Betraying The Armed Forces Through The ‘Office Of Missing Persons’

By Mahinda Rajapaksa

Mahinda Rajapaksa

Mahinda Rajapaksa

In the midst of all the political and economic chaos in the country, the government has placed before parliament draft legislation to set up an Office of Missing Persons. This is one of several institutions to be established ‘to deal with the past’ in terms of the UNHRC resolution that the yahapalana government co-sponsored with the Western powers in September last year. The Office of Missing Persons Bill has many provisions designed to persecute our armed forces and I wish to highlight some of them as follows.

1.       The Office of Missing Persons will not be a part of Sri Lanka’s State law enforcement and justice system, but an independent body incorporated by parliament which gives its members the power to function outside the normal rules and regulations that guide state institutions.

2.       Even though it is described as an ‘office’ the proposed OMP will be a tribunal for all practical purposes which can examine witnesses, issue summons and hold hearings. Its officers can enter without warrant, at any time of day or night, any police station, prison or military installation and seize any document or object they require for investigations. Anyone who fails or refuses to cooperate with the OMP may be punished for contempt of court.

3.       The seven ‘members’ of the OMP are to have experience in fact finding and expertise in human rights law and international humanitarian law which means that the appointees will for the most part be representatives of Western funded NGOs or those who have worked with Western sponsored international war crimes tribunals.

4.        According to Section 21 of the draft legislation, the OMP will have the power to receive funding directly from any foreign source.

5.        The OMP can acting on its own, enter into agreements with foreign persons or organisations concerning its work.

6.       The ‘members’ of the OMP can establish units and divisions and delegate their powers and functions to those entities. They can also can appoint and dismiss staff and consultants. It is not specified in the draft law that the members or staff of the OMP have to be Sri Lankan citizens.

7.       Complaints can be received not only from relations and friends of missing persons but from any interested party both local and foreign.

8.       Government bodies at all levels including the armed forces and intelligence services are mandatorily required to render fullest assistance to the OMP and the provisions of the Official Secrets Act will not apply to the proposed institution.

9.       According to Section 12 (c) (iii) the OMP can admit as evidence any statement or material disregarding the criteria laid down in the Evidence Ordinance.

10.   The provisions of the Right to Information Act will not apply to the work of the OMP. No court, not even the Supreme Court can order any officer of the OMP to submit to courts any material communicated to him in confidence.

The foregoing makes it clear that this Office of Missing Persons is meant to be an integral part of the judicial mechanism to deal with allegations of war crimes that the yahapalana government has undertaken to establish. If this draft legislation becomes law, every member of parliament who votes for it will be held responsible by the people for betraying the country and the armed forces.

    1. Neither were the white vans that your family ran which is also suspected of assassinations, drug running and kidnapping for ransom.

    2. Isn’t this how it should be done in an environment where the Judiciary, police and law enforcement was corrupted to the core by politicians for a decade.

    3. Unlike your govt where fact was a casualty of corrupted politicians and their family this govt is trying to bring some credibility. Whats wrong with that.

    4. Sri Lanka is not drowning in funds, the well is practically dry thanks to your govt and some family members accused and facing trial for highway robbery. So some one else is funding say thank you and move on.

    5. If Sri Lanka does not have the skills why not?

    6. This is a huge file and does need different disciplines. No the likes of Modawansa and Gompalika are useless.

    7. Shouldn’t you go where there is information and evidence?

    8. If you have nothing to hide shouldn’t you do that?

          Dear Mahinda,
Do not worry as it will become useful to you. Very soon you will go missing. Then your people can make a complaint to OMP to find out what happened to you and get a death certificate.

Everyone give Percy a break. Percy how can we tell you that we actually don’t need to know what you think. Please just get that into your head. Your wife, sons and their girlfriends, siblings are just arrogant, obstinate, head-strong and show no humility even when they are arrested. So how do you expect us to forgive you and them one day.

“”Betraying The Armed Forces Through The ‘Office Of Missing Persons’””

There are no armed forces after 1948 but warlords with different colours and changing it like chameleons.Pedophiles in the un peace keeping missions.

when MR1 left in 2015 the nation was indebted to the tune of US$$ 43 billion mainly to China. That is 73% of GDP and the worse for an emerging nation.
When the Brits left in 48 the nation was the best managed in the south asia region.

You’ve being saying the armed forces will be betrayed since the day you got booted out. Yet nothing has happened. I think even your die hard fans are beginning to see through it now.

If the bill is such a problem, why don’t you attend parliament and vote against it? You are an MP after all, arent you, even if you havent sat in on a single session this year by the sounds of it?

    Mahinda Maama,

I laugh loud and long whenever I hear about this business of missing persons.

They are all wasting their time, aren’t they? ONLY You-Know-Who and henchman know the truth about what happened, and where the bodies were buried.

As we used to sing in old days, “somebody know, nobody tell, but somebody stole the wedding bell”.

Prageeth, et al and all those whose last ride was in a white van and won’t be coming back anytime soon. Also, Lasantha, Wasim et al sleep well, your secrets are safe.

All this Office of Missing Persons bollocks are only good to give a few people some work.

The guilty will not spend one sleepless night!

Just a small reminder MR blocked THIS website during his “rule” and is now using hit to reach who exactly?

Either way, the content of his press release (did he use that pathetic letterhead again?) shows that either he is already very worried, or he should be.

It seems to take the current government a while to sort things out, but if this bill is passed we are getting closer to real reconciliation.

Do not worry Mr Rajapaksha . Our armed forces will come through head held high . Its just there are a lot of crooks that you instilled in the army to boot lick to your whims and fancies for your betterment . The un law full killings and abductions etc etc is what the legal process is for.

Your brother , Shivndra , Jagath , Captain Nevile , Captain tissa , your brother Gota , and yourself to name a few will have to hauled up in courts sooner or later.

    2

Rajapakse, now you are getting frightened for the crimes you perpetrated. The OMP is a brilliant idea that the new government has initiated and will bring back respect and integrity to SL which you so cruelly destroyed. Criminals like you cannot see the dignity which this office will bring back to the country. Your excuses and reasons given in the stupid article someone wrote for you is driven by purely selfish and unpatriotic thoughts to cover the bums of your family and yourself as the commander in chief who was the biggest thief. The blatant disregard for the norms of decency and rights of citizens which you openly flaunted, the vermin that supported you in milking the country dry of its resources, the complete disrespect for citizens rights and insatiable greed which you and your family displayed will now be brought to book. Wishing you many more sleepless nights with the thoughts that you will be made accountable and given the punishment that you deserve, a long term in prison to experience the hell that others went through with the torturous and depraved behavior of your family and you.

    “parliament draft legislation”

Surely our parliament will not approve anything harmful to the country? Hopefully this will be chopped up like the 19th amendment.

      1

      New Vanguard (and others…)

      KEEP CALM and carry on.

NOTHING……No NOTHING harmful will befall our country, our heroes, and the great Liberator.

The reason is simple; NO government of Sri Lanka (or its proxies) has been held accountable for anything perpetrated in its name, viz 1958, 1971, 1977, 1983, 1987-89, Bindunuwewa….etc etc and on and on. In many instances they have even had help from outside governments/forces.

Now these people talk like heroes but before 2009 when terrorism or terrorists. innocent people were massacred.even new born child were killed. pregnant mothers were cut in their wombs. children were taken out and dashed on the walls of their own houses by female LTTE carders. these pundits could not see them. not uttered any single word against such brutalities.when those culprits were given the punishments they deserved and restored peace for all now talk on human rights of those murders but not talk on victims. new born children, children killed even in their mothers wombs.are they not entitle for human rights. only the murders entitle why. these pundits should explain. without waging war against them did we have option to stop such brutalities . those pundits should show the the ways then regime should have taken.if they agitate for human rights of those culprits.our forces done correct thing under the instructions of high command brought country into normalcy.now no point in talking past.look for future.

    Mr. Rajapakse

Why are you worried about the OMP bill. According to you and your brother you both fought a clean war. So there is nothing to hide. Your anxiety about the bill will only show that you and your brother have a lot to hide.
    So be at peace.

This coward is getting a little agitated and anxious because the armed forces took orders from him and his brothers when they committed the war crimes and other atrocities. The military when put on the spotlight will tell the truth and implicate the Rajaaksa criminals to save their own skins.

Rajapaksa is scared, no doubt about it!

Where else can they be presidents, ministers, secretaries, lawyers, it is only in the so called Banana Republic – Sri Lanka.

With his barely complete GCE (OL)Gota R. could become a gas station assistant and dish washer in the United States. If this idiot – MARA is shipped to US, can you imagine where will he end up?

Mahinda will be dead worried because where the foreign intervention lacks the legal force, the local laws will be able screw his balls. Now that his pal brother-in-crime is suddenly taking too often to escape the long arm of the law, and Gotabaya is breathing his last fresh air before the pounce, MR is running scared that he will be consigned to the depth of the dungeon and left to rot there. Dr. (Miss) Radhika Coomaraswamy, in her recent comments to a book by Architect C. Anjalendran centred on the family of the famous “C” Brothers – Suntheralingam, Nagalingam, Thiagalingam et al – used the interesting
coinage Career-Communalists. Among the leading politicians in the country Mahinda Rajapakse will fit into this description together with men like Dinesh G, Champika R, Udaya G, Gunadasa A, Nalin de S and many leading Buddhist priests in the country with an established political inclination. It is they who are the bane of the country today.

This Press release of MR is a further sign if not for crass and divisive communal politics he has nothing to offer by way of leadership to the country – either to its economic or political woes. It is the crop of utterly inefficient but venal Ministers and political leaders who are really the cause of Sri Lanka’s multitude of problems. An ignorant and foolish voting public only prolongs and aggravates the problem.

Mahinda, if I am not mistaken, you were a human rights campaigner when you were in the opposition in the late 80s. If that is correct, you seem to have taken a 360 degree turn & not concerned about missing persons anymore, whether or not the armed forces are to be held responsible. It just proves what a hypocrite you are.

The armed forces of a democratic country need to be disciplined. That is the difference between terrorists (or the so called freedom fighters) & armed forces of a civilized country. Atrocities are committed by the armed forces in the heat of the battle but nobody can commit mass murder even in battle conditions. Even psychotic murders are entitled to a fair trial in accordance with the laws of the country & a vigilante army is no better than common murderers. If the SL armed forces were not responsible, it is unlikely an international court would find them guilty, even if they bore a grudge against SL but more than the solders who may have actually committed the crime, it is the Officers who gave the order or turned a blind eye that should be held accountable. To me, it looks as if you & your cronies are hiding behind the foot solders to save your own skin.

“Mahinda, if I am not mistaken, you were a human rights campaigner when you were in the opposition in the late 80s.”

Most if not all crooks and dictators have portrayed themselves as “Human rights defenders” to get to position of power and then abused the same people they said they were defending.

Look at the life of Robert Mugabe: MR would have been the same and a life term President if he was not kicked out.

This is a another Diaspora, NGO and UNP London plan to keep the Sinhala Buddhists at bay.

This will enable the UNP to cripple the Armed Forces.

And enable the Colombo Elite , Anglicans , Vellalas and the Wahabis to thrive in Batalanada’s USD 40 Billion Megapolis with the Dual Passport Diasporians and the ETCA imported Hindians.

Wonder what Bodhi Sira and his young apprentice Duminda are going to do about this ?.

May be Bodhi Sira is planning to retire in the Megapolis too, with the new Lawyer daughter with her LLB from London working for the Diaspora Pension Funds.

“This will enable the UNP to cripple the Armed Forces.”
This can only happen if the armed forces are complicit in war crimes and crimes against humanity. SO ARE YOU IMPLYING THAT THEY ARE?

“And enable the Colombo Elite , Anglicans , Vellalas and the Wahabis to thrive in Batalanada’s USD 40 Billion Megapolis with the Dual Passport Diasporians and the ETCA imported Hindians.”

Come-on be reasonable we let you guys to come into Colombo and did not object to you studying English either.

Your mate Batalanada Ranil’s centre piece of the Megapolis is the Chinese built Colombo Harbour City.

It was Bataanada who was forced to take the Begging Bowl to Beijin..

And Bodhi Sira made sure of it…

Read his spiel to the Diaspora in Sngapore to whom he wants to bend over, which ever way possible, although his age makes it a bit difficult.

Now he wants to Sell Mattala Airport to pay his mate’s Son in Laws 2.95 percent Commission each year for the next 30 years.

You are lucky because you don’t have to part with your dole to pay Mahendran’s Retirement Expenses, unlike the Yahapalana sucking Colombo Elite.

In the past the traffic of Begging from SL was towards the UN ,
the Kathawa leaders of the past Regime were sent to BEG FOR PARDON AND BE LENIENT FOR THE WAR CRIMES.

Obviously you are not up to speed with Batalanda Ranil and the pretty boy Mangalana’s 10 year plan for Yahapalana suckers to become the richest in South Asia on the back of Thamil Diaspora.

Batalanda wouldn’t spend three full days of Prime Ministerial Time to talk bullshit… Right…

Colombo Port linked to Kerala Port, Madras Port, Kochin Port and god knows how many other ports, to bring goodies in including Kerala Herb with out any checks because Port City will be under a different jurisdiction .

50,000 Dual Passports have been already issued for your mates all over the West,to bring in the Dosh.

Hindian and Singapore Diaspora wouldn’t have the dosh,to even pay the Application fees except Mahendran clan.

Sale board has already gone up at Mattala Airport.

And you reckon our Siinhala Buddhist leaders haven’t left any assets after Mr Pirahaparan.

With Federal Eeelam in the North East , Federal Megapolis with its 8.5 Million Yahapalana suckers, travelling around in Japanese high speed Mono Rail, shopping in Wahabi Shopping Malls alongside , Singaporeans and Hindians .what a sight it will be if you are around.

Don’t worry about the rest mate , They are just only Sinhala Buddhist dumb asses as your mates call them.

Also watch that ex UNP leadership aspirant Keselwatta Kid talking big about the Hindians making the Yahapalana suckers so rich with ETCA coming through the Colombo Port.

            It is on U Tube.

Don’t get distressed thinking about the past, It is not good specially at your age.

Play golf and keep fit to enjoy the Bacon in the Megapolis in 2025.

May be you will even run into Suren Surendran and the Reverend as well, while Power Walking in Torington .

I am a convert to Elderflower Cordial during the Hotty Days. You must try with lemonade , the Cordial and Rocks of ice to cool you down , don’t forget to throw few sprigs of Mint leaves and see how invigorating .

                  Cheers.

The Reality is we are not a super power. We need Begging bowls , Lots of it.
So Every movements of the Politicians and the so called Leaders of the Services of our country are scrutinised by the big wide world. .
Beggars cannot choose, You and your masters can scream at Diaspora, NGO, UNP London for keeping the Sinhala Buddhists at Bay.
Who do you think you are?? You people are Beggars from just another THIRD WORLD COUNTRY.

Please go and ask your Master that who created this scenario??
No one other than your master and the ilks of your kind exposed our country for total Annihilation.
Now need to face the music! Don’t you think??
Your chorus ‘ of Batalanda , Bodi Sira and whiskey ….. Please keep on repeating which is not effective anymore.

Best to sing the last song played by the musicians when the Titanic was Sinking in the Atlantic Ocean.

I mean, no one has said anything about the forces being involved in these disappearances no? This former president himself said the forces weren’t involved. So how is the OMP a tool to ‘betray’ the forces?

Unless this is some kind of confession…

This is called ‘Illang kanawa’ only 2 out of 38 have said anything positive about you!! I know you are a thick skinned bstd! With little education, sacked from Richmond and Nalanda, you got entry into Thurstan through compassion of late Mr. M.D.Gunawardena the principal. You never studied but rioted there and like your son, late Jeyaraj Fernandopulle was your proxy at law college exams!!! Why were you so scared of JF? Anyway you did not understand a word written by your pro/f/(xy) GL the power hungry professional who would sell ethics for position! Neither would you understand the replies sent to your/proxy post! Let someone reply all these posts! Maybe track down all those who were negative to you in White vans! You have enough money pilfered from us for petrol! Unfortunately you will have to jail 95% of us! But there won’t be enough space in jails since your kith and kin occupy most space!!!Subha Anagathayak!!

No matter what others say. He may be a happiest man as he implemented what he promised.I do not think he is worry of consequences of his actions as long as general public live in peace.nobody who criticized him does not show us path he should have taken in restoring peace in this land from south end to north end.Nobody show us the solution to terrorism and terrorist war.he is not responsible for creation of that he just ended it for the benefit of all.Path he took mIGHT hurt some but we have TO understand that terrorism almost destroyed every thing.now people can talk and do postmortems but nobody was prepared to take risk of on his or her own lives his or her family members .terrorism should be countered by terrorism. not only armed terrorists but sympathizers as well. That is the lesson we have to learn out of this war.those do not respect or safe guard others human rights are not entitled for the same. that is what Russians are doing with ISIS.

    Dear K.A.S

Check your balls mate; I am sure you wouldn’t be surprised if they are missing. Otherwise, you wouldn’t open your garrulous mouth to spill non-sense like this.

Anyway, MaRa won’t exist that long to hand in your diplomatic posting to Toronto. Mara will soon find his own hell.

This appears to be a defence by Mahinda Rajapakse on behalf of the Armed Forces which he ( and his Defence Minister M.Sirisena ) commanded during the war, in anticipation of what may be revealed about how citizens went missing, even after they surrendered to the army during the final days.
He anticipates being accused of “command responsibility”.

If the armed forces have violated any laws then the head of the armed forces Mahinda Rajapakse should also be punished. Any one who has violated any law must be punished.

Rajapakse dynasty will be making a last minute bid to capture power in a couple of weeks or months with the help of so many important sections of the State.
All this is tied up with the progress of a]The Thajudeen Murder,b]The murder of Lasantha W.
MS/RW need to be awake all night.
It would not be a case of once a knight always a knight;Once a night is enough!
