war crimes received little attention in Sri Lanka. Most people appeared to think either that civilian casualties were unfortunate but unavoidable consequence of war on terrorism or that, even if crimes were committed, there was little that could be done as long as the Rajapaksas remained in power.\u201d The cable further says \u201c General Fonseka trust the\u00a0topic onto the national scene, however, in a December 13 interview published in the local Sunday Leader newspaper, in which he said Defense Secretary Gotabhaya Rajapaksa had ordered troops from the 58<sup>th<\/sup>Division to kill any remaining LTTE leaders, in particular Pulidevan, Nadesan and Ramesh, in spite of a reported attempt by them to surrender. This interview was immediately met by a firestorm of criticism from the\u00a0government allies, accusing Fonseka of egregiously betraying his country and exposing its \u2018loyal, courageous soldiers\u2019 to war- crimes investigations and the possibility of being arrested when travelling overseas. Walking the tightrope of courting both Tamil votes and Sinhala voters, Fonseka backed off his statement two days later saying he<\/p>\n<div id=\"attachment_748\" style=\"width: 470px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2011\/10\/general-sarath-fonseka-colombo-telegraph3.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-748\" class=\"size-full wp-image-748\" title=\"General-Sarath-Fonseka- colombo telegraph\" src=\"http:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2011\/10\/general-sarath-fonseka-colombo-telegraph3.jpg\" alt=\"\" width=\"460\" height=\"276\" srcset=\"https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2011\/10\/general-sarath-fonseka-colombo-telegraph3.jpg 460w, https:\/\/www.colombotelegraph.com\/wp-content\/uploads\/2011\/10\/general-sarath-fonseka-colombo-telegraph3-300x180.jpg 300w\" sizes=\"auto, (max-width: 460px) 100vw, 460px\" \/><\/a><p id=\"caption-attachment-748\" class=\"wp-caption-text\">Fonseka Opens Up Pandora&#39;s Box<\/p><\/div>\n<p>had been misquoted, and that he would take full responsibility for anything done by his troops at the end of the war.\u201d<\/p>\n<p>Under the subheading of \u201c Anti \u2013 corruption as the new accountability?\u201d the ambassador wrote \u201cAfter ten days of brutal hits on his statements about the killing of the LTTE leaders, General Fonseka may e less likely to bring up specific human rights incidents that are related to ethnic divide and instead may talk more about general political reconciliation and the way ahead.\u201d<\/p>\n<p>Responding to Secretary of the Ministry of Human Rights Rajiva Wijesinghe\u2019s letter to Philip Alston the ambassador wrote \u201c Although local media has no reported this development, it is unlikely that Wijesinghe\u2019s arguments will stop either the UN\u2019s interest in the alleged incidents or the attacks on Fonseka by the Rajapaksa camp.<\/p>\n<p><strong>The Colombo Telegraph published another cable on 10<sup>th<\/sup> October which shows, the Presidential candidate General Sarath Fonseka stood by the controversial \u201cwhite Flag\u201d story published by the Sunday Leader.<\/strong> The cable written on 14<sup>th<\/sup>\u00a0December 2009 at 13.50pm by the ambassador Butenis and classified as \u201cConfidential\u201d recount the details of a lunch meeting she had with UNP deputy leader Karu Jayasuriya and Sarath Fonseka on 14<sup>th<\/sup>\u00a0December 2009. Rather than pushing accountability for\r\npossible war crimes and human rights violations, Fonseka may\r\ntry to push anti-corruption as a major campaign theme,\r\nattempting to appeal to all ethnic groups.  END SUMMARY.\r\n\r\nRESPONSE TO INCIDENTS REPORT\r\n----------------------------\r\n\r\n<a id=\"par2\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par2\">\u00b6<\/a>2. (C) President Rajapaksa formed a committee in early\r\nNovember to look into the allegations of violations of\r\ninternational humanitarian law raised in the State\r\nDepartment's \"Report on Incidents\" of October 21, 2009.  This\r\ncommittee is expected to issue their report on December 31,\r\n2009, but Ambassador was recently cautioned by Foreign\r\nMinister Bogollagama not to expect too much from this initial\r\naction.  Bogollagama said rather than a full-scale response\r\nthat is released to the public, the committee would send an\r\nadvisory memo to President Rajapaksa, making recommendations\r\non what items in the report merit further action and what\r\naction might be best.  The president would then consider\r\nthose recommendations and decide how to proceed.  Bogollagama\r\nappeared keenly interested in recent U.S. Appropriations\r\nlanguage requiring a follow-up report to the State\r\nDepartment's October 21, 2009, report on incidents at the end\r\nof the war.\r\n\r\nFONSEKA OPENS UP PANDORA'S BOX\r\n------------------------------\r\n\r\n<a id=\"par3\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par3\">\u00b6<\/a>3. Former Sri Lankan Navy Commander\r\n\r\nCOLOMBO 00001180  002.4 OF 003\r\n\r\nWasantha Karannagoda, for example, said on December 23 on\r\nstate media that Fonseka's comments jeopardized the Sri\r\nLankan military's chances at obtaining coveted UN\r\npeacekeeping operations assignments in Haiti and elsewhere.\r\n\r\n<a id=\"par4\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par4\">\u00b6<\/a>4. (C) UN Special Rapporteur on Extrajudicial, Summary or\r\nArbitrary Executions Philip Alston reportedly has sent a\r\nletter to the GSL requesting more information on the alleged\r\nincident involving the three LTTE chiefs.  In the\r\ngovernment's own backtracking exercise, Secretary of the\r\nMinistry of Disaster Management and Human Rights Rajiva\r\nWijesinghe has reportedly sent a letter back to Alston\r\nclarifying that since Gen. Fonseka subsequently retracted his\r\nstatement, there was no longer a need for Alston's request.\r\nAlthough local media has reported this development, it is\r\nunlikely that Wijesinghe's argument will stop either the UN's\r\ninterest in this alleged incident or the attacks on Fonseka\r\nby the Rajapaksa camp.\r\n\r\nSIVAJILINGAM DEMANDS JUSTICE FOR TAMIL DEAD\r\n-------------------------------------------\r\n\r\n<a id=\"par5\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par5\">\u00b6<\/a>5. (C) TNA member of parliament M.K. Sivajilingam, who\r\nrecently broke with his party to present himself as a\r\ncandidate for the presidential elections, raised the need for\r\nan international inquiry into civilian deaths and injuries\r\nduring the war as a primary theme of his campaign.  The\r\nleadership of the TNA has not pressed either candidate on\r\nthis publicly.  TNA leader P. Sampanthan on the other hand\r\ntold Assistant Secretary Blake and Post that while he was\r\nconcerned with the accountability issue, he believed it was\r\nboth unrealistic to expect the government to do anything\r\nabout it and dangerous for the Tamil leadership in Sri Lanka\r\nto raise the issue publicly.  Nevertheless, he believed it\r\nwas important for the government eventually to take some\r\nsteps towards accountability if it were to achieve meaningful\r\nnational reconciliation.\r\n\r\nANTI-CORRUPTION AS THE NEW ACCOUNTABILITY?\r\n------------------------------------------\r\n\r\n<a id=\"par6\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par6\">\u00b6<\/a>6. Fonseka\r\nappears to be hoping that anti-corruption emerges as a\r\ntouchstone and has attempted to paint the Rajapaksas as a\r\nfamily-based kleptocracy, giving out hundreds of jobs to\r\ndistant family members, building grand houses for themselves,\r\nextorting vast sums of money from the country, and fostering\r\na culture of corruption throughout the government.  The\r\npresident, however, may be relying on his own internal\r\npolling, which we understand from sources in the president's\r\noffice indicates that while a majority of voters know the\r\nRajapaksa family is corrupt, they still would vote for him as\r\nthe more experienced politician who does what he says he will\r\ndo.\r\n\r\nCOMMENT\r\n-------\r\n\r\n<a id=\"par7\" href=\"http:\/\/wikileaks.org\/cable\/2009\/12\/09COLOMBO1180.html#par7\">\u00b6<\/a>7. (C) As Sri Lanka tries to move beyond the war,\r\naccountability for possible crimes remains a significant,\r\nthough secondary, issue in Sri Lanka.  Whether speaking of\r\naccountability for ongoing human rights abuses or for\r\nincidents occurring during the final stages of the war, the\r\nissue had not received much attention from either the\r\ngovernment or the public before the recent flurry of activity\r\nfollowing Fonseka's statement.  Given their possible\r\ninvolvement in most if not all incidents investigated, top\r\n\r\nCOLOMBO 00001180  003.4 OF 003\r\n\r\ngovernment leaders, in particular the Rajapaksa brothers,\r\nhave not pushed for greater accountability.  Indeed, given\r\nthe risk of exposing his own involvement, it was surprising\r\nto many that Fonseka attempted to raise this as a campaign\r\nissue, and he will probably not do so again.  We are unaware\r\nof any cases in which a sitting government has undertaken\r\nwholesale investigations of its own troops or leadership for\r\nalleged war crimes, and it is probably unrealistic to expect\r\nthe current Sri Lankan government to do so.
