Open Letter To HNB: Infringement Of Fundamental Rights Of Tamils & Insulting Tamil Culture

By Murali Vallipuranathan

Dr. Murali Vallipuranathan

Mr. Jonathan Alles

Chief Executive Officer

Hatton National Bank PLC

479, TB Jaya Mawatha, Colombo-10

Infringement of Fundamental Rights of Tamils and Insulting Tamil Culture

We are dismayed to learn that your bank had punished two employees of Kilinochchi Branch for commemorating the deaths of their relatives and beloved ones. Anniversary commemoration of the dead has been an important part of the culture of the Tamils and Sinhalese for several centuries. In fact one of the oldest Tamil moral text Thirukural dated 3000 years back in stanzas 42 and 43 stated the importance of humans to perform their duty towards manes. In this context we see your ill-conceived action against your employees who were involved in commemoration of their dead relatives as not only a grave insult to the Tamil culture but also a serious infringement of their fundamental rights.

Article 14 (1) (f) of the Constitution of Sri Lanka stated “Every citizen is entitled to the freedom by himself or in association with others to enjoy and promote his own culture”. Notably no restrictions are placed in this freedom by any other articles of the Constitution under any circumstances. From the medical point of view commemorating the dead is very important for a grieving person to recover and promote his mental health. In the Sri Lankan context this has become more important especially because neither compensation was given to most of the affected persons nor perpetrators responsible for the holocaust were brought to justice.

Kilinochchi is a place where very large number of residents belonging to this region suffered heavy causalities in 2009. Therefore your bank which intend to promote business relationships with Tamils in this area should have tried to understand the feelings of the people in the area and itself organized the cultural event of commemorating the dead anniversary on 18thMay. Instead of this goodwill action your bank along with irresponsible southern racist media had gone to the level of portraying the peaceful commemorative event as an event sympathizing with the LTTE. We strongly condemn this oppressive action by your bank. I am sure that you are fully aware for several decades Tamils had preferred Hatton National Bank to other state banks for obvious reasons. Now since your action against the Kilinochchi staff is published in the media several Tamils have started closing their accounts and your bank is rapidly losing popularity among Tamils.

Therefore if you wish to continue your business successfully with Tamils in future I suggest the following:

  1. Reinstate the interdicted officers without delay and pay compensation for the mental suffering and humiliation they have faced by the interdiction.
  2. Withdraw the statements in Facebook and other media portraying the commemorative event as an event threatening peace and harmony in the country.
  3. Open apology to all Tamils for your action which had insulted all the Tamils and assurance that your institution will not obstruct participation of your employees in the death anniversary commemoration of Tamil civilians in the years to come in.

If you agree with my suggestions please respond within 2 weeks so that I can publish your response in media and will try my best to minimize the damage to the bank. But if you fail to respond I am afraid that this issue will get escalated by spreading to all the branches in the North and East, local and international human rights organizations, media and become a strong campaign to defend the fundamental rights and the dignity of Tamils.

Anticipating your early response.

Thank you

Yours sincerely

    Useful:
    Definition of Genocide
    Article II
In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
    a. Killing members of the group;
    b. Causing serious bodily or mental harm to members of the group;
    c. Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
    d. Imposing measures intended to prevent births within the group; (e) Forcibly transferring children of the group to another group.
    Elements of the crime
The Genocide Convention establishes in Article I that the crime of genocide may take place in the context of an armed conflict, international or non-international, but also in the context of a peaceful situation. The latter is less common but still possible. The same article establishes the obligation of the contracting parties to prevent and to punish the crime of genocide.
The popular understanding of what constitutes genocide tends to be broader than the content of the norm under international law. Article II of the Genocide Convention contains a narrow definition of the crime of genocide, which includes two main elements:
    1. A mental element: the “intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such”; and
    2. A physical element, which includes the following five acts, enumerated exhaustively:
o Killing members of the group
o Causing serious bodily or mental harm to members of the group
o Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part
o Imposing measures intended to prevent births within the group
o Forcibly transferring children of the group to another group

        Burt

“Should Latha or the Sri Lankan educational system be blamed?”

The rot actually started with the Public Racist Aryan Anagarika Homeless Dharmapala or bit earlier.

Now more and more Liberal Sinhalese are leaving the island. Surprisingly once they are out of the island most of them identify themselves with Sinhala/Buddhist noisy fascist minority. Most of them talk about Sinhala/Buddhist cause. When asked to explain they couldn’t say more than a few lines of the well sold usual text of Sri Lanka a small country being threatened by neighbours, INGOs, Tamil Diaspora, 80 million Tamils, ………….. “we shall fight on the seas and oceans, we shall fight with ….Kaduwa made in vane (steel), Maha- Dunna the long bow, …………… ..
The need to preserve the heritage and Sinhala/Buddhist culture …………… if necessary they would not mind bringing back the war criminals, hora’s back to power, …………

I do not understand why they are turning into “max morons” of this Sinhala/Buddhist fascist world.

If you raise the question of war crimes being committed in this island from 1971 on wards they dodge the question.

I am not sure whether to blame education or their paranoia, especially wen they are lost in western countries.

The level of comments to this article by a few Buddhist Sinhalese Fundamentalists questions the level of civilization achieved by the educational system in a Buddhist country. It is sad that the son of a well civilized journalist (Dayan Jeyatiaka) behave like a third degree creature promoting the hate and violence in order to bring back the murderous regime into power. Dayan is not bothered about the damage caused by those comments to the Buddhism and Buddhist Civilization because he was a Christian.

Ajith: what ever education they got, Sinhala peolle never blew up in order to kill people in bus stands, they never shot at devotees in buddhsit temples and mosques. they never were killers and now establish democracy fronts to start the LTTE again.

        J,
You may have lost memories. Who will forget about dragging children, mothers and elderly from into middle of street and burn them in daylight street by street? Have you heard about Navali church bombing or Kumuthini boat massacring or drilling of eyes of a prisioner?

Sinhalese never killed? What about 1956,1958,1971,1977,1981,1983 .Not only you killed the Hindus,Christians but their gods too were pulled out from the temples and churches and destroyed. Fortunately Muslims do not have statues hence their gods escaped but the god’s abode -the mosques were destroyed.During the 1983 riots one man was seen running with a Hindu Statue in hand. When he was confronted by a police he is supposed to have said ‘ I saved God and God saved me’ and continued to run faster…….. Whether both of them reached their respective destinations? -God only Knows.(GOK)

Ajit, May I disagree and take offence to your last sentence ( He was a Christian) It defeats everything else you said above it. People (Tamils and Sinhalese) including clergy ( Priests, Monks and Iyars) do horrible things in the name of religion. This should not translate to a blanket statement that a particular religion is bad. If one looks deeply into Buddhism, Hinduism and Christianity one will conclude that the fundamental teachings of these religions is to love one another and not to harm others. Therefore, one must respect all religions. I am a Tamil and a Catholic I follow one religion and culture and respect all religions and cultures.

I still do not understand how the human-woman who mated and copulated with a lion had ended up in one piece, alive and gave birth to Sinhala ethnicity.
The reason that I am struggling to grapple with is that when a lion copulates with lioness, at height of intense intimacy and orgasm, the lion attempts at mauling the lioness’s neck and shoulders with canines, incisors, and strong and stiffened claws of its paws. It is the natural reaction of lion at height of intimacy and orgasm. Yet, the female lions comes out of it alive and in one shape because of the ‘wild’ neck and shoulders it develops during its formation stage.
The lion does also stiffen the paws and claws-in in the shoulder blade area of lioness at the height of intimacy and orgasm. Yet, by the natural fitness of shoulder blade the lioness develops ( at springing on to the buffaloes or larger other animals than itselfby aiming its front legs) during its formation stage and also by stiffening the shoulders the lioness comes out of copulation in one piece.
The same is true for all big cats, even domesticated cats.
As it was a lion with whom the woman who had given birth to Sinhala etnicity had intercourse with, the copulation must have been conducted in missionary or the normal cat’s copulation position, which is doggy position in vulgar parlance.
If the intercourse had taken place in missionary position, the lion would have mauled, chewed her entire head and torn off both breasts, the rib cage and would have devoured the innards (liver, lungs, heart etc) at the height of intimacy and orgasm. On the other hand, if the copulation was in doggy position, the lion would have mauled, chewed her entire neck and torn apart both shoulders of the woman and would have devoured the innards (liver, lungs, heart etc).

The Sinhalese have had enough of these humbugs.

It seems that most people who have commented negatively are the so called elites who in my opinion are very narrow minded and probably have a very low IQ and absolutely no class. For them Tamils are Tigers, Jaffna Tamils are Tigers, Expat Tamils are Tigers, All Tamils who died in the war are Tigers,Tamils who oppose any wrong-doing are Tigers. This is similar to the incidents in the UK during the 70’s where the racist whites called every colored person a Paki. But we educated and broad minded Tamils know the difference between races and religions. We believe in one Sri Lanka. We believe in respecting religions and cultures. We know how to debate a point without attacking a race, religion or a culture. We know how to agree to disagree without insulting. We know that many civilians died on May 18th. We know that HNB bank observes religious festivals and other events. We know that the government owns some percentage of HNB. However, they say there is no point in trying to convince a man who belives that a dog has only three legs. With that I rest my case.

    • 5
      6

Well stated Marie. You deserve applause for that. It is wrong to label all Tamils as Tigers. Some of the most decent people so know are Tamils and they won’t have a bar of what the Eelamists are doing. In fact I have said before that zColombo Tamils are almost to a man different from those up North who probably have no association with the people of the South. The word hospitality is not known to theJaffna people noted for their parsimony. Much of it due to their selfish, isolated life styles. To get to the HNB incidentit is clear that what happened there was to commemorate Prabakaran, not some relative of a pen pusher in the Bank.Even if it was a relative how dare does one go to one’s work place and hold ceremonies there without permission.? That is a ridiculous proposition that you seem to support and therein surfaces the hidden communalist agenda even among well meaning Tamils. Need I say more.yes it is difficult to convince someone that there are dogs with only three legs.

“how dare does one go to one’s work place and hold ceremonies there without permission.?”

i have to agree with percy here though it pains me to do so.A basic respect must be given to the business that has given you a job.It functions as a business not a social charity or something. If you don’t value your job then let someone else who is dying to have one get it.There are so many highly qualified youths in the north without jobs,

      • 0
        0

Percy, When one categorizes a criminal act of an individual as a character of that race it is education and broad mindedness at the highest level. Sarcasm aside. Example of Colombo hospitality in its the best form was on July 23, 1983 the day when innocent Tamils were butchered. I definitely concur with you that Jaffna people do notknow or practice the type of Southern Hospitality that you are in favor of. But the truth is many military personnel in the North and a majority of Sinhalese in the South are kind to fellow human beings especially the Tamils and follow a different type of hospitality namely the Jafnna Hospitality. at its highest form.

People have expressed their frustration about what’s happening in the country. Some people can’t stand the truth. The majority race is succumbing to a minority race very badly. It has come to situation where the minority things they are Gods. Somebody like Mrs Udubeddewa (and also Ms Mange) had the guts to say this and I take my hat off to them especially the older lady.

Murali is claiming that remembering the dead is a ‘fundamental right’.
Some commenters here suggest that only a certain ethnic group have this right!

Osam Bin Laden was a hero for the follwers of Time Machine then now ISIS is a champion.
Tamils should close their accounts at HNB all over the country let the bank do business with Podi Menike and Punchi Banda.
Overseas Tamils make sure not to deal with banks there who have HNB as representative in SL.

    Dear Murali,

We are appreciating your open letter. After the end of the war, when the Sri Lankan people joined altogether in a massive project of building a Cancer Unit at Tellipalai and at the ceremonial handing over of the foundation stone at the Thuraiappah Stadium, after receiving it, I said as ” This project has been accomplished with the involvement of all citizens of different ethnic and religious community after end the war and hence the New Tellipalai Cancer Unit can be called as a Monument of Peace”

It is worth mentioning that the HNB too helped a lot to this successful project. Mr.Rajendra Thiagarajah who won many Bankers Leadership award and Mr.D.Soosaipillai who is in the Board of Directors of HNB as both being Tamils should come forward in resolving this issue soon.

I believe that “The Real and Lasting Victories are those of Peace and not of War” Even the Government should arrange prayers for all who died in this war rather than commemorating as a War Victory, as this war was within the country what ever said and done.

If we all the Citizens of Sri Lanka realize this, we all can march forward with our abundant natural resources and high literacy of our people. We can even go ahead of Singapore !

Percy, Before we get into a difference in opinion about the Tamils and their mentality let’s just look at the religions. Christianity, Buddhism and Hinduism. All these religions teach just one thing under different umbrellas. Love thy neighbor as thy self and do not harm others physically or verbally. Hence the Christians, Buddhists, Hindus and the associated clergy Priests, Monks and Iyars who practice hatred and racism as Sinhalese or Tamils
are people who are not true to their faith. So in the same token the people on this forum who speak with extreme views really do not represent the views of the majority of the SriLankans who are respectful to others. With due respect lets agree to disagree and leave it at that.

Percy, All offices in Sri Lanka both government and private celebrate festive days, birthdays and other memorable days. So that is a mute point. Before we get into a difference in opinion about the Tamils and their mentality let’s just look at the religions.
Based on your opinions one would conclude July 23, 1983, the day that many innocent Tamils were butchered, would be your hospitality/ celebration day. With due respect lets agree to disagree and leave it at that.

There was news piece yesterday. It is really not to worth to mention it after all these comments. There are many family splits and suicides by these banks microloans. It has become a social sickness of the war deprived Tamil who watch it on TVs and go, see and experience the Colombo life. Then they go for modern amenities with these daytime robbers, Banks forced micro loans. There many decent family real cultural housewives are turned into the keeps of these banker’s and collectors and made prostitutes. Recently (as i know of last week alone) there are three major Tamil articles about the cruelties of these micro loans. None of the TNA parliamentarians, for my knowledge, so far have taken this to parliament yet.

Let me tell the news appeared yesterday:
A guy borrowed loan to buy a motorbike. Three months overdue. Bank sent bouncers to repossess the motorbike. They saw only the wife at the house. They used ugly filthy languages to threaten her. These bouncers are Old Paramilitary and Army supported goon. She complained to police. Now the police station and the Bouncers are threatening unless the complaint is withdrawn the family will be wiped out.

This Sinhala Army controlled banking practice cannot be allowed to continue in war torn area. These Sinhala Banks has to be wipe out and North East has to have foreign Banks.

      Bineka Venurapolonnowita,
If you can read Tamil, please read yesterday’s Tamil news. If you cannot read Tamil, please ask a person who can read and then check it out of what I said above is not in the news. In USA between 2008 & 2009 basically every home other home owner failed to make payment to mortgages. To get out of their legal responsibility of owning a house and going for prison for failing to pay real estate tax, owners were selling their houses for $1. Read my lib “$1” a house in USA. Banks lost and went bankrupt. But they could not treat the borrowers the way Sinhala banks doing to Tamil Widows. The government came to power that time felt they were its citizens and put forward programs to resolve it all. Now, for more than 10 years, the USA’s matured economy is keep showing growth. Three years ago in Lankawe, they brought a Tamil, under a one year contract, to quickly turn around the collapsing CB by the previous government’s looting. Those new politicians robbed the CB further and they chased out the Tamil, so their games will remain hidden. But the Colombo Media is talking (not doing anything about it) only about one Tamils who robbed the Central Bank as per his masters’ direction and shared the money as per the beneficiary list given to him. Lankawe is listed as the number in the world in murder concentration, as per IGP. None of those murder cases are coming to courts or in the Colombo Sinhala Media.

No I am not going to read Tamil news. Why should I?

You want all state banks to be removed from North. How dare are you? North is traditional Sinhala homeland. We are going to live there soon in droves as we have no land to live in the south.

Be sensitive to Sinhalese sentiments please.

“North is traditional Sinhala homeland. We are going to live there soon in droves as we have no land to live in the south.”

When and how did North even South became Sinhala homeland.
If you do not have land in the South stop blaming the Muslims and stop procreating, and pack your bags and go back to your ancestral homeland in South India. When you go take your Muslim and Tamil brethren with you. Tamil Nadu has plenty of land to accommodate their descendants of Kallathonies from Sri Lanka.

It appears my assumption is correct i.e. many of your misunderstanding are because you are too innocent to figure out the maneuvering of the government placed paid commentators in CT.
You appears to be not knowing that CT’s removal procedure is not one single line of ” if somebody writing racial matters it will be removed ” .
Beyond those rules, if you are not new, you know they dislike links. I knowingly took the risk and added links because I didn’t want to sound to you that I was just storytelling but there was no real news, behind my talks (in other words no Tamil women are affected by micro loans). In fact that was the feeling you were showing earlier. Your case, you are reading in English and you are coming to know at least what some of the Tamils are feeling. 95% of the Sinhalese may know what is going in a Hindi Movie, but nothing about North or East. Reginald Corey is holding North under Rapist Army Jackboot. Northern people asked to remove him. This time he was placed to Kandy. He complained to Ayatollahs, probably because the fall of forceful plugging out of Widows. They called Colombo and reinstated him back to North. He went there happily 2nd time. Then he said “I am happily back here, when I was posted here fist, my wife refused come with me fearing of North. Now it is ok for her too”. This is the knowledge about the North of the Northern Governors. But strong head Reginald doesn’t give damn to confess it, but like to control North under Rapist army Jack boot.

I cannot bring back what CT removed because it is going to removed it again.
The link I gave you had pictures of women devastated by micro loan pluggings, with their sober faces, taking their complaint to CB- Kilinochchi division.
