A Woman Lawyer Exposes Some Disgusting Abuses Of Sri Lankan Justice System

A woman lawyer has exposed the utterly confused, silly, and sad situation that prevails in some of the courts, which she had been practicing for over seven years. It is a revealing speech, which shows the lowest depths that the justice system in Sri Lanka is faced with. She exposes some of the judges and also lawyers including some members of the Bar Association of Sri Lanka.

For example, she, Sugandhika Fernando, speaks of going to a court where she found that three people applying lime on the head and the foot of judge because the judge has come to court too drunk, and that to revive him before the court sessions. Then she gives details of long series of events, which are highly scandalous and shameful.

There certainly is something radically wrong in the judicial system and also the manner in which legal profession is practiced in many parts of the country. She gives examples of corruption, sexual exploitation of clients and even junior lawyers by some seniors, and also how lawyers collaborate with police men in corrupt practices.

What is important is that she and few others are speaking about these things loudly. However, in the private sphere, many lawyers and clients, and people who know about the facts in the courts have same type of tale to tell from all around Sri Lanka.

What is even more saddening is in a manner in which some of the present leaders of the Bar Association are behaving, ignoring all these criticisms and even attacking the critics for reasons, which are far from honorable.

It is to be hoped that more people will begin to articulate like this lady-lawyer has done and also some other lawyers. In addition, a protest movement develops to explore the rotten aspects of justice sector, which is so vital for proper functioning of society.

All this corruption and demeaning behavior implies that people at large are denied of opportunities for justice, and that people will therefore have little trust in this kind of system. (By Asian Human Rights Commission)

    Can we please stop saying/writing/referring to ‘lady lawyer’? The vocation of lawyer is not prefixed against gender. The vocation is genderless, hence there is no need to say ‘lady lawyer’. A lawyer is a lawyer, whether male, female, intersex or anything else!

    I am an English speaking Aussie living in Melbourne. How the hell can I understand this clip when someone is jabbering only with few broken English in the middle. CT has to be fair, restrict this website to English speakers and readers only not Sinhalese. We are everyday readers. Sinhala texts can go to some other website like Lankaweb.

      If you look at the Menu Bar, just below where they say that “In Journalism Truth is a Process” you will see that there there are some articles in “Sinhala” – written there in Sinhalese characters; no Tamil section – but I have not seen protests about that.

      What surprised me is that this article, with the all important video clip, has not appeared in the “Sinhala Section”. I’m very surprised at that. Comments in that section can be either in English or Sinhala. but in the English Section Sinhala and Tamil are not allowed. Well that is CT policy; like it or lump it.

      Ideally, all of us Sri Lankans ought to know all three languages; in terms of votes cast English speakers are those who matter least. Learning a language is very difficult, so it’s not a bad thing that you’re in Australia, but if if you want to know about Sri Lanka, please listen to this.

      Sugandhika Fernando speaks too fast in both languages; her English is NOT broken, it is typically Sri Lankan – especially the intonation and stress patterns. So yes, it is difficult to get all the details. Her English is actually fluent; vocabulary quite sufficient, grammar is O.K. That is her!

      She comes through to me as an extremely honest person – that would not have been possible unless I strained a little to understand her.

      This is Sri Lanka; possibly you never understood that. We HAVE to communicate our message to those who know ONLY Sinhala (communicating to Tamils comes some way behind in importance).

    In the facebook people are promoting Naganada Kodithuwakku as the next President. He is receiving lots of support, more vote than MS and Ranil. Nagananda is a top lawyer and is highly qualified no doubt but I think this lady is the best bet. Surely she has all the credentials to be the best leader like Lew Qwan Yeu. She is so attractive she could reflect a postive picture of our most beloved country. Nagananda can be her deputy (Prime Minister like Ranil now). The duo will make a paradaise out of the most beautiful land. Sugandhika please consider.

          But tell me how much off the mark am I in this? Once some of the major Tamil politicians identify Nagananda and team as liberal, honest and non-racist, would it be the case that “Tamils will vote for him”. The obvious flaw in such thinking is that 3 million (or whatever) Tamil voters do not act as individuals. Such stereotypical thinking is , of course, patronising and racist!

    Sugandhika is going to be sued for millions if not billions of Rupees by the law community. There is no chance of fighting and winning against this action because the judges will be up in arms against her. Those who praise, salute and worship her should think of doing something practical to help her when the need arises and you can be sure that, arise it will – very soon. I suggest that we start a fund to pay the fine, pay her dowry and generally help to support her for the rest of her life, because if anyone is thinking that she can be employed as a lawyer after this, then they have another think coming.

    Rodrigo as someone who has not said anything supporting her is the best choice as the treasurer. Why, because he will not be jailed and his property confiscated as a punishment for insulting the whole justice system. As for the others who have been not so careful, we shall be starting another fund to defend them and later support their families.     Sughandika Fernando, on re-reading your article with the mindset of a lawyer, I must say that you have screwed yourself in style. I can understand a person without any knowledge of law acting so stupidly, but a lawyer? Don’t you understand what libel is? A group libel action will be instituted against you soon. It will perhaps be the biggest and most publicized libel action in SL.
    Adding to that, you go and antagonize the police, the very people who could have given you protection against physical harm in this situation, by saying, “….and also how lawyers collaborate with police men in corrupt practices….” . Is there any finite limit to your stupidity?

    The commentators who were saluting and praising you would do well not to cheer you on anymore. I am saying this not only for the sake of Sughandika. Her case is hopeless and no one can help her, not even Allah the non-existing God. I am saying it for the sake of my fellow commentators, including Sam Fernando (another Fernando. Ha! Ha!).

    Who will clean our toilets without them? So, I advise them to apologize to everyone they have offended by their support for Sughandika and I will see to it that they will be left in peace to keep our toilets clean.

      UAE and Black money: You are naïve. UAE is not refusing because of the nature of the Sri Lanka’s justice system. It is because, the UAE (especially Dubai) policy is not to do anything to upset future depositors of money. Dubai has become a place for black money and money laundering as well as a place where the underworld of US, Russia, India, Pakistan and Sri Lanka operate with impunity. Everything depends on money there.

      If they extradite Weeratunga, present and future customers, who are mainly other Weeratungas in other forms, will think twice before considering Dubai for their investments.

      That is why Weeratina will not be extradited and not because of principles.

    Judges postpone cases just to satisfy the lawyers for flimsy excuses. This suits the lawyers since even if a senior lawyer does not appear his junior will collect the money from the plaintiff who is the victim. Cases drag on for years due to such postponement. Our justice system is rotten to the core due to the hand in glove actions of lawyers and judges. I know of one case where a claim for an accident has been filed as a cvil case and it has dragged for nearly 6 years. Land cases are the wrost sometimes taking 20-25 years to give a verdict. By that time most of the cpeople who filed the cases are dead and gone.Judges instead of passing verdicts merely postpone cases when all evidence is there to take a decision. Also lawyers who charge exorbitant sums of money running into millions and do they pay income tax. Just like the doctors they should be forced to issue receipts and income tax sleuths should actively pursue these matters.

    Corruption in the executive, legislative or judicial branch of the government of Sri Lanka is well known but amongst the three branches of government the nefarious activities in the judicial branch is covered well by the risk of being cited for contempt of court. The words “Swameeni”, “Hamuduruwane” are all a facade. The attitude is if you have to come to me pay my price, be it cash or kind, even sexual. It is a pity that the judicial branch of the government is not subject to public scrutiny. Why not electronize the process so that certain minions in the system loose their market. Bhutan is a good example. The system should be such that a formal hearing have to be done when it is absolutely necessary. Corruption is at its best when there is face to face contact.

    The Case of the Lime Attorney:

    In the case of Jesus & the Israelites, the apostles knew where they were being sent (among wolves), how they should be disguised (as sheep) and how to behave once they were there (wise and non-aggressive).

    In the case of Sugandhika Fernando, we have a rather stupid lady with a big mouth being dressed up as a pit bull (ගොනාට ඇන්ද) and sent in to the arena to fight the matadors armed with lethal weapons, a rare experience as experiences go, but one that she probably would not survive.

    Finally, I started to watch the video clip but stopped half way. She was going on and on about some limes being cut as a cure, how it was applied, where it was applied and so on to prove that some judge was drunk. It was in such bad taste, that I could not continue watch or listen to it any longer and pressed the stop button. Some may enjoy such Mariyakade talk. But I don’t.

    One thing is clear. This lady enjoys talking, probably the reason why she took to law as a profession. From the way her mouth moves, its shape and gestures I could place her in the Southern Coastal around Balapitiya, which, just as a matter of interest, is famous for Salagama (Hali) caste people, who have are genetically prone to be extremely talkative.

    To pass judgment on a noble profession based on the evidence given by a loud mouthed lady with two lime fruits would be the height of folly. Ladies and Gentlemen of CT, with that, I rest my case.

    She is brave – very brave. There is one lawyer currently practicing in Jaffna who is well known for his alcoholism and fraudulent activities in the UK. Apparently he is/was the president of a Bar Association in Jaffna!!!
    He fled from the UK and settled in Sri Lanka , apparently gone back to give his ‘ expertise’ and ‘service’ to his own people. He is well connected to EPDP as well.

    The President ought and should appoint a panel consisting of three Chief Justices from the Commonwealth. Then get all of the sitting justices to send in their voluntary resignations.

    The Panel will be entrusted with the job of sifting through the credentials and past track records of each and every judge for a thorough and close scrutiny. All of the judges who pass the test or close scrutiny would immediately be reinstated as if there had never been a lacuna.

    All of those who failed the test or did not stand up to close scrutiny should be sent on voluntary retirement without loosing any benefits.

    The Bar Association of Srilanka must be disbanded and must be replaced by like that of Law Society of Singapore in the same way Late Hon. Mr. Lee Kuwan Yew wanted it to be.

    Lawyer Sugandhika Fernando’s expose’ of some disgusting abuses in Sri Lankan Justice System is courageous and timely. The number of comments exceed 240 shows the interest she evoked. We have all experienced situations similar to what Sugandhika describes.

    As an aside consider the injustice meted out to minority Lankans for the past seventy years and continuing. Unfortunately their grievances are never addressed. It has reached the stage when attempts to solve the issue are termed ‘traitorous’.
