Allegation Regarding The Disappearance Of Rs. Two Billion In The Construction Of The Lotus Tower

Speaking at the opening ceremony of the Colombo Lotus Tower, the President made a statement to the effect that back in 2012, one of the Chinese contractors involved in the project – a company named ALIT – had taken the advance payment of Rs two billion (Around 15 million USD at that time) made by the Telecommunications Regulatory Authority (TRC) and disappeared. The President also stated that the government had sent the Sri Lankan Ambassador in Beijing to the address given by ALIT and discovered that there was no such company at that address. This allegation was flashed around the world by international news agencies including Reuters and it became a major news story in many Asian countries.

At the time that this payment was made in 2012, the TRC which was in charge of this project was directly under me as the President. Therefore I wish to make a clarification regarding this matter. In 2012, the total cost of the Lotus Tower project was estimated at 104.3 million US Dollars. The Exim Bank of China agreed to provide a loan facility of 88.6 million USD or up to 85% of the total project cost. The remaining 15% of the cost had to be borne by the TRC. The contractors for projects financed by the Exim Bank of China are nominated by the Chinese government. Accordingly, the China National Electronics Corporation and ALIT were nominated by the Chinese government. The Lotus Tower was due to be completed by 2015, but due to the yahapalana government causing delays in the project and due to lapses on the part of the contractor, it could not be completed according to schedule.

In projects of this nature the 15% ‘local component’ has to be paid to the contractor upfront as an advance payment. Documents confirm that on 9 October 2012, the TRC had credited 15 million USD (Rs. two billion) to the account of the main contractor China National Electronics Corporation. The latter company is still the main contractor of the project. The advance payment of Rs. two billion was never paid to the other contractor ALIT. The relevant documentation will show that from day one all payments had been made to the account of China National Electronics Corporation.

The two contractors recommended for the Lotus Tower projects are 100% Chinese government owned conglomerates. The active party doing the contract was always the China National Electronics Corporation and not ALIT. To say that a major Chinese government owned conglomerate had disappeared with Rs. two billion belonging to the Sri Lankan government, is a horrendous insult to China. This insulting statement was moreover made in the presence of the Chinese Ambassador. We can understand why the government would want to sling mud at the political opposition on the eve of a decisive presidential election. But to publicly insult a major world power that has always been friendly and helpful to Sri Lanka, is unconscionable.

From the time the present yahapalana government came into power, all they have done is to declare open the projects started by my government. The Colombo Lotus Tower is also one such project. The Lotus Tower can generate enormous revenues for the government by providing telephone, television and radio broadcasting services and also by attracting local and foreign tourists. But its cost has been less than a seventh of the cost for example of the privately owned Shangri La hotel project in Colombo. The Lotus Tower is therefore, an excellent investment. This is also an edifice that will symbolise Sri Lanka, much like the Eifel Tower in France.

This unfounded allegation of a Rs. two billion fraud in the construction of the Lotus Tower was made at its opening ceremony in order to prevent the credit for constructing such a national asset from going to the SLPP and the Joint Opposition. What we saw happening was no different to throwing stones at a neighbour’s new car out of sheer jealousy. For more than five years we have heard a lot about golden horses, Lamborghinis and bank accounts with a balance of 18 billion USD, but this is the first time that anybody heard of a Chinese company that had disappeared with Rs. two billion belonging to the TRC. In April 2019, the Auditor General published a 670 page special report on the Lotus Tower project, but it makes no mention at all of a Chinese contractor who disappeared with Rs. two billion.

What this indicates is the remarkable ability that the yahapalana leaders have to concoct complete falsehoods in a manner that suits the occasion. If this statement was made due to wrong information being conveyed, I expect the relevant individuals to move quickly to issue a correction. Since all documents pertaining to the Lotus Tower project are available with the TRC and the Auditor General, ascertaining the truth with regard to this matter is not a difficult task at all.

    7. Making a synthetic lawyer of an idiotic son who couldn’t even pass his GCE (OL)

    8. Killing the most famous rugby player on behalf of another moron son
    9. Soliciting sex from girls of the families that lost their loved ones due to Premadasa Terror campaign in exchange of your service as a human rights lawyer in 1980s

        This is a total falsehood. Dr Amith M died in Israel during an official visit. He died in 2007 in Hospital of Pneumonia. A full inquiry was supposed to be held but as usual the result is not known. How can you hold MR for a death in 2007 ? In the name of truth publish this.

    I did not see a confirmation if the ALIT’s address used in the contract was correct or not in the above diatribe. Neither I see an explanation, if the address used was wrong, why was a wrong address used.

    What is the ROI of the tower? What year it is reaching break-even? What are other projects considered for that loan money? Why were they rejected?

    There thousand and thousand Tamil villages drying without any water for years. There are no solutions for that from Muslim-Sinhala Appe Aanduwas. Nobody believes the Lotus Tower was a needed project and built with clean projects.

    Uncle, a small clarification. MS being a fool , “jumped the gun but ended with dud”. The fact is Chinese companies are known to “cook the books”. People who are in stock trading are well aware of this fact. . What ever figures they give in annual reports are unreliable. So please keep your praise for another day. Chinese Exim bank, China Construction Bank,Bank of China, China Industrial Bank ,China agricultural Bank are the main lending banks and they all have been involved in illegal activities, within or out side of their countries. Also some of the higher ups were given death sentence for fraud (you are lucky to be in Lanka and not China). The fact is when such deals are made usually there is a main lender and one or more subsidiary which are assigned as shell companies to take care of kick backs, bribes, lobbying, illegal laundering —etc. In business world it is an open secret. So you in your usual style giving this conglomerate and other BS are not worth to “fly a kite”. Because its true, MS had the audacity to tell this in public in presence of Chinese diplomat, but he got the facts wrong. As you rightly mentioned there are two companies, none vanished but one is a shell company and other is lender. You paid the shell company which was returned back to you as kick back.The account book may show this as upfront/advance payment but it is a kick back to get the ball rolling. If anyone is interested read about Bofors gun scandal or recent Italian helicopter scandal in India.It is the subsidiaries which are alleged to be involved in illegal payments and not the main supplier/contractor.

          The accounting needed for much more than Rs 2B. We are not worried if New King’s effort to tracing was exhaustive or not. Now, he has said it out. Old King has replied to that. What do you want to deviate from those two and enter into third area that New King didn’t look for the missing money properly? It seems you have forgotten that New King was Old King close associate during those thefts (in fact, until New Prince beat the ASP’s son) took place. Don’t’ you want to think that New King does know better what happened that time than you or me?
          As a matter of fact, the Exim bank paid only $67 M of the loan signed for $85M. Do you know how the Lotus Tower Books shows the shortfall loan? Do you know how the money due to the contract was paid? I guarantee you the Lankawe who had handed over one after other Colombo City lands to China to keep it cool from asking for loan back, never could have paid the $20M to the contractor. Do you have any explanation for what is that (85-67=)18M

    President Sirisena is a loose cannon; his alleged statement was apparently made to appease a certain section of the UNP in this election time. He has a lot of advisers who hate the Rajapaksas (just like some comment writers here on this web site). However, slinging mud will not resolve any issue, and Sri Lankans are fed up of this dirty act in journalism.
    1. If the original payment was made to the same account that the current government is also using to pay back the loan installments. I am sure there is no issue with regard to the payee, payer and payment.
    2. If Rs. 2 billion is missing, the Yahapalana government should have found it out at the very outset, in 2015 (and not now). Even the auditor general has not found such amount missing in his annual reports. Therefore it sounds like a mistake that needs to be corrected immediately.
    3. President Sirisena is notorious for having acted many a time like a loose cannon in the past and this alleged statement could be another concocted story by his idiotic advisers to get him some cheap mileage during his last days in office. These myopic advisers want to show their president is ‘lilly-white’ and only others are ‘corrupt’. Now, it has apparently back-fired.
    4. I hope the Chinese government will come up with more concrete information and details with documentary evidence to clarify the matter and then, the President’s office will have to tender a formal apology to all parties affected.

    I fully agree with the former President as this was not the venue to make unsubstantiated allegations. MR has given clear evidence of the transactions, which includes a 700 odd page report by the Auditor General. The Nelum Tower will enhance the digital communications of this country. The Chinese Govt have been generous in the provision of useful public amenities. Witness the BMICH, which they built and bear maintenance costs. What crowds throng to events held there. Also the Nelum Pokuna Concert Hall.

    Gratitude seems to be non existent in our country.

    Most of the comments are out of tangent , and refer to past matters. It seems the commentators are only interested in slinging mud at MR whatever the subject. It is time the CT Editor deletes comments which seem to emanate from feeble minds.

    China does business all over the world as part of its “Belt and Road” initiative. Lending money to underdeveloped nations for infrastructure development. So it is very unlikely $15 million USD simply vanished, as the contracts are personally awarded by the Chinese government. There are heavy penalties (execution, long imprisonment, etc) for this kind of fraud in China. Regarding the existence of the company, I was able to ascertain that said company, Aerospace Long-March International Trade Co Ltd, has existed since 2006. It has a “Bloomberg” business profile, an address in Beijing, and a publicly available phone number. Bloomberg is high profile for business in North America, they would not carry these details if the company was fake. In any event, I am certain the company exists, as they make weapons for the PLA and weapons for export.

        Please stop slinging mud at those who try to find out the truth about President Sirisena’s alleged statement that sounds like a blatant lie. We listened to your type of people in January 2015, believed your assurances about Yahapalana leaders, and voted this government to power. Look what has now happened?
        You may not have ulterior motives to destroy this beautiful island of Sri Lanka; similarly, there are millions of Sri Lankans both in and out of the country, who love it, help it, and protect it. Obviously, MR is one of the most popular leaders in the country and those who can not stand his growing popularity and achievements continue to concoct negative stories about his policies and development projects.
        I did the same research like Lester and found out that President Sirisena’s hateful and jealous statement at the opening ceremony of the Nelum Tower is baseless and damaging. Fortunately it has now backfired and we should urge the president to correct it and tender a formal apology to MR and the Chinese government!

          The Chinese value reputation very highly. If this kind of fraud occurred, it would be a big embarrassment to the Chinese government. The perpetrators would be jailed (or executed) and any business operations immediately shut down. Sirisena’s lies are obvious here.

    Now to everybody Sira’s utterances are the Gospel truth eh? Ranil got f****d himself when he stopped all Chinese funded projects thinking his beloved Uncle Sam and the former colonial masters (remember he celebrated 500th anniversary of Portugese arrival in Sri Lanka) will rush to pump money. He had to eat his own secretions and crawl back to Chinese for help. The result was Chinese acquiring the Hambantota port for 99 years and over Rs 5bn loss due to delays in Lotus Tower project according to Auditor General among many other losses including in the Port City project. Sira seems to have resigned to the prospect of his political oblivion and determined to create utter chaos including destroying vital diplomatic relationships like Ranil did soon after 2015 elections. In Sinhala they say “yana yaka korahath bindagena yanawa”, meaning when a demon is exorcised, it will destroy stuff to demonstrate it’s departure.

    All are crooks, trading allegations at each other. The Jarapassa regime needs no further description and that is why it was booted out in 2015. But the regime that many including myself who placed faith on to have a clean and good administration in fact openly looted state coffers and made the sacred word “Good Governance” a joke and a brand name for ace crooks. It improved the record by delaying elections, firstly the local government and secondly the provincial councils, which is yet to be held, all in the pretext of a change of law requiring some procedures to be complete. The prognosis is clear. Both the mainstream political parties are not fit to govern. Then is the choice in selecting some third force which has no experience at all in governing a country or are we to anticipate an undemocratic take over by force? How sad, leaving the voter with no proper choice and to make a mockery of voting?

    15% of USD 104.6 Mln. is not equal to USD 15Mln. It should be USD 15.7Mln. Maybe Wimal helped with the calculations or the USD 0.7Mln (Rs.91.8 Mln.) was taken as “rounding” to a special fund?
    The decimal is included for the total cost of USD 104.3 Mln. & loan of USD 88.6 Mln, but not in the ‘local component’. Where did it disappear to?

    When mentioning the loan facility of USD 88.6Mln (which is around Rs. 15 Billion of foreign currency denominated debt), why have the repayment terms not been mentioned? What is the rate of interest and how many loan installments to pay back?

    The amount of ‘enormous revenues’ to be generated by the tower needs to be specified in numbers. Costing less than Shangri – La does not prove that this is an excellent investment.

    Assuming the cost of this loan is 10% (interest +currency depreciation), the annual cost is Rs.1.5 Billion to begin with. This equates to Rs 125 Mln. a month or Rs 4.2Mln per day, 365 days of the year. Therefore ‘enormous revenues’ need to be well in excess Rs 4.2Mln daily.

It brought the entire country into shame and tarnished the image. This is a clear cut demonstration of political revenge by using such scam runs into billions. Mig deal, Hambantota airport and harbour (I saw few fishing vessels and not a single flight at the airport) Galle face terrace sale to Shangri La, Kirsch Housing Projects, Highways, etc, etc. So you conveniently forgot how much you, your brothers/sisters, sons, wife, nephews and nieces plundered your colourful, long reign of terror Mahinda.

    Now the so called disappeared company has issued a statement……….Karunasena Kodituwakku also has found it and met it’s management………The Rs 2bn appear to have been fully recovered (a reason why auditor general did not find it missing in the first place)……
