Basil Rajapaksa Remanded Till May 5th

Former Economic Development Minister Basil Rajapaksa was remanded till May 5th by the Kaduwela magistrate.

Basil RajapaksaTwo other officials, former Secretary of the Ministry Nihal Jayatilake and former Divineguma Fund Director General R.R.K. Ranawaka, who were accused of committing fraud under the ‘Divi neguma’ fund were also remanded.

Former President Mahinda Rajapaksa’s brother Basil was questioned for several hours since last morning and he was later arrested. Basil Rajapaksa returned to Sri Lanka yesterday from the United States .

      It is sad day for the VOTERS… why is that ALL politicians who when arrested are accommodated at the Prison Hospital? This has become a national sport where politicians from both sides of the aisles in the parliament..when arrested end up in prison hospital depriving the genuine people of their right to be at the prison hospital..

      IF SF could be in jumpers and in the queue for food, there is NO reason why Basil shouldnt be in jumpers and in line for his plate of food… All the doctors at the Prisons who recommend hospital stays should be dealt with severely or even their licence to practice should be revoked !

        Whether to use deadly force is dictated by the circumstances surrounding an event not the environment. Enforcing law and order in an controlled environment should be easier than an uncontrolled environment.

      Gota had planned & organized a protest in-front of Bribery commission tomorrow to stop him being questioned but police has taken a court order against any protests , my gut feelings say Gota will be arrested on Friday .

    The law of the land says that every person is equal before the law.

    If there is a plausible and prima facie case exists, the law requires the Director General Bribery to act as required by law and I believe the DG, Bribery Commission, Ms Dilrukshi Wickramasinghe, owe a word of praise from all of us, particularly at a time she has to act on her own when the three Commissioners appointed by MR are impotent.

    Due process established by law, applies to all citizens irrespective of the positions they hold or held. With no exception MR, MY3, RW, the same yardstick shall apply. This is what the Rule of Law requires and this is what exactly the government promised to the people.

    Who knows, probably, in the near future, there could be serious allegations of corruption against RW.

    I heard Basil’s lawyer already built his defense. Its solely based on his portfolio not properly defined.
    When his brother gave him “Economic Development” it was assumed that he was supposed to develop the family economy and that is what he did. Now can you blame him for that? :)

    Let this be the first step to ensure that the Rule of Law has been re-established in our country.
    This out come would not have resulted, if Cheap Justice Mohan Peiris was CJ, he would have countermanded the Kaduwela Magistrate’s order and had him remanded in custody instead.

    Good. But his volunteering to return and get arrested could be a part of a conspiracy to agitate their own blind followers, leading to a state of lawlessness in the country. None of the rajapakshas and wickramasinghas of the previous regime and their hangers on should be trusted. Authorities must be wary of this major trick by MR and his family. I hope that people would remain calm; better to put booruwansa and the ring leaders of sleeping in the well MP parasites behind the bars. Carrying fake passports is a good reason to hold these criminals.

    It appears a roller coaster run for Basil; Enjoying the Vadakil Vasantham; fleeing to the USA less kurakan shawl; Business and First Class travels with a heroic reception on return to the beloved mother Lanka with Jaywewa cheering; and now, in jail. Not sure a business class cell is being provided in the remand Centre for this VVIP who is notorious for white collar crimes. However, out of the MR’s lot, he is a bit different, didn’t want to involve unnecessarily in murders or any criminal activities, he means only business, and he knew only through business he can prosper. He came with a mission, and he was executing it, maybe the two more years he planned to rob were robbed from him pre-maturely because of a stupid astrologer. Only future proceedings will reveal what actual % he claimed as his commission on projects that he implemented. Rumors vary this figure from 10 to 40?.

    I thought the writings were on the wall for Basil with his famous brother distancing himself responding to a reporter “has he arrived back?”. And, even worse, MR’s comments that his only shortcoming was trying to cover up the wrongs of some ministers and it will not happen in future. Appeared, the comment was directly targeting Basil, the scape goat in that “Ministers Lot”. Appears a family feud was on going even during those good days, maybe due to the fact that Basil’s earnings were exceeding the MR’s.

    Also, while Tsunami funds misappropriation was being considered as a day light robbery, going with Tissa’s ministerial appointment as a case to answer, although it was made while the government was on the care-taker mode, which was illegal and deemed to be a corrupt act, makes to wonder what was the thinking behind this kind of pursuing, looks a kind of soft peddling providing some sort of reprieve under double jeopardy in future. The whole game being played is puzzling, definitely looks as if some complicit involved of other side.

    Next, he will be moved to a private ward at the National Hospital, and then viola` he will be granted bail!

    I felt UNP-Ruling Party authority of evil intention of Ranil W….political motivated act of law and CBK allied with MS Presidency; violated reality of facts has been overrule by network of legal Rules stretches over social and political life of democracy the events of which constantly crossed by the lines of Juridical framework and its obligation of arrest of Basil Rajapakase.

    Most important thing is circumstances of political assumes a certain legal aspect has been denied by time, that Basil was arrested by the Court of law.

    Arrested of Basil R… thus against the various facts and act of political ,intellectual intercourse and social relation, arise a series of facts and act of law on which depend the changes of economic development model and path of capitalism since 2010 after end of War.

    In my view it is hardly necessary to point out that Juridical verdict and act do not simply reflected counterparts of in their political economic and social of life and neo-Liberal policies.

    In the case of Basil Rajapekesa, case of corruptions or misappropriations govt. funds the judge may objects in course of an examination of witness to irrelevant question and to the bringing in of unnecessary documents.

    I have to sum up that, we have to recognize two entirely different kinds of facts, which indeed exist case of Basil.R…not only in juridical theory ,but in actual legal distinction of law.

    In here that remember the Court of Judge is not legislators. How will Judge find what is called the RATIO DECIDENDI—- the principle on which the decision is based? The first duty of dispute may be largely question of facts of political different path of development.

    At any rate the court of judgment will case of Basil R…involve the application of principles of law to want concrete facts.

    But Central Bank Governor Mahandrian of Bond inside trading of massive Financial involvement of corruption charges has not bring before court of Law ?

    Is this no fair deal or fair judgment by UNP-Ranil.w… CBK and MS regime RULE Of LAW? or Good governances by UNP regime?

    No point in arresting Basil. First Mr Luni Gotha and MR who appointed him to a very important post to be arrested. Actually MR by appointing a Thug as defence minister, misused his power and ruined the country. Now no body can bring back the people eaten by the shark or killed for body parts or by indiscriminate bombing. No body can replace the life, monetary and moral losses to the north and east people.     The venal Rajapakses will strain every sinew in their system to create maximum trouble on this move- which they will consider “provocative” Remanding Mr.10-50% – they know, is the step before Gota and MR are taken in next. The swords are out and the battle line drawn up. Ranil will be the first to abandon, if trouble breaks out.

    The Sirisena team has to plan out their counter-attack immediately.
    first is to get the Mahanayakas, the Buddhist clergy and the armed forces on to their side. The Rajapakses have already taken over the Parliament. What shameful and unprecedented behaviour in Parliament. There is no respect for the sacrosanct dress code or Parliament itself.

    Sri Lanka’s biggest handicap is the lack of discipline – in every field of activity. It is discipline that brought Germany, Japan and the Western powers up. We simply don’t have it in us – with out thug mentality.

    We all know that Basil is not the biggest culprit or the only crook when you take the Rajapaksha clan and their cronies.

    Mara, Gota, Namal, and the rest have done the same, if not worst, things in Sri Lanka.

    So why arrest Basil on arrival? Should they not have done the same to Gota for instance all this while?

    I can only imagine why this is so! One thing is clear however, Basil has had some issues with the Mara clan. So is it possible that Basil was arrested with the Blessings of Mara?

    Perhaps Basil is a scape goat! One can only speculate. My question still remains why Basil? And similarly why not others?

    is it possible that Mara and co. are having some level influence in this government? To me it like that because a lot of people who are obviously guilty are still walking the streets.

    If Mara has influence in this govt. We have ask how and why this is so. Is there some unseen link? If so who or what it is? Likewise how do we counter that influence.

    I know for a fact that as long as Mara is meddling into the affairs of our country corruption will never cease. As long as there is corruption a country can not progress.

      I think it has to do with the evidence you have to prosecute in Courts successfully. Looks like the State has sufficient facts to nail Basil.
      They are obviously working on MR and GR as well. If you remember, Sicile Kotelawala is holing up for so long, probably in the UK – because, as I learn, Interpol does not have enough convincing evidence to indict her.
      But the mess MR and GR have got into are so wide it is possible they will get into trouble sooner than later. Besides, both foolishly antagonised India and the West during their time and these countries and the main players therein will demand eye for an eye.
      The Ukrainian arms racket – and possibly others in Africa and India – can spell serious trouble once the facts are laid out.
      The UNHRC issue coming up in September can spell further trouble to the
      “divine-anointed” family.

      I wish the judge has the balls ….to ask for a 2nd opinion from a well known Doc and if there is NO need for hospitalization …..the doc who ordered to initially hospitalize BR should be charged for contempt of court making it a lesson to others who issue bogus medical opinions. Especially for politiocs who are arrested… also charge the lawyers who represent these scoundrels for aiding and abetting them along with the doctors whereby they lie to the court so that they have a favor granted by the judge which amounts to contempt of court…

      That is the job of the Prison Warden. I saw the video which shows Basil walking out of the vehicle in which he arrived. Basil’s gait said his life was in no danger to justify accommodation in the Prison Hospital.

      Hope the Prison Warden has the balls to review the decison to hospitalize and put him back with the other prisoners.

    MR cronies, inspired by the numbers that attended the SLFP snubs meetings had planned to sabotage the 19th amendment and also usurp power by force after a staged May Day rally under the patronage of MR. For this the MR cronies had got the Bribery Commission to issue notice on MR and Gota of which the Director General BC nor MS or RW had been aware.MR cronies miscalculated since none of the Rajapaksa Family will be taken into custody because MS/RW are week that they will take time with the 19th A, to take advantage of the situation.     This is a good lesson to MS and RW to weed out all the MR cronies from public Office who are trying to scuttle Good Governance. Start with the Bribery Commission as to who issued the order to question MR and Gota?

    Dr Navin…..learn law and justice is important ,dose matter learn form gamaya.

    I have no doubt that advantages of our legal and political system far outweigh the disadvantages by ongoing rule of law manipulated by MS,UNP-RANIL & CBK back POLTICIAL REGIME. Under the present regime still the disadvantages are serious in Rule of Law IN SRI LANKA LEGAL ORDER.
    The cure for them to be found of law, moral and justice and has from time to time been found in Law of Land not by the present regime.

    Now case before Basil R….it will something happen that UNP ruling party working of the law and procedure of Majesty court will result in particular cases in injustice and hardship to the political rivals.

    We might feel inclined to say, well that is a pity , but it be a would be worse to make the law uncertain than a particular hardship unaddressed by UNP Party in power. Law of land that lost confidence by citizens of Sri Lankan.

    That was not the right thinking way that our democracies looked at case of Basil R… Law and morality were not clearly address by UNP.
    The case of Basil R… law and justice was not founded in any one of the court.

    But case of Arjuna Mahendran totally different of justice by UNP ,its looked by UNP ,CB inside trading of Govt. Bonds treat as that Queen’s justice ,that matter of justice that right at least as a favors of CB governor.
