Breaking News Example Of Yahapālanaya In Australia: Cardinal George Pell Found Guilty & Set To Go To Jail

Could this ever happen in Sri Lanka?

Could this ever happen in Sri Lanka if a Mahanayake of any of the nikayas was found guilty of criminal conduct like sexual abuse and rape of kids under their care? Or a Muslim Mullah? Or even our own cardinal Revd Malcolm Ranjith? However serious the case may be, it would never have reached court in the first place. Furthermore, if it was a high politico, the complainant would have been sent missing under Gota’s kind of ‘disciplining.’ That has become the Sri Lankan way.

Cardinal Pell’s Case

The case in Australia is about a most sensational court verdict handed down to one of the Catholic Church’s highest ever dignitaries. The Cardinal was found guilty by a Melbourne County Court of sexually abusing two choirboys in St Patrick’s Cathedral in East Melbourne. This incident had been 22 years ago. However, the issue was raised a few years ago and authorities had to act on the complaint as the law requires.The verdict was given as on December 11th last year but Australian media has been barred from reporting the verdict until now, due to a court-imposed suppression order. The details were out today (26/2/19).

As stated by The Age Newspaper columnist Tony Wright, “[the verdict] will rattle confidence in the structures of the Catholic Church, all the way to the inner sanctums of the Vatican City, as no sex abuse scandal has done before.”Adds Wright: “Here is a Prince of the Church, handpicked in 2003 by a Pope himself, John Paul II, as a cardinal; a prelate, set above others, entitled to be called His Eminence.” Cardinal Pell was one of those 113 privileged Cardinals who sat in conclave at the Vatican to appoint the new Pope Francis. Every reason for special hush hush and protection in a Sri Lankan context.

Law above Persons

On the other hand the scenario is vastly different here in Australia. No person, however eminent and powerful can escape the law. The Australian law stands above everyone. This also means the judiciary, which is at the pinnacle of legal system, is held sacrosanct and is never interfered with. This is the essential core idea of our own Revd Sobitha’s yahapalanaya mission. The United Front government campaign in 2015 was for replacing the lawless and arbitrary regime of the Rajapaksas with a system where the law is above all. Maitripala Sirisena was made common candidate while Ranil Wickremesinghe, head of the largest single party in Sri Lanka, voluntarily sacrificed the opportunity he himself had.

19th Amendment

There are many critics of Ranil Wickremesinghe and the United Front government  but what cannot be denied is that this government managed to bring in the 19th Amendment and this bit of law had provisions embedded to keep the law above all. Unfortunately, the new law could not do away with the absurd immunity allowed for the Executive President. Maybe because that provision needed a referendum. The rest was fine. President’s direct ability to pick members of the judiciary was taken away as the the Constitutional Council was entrusted with the task of picking form among the nominees given by the President. I think even that amount of leavage should not have been left for the President. The structure of the Constitutional Court  reflected an adequate amount of political representation but its independence had been made secure. 

And see the results today: Judges and judgments are free from the President’s and Prime Minister’s interference. No Chief Justice had  been obligated to give the verdict required by any political power.

The power of the yahapalanaya concept was more than amply demonstrated when our judges saved our democracy both from a crazy President who joined  the Opposition forces led by Mahinda Rajapakse in the shameless and frightening October 26th coup that went on for 52 days stalling the operation of governance in the country and holding our people to ransom.

No Remorse

That both Sirisena and Mahinda do not feel remorseful for what they did is clear because these two blokes are now on a campaign to attack the Constitutional Council- the creator of the independent judiciary. Sirisena is madly upset because, occupying as he does the mindset of the incumbent of the President’s  office prior to the 19th Amendment, he thinks he is the big boss who can appoint judges without restriction. Knowing the man only too well and being too close to the coup episode, it is easy to imagine what kinds of judges Sirisena would pick. Their attacks on the Constitutional Council and on our judges  is totally without logic, reason and evidence. It is an expression of mere frustration-aggression.

Can these two leaders be educated about the beauty of the Australian example as manifested in Cardinal Pell’s conviction? This is a subject that our print and electronic media should take up in seriousness for the sake of raising the consciousness of our people to the vital need for a strong and independent justice system that catches all without reservation.

Clergy Issues in Sri Lanka

With regard to clergy issues, the Sri Lankan culture is also to be blamed. Buddhists give uncritical respect for anyone who dons the robe.This inspite of Buddha’s own advice to be wary of monks  who misbehave. Technically, even if a Buddhist sees a robe hanging on the washing line they should, under this social logic, run and worship the piece of fabric. Mercifully, we don’t witness such enslavement!

Our political and other leaders are seen on a daily basis  pandering to the Sanga sans reservation. 

Ravi Karunanayake

The other day, I observed two shocking incidents in this regard. One is when  Minister Ravi Karunanayake and some Opposition MPs visited the jailbird  raucous monk Galagoda Atte Gnanasara in prison. This monk  has  a terribly bad reputation. However, Ravi Karunanayke is reported to have advised the monk to come out of jail and restore the purity of Buddhism!! It is unlikely Ravi was giving expression to some intelligent sarcasm. Sarcasm, if it was, would have been in bad taste and politician’s don’t do that sort of thing. I think Ravi Karunanayake is a disgrace.

Gotabaya and Bro with Revd Pitiduwe Samantha Bhadra

The other episode was about prospective candidate Gotabaya and his former powerful brother Mahinda paying a visit to Pitiduwe Samantha Bhadra on the latter’s birthday. This monk is a sort different from GA Gnanasara. However, he falsely claims he has reached the ‘rahath state,’ and so he has managed to get thousands of gullible pilgrims visiting him on a daily basis with gifts (pirikara). He gets his followers to arrange lavish displays on every birthday. This practice is incongruent with the doctrine of selflessness (empty self or sunya) in Buddhism. Yet, for the miserably credulous this wouldn’t matter. My point is why did these two politicos go there? Obviously to boost their vote-base among Sinhala Buddhists. In the process of this selfish thrust they only help to cement the false social consciousness around Samantha Bhadra. Our leaders should never set examples like this.

To add to the campaigning politicos, did I not spot Dhammika Perera-Sri Lanka’s richest man- pouring over luxury gifts got down from France? I am hoping that was an optical illusion. It is reported that this ‘Rahath monk,’ was made richer by over 20 million gifts on his birthday!

Instead of uplifting the social consciousness of our people towards modernity, these leaders are working towards a regression of our society.

        Now that you have talked about this guy I’ve never heard of …………… what are my chances of becoming a monk like Pitiduwe Samantha Bhadra ……….. living the high life and at the same time getting the devout Buddhist JD/Jimsofty ( and perhaps Native Vedda; that’ll be the day :)) ) to fall down at my feet?

        Looks like a great career-move ………. can’t ask for more!

Azad Sally did not even face the Camara. I wonder what they were told. PENTHOUSE RAVI my be saying, IF I become the PM, I would keep him a few more years. I am wondering the Bhikku was not there and he was in Singapore, but Penthouse Ravi’s Friendly Drug Barons may have told certain things to him. Talk about the parliament and say which kind of Criminals or Fraudster that are not found in Welikada, or Anguna Kolapelessa are found in diyawanna Oya. Listen to what they talk. I wonder whether that place had done any work during their entire 71 years. It is all lieing and accusing each other for wrongs one another did. Thye the electricity bill alons is Rs 50 million a month and there 1000 employees to serve 225 criminals, money launders and drug pushers. Ranjan Ramanayake says there are even drug addicted ministers. Kiriella say he surantees that there are no Drug pushers. How about Tourism minister John amaratunga was going to buy a Rs 1500 million worth house in colombo Seven. I know he wanted to give a tourism contract to CNN. They pay hefty commis money.

    Sinhal buddhist everybody knows that there are corrupt bhikkus in Srilanka but they also know people drive far in order to give Dane to SILWATH bhikkus while DUSIL bhikkus have to depend on their pockets. during Buddha’s time Devadattha was one such dusil one who used his oratorship to win even a king. I think Galaboda Aththe Ghanasara bhikku is paying some his past life Karma. Another thing is check the MAgistrate who sent him to jail. He may be the one who saved several U”NP ministers. YEsterday, one UNP minister showed how educated he is in Sinhala, buddhist literature and arithmetic. HE said that 42 UNPs MPS amounts to 1/3rd of the parliament. Probably he meant that most MPs are not coming to the parliament as their salaries go directly to the account. Maithripala sirisena said That the 19th amendment is a SUJATHA DARUWA. That MP, Ajith Mannaperuma said SUJATHA under the bo tree. Anyway, Ranil does not have anything to talk except the bond scam and his MCC written 2020-2025 Economic program. So, he is talking about Maithripala Sirisena’s program.
    The good thing is NOT SO EXECUTIVE PRESIDENT IS REPORTING TO THE PM RANIL AS WELL AS TO THE CONSTITUTION COUNCIL OF WHICH SOME OF THE NGOs IN THAT REPORT TO THE INTERNATIONAL COMMUNITY.     It is time for Catholic Church to let priests and nuns to get married. If not, it will forever shrouded in sex scandal. Keeping away from sex is an unnatural act.

We can lessen the impact of child abuse in the Catholic Church by letting priests and nuns get married. One swallow does not make a summer, and one murder does not make all Christians murderers.     What would be surprising in Australia is that the matter involving Cardinal George Pell was swept under the carpet. Many years ago, I believe in the 1960’s or 1970’s, where electronics goods were a fancy, a cabinet minister brought in a tape recorder into the country without paying the customs duties. Both the Ministers, the one who brought in and as well as the line minister in charge of customs had to resign. That is general norm of Shyamon’s adopted land. Unfortunately whatever the pious intentions of the late Ven. Maduluwawe Sobhitha, the word “Yahapalanaya”, a noble concept, was reduced to a brand name, thus signifying “some are more equal than others”. The way it is reported here is such that anybody who does not know much about Australia is likely to get the impression that the judge who heard George Pell’s case performed an exceptional task, acting without fear or favor amidst possible odds. I am under the impression that the norm of Australia is not to act without fear or favor. In my mind mixing up this term “Yahapalanaya” with the system that prevails in Australia is an insult to Australia. What happens in Sri Lanka, we all Sri Lankans know. What people like Shyamon can educate us is what makes Australia sustain a system of good values as opposed to this country which we in this country cherished years back and got reduced to nothing.

    Shame-On jayasinghe – The Vatican and the Catholic Church could not hide behind the smoke screens anymore.
    If anything to go by not only this is just one off incident that the Church could not sweep under the Carpet.
    In actual sense, if anything to go by, 2/3rd of Church Clergy from the Americas to the Australasia should be behind bars for similar offences which the church had tried hard to sweep under the carpet or some Victim’s silence have been bought over just like our MPs in the Sri Lanka Parliament to crossover.
    Latest is the list of Paedeopile Clergy list has gone missing fron the Vatican..

    Did Pent House Ravi go in to see Gnanasara or at his expense his buddies in there?????

    What has the Cardinal got to do with Srilankan Politikkas and the Mahanayakas….

    The focus should have been on the Yahapalana aspect of the Australian Political and Legal System instead of trying to score cheap political points..

    What is the big deal about this incident, when the whole world has been hearing these issues of the Catholic Church for along time.
    And a few high profile Priests already are serving Jail terms even in the US.
    And the Vatican just concluded a highest level conference on how to prevent these issues going forward..the issue

    Wish these Die Hard barrackers of Dr Ranil write how 293 Kilos of Heroin lands in Kollupitiya while Madush is resting in Dubai Police Station.

    Specially when these dudes have been swearing all along how good the UNP Yahapalanay has been to our inhabitants..

    The author tries to connect this conviction to our country to show that our society will never punish high ranking wrong doers. That is a valid point. But he missed another valid point. Religeous leaders of any religion claim to be holy and to have a special relations ship with their respective god or gods. But somehow their gods do not punish these offenders. Even the governments look the other way while the victims have to deal with the abuse on their own. In the case of this cardinal one of his victims became a drug addict and then died of a heroin overdose. Where was god for the victims? This case is one among thousands all over the world. It is an epidemic that was covered up on purpose by the highest ranking religeous leaders who went on to be declared saints. It shows that the whole edifice of religous institutions and their claim to authority is bogus. The bottom line that I take away from this case is that either there is no god or god does not give damn for human beings no matter how much obeisance with pay to him.

    Errant priests who abuse our trust and our vulnerable children are the curse of our generation – whether they be Catholic, Muslim, Buddhist, Hindu…whoever.

    This is a good time to remember that in another country where no one is above the law, a Buddhist priest was found guilty because the victim was brave enough to speak up. I am referring to Pahalagama Somaratana, 65, of Dulverton Road, Croydon, was also put on the sex offenders register for life. He was also ordered at Isleworth Crown Court to never work with children. Somaratana was the chief incumbent of Thames Buddhist Vihara. Police said the assaults had taken place in Chiswick, west London, in the 1970s.

    We must educate our children NOT to put up with abuse of any sort.
    NO priest, NO teacher, NO coach………NOBODY should be allowed to get away with abuse.

    SJ’s point about complaints against politicians and senior clerics in SL not even coming to court is valid but his article gives a very incomplete picture regarding the conviction of Cardinal Pell. Strangely, in the case of Cardinal Pell, it seems his case was pursued in the way it was, precisely BECAUSE of his position. He is the most prominent Catholic clergyman in Australia, the ‘public face’ as it were of the local Catholic Church which has been identified with many cases of clerical sexual abuse. Pell has been a strong and uncompromising defender of his faith. He was a man they loved to hate, and they were out to get him.The Victoria Police went to extraordinary lengths to pursue Cardinal Pell and the media carried out an intense campaign to blacken his name even before the case came to court. The verdict itself is difficult to understand seeing it was ultimately the word of the complainant – NOT supported by any witness- against that of Cardinal Pell, alleging offences which could not conceivably have occurred where they were alleged to have. Unfairly hounding a man and getting a skewed judgement against him is no less reprehensible as shielding an offender.

    This article has got the wrong end of the stick. Cardinal Pell’s case should not be taken as an example of a bad man being caught by the law, and compared that as the best application of law without fear or favour. This case is in fact a disgraceful perversion of justice.

    He went to trial on allegations that he assaulted two boys in St Patrick’s Cathedral in 1996. He denied the allegations, One of the alleged victims had later denied ever being molested, did not make a complaint and was not interviewed by police or examined in court (he died in 2014 in a car ‘accident’). .The jury believed the testimony of one of the boys that he was molested in the crowded church.Pell was found guilty on the uncorroborated evidence of one witness, without forensic evidence, a pattern of behaviour or a confession.

    Pell’s conviction is result of a long grudge the schemy Jews of Melbourne had against him since he made a remark about Jews being intellectually lesser than the Egyptians on TV, during an appearance on ABC TV’s Q&A program in April 2012. They hounded him since then

    This case was run on the word of one witness, let alone gain a conviction. Pell was found guilty on the uncorroborated evidence of one witness, without forensic evidence, a pattern of behaviour or a confession.No one has alleged Pell had a history of this type of crime.

    Despite the fact that Pell had answered all questions and didn’t choose to invoke his right to silence when he was interviewed by police, his lawyer, Robert Richter, QC advised him not to take the box. It is a suspect, bad advice on the part of the QC – and who wants enemies with friends like that?

    Mr Jayasinghe’s attempt to exploit this case for political advantage in Sri Lanka should be condemned as dishonest as well as stupid.

    This man was convicted of crimes committed in 1996. Cover-ups were systemic in Australia and Ireland. These are acts of gay Phedophilia.

    You realize there’s been a,global systemic COVER UP in the Cathlic church that has gone on for decades ACROSS THE WORLD? Ireland, police were involved in cover ups.

    In Boston, US$ 3Billion was spent to silence victims by the Church. They kept moving the pedophile priests from one parish to another through out the entire US mate.

You must have been asleep when others raised these issues. This isn’t new. Ireland apologized for the government cover ups. Same happened in Australia. Time to start a conversation about all religions in Sri Lanka and India etc., start with rape of nuns and pedophiles. Remember that poor people willingly let their young boys become prey to foreign pedophiles in costal areas because these old pedophiles spend for the families to buy rights to rape. But parents arw,complicit because they know boys can’t get pregnant. Where the duck have you been? Enough studies exist on this shit in Sri Lanka. You act like some purveyor of recent truths. Read about the cover ups that have gone on, and still going on in the US catholic church.

    The former Cardinal was able to keep the accusations at bay and probably carried in his mind a sense of impunity.

    The stories spill out in the sitting rooms of Catholic convents, where portraits of Jesus keep watch and fans spin quietly overhead.

    They spill out in church meeting halls bathed in fluorescent lights, and over cups of cheap instant coffee in convent kitchens. Always, the stories come haltingly, quietly. Sometimes, the nuns speak at little more than a whisper.

    Across India, the nuns talk of priests who pushed into their bedrooms and of priests who pressured them to turn close friendships into sex. They talk about being groped and kissed, of hands pressed against them by men they were raised to believe were representatives of Jesus Christ.

    “He was drunk,” said one nun, beginning her story. “You don’t know how to say no,” said another.

    At its most grim, the nuns speak of repeated rapes, and of a Catholic hierarchy that did little to protect them.

    Galvanized by the #MeToo movement and the sex abuse crisis commanding the attention of the Vatican, women religious are now openly discussing a subject that was once taboo – sexual harassment, abuse and rape of sisters by clergy – in congregational motherhouses and national conference offices.
    Slowly, an era is ending in which Catholic women religious were silent victims of sexual abuse by priests and bishops. Consider these developments in the past year:
    In Chile, the Vatican is investigating a congregation’s complaints of sexual abuse by priests and mistreatment by superiors.
    In India, Bishop Franco Mulakkal of Jalandhar has been arrested on charges of raping a former superior of a congregation – multiple times. He is the first bishop in India to be arrested for sexual abuse of a nun. He has denied the charges. More than 80 sisters were among 167 signers of a letter in July asking that he be relieved of his pastoral duties. Five sisters of the congregation and other supporters engaged in a highly unusual public demonstration supporting the former superior and protesting initial inaction by church and state authorities.
    Statements encouraging sisters to report abuse and religious women to believe and support victims were issued by the International Union of Superiors General, the largest worldwide representation of Catholic women religious leadership; and by the Leadership Conference of Women Religious in the U.S.
    The Associated Press published a story in July about sex abuse of sisters, drawing upon an article by the National Catholic Reporter in 2001. In January, AP published a separate story focusing on India. Other media reports have surfaced about abuse in Myanmar.
    In more than a dozen interviews for this Global Sisters Report article, some patterns across countries and continents emerged on how to help prevent abuse and support victims if it does occur.

    NO ONE should be protected by the police or goverment. That particular priest you mention should be tried in courts. But will victims even see themselves as victims in most cases in Sri Lanka or India or think it is the way of life to be subservient. If not perhaps public humiliation and stoning or lashes if no one is willing to give evidence? Imagine the problems in sexually repressed nations when in US too these have been decades and decades of cover-ups mate. Come on man. Buddhist Monk, Poosari, Paadiliya, Imam all must be tried in courts if people are willing to come forward. How about all the sadists and hidden gays? This is not just about gays because it is about phedophiles and not happy consenting adult homosexuals and lesbians who are free and should be free to love whoever they like and have sex with CONSENTING partners, not engage in rape like a Monk or a Priest.

    Are you aware of the roaring gay and heterosexual pedophile sex tourism in Sri Lanka and Philippines but in Sri Lanka it is mostly gay beach boys. Their parents get a sugar daddy: an old white guy from Germany or US and then they rape the boys or keep them as lovers. Everyone is happy because of the sugar daddy giving money and presents. So this is the other ugly social side of tourism and poverty.
