Betraying The Armed Forces Through The ‘Office Of Missing Persons’

In the midst of all the political and economic chaos in the country, the government has placed before parliament draft legislation to set up an Office of Missing Persons. This is one of several institutions to be established ‘to deal with the past’ in terms of the UNHRC resolution that the yahapalana government co-sponsored with the Western powers in September last year. The Office of Missing Persons Bill has many provisions designed to persecute our armed forces and I wish to highlight some of them as follows.

1.       The Office of Missing Persons will not be a part of Sri Lanka’s State law enforcement and justice system, but an independent body incorporated by parliament which gives its members the power to function outside the normal rules and regulations that guide state institutions.

2.       Even though it is described as an ‘office’ the proposed OMP will be a tribunal for all practical purposes which can examine witnesses, issue summons and hold hearings. Its officers can enter without warrant, at any time of day or night, any police station, prison or military installation and seize any document or object they require for investigations. Anyone who fails or refuses to cooperate with the OMP may be punished for contempt of court.

3.       The seven ‘members’ of the OMP are to have experience in fact finding and expertise in human rights law and international humanitarian law which means that the appointees will for the most part be representatives of Western funded NGOs or those who have worked with Western sponsored international war crimes tribunals.

4.        According to Section 21 of the draft legislation, the OMP will have the power to receive funding directly from any foreign source.

5.        The OMP can acting on its own, enter into agreements with foreign persons or organisations concerning its work.

6.       The ‘members’ of the OMP can establish units and divisions and delegate their powers and functions to those entities. They can also can appoint and dismiss staff and consultants. It is not specified in the draft law that the members or staff of the OMP have to be Sri Lankan citizens.

7.       Complaints can be received not only from relations and friends of missing persons but from any interested party both local and foreign.

8.       Government bodies at all levels including the armed forces and intelligence services are mandatorily required to render fullest assistance to the OMP and the provisions of the Official Secrets Act will not apply to the proposed institution.

9.       According to Section 12 (c) (iii) the OMP can admit as evidence any statement or material disregarding the criteria laid down in the Evidence Ordinance.

10.   The provisions of the Right to Information Act will not apply to the work of the OMP. No court, not even the Supreme Court can order any officer of the OMP to submit to courts any material communicated to him in confidence.

The foregoing makes it clear that this Office of Missing Persons is meant to be an integral part of the judicial mechanism to deal with allegations of war crimes that the yahapalana government has undertaken to establish. If this draft legislation becomes law, every member of parliament who votes for it will be held responsible by the people for betraying the country and the armed forces.

    Either way, the content of his press release (did he use that pathetic letterhead again?) shows that either he is already very worried, or he should be.

    It seems to take the current government a while to sort things out, but if this bill is passed we are getting closer to real reconciliation.

The OMP is a brilliant idea that the new government has initiated and will bring back respect and integrity to SL which you so cruelly destroyed. Criminals like you cannot see the dignity which this office will bring back to the country.         my wife with me always. she is the one who instruct me to make comments in this way as she knows how peace is important at any cost as she is from so called boarder village.her entire family circle still live there.but her two sisters were brutally massacred by LTTE with their husbands and four children. vauniya was most effected area you may be aware of it.we always remember our heroes and worship them as we are able to visit her native land freely.relatives are safe now.you all must get your mind examined I feel.those do not respect others human rights are not entitled for the same at all. you have to earn the respect. it is not fall on to your lap automatically.

    This Press release of MR is a further sign if not for crass and divisive communal politics he has nothing to offer by way of leadership to the country – either to its economic or political woes.     Mahinda, if I am not mistaken, you were a human rights campaigner when you were in the opposition in the late 80s. If that is correct, you seem to have taken a 360 degree turn & not concerned about missing persons anymore, whether or not the armed forces are to be held responsible. It just proves what a hypocrite you are.

    The armed forces of a democratic country need to be disciplined. That is the difference between terrorists (or the so called freedom fighters) & armed forces of a civilized country. Atrocities are committed by the armed forces in the heat of the battle but nobody can commit mass murder even in battle conditions. Even psychotic murders are entitled to a fair trial in accordance with the laws of the country & a vigilante army is no better than common murderers. If the SL armed forces were not responsible, it is unlikely an international court would find them guilty, even if they bore a grudge against SL but more than the solders who may have actually committed the crime, it is the Officers who gave the order or turned a blind eye that should be held accountable. To me, it looks as if you & your cronies are hiding behind the foot solders to save your own skin.

    No matter what others say. He may be a happiest man as he implemented what he promised.I do not think he is worry of consequences of his actions as long as general public live in peace.nobody who criticized him does not show us path he should have taken in restoring peace in this land from south end to north end.Nobody show us the solution to terrorism and terrorist war.he is not responsible for creation of that he just ended it for the benefit of all.Path he took mIGHT hurt some but we have TO understand that terrorism almost destroyed every thing.now people can talk and do postmortems but nobody was prepared to take risk of on his or her own lives his or her family members .terrorism should be countered by terrorism. not only armed terrorists but sympathizers as well. That is the lesson we have to learn out of this war.those do not respect or safe guard others human rights are not entitled for the same. that is what Russians are doing with ISIS.

    This appears to be a defence by Mahinda Rajapakse on behalf of the Armed Forces which he ( and his Defence Minister M.Sirisena ) commanded during the war, in anticipation of what may be revealed about how citizens went missing, even after they surrendered to the army during the final days.
    He anticipates being accused of “command responsibility”.

    If the armed forces have violated any laws then the head of the armed forces Mahinda Rajapakse should also be punished. Any one who has violated any law must be punished.
