Arjuna Mahendran Affair: An Open Letter To The Prime Minister Of Singapore

Your Excellency

We are writing to you today as citizens of a neighbouring country maintaining extremely cordial and friendly relations with Singapore, ever since Singapore was born as a new country.

Our two countries are bonded together as members of the Commonwealth of Nations through the Commonwealth Secretariat and are committed to operate with inter-governmental consensus of the member states of the Commonwealth. We recall and hold with esteem respect and honour our admirations towards the first Prime Minister of Singapore, Late Lee Kuan Yew, as a leading political figure in the region with outstanding achievements, accepted with open doors to any government anywhere in the world. We recollect with gratitude his extremely friendly attitude displayed towards our country throughout the tenure of his office as the Prime Minister.

Your Excellency, a few years ago one of your citizens, (formerly a citizen of Sri Lanka) was invited by our Prime Minister Ranil Wickremesinghe, to head a leading government institution of our country. His name is Luxman Arjuna Mahendran and the institution he was invited to head was the Central Bank of Sri Lanka. Arjuna Mahendran was appointed, designated as the Governor of the Central Bank of Sri Lanka in January, 2015.

Shortly thereafter, in February that year the news of a controversial Treasury Bond transaction broke out spreading shock waves in the economic circles of the country culminating into a public demand for an investigation by the authorities to divulge the true facts relating to the issue. Despite several futile attempts by some politicians to shield the matter, the Parliament of Sri Lanka decided to refer the case to be inquired into by the Committee on Public Enterprises (COPE), a standing committee, of the Parliament.

In October 2015 COPE revealed that the Governor of the Central Bank of Sri Lanka Arjuna Mahendran should be held responsible for the Bond Issue Scam and legal action should be initiated against him. However President Maithripala Sirisena announced the appointment of a Commission of Inquiry, under the existing Laws of Sri Lanka to further investigate the case.

This Bond Commission after protracted investigations and leading evidence of several persons including Governor Arjuna Mahendran and the Prime Minister Wickremasinghe, over a period of 10 months long deliberations, issued its report on 16th January, 2018. This is now a public document of the country.

The commission of inquiry has recommended the institution of legal action against those involved in the scam including Arjuna Mahendran. Accordingly the Attorney General of Sri Lanka has filed legal action and the courts have commenced the judicial process prosecuted by the Attorney Generals’ Department.

Two of the accused are in remand jail under Court orders and summons have been issued to Arjuna Mahendran to appear before Courts.

The legal authorities of the government have informed Courts that he could not be traced at the address given by him in Singapore to serve the Summons on him. Courts have now issued an open warrant to arrest him. Sri Lanka Police, it is reported, has sought the assistance of the Interpol to arrest him to be produced to courts for the judicial inquiry. Interpol’s Singapore branch has now informed Criminal Investigation Dept of Sri Lanka that Arjun Mahendran is in Singapore.

The Commission of Inquiry has pointed out interalia possibilities of conflict of interest and insider dealings associated with this scam. The country is waiting to see the wrong doers being dealt with according to law and to the recovery of several Billions of state funds squandered in the process of the scam.

The economy of the country is also in dire states. When the Bond Scam came to light the country was caught up in a huge debt trap. The position has been worsened many fold due to the scam.

Therefore, we appeal to you, as citizens of a friendly neighbouring country, to use your good office as a friendly gesture to help the authorities to arrest your citizen who is required here to face legal action of a fair trial in accordance with known recognized judicial norms assured by the Government of Sri Lanka under the guidance of our Prime Minister.

In the context of the most recently developed relations of the two nations to agree on trade policies to encourage travel related business, tourism, immigration and providing people with opportunities to enhance their mutual livelihood, your kind response to our earnest appeal would be appreciated whole-heartedly and passionately by the people of Sri Lanka.

          Rusiripala, please stop your stupid posturing to please Sinhala racist gallery. No country will just hand over its citizen just because an idiot like you send a letter. There has to be proper judicial inquiry before a credible bench, where defendant is well represented, and evidence placed to prove any offence. Sri Lanka judicial system is not only corrupt but is institutionally racist. Just because Tamils cannot get justice in Sri Lanka, you cannot kick about Tamil citizen of a foreign country. There is rule of law in Singapore unlike the kangaroo courts of Sri Lanka. You are invoking the declaration of UN Human Rights Council. It is the same council that conducted an inquiry and found that there is a prima facie case of war crimes committed by Sri Lanka security forces on non combatant Tamils. Will you recommend that all these war criminals be handed to stand trial at the Hague. You cannot have double standards and if you are one advocating such, then any inquiry in which you are involved cannot be called fair. Know your limits, and Singapore government response will put you in your place.

            Are you against the idea of this writers request to Singapore PM on the grounds the RW appointed Former Governor alleged chargers should be treated differently to others because of his ethnicity he is Tamil and because of injustices done to other Tamils?

            What is sadly amusing is support and compassion demand of justice for alleged Pilferer of hard working tax payer’s money on the grounds of injustices for one section of the people and failings of successive government’s failure to uphold the law.

              There should be a state procedure of dealing with such requests regarding alleged crimes and there is no need for an individual to make a request to Prime Minister of another country. I am sure the state has issued an arrest warrant through interpol. Mr. Rusiri appears to work for a Team that provides information for a commission of inquiry. I don’t know what authority he has to write to Singapore PM. At least, in the case of Arjuna, his son and the company involved in the alleged scam are within the country and the money lost can be recovered but in other cases even those alleged regarding the corruptions and the tax payers money lost under previous regime are not pursued or not worried is a symptom of what?

I think there had been lot more BOND scam with the knowledge of this know-all SUSURI AND Wijewardhana occured during the high days of Mr Megalomaniac.               There is nothing wrong to write to anyone about any matter. Even if President of Sri Lanka writes, Singapore government will politely reply to him to follow the rule of law both nationally and internationally. In this case it is obvious that he is doing for his personal glory to portray himself as a champion of justice. When someone does things knowing well that it is not going to take him anywhere, it is not wrong to call him a fool. Where was he when Greek bond scam took place during the last regime. Is it because the culprit of that was a Sinhalese. Everyone who had committed crime must be punished. You cannot pick and choose to bring certain people to trial and covering up others. When it happens according to ethnic lines, it is an act of racial discrimination.

              To call Singapore a safe haven to get away when there is big trouble is not quite correct. All those who went for treatment genuinely or not went there with the permission of Sri Lanka government, and when treatment was finished they had to return back. Times have not changed in Singapore and present government is upholding the principles and practices engrained by its founding father. They will never hide anyone who is proven guilty, unlike Dubai. You are unaware that Singapore was a centre for arms trade for several years done by government enterprises, but they took precautions that it is not sold locally. Singapore functioned like a business organisation from the start ignoring human rights concerns, and this is the reason for their success.

              No one in their right mind opposes Citizen activism where the state fails to act in time and in good faith.
              However many oppose his hypocrisy.

The point is that just because someone has committed a crime, that does not mean that YOU should have to write letters each and every time. I was taking your side against the comment made by Mudson but you didn’t realise it.

        You should send a few Sri Lankan judges to observe the entire proceedings. You cannot trust the US judges.

Our honorable former defense secretary (USA citizen) is in this country who was involved in the MIG deal and it was our honorable former President who appointed him as a Srilankan envoy is in this country and he regularly meets Uthayanga in various countries is also in this country. Rusiri should tell us why there was no legal action against them. What is the point of writing to Singapore Prime Minister regarding Arjun when all these criminals are freely enjoy without fear.

    Dear Lankans, I find it hilarious to see hundreds of comments arguing who is more corrupted?? who looted the most, how many houses are owned by Rajapaksa family/GR so on and so forth.The common sense says for a small country like Lanka the depth and impact is irreversible.Instead of comparing who is corrupted and who is not, the debates are more of who is more corrupted than other. I hear soon there is going to be version of Guinness book which will help in settling the matter for our readers. Is it because the accused of that fraud is a Sinhalese and the accused of this fraud is a Tamil.     Now, Ranil is trying to blame tha tMCC is the one who instructed Arjun Mahendra to do it. but, he doe snot say that he, POLITICALLY EXPERIENCED PRIME MINISTER OF THE COUNtry, with the help of the finance minister did it. Ranil and Arjun Aloesisus were meeting frequently in othe rplaces and were discussing about their work. I heard FTA talks was mostly about Arjun Mahendran and Singapore Prime minister had said that Arjun Mahendran won’t be released because it is the prime ministyer who has to take the blame. Itlooks Arjun Mahendran has explained the story to Singapore PM. Mahinda Rajapakse is laughing it is my men who were watching it.

    How ridiculous is it to ask a person talking about a scam why he is not discussing about some other scam!?
    Why don’t you address the blame to yourself

    The cases against Udayanga and Wickramasuria must be followed by law enforcement agencies.This government was very slow to chase these two guys when the property racket in the USA and the MIG deal have been in the news for nearly 10 years now. Ranil looks at everything from his personal interest point.

    The involvement of PM Ranil in the Bond scam is another matter.

    Ranil and Mahendran are best of buddies for nearly 40 years. Ranil being an expert in almost everything should have assessed Mahendran and his son in law well.The entire UNP under Ranil have received cheques for millions from Aloysious and Mendis Special.

    Singapore should help poor Sri Lanka to get rid of the corrupt including the hypocrits and manipulators calling themselves good men and old boys.

    The Commission was a farce. They did not even summon PM Ranil to question him. Ranil came only voluntarily and was given easy questions by Attorney General who was appointed by Ranil !Two of the Judges were old Royalists ! So we are a banana republic. But Singapore can help us now.

        People of the Country ensured a change in 2015 of an oppressive regime under that curtailed the basic human freedom / rights for 10 years….freedom of speech & criticism is one aspect that was severely dealt with instilling fear psychosis if it involves the “Czars “of the regime..The new Govt freed the Country from all sources of oppression. But that does not mean the past heinous crimes crimes by using the Security forces maintained by the Country cannot be discussed…Sirasa TV was burnt down in 2008 stoned on several occasions then…But under the present restored freedom don’t Sirasa want Justice..? unless all the incidents are cooked and self inflicted by Sirasa…? are they so corrupted to not to talk about the past issues..?     All Non combatant Tamils were killed in the last battle was by LTTE as the Tamil civilians were crossing the terrorist lines to Sri Lankan Army areas after breaking the Human Shield by the Terrorist LTTE.

    The judiciary in Sri Lanka is corrupt to the core and lacks credibility. This is the same reason why Udayanga’s extradition is delayed. Singapore should not extradite Mahendran even if Interpol pin points his location. Mahendran is not a Sri Lankan citizen but a Singaporean and they have a duty to him and not go by an order of a Kangaroo court..

      It would have been reasonable to arrest, (keep them in custody, investigate, charge find guilty, …) ……………….. other criminals including war criminals, crooks, thieves who stole cash and gold from Vanni, received kickbacks from military supplies and civilian contracts, ………..who are not only currently living in this island but also putting forward plans to capture political power and make Sri Lanka into a Fascistic state of kleptocracy.

    A Big Thank You: Right action in this regard, coming even from the Devil himself, is welcome. I thank the author for this move and I will do anything within my power to support him. I am wealthy enough bear the individual divided cost of this scam. But I cannot keep idle when my gardener, who lost his customers and hence his income as a travelling fish vendor when 2 big supermarkets opened in our area and had to do odd jobs, has to pay some money to cover the losses of this massive robbery, every time he consumes even a ‘nikan they’ – a plain tea. He is already overburdened with so many indirect taxes necessitated due to robbery, corruption and simple ineptitude by the people he voted for and something has to be done – soon.

    This wonderful person who has to support a family of 4 bears up everything with equanimity and no complaints. He does not smile but nor does he frown. It is the ever suffering people like these who make up our society and are the real strength of its foundations. Every time a Minister buys a super luxury vehicle or a Mayor wants to sit on a marble commode and do the job, more is added to the burden of these people. If we do not control this kind of crimes and behavior, one day the columns supporting our society would collapse. And on that day everyone will have to pay for their crimes against society.

            Well, when you put it that way, it does not seem to be much. come to think of it. It is a drop in the ocean. Per head per annum it works out as Rs 16.

            So, I was wrong to assume that my gardener’s income would be affected by it. Surely, he can absorb Rs 16 X 4 = Rs 64 per annum. It is certainly not going to affect his economy.

            No wonder, my good old teacher failed me twice before allowing through in the 3rd and the last shy.

            I am now thinking of giving up this miserable job in Saudi and returning to Sri Lanka to rob banks- preferably Public Banks. Highly lucrative for the thief and hardly felt by the victims. The ideal crime.

In contrast, when Ranil tried to cover up the CB Bond scam, it was like a man trying to hide his shit and getting it in 7 places.
                And what about Sirisena? The other day he was talking about the heaviest floods that hit the country in years and he was saying that it was a good thing! Even if the Yahapalana Government doesn’t do anything the GDP will increase because of the floods. How would have the hundreds of thousands of flood-victims felt when they heard this? I wish that the floods will do one more thing for us – wash away the Parliament with all its inept politicians like him. I am sure that will make the GDP rise like a rocket.

What Prof. AKD explained in a previous article is true. The whole bond scam was planned and executed to pay back loans taken from certain parties, for funding the 2015 elections. But that does not let the ‘Shit On 7 Spots’ off the hook. The whole thing is serious crime and an Akusala Kamma. The whole sordid episode is well recorded and backed by solid evidence.
                    So we have Mahinda on one side with his alleged 4000 + billion heist with no credible proof that could stand in a court of law and ‘Shit On 7 Spots’ with a much smaller 11 billion but with solid evidence against him. The ‘Seven Spot Man’ has a ‘One Shot’ and a ‘Pus Shot’ on his side. But the support of Pus Shot cannot be guaranteed. He sometimes shoots at his enemies and sometimes at his friends. The day is not far when he shoots himself in the foot.

    Open letters are often written as a last resort. They are more for political purposes, though necessary at times, and tend to be more confrontational than persuasive.

    I have been a lawyer in New York and Toronto for 30 years but even a junior law student could see that Bond Commission was highly politicized when it refused to hear witnesses who could testify about the lower level information leakage from the SL Central Bank. When you add the shrillness from Sirisena and Killi’s Sirasa media, and the fact that the Bond Commission judges and Central Bank deputy governors were given favors like Japan delegation trips, tenure extensions and plum assignments to Govt departments, there is no credibility left for the SL attorney-general’s Office and Mr Sirisena. Sad.

      Open letters are for local consumption. The letter itself has no merit. This issue has gone on for years and after an inquiry for over an year still unable to bring charges as there is no SCAM that broke the law or at least on one is able to bring in charges.
      I agree there could have been a lot of unethical behavior but that in itself is not illegal.

      Now govt is on a fishing expedition while keeping two professionals behind bars without bail while the real fraudsters of the Mig deal and other major fraud are protected by a kangaroo court which will not allow the CID to do its job.
