An Army Major Is Hospitalised; Mervyn Silva’s Son Malaka Silva Has Done It Again

Army intelligence officer Major C. Pradeep was admitted to the National Hospital after being assaulted by a group led by controversial minister Mervyn Silva‘s son Malaka Silva at a five star hotel in Colombo last night, according to a complaint made to the police.

Army Major was assaulted by Malaka Silva, Former Minister Mano Wijeratne’s stepson Rehan and five other persons at the Jaic Hilton car park at around 3.30 early this morning.

Police spokesman Ajith Rohana said a corporal who was with the Major at the time of the incident was also injured during the clash. The Slave Island police have recorded a statement from the Army Major who charged that his official pistol had been taken away by the group.

Not unlike his father, Minister Silva’s son Malaka has been notorious for terrorizing Colombo and its nightspots and is also a paid government official in Minister Silva’s Ministry. No one dares speak out against the Silva family due to their connections both with the underworld and their immunity due to presidential patronage.

Malaka’s track record

* In September 2007 an Accountant, Chaminda Senasinghe was hit on face with pistol butt by Malaka Silva at the Bistro Latino Restaurant. Speaking to The Sunday Leader from the Nawaloka Hospital, Chaminda recounted those last moments before he fell to the floor only to be kicked and manhandled by about 10 persons. (Sunday Leader September  9, 2007). After visiting hospital Chaminda lodged a complaint at the Bambalapitiya Police Station. However Malaka had made it to the police station before Chaminda and had himself made a complaint indicating a small bruise on the bridge of his nose and stating a group of persons had assaulted him. Senasinghe who had 11 stitches on his forehead and Malaka Silva was remanded on September 11, 2007 for pistol whipping Chaminda Senasinghe.

* Malaka Silva and two of his bodyguards on November 2, 2006 pleaded guilty to attacking attacking Police Narcotics Bureau (PNB) officers who were on a drug raid at a night club in a five star hotel.

Colombo High Court Judge Upali Abeyratne ordered each of them to pay compensation of Rs. 10,000 each and enter into a bond in Rs 100,000 each to be of good behaviour for one year. The accused were Malaka Silva and his bodyguards Sampath Kumara Rajapakse and Prasanna Kumara Suresh. The judge ordered that the compensation be directed to the Police Rewards Fund.

In a direct indictment by the Attorney General the three accused were charged with willfully causing hurt to deter a public servant from his duty. Malaka Silva was charged with intimidating and obstructing the PNB team which went on a narcotics raid with a court order to the night club My Kind of Place at Taj Samudra in the early hours of July 24, 2005.

The accused were indicted with assaulting police personnel including PC R.W. A. Dayan Lasantha – an offence punishable under Section 323 of the Penal Code.

According to the statements given by PNB officers and PNB OIC Buddhika Balachandra at the magisterial inquiry, on the said date the narcotics team, on a tip-off had raided the night club to arrest an ‘ecstasy’ dealer who was said to have been trafficking the drug at the hotel. When the PNB officers who were in plain clothes were leaving the night club after completing the ten-minute raid, Malaka Silva had obstructed them and abused them in foul language. Malaka Silva had allegedly threatened the police officer at gunpoint and assaulted the police officers. Later he had called his bodyguard who was armed with a pistol and attacked the police officers.

The PNB team had allegedly withdrawn from the place as the accused were armed and as they did not want to create a problem there. Later they had complained to the Colombo Fort police station.

The accused had later surrendered to the police station. Ironically two days after the attack former Police Chief, Chandra Fernando, announced the release of Malaka Silva and his mates saying that there was no evidence. Media reported that the police were under pressure not to work hard on the case.

In his attempt to defend his son, Mervyn Silva abused journalists in filth and stated that he knows what to do with the owners of Sirasa and Swarnavahini – two privately owned media outlets.

Earlier in connection with this trial Malaka had also been banned from entry into night clubs after 7 p.m with a warning that if the ban were violated the one million rupee bail on the two persons would be converted to a fine and charged from them. (Sunday Leader September  9, 2007)

* According to a leaked US diplomatic cables, in February 2007, US Ambassador Patricia A. Butenis wrote to her Secretary of State saying that “according to a former Sri Lankan security services official, drug kingpins in Sri Lanka have political patrons in the government, chief among them Dr. Mervin Silva, a Member of Parliament and the Minister of Labor. His son, Malaka Silva, is suspected of trafficking the drug ‘ecstasy’ in Colombo.”

Late minister Mano Wijeratne has two son’s from his first marriage and  his second wife Bharathi Wijeratne (the present Sri Lanka Ambassador to Turkey) has a son from a previous marriage. His name is Rehan Jayawickrema and he recently changed his name as  Rehan  Mano Wijeratne. Rehan is the person who allegedly involved with this attack with Makal Silva.  Earlier version of this story named him as former minister Mano Wijeratne’s son.

      MR tried to get rid of Mervyn in similar fashion as how Sripathi was rid off. The thing is that you can not rid someone before his time. Therefore Mervyn survived the motor accident unlike Sripathi. Now MR has to tolerate Mervyn’s antics. If Mervyn is treated otherwise, not as in Chandrika’s case, where he threatened to reveal the number of bush hairs, but here he will reveal MR’s arse hole size.

    A soldier on leave down south,had assaulted a tamil man who failed to address him as ‘Sir’ and, he & his friends burned down seven houses of tamils.
    There was no action by police.
    Now, Malaka Silva assaults an army major and a corporal and has not even been arrested.
    The contrast in law enforcement is striking.

    If a tamil civilian had assaulted an army soldier there would have been grave consequences.

    I am writing to you regarding your article published on your newspaper regarding Mr. Malaka Silva’s connections to late Mr. Manodha Wijeyeratne’s son. As the only sister of the late Mr. Manodha wijeyeratne , I would very much like to inform you that my brother has only two sons; Subodhana Wijeyeratne and Hasitha Wijeyeratne.

    They have nothing to do with Sri Lankan politics and have been living abroad for the last 18 years. Hasitha received his Bachelor of Science degree from University of Hertfordshire and currently working at the Clochester Hospital in U.K. Subhodhana who graduated with honours from the University of Cambridge UK is currently undergoing his Phd studies in Japan.
    I can personally assure you that no one in the Wijeyeratne family , has any aptitude or respect for thuggery. Therefore I will be very grateful if you would be kind enough to rectify this article as it could only tarnish the images of these two innocent children.

        a step son to Mano.He’s not Mano’s biological son.Therefore this

      Dear mrs Hulangamuwa ,

      To all the people who read this article and commented I would like to state that I had at no time told the papers that I was the late Mano Wijeratne s son.He was my stepfather.the name Wijeratne derived from my grand uncle the late general Ranjan Wijeratne . I have no need to lie about my heritage as I come from the prominent Jayawickreme family hailing from weligama..the late minister montague Jayawickreme is my grand uncle who was also part of Sri lanka s first cabinet..my step father cut all ties will his family and this can be proven by the way the his own brother, Niranjan Wijeratne ridiculed him on the Sunday leader a couple of years ago.

      I hope Mrs Hulangamuwa that you know that your brother , the late Mano Wijeratne considered me to be more of a son than his own children..each and every politician, opposition or otherwise will bear witness the the fact that mr Mano Wijeratne would proudly introduce me to them at any given time calling me his son.

      You did not even have the decency to contact me after this issue.
      I don’t want to wash dirty laundry out in public like you have which clearly proves your class and creed.i sincerely hope that you do not take this issue and make it a platform to air out your frustrations with me and my family..

At no point did I accuse you of claiming to be my brother’s biological son; I merely pointed out that the newspaper had referred in its earliest edition as ‘Mano Wijeratne’s son’ . I’m sure you’ll agree this was ambiguous phrasing at best and that some people had mistaken ‘son’ for one of my nephews who have nothing at all to do with this situation.     Poor late Mr. Mano. May he rest in peace.
    All I wish to state is that no action is every taken against people like this.
    Is this a good image of the government for their citizens as well as other countries. I have to say that in a time such as this when we are trying to rebuild ourselves, is such good reputation within the government a positive outlook for all other countries and their very own citizens.
    How is it that a normal citizen of this country is remanded at once with no questions / answers been given and an unruly person like him been given all the freedom and power to do what he pleases? Is this injustice brutal or what? How is it that a poor person would have been murdered right now. But a Minister’s son been allowed freedom no punishment or whatsoever for such behaviour.
    Such unruly behaviour is definitely not a positive aspect for our children and the youth of this country.

      You have asked a very pertinent and important question.
      Why do ALL magistrates remand ALL persons brought before them AUTOMATICALLY,without inquiring/ascertaining the ‘other side’ of the story from the person/persons produced before them by the police – as required by law and the constitution?
      Even obviously injured persons are thus remanded.
      Is this not a perversion of justice?
      In real democracies,the police firstly remind the arrested person of his rights and inquire whether he is willing to make a statement,or whether he requires a lawyer.
      If he needs one, he is allowed to phone and obtain a lawyer to come to the police station. If he says he is unable to obtain one, the state provides him with a lawyer who is allowed to first confer with him in private,and later gives a statement – duly recorded – in the lawyer’s immediate presence.
      After this only, the police decide whether to produce him before a judge, if they think that there is a good case to prosecute him in courts for an offence.
      When will this happen in sri lanka?

    This is how they treat an officer who worked in the battle field during the last war. I don’t under stand why president and Mr Gotabaya are silent in this kind of a situation.     To all the people who read this article and commented I would like to state that I had at no time told the papers that I was the late Mano Wijeratne s son.He was my stepfather.the name Wijeratne derived from my grand uncle the late general Ranjan Wijeratne . I have no need to lie about my heritage as I come from the prominent Jayawickreme family hailing from weligama..the late minister montague Jayawickreme is my grand uncle who was also part of Sri lanka s first cabinet..my step father cut all ties will his family and this can be proven by the way the his own brother, Niranjan Wijeratne ridiculed him on the Sunday leader a couple of years ago.

    I hope Mrs Hulangamuwa that you know that your brother , the late Mano Wijeratne considered me to be more of a son than his own children..each and every politician, opposition or otherwise will bear witness the the fact that mr Mano Wijeratne would proudly introduce me to them at any given time calling me his son.

    I don’t want to wash dirty laundry out in public like you have which clearly proves your class and creed.i sincerely hope that you do not take this issue and make it a platform to air out your frustrations with me and my family..
