Breaking News: Chief Justice Replies The Most Serious Four Charges On Her Finances And Bank Accounts

The Lawyers for the Chief Justice Dr. Shirani A. Bandaranayake replied to the allegations related to her bank accounts in the impeachment motion. It replies the most serious four charges on finances. According her lawyers all operative bank accounts have been declared by her. Only accounts not declared are those which are closed or with zero balances- so there are no assets. The much talked of apartment is bought by her sister and brother in law- engineers in Australia who have sent all monies through the Bank. 

Her Lawyers  Neelakandan and Neelakandan wrote to three major media companies re the allegations. We below publish the letter wrote to MTV/MBC .

Dear Sir,

We are the Lawyers for Dr. Shirani A. Bandaranayake.

Publicity has been given in various newspapers regarding allegations against our  Client

At present, we bring the following facts regarding her bank accounts and remittances  to your attention and through you, to the Public.  Our Client has been banking exclusively with the National Development Bank (NBD)  since  2010. Our  Client  has declared  all  operative  accounts  that have assets in  her  declaration of assets and liabilities. The Bank has informed our Client that there are a  few non-operative accounts which contain zero balances. There may be non-operative  accounts in  other banks which  our Client operated prior to 30th October 1996, which  our Client believes have been closed.  Our Client was appointed a Judge of the Supreme Court on 30th October 1996. Since  then no money whatsoever has been remitted to our Client from abroad or from this  country save and  except from her immediate family (inclusive of her sister) and her  official remuneration.  Our Client’s sister and her husband, who  are employed  as professional  engineers in  Australia, reserved an apartment (for purchase by them) when they were in Sri Lanka.

Thereafter from  time  to  time,  our  Client’s sister  (through her  Australian  bank)  remitted sums of Australian dollars for the purchase of the Apartment. This was later  converted to Sri Lankan Rupees by NDB. In Sri Lankan Rupees it was approximately  Rs.27 Million. Our Client, by cheques, directly remitted to the seller in installments a  sum of approximately Rs 27 Million. The Bank has confirmed these transactions.

The sum of Rs.34 Million mentioned in your news item is not accurate. The sum of  Rs.19  Million approximately  mentioned in  your  news item is  a part of  the  aforementioned purchase consideration of approximately Rs.27  million. There  was  never a remittance of Rs 34 Million into our Client’s account.

In the circumstances, in summary:

(a)  our Client has declared all her operative bank  accounts having assets in her  declaration of assets and liabilities; and

(b)  after her appointment  as  a judge of  the  Supreme Court our Client  has  not  received any remittances from anyone in Sri Lanka or abroad save and except  the remuneration as a judge and the remittances from her immediate family.

Thus clearly there has been no financial impropriety on her part.  Our Client totally denies the other allegations and can easily refute them.  Our Client instructs us to state that she will, as always, continue to duly and properly  discharges her duties without fear or favour; she will do so, independently, impartially  and fearlessly in accordance with the Law.

      Absolutely, Bravo on the response! Also Bravo in opposing the real reasons for the impeachment – I oppose this based on the REAL reasons for the impeachment. BUT, I cannot say I condone all the supreme court judgments in the recent times (not only during the present CJ’s tenure).

        To answer…this is a firm of proctors, good or bad as any oher firm. The response which is well drafted, is not by them but by aan actual advocate. They only act as a conduit in sending the letter.

        Couple of points here.
        What is wrong in hiring a law firm?
        If it is controlled by all Sinhalese, she may have another issue. Some stupid politician will come and say, this lawyer’s sisters sister-in-law’s uncle’s brother-in law’s niece is from this party and then try to link CJ to that party.

        Is there any proof to say that Neelakandan & Neelanadan has connection with Diaspora? Even if, what is wrong there?

        I quoted something referenced by you. Please apply that to it.

    MR Ranil Co should be ashamed of their deceptive actions. Impotent Ranil supported his Boss, simply because the Supreme Court, being the watchdog of the people, pronounced some decisions that hurt MR that was clearly against the sovereign rights of the people. Good that they brought these frivolous allegations against the CJ hoping that she would step down, permitting MR to appoint one of his stooge to be the CJ. Now their nudity is exposed to the whole world.

    In real democracies,candidates for high public and judicial office,declare their assets and details of their tax liabilities, publicly,and these are published in the free press in those countries.

    Rajapaksa probably thought the Chief Justice would be an easy push-over but it looks like she is a determined and courageous lady. She is educated, unlike Rajapaksa the bully,and has everything to gain by standing upto him.

    Rajapaksa is going to end up with more than rotten egg on his face at the end, which will be well deserved. The consequences of Rajapaksa winning this have unimaginable adverse consequences for the country and I hope all the people will come together and thwart the bully’s attempts to usurp supreme control over the country’s institutions that guarantee their rights and freedom.

    MPs, ministers and other high officials are required to declare their assets. Have the Rajapaksas done it? What about the Helping Hambantota millions? The previous and devious CJ Sarath Silva let MR off the hook. Recently, there were media reports about Swiss bank accounts owned by Sri Lankans. Will the government investigate and tell the public who the owners are, and uphold the rule of law by bringing them to justice? The government talks about “the law of the land” and “nobody is above the law”, but practice it only when they want to get those who challenge them, and that on frivolous charges.

    I would like to reply to Pandukabaya de Silva. I worked with Tamils and Sinhalese for more than 30 years. There are more gentlemen among Tamils than Sinhalese. So please do not try to label all Tamils as LTTE. CJ should be brave enough to find correct people among all the Opportunist lawyers.

    If she is so prim and proper why hang on to her position and waste time of the tax payers. She cannot play with millions when she is the CJ even on behalf of her sister or who ever it is. Allegations are real which have to be proven. However, after such allegations are levelled against her can she function in her capacity as a judge in good faith? Also now only understand that she never has practiced law. She has ascended to this higher office due to her name associated with Bandaranike. She should take leave of abscence until her case is determined. We will see what comes of these allegations.

    Those who insult will surely get disgraced by their own country men and internationally. They are looking up and spitting. They are revengeful and bend to destroy anyone who cross their path if they consider it a wrong way.
    By this impeachment motion they are trying to humiliate a lady of good repute, in fact they are humiliating the entire Sri Lankan women. As a Nation we felt proud when she was appointed as the first Lady CJ, within a period of short time they disappointed all women folks of Sri Lanka by trying to impeach her purely for political reason. Where is the party of monks, their deadly silence is disgrace. Are they upholding the dignity of women.
