Amending The Constitution Will Be The First Step To Autocracy: Stop It!

The most important portion of President Gotabaya Rajapaksa’s statement in Parliament on Friday 3 January 2020 was his commitment to amend the Constitution.

There were many commendable things in the statement as always, like motherhood and apple-pie that many will agree with. A non-apple-pie matter that points to the future I quote from the news report:

Delivering his government’s policy statement at the inauguration of the Fourth Session of the Eighth Parliament, the President said the existing constitution had given “rise to many problems at the present time because of its inherent ambiguities and confusions. In order to safeguard the security, sovereignty, stability and integrity of our country, it is essential that changes be made to the existing constitution”. He said that reforms would be introduced to the Constitution to “establish a strong executive, legislature and independent judiciary that can ensure the sovereignty of the people”.

END QUOTE

The writing is on the wall; let’s cut through the slosh about legislature and the decorations about judicial independence and get to the point. GR wants a “strong executive” presidency, therefore 19A which restricts his powers will be repealed and to do so he MAY need a two-thirds majority at elections later this year. (I will explain in a moment why I say MAY and not ‘may’). Much as I have said, to the displeasure of my friends on the Left, in my post-election columns, that ‘a new president needs a chance to prove himself’ and argued ‘be patient, wait and see, alleged human-rights violations by the military on his watch notwithstanding’, this matter falls into a different category. It is about something he has declared he intends to do. And it is bad!

The JR Constitution is egregious, no ifs and buts. In the JR era it was the vehicle of an autocrat. MR indulged in absurd abuses of power and the executive presidency was a canopy papering over the worst corruption in any period of Lanka’s history. In a word the “strong executive” presidency has been a curse upon this country and the people must fight tooth and nail against the plague. The worst about 19A is that it did not entirely abolish the executive presidency and pussy-footed creating a neither here nor there pudding. The Westminster model has drawbacks, American tripartite balance-of-power is unusable in Lanka because of the debility of our institutions and toothless timidity of parliamentarians and judiciary. Hence the best of a bad hand for Sri Lanka is to opt for the Westminster model with a part first-past-the post and a part proportional (PR) electoral scheme. 

Saint Augustine is a man after my heart; I recite his prayer whenever needed: “Oh Lord give me chastity, but not yet”. Likewise though the all-PR system is defective I do not want it put aside, yet. My reasons are straightforward. (a) The existing PR scheme makes it near impossible for any party to secure a two-thirds parliamentary majority; (b) I am opposed to an amendment to create a strong executive presidency; (c) only a bipartisan consensus can achieve this in the existing scheme; (d) hence to block the return of a strong executive presidency it is necessary to prevent changes in the electoral method. Life and death imperatives take precedence over imagined “Vistas of Prosperity and Splendour”. The existing PR scheme must be retained for now and the electorate must do its duty and deny GR-MR-SLPP-SLFP cum Dead-Left a two-thirds parliamentary majority

That is desirable but far from safe since the blight of a despotic constitution cannot be defeated so easily. My pro-Gota friends cheerily remind me “Oh come on Kumar, we will buy them if we don’t get two-thirds at the election. You know how easy it is to buy UNP, Muslim Congress, Makkal Congress and even the odd TNA parliamentarian”. This, dear reader, I am reluctant to deny; I do not think any better of our parliamentarians than you do. 

The threat however is a great deal more serious than that. Think of how authoritarians slide into office, and then, consolidate their grip. In Reichstag elections throughout 1932 and 1933 Hitler’s Nazis polled between 33% and 37%; never close to 50%. However having gained control of the Reichstag through alliances and persuaded President Hindenburg to appoint Hitler as Chancellor they enacted statutes which were used with devastating effect to destroy all opposition. Power grabs by other despots too illustrate, how given a foot in the doorway, control is tightened till both de jure and de facto a “strong executive” is consolidated. How foolish the German liberal classes were is shown in a ‘great’ publication Frankfurter Zeitung, Jan 1933: “It is hopeless misjudgement to think one could force a dictatorial regime upon the German nation. The diversity of the German people ensures democracy”! Therefore my “MAY” a few paras ago. Even if GR-MR are denied a two-thirds majority in the parliamentary elections, we are hurtling into a tunnel whose exit could be authoritarian dictatorship of some form. Lanka is fighting a rear-guard action against a complete power grab, and this makes the future precarious. 

The GR-MR regime draws sustenance from Sinhala-Buddhist (SB) nativism hence it is no surprise that it is said to be planning to re-vamp or abandon UN Resolution 30/1 and close down the Office on Missing Persons (OMP) – Daily Mirror report.  Work on accountability and ascertaining the truth through investigation is not the regime’s cup of tea. It denied disappearance ever occurred so why maintain an outfit like the OMP? The regime will pay compensation to families as in CBK’s days to keep them quiet. The fusion of an authoritarian strategy with nativist mass emotions is a deadly combination. What the parliamentary elections will confirm or disprove is whether the chauvinist surge to the GR camp is an enduring phenomenon or just a transitory flash in the pan. If the former, heaven help Si Lanka.  

Notwithstanding this gloomy prospect one must keep up the fight every step of the way. If the infatuation of the SB-mass with GR-MR is not an obstinate political transformation it will be possible to reverse it to a degree. The first step must be to deny GR-MR a two-thirds majority and an opportunity to amend the Constitution by legitimate means. This will strengthen the hand of the democratic citizenry in resisting attempts to force dictatorial measures by more roundabout means as in the 1930s in Germany. 

President Gotabaya is playing it cleverly. The Roman god Janus is depicted looking in two directions. Gota’s pragmatism and penchant for getting things done is winning him plaudits. He seeks to widen his base and is doing so with success. The middle-class is impressed by clearing garbage, cleaning drains, improving roads and surprise visits to government departments to nab errant officers sleeping on the job or absent from duties. It is said productivity is being enhanced and costs are being cut. Limiting the size of the Cabinet and prohibiting ostentatious displays of photographs of politicos is engendering a positive response. The message is: “Give me authority; I will deliver the goods and take you forward”. Authoritarianism attired in achievement is not a message that can be easily resisted. It is a common, if half serious cliché to say: ‘Sri Lanka needs a dictator to clean out the muck and mend the country’. That’s GR’s other market; by other I mean the non-SB nativist sector. Actually the two markets overlap.

Truly we are in uncharted territory; no one, least of all President Gotabaya himself, can predict how things will evolve over the medium of term of about three years. Observe that rampant nepotism in corporate appointments (Gota’s US travel agent; MR’s son’s in-laws) is raising its ugly head again. All in all, I see the following, roughly in order of importance (influence not morality) as critical factors.

1. Sinhala-Buddhist politics: How long lasting the upsurge we witnessed at the end of last year? Will it harden to the bedrock of a lasting ideology spurring nativist authoritarianism?

2. President Gota the doer; the man who makes trains run on time, burnishes city walls, cleanses drains and makes departments work. This image, Janus-faced with Sinhala-Buddhism, can grease the way to nativist cum pragmatist (institution reforming, militarist), authoritarianism.

3. Alternatively, will people in increasing numbers (SB people, the minorities are anyway lost to Gota) take fright that an intolerant, illiberal and nepotistic autocracy is taking shape and buck the trend? Are the feckless UNP, rudderless JVP and the homeless minorities able to work together to achieve any mobilisation at all? The signs don’t look good.

4. Only fourth in importance, in the medium term, is the economy. There are modest prospects for growth if the debt canyon can be bridged. Usually, the third leg of the triumvirate underpinning authoritarianism is populism. But splashing goodies at the masses is not possible without running up more debt – the already promised tax cuts and 100,000 jobs will wreck the budget. So the regime has a problem, it has to talk its way out with its creditors or with the masses.

5. The minorities, Tamils (both variants) and Muslims, won’t matter in political calculations for some time to come. The November melodrama has turned them into sideshows. 

6. The big wide world outside (Geneva, New Delhi, Westminster and DC) can, I think, be side-lined by the regime for some time. The Tamil diaspora and the international human-rights movements have by and large been emasculated.

What then is my overall estimate for the medium term? Advantage Gota and authoritarianism for now! But still far from point, set and match. To defeat this a double-fault has to be forced on the regime. First deny it a two-thirds parliamentary majority; second throwback all attempts to amend or subvert the constitution except with tri-partisan endorsement. Tri? Well, Regime, UNP and the Minorities.

    Sajith Premadasa has organized the “New Sulanaga ” to start in Nugegoda just like Mahinda started his Pohottuwa in the same location.

    Dr Ranil does not need a New Sulanaga as the UNP now has the Mahasanga with him again, alongside, the Elite ,Anglicans, Vellala and the the new addition Muslim peoples Congress and the SLMC.

    This is a formidable combination with the UNP now covering all bases from Elite to the Dalits in every corner.

    Add the JVP and those 40 Seats which the TNA Boss Abraham is bragging , Nandasena will be struggling to get 100 seats let alone change the Constitution.

    I haven’t even counted the CBK factor..

      He could get his Aryan Sturmabteilung to smash the parliament, abolish constitution, establish a monarchy, crown himself being the first emperor of Sri Lanka, rewrite the history or add his epic story to Mahawamsa, ……. send all his nephews and nieces to serve on the foreign missions, …..

      Why bother with 19th, 13th, …… ?

    The phenomenon of governance or leadership by the incompetent is described
    by some ,as follows: A system of governance where the least capable to lead are
    elected by the least capable of producing, and where the members of society
    least likely to sustain themselves or succeed are , rewarded with goods and
    services paid for by the confiscated wealth of a diminishing number
    of producers. This is one definition for INEPTOCRACY I found among many .
    There are other definitions that suits different situations but for us Srilankans,
    I believe this suits best. People in Srilanka don’t protest on the street against
    their grievances and instead they choose their favoured ones to inflict
    sufferings on them . Like it or not , dictatorship is not far away , people have
    more than earnestly and willingly demonstrated their disregard for freedom.
    Generally it was women of those days that was quite infamous for idle talks
    but the situation has now reached explosive proportions that our MPs have
    no better jobs to do ! The Govt has nothing better these days than releasing
    opponent’s call recordings and just look what we use technology for !
    Doesn’t this remind you the story of the garland and monkey ?

    I see strengthening the executive -including the state apparatus and security forces- over the legislature and judiciary as the principal trend to be observed in the coming years. Current cosmetic changes will not continue. Real politik will be at play.

      Srilankans have not tasted real democracy , for them , voting and work
      stoppage is the democracy . Even these two actions are not for their
      benefit.They are organised by groups with vested interests . People are
      just customers ready to buy their cheap products even without knowing
      their product details ! So , for such a society , what is Real Politics going
      to mean ? We have been encouraged to go on Hero Worship and we do it
      with so much delight which in return guarantees good results for the
      designers . So , all we have is , Heroes and not public servants ! As long as
      this is the situation that goes in circles , nothing in the country will
      change for better ! People have only simple things to learn for a change .
      One such step is they must free themselves from being hired as a first
      step towards depoliticising themselves . If you want to put yourself into
      the intelligent public then you have to walk in that direction..If you closely
      watch the president election campaign by all three main contestants , you
      will notice that only J V P did a meaningful campaign to educate the
      voter but what happened ? Only 3% reacted in kindness . Nearly 13 million
      went their own traditional way. And this time it was a CLEAN HERO
      WORSHIP . Who wanted this ? A huge section of the majority !

        Politics in Lanka and perhaps countries like India also is not a contest of ideas and policies alone. People(voters) even at the grassroots level expect rewards of some sort. So politics is a game of rewards and punishments. This is how the party and alliance system has been formed in post independent Lanka. what reward can voters expect from the JVP in an immediate sense?

        The patron-client system that has been built by the two mainstream coalitions continue like Tattumaru system in paddy cultivation in the past. Reality is interpreted by powerful voices according to which side you are on in this system.

        In this context, it is not possible to talk about an independent judiciary, public service, police etc. All those associated with the state up to the level of Grama Niladhari are bound by this system that has been constructed in the name of democracy. No point in talking about Westminister principles and practices as a guide in this case. A political and mass movement from those who have been excluded from this patronage system need to organise a third alternative-the form of which has to be further discussed and reflected upon. Securing power by any means and installing a patronage system for a period in governance needs to be stopped.

          My emphasis is Change . The system needs real change and I didn’t
          Highly recommend J V P’s ability to bring that change through
          their whole set of policies on all fronts but so far , they have
          identified the real needs of the people and the failures of all post
          independent rulers and the reasons for their failures . One has to
          have the will to step out of the box and take a risk on a new journey.
          My best example is , recently three female students lost their lives
          in Azerbaijan on a fire accident ! Our people are taking the risk of
          boat travel on highly dangerous seas to creep into Italy and Aussie.
          Many have lost lives , many stranded and many are deported
          when caught ! Examples are plenty , crying foul for a change .
          This is what I wanted too in my comment . It doesn’t take any pain
          to describe our dull and sluggish attitudes but it surely takes
          courage to set out on an adventure .

    Very timely analysis and warnings. This article should be read with Victor Ivan’s article on Sarath Silva and the status of the Judiciary.
    GR-MR-BS actions need to be viewed with the Instruments of the India-China-Russia-USA Quartet. There will not be much music. Dissonance will be the result. Muslims and Tamils of this world are not going to be spectators.

    It appears you too are rapidly going ga ga hence I suggest you change your hair gel for about 52 weeks and see if you could reverse your mental decay. Don’t worry about Sarath and Kamal both will be put in their right places by Mahinda/Basil/Namal once they get a few more MPs just after the next parliamentary elections.

    The government didn’t have even simple majority let alone a two thirds majority when they won the war!

    DSS’s government in 1947 didn’t have even simple majority let alone a two thirds majority when they won Independence for Ceylon!

    Present challenges are far less than that and certainly don’t need a two thirds majority. Rajapaksas are trying to be next Hitlers. Don’t give them more than 110 seats in the next parliament. Keep options open. All UNP voters on November 16 must go and vote. Do not give up. If SLPP gets the same votes as November 2019, they can only have 116 seats.

      Lack of leadership and collapse of grass root an organisation,
      and alienation of the working class, are the main reasons for this pathetic situation in the UNP.

      JVP is also weakened because of lack of vision and international support.

      Now SLPP is favoured by the Chinese Communist Party instead of the JVP because
      China is only interested in expanding the Chinese Empire not communism or socialism.

      So we the people are at the mercy of the Rajapaksha’s.

      Hope there will be a healthy opposition in the country so that democracy could flourish again.

        No INVESTIGATIONS both on EASTER sunday disaster and BOND scam

        No Feritlizer subsidieries as promised to the farmers ?

        But ABOVE all, MEDIA dont seem to raise the question about above points ????

    Dear Mr G

    Appreciate the good work done in the South.
    Now please focus on the North.

    There are many similarities between the South of Srilanka and the North,
    from a socio economic perspective.

    I propose to the current government to build a High Tech University in Killinochchi
    (similar to the one that will be opened in Sooriyawewa Hambanthota)

    This will be a good investment interms of empowering talented Sri Lankans to reach their full potential, which will inturn contribute to the improvement of the quality of life
    of Sri Lankans.

    There should be consensus among all Sri Lankans regarding any changes to the constitution.

    These changes in laws and the Constitution towards an autocracy will happen slowly but surely, in a way that it will not be noticed by the people in the country. It has happened many times before in other nations and now it is happening under our noses. All this because the voters wanted the roads clean. Gota is cleaning out the laws that prevent him from being that dictator, and making way for one family rule.
    His voters are too naive to realize it.

      Monkey around with the constitution started with the coalition govt of
      Sirimavo that won the general election in 1970 reducing the U N P to
      17 seats . The disease since then keep going on and on for fifty years
      now with no treatment , let alone cure , in sight ! It is an epidemic now .
      Trying to force the people to live with these age old tactics is the name
      for the game to achieve their objectives .

Now await the abuse of the ever increasing throng of Sinhalese Buddhist Fascist lunatics , who unfortunately are now the vast majority of the Sinhalese. They no more a fringe movement but now mainstream. Like you stated the West the UN and India do not care and will not interfere, will just mouth out platitudes about just Tamil rights but for their own selfish motives , are trying to appease these Sinhalese racists but as usual will fail and will ultimately have egg on their faces. The Sinhalese know how to manipulate , lie, cheat and create fake history. We Sri Lankan Tamils are very well aware of this Very recently the racist Sinhalese Buddhist monks and members belonging to extremist Sinhalese parties accompanied by various Sinhalese government officials have again gone to the ancient Neeravadi Pillayar kovil in Mullaitheevu , to visit the illegally built Buddhist vihara within this ancient historic Hindu temple. They are deliberately going there to provoke , create trouble and to show the local Hindu Tamils who is the boss now and they can do whatever they like to the Tamils and this ancient Hindu temple with impunity. They later visited the army camp of the occupying racist Sinhalese armed forces. Most probably were entertained there right royally and given lots of food , drinks and praise heaped on them. But that opportunity will arise only after 5 years. For MR, it is better to continue with the 19th amendment than to have it abolished. Unless he has some other sinister plan up his sleeve! President also gave a pardon to a military personal who was sentenced to death by judiciary. What is the role of judiciary in ensuring that justice is made to the people. Northern and Eastern Srilanka is a part of unitary Srilanka. The people of North East did not accept him as their president. He has lost executive power on North Eastern people. Democracy is not Dictatorship. If you loose the democracy people will loose their rights to demand rule of law, independent judiciary, independent journalism.
