Budget 24: Economy Collapsed Because Public Money Has Been Stolen By MR & His Brothers

Thank you presiding member for the opportunity to speak at the second reading of the budget proposals that have been presented to this House by his Excellency the President and Minister of Finance. Whenever I have spoken on the second reading and if it was the president who held the portfolio of finance, I have consistently raised my objection to that fact and I must place my objection today also. I have said this since 2010. The reason is that the constitution says that public finance is a matter that is entirely in the preserve of Parliament, and therefore I take the view that it is only a Member of Parliament who is accountable to Parliament in that way, who must hold the portfolio of finance.

His Excellency the president is not a member of parliament, although he can attend Parliament and he can answer questions. I take the view that the chief of the executive, who is not a member of the legislature, should not hold that post. Having said that, I want to start by welcoming some of the proposals that have been made, for instance we welcome the increase in monthly cost of living allowance of public sector employees and pensioners. Although insufficient it is a welcome increase. Also the increase the monthly allowance for persons with disabilities, elderly citizens and kidney patients – most welcome. Then expediting compensation for missing persons. There was a large sum that was allocated several years ago, that was not spent. There is an amount in the appropriation act but over and beyond that His Excellency in his speech said, he is allocating a further sum to expedite the payment. Providing land ownership to farmers; Yes! that’s a very salutary proposal and we welcome that, fishery industry development in the northern region; a long felt need and in the budget proposal that has found mention and we welcome that. Construction of houses for internally displaced person, initiating preliminary work for the water supply project in Jaffna: all of these are matters in the budget proposal that we welcome. However, it is one thing to have these proposals and it is quite another thing to see them realized. So that is why we have reacted with scepticism, when even these welcome proposals are mentioned. We have tracked or several agencies have tracked the progress made on budget proposals. The committee on Public Finance has been specially tasked to do this and between the years 2015 and 2019, I had the honour of chairing that committee. And we started that process, but often came up against a blank wall because there was no information available and I must say current chair Hon. Dr. Harsha de Silva is also taking a lot of effort to track to see whether previous year’s budget proposals have been implemented or to what percentage has actually been realised. Only 8% of last year’s budget proposals – there is even some progress at all. A stupendous 68% has no information at all – no information at all! Then how can we be satisfied? How can we be happy that some progressive proposals have been made? They amount to just words, and I urge, I urge the chair of the Committee on Public Finance to sit at least once a month and summon officials to disclose to that committee the progress made on each of these proposals. It must be a continuous assessment process. If not, Parliament cannot actually exercise that power over public finance. Those words in the constitution also will become like mere words like in the budget proposals. So if that is to have any meaning and in the full house we will not be able to do that, so now that we have a committee on public finance, I think it would be appropriate to have regular, at least once a month a meeting to assess the progress on all of these proposals that are being made. 

I must say that the revenue proposals are wholly unrealistic and it is not this year alone that it is happening. If this is a trend, then we must know that those are unrealistic. Even in the past years we have found that it’s a habit to make over estimation of revenue and under estimation of expenses. That’s a way you show – at the budget proposal time at least – a smaller deficit knowing all too well that that is a false figure. That that deficit is much larger, several times more. So the revenue proposals are wholly unrealistic even now. Even now the reason given for the increase in the VAT percentage is said to be “revenue has not been collected as envisaged” – so we knew that well before, well before! How did we know that, because revenue has never been collected as anticipated or as disclosed as the revenue proposal. We know that. Now that is being said as the reason for burdening the entire population with the VAT rate increase. If the Inland Revenue properly collected taxes from those who are obliged to pay taxes we obviously won’t be in this state. And that is why in the governance diagnostics the IMF has correctly pointed to revenue collections authorities; the customs, the Inland Revenue, has been severely corrupt, high officials being corrupt. My only grouse with that report is that they left the political masters out of it. In fact, the revenue collection authorities are shielded and protected by political masters in office who are more corrupt than those officials themselves. That is the reason why the country went into bankruptcy.

There is also heavy disparity in allocations. Defence continues to be a high expenditure. We are said to have the 17th largest army in the world. For a small country such as ours – 17th largest – just the size of the army itself. I can understand when at a time when that was perhaps necessary. But 14 or 15 years after the internal strife ended, there doesn’t seem to have been any effort taken to demobilise the armed forces. That effort has not happened at all. And so we keep pumping money into a sector that is not necessary to be maintained in the current context. 

And with regard to corruption, the supreme court delivered a judgement yesterday – 265 pages, most welcome judgement of the Supreme Court. Unfortunately it is a majority judgement, one judge for reasons that he has stated has dissented. That’s four to one judgement holding the then President, ministers of finance who held that portfolio, governors of the central bank; the successive governors, secretary to treasury, advisor to the President, one member of the monetary board and the monetary board itself, responsible for the collapse of the economy.

I want to recount a particular series of events. The advisor to the President Dr. P.B. Jayasundara, was found guilty by the supreme court in the case of Hon. Vasudeva Nanayakkara Vs. K.N. Choksy and I must disclose my interest in this matter because I was the counsel who appeared for Hon. Vasudeva Nanayakkara. He was found guilty and fined Rs. 500,000/- at that time by the supreme court. He paid the fine. He was told that he cannot hold public office thereafter. He gave an affidavit to court stating that he will not hold any public office thereafter. Then there was a change in the office of the Chief Justice. And the new Chief Justice …(Interruption).. the Minister of Justice in asking to name the person, I will tell, it’s not wrong to name him.

The new Chief Justice Asoka de Silva constituted a court to which Dr P.B. Jayasundara made an application to withdraw his affidavit. Why? because then President Mahinda Rajapaksa insisted that P.B. Jayasundara and P.B. Jayasundara alone must be appointed secretary to the treasury. As counsel for Hon. Vasudeva Nanayakkara I objected to this. One day the full court sat – 10 judges sat, one judge was unavailable. And then a 7 judge bench allowed it, with one dissenter, Hon. Shiranee Tilakawardane, wrote a dissenting judgement, a dissenting order, others allowed it. And he was appointed secretary to the treasury. The Chief Justice at that time who allowed it, the day after his retirement, became the legal advisor to the then President! So, corruption in high places is demonstrated by just this example. And now the Supreme Court again finds that President, his 2 brothers, Dr. P.B. Jayasundara and others responsible for the collapse of the economy.

There is one thing that they have not done, and that they should have done, the court should have done. In the Easter bombing case, for failure to prevent the attack the former President, several others were asked to pay hundreds of millions in compensation. But in yesterday’s judgment those who have been found guilty – found responsible for the economy collapsing in this country don’t have to pay any compensation. The Court says petitioners did not ask for compensation. The court could have granted just and equitable relief – surely the Rajapaksa brothers have enough money to pay the 22 million people in this country. Surely if the compensation had been ordered, all the money that is parked outside the country can be brought. The Minister of Justice himself said several people have parked money outside the country. It can be brought and the country’s economy can be revived just on that alone. Country’s economy collapsed because country’s public money has been stolen by the President and his brothers and several others who worked with them. They have taken the money out of the country. What the Supreme Court should have done is to have ordered them to pay compensation for every citizen of this country, and bring that money into the treasury and that would have seen the revival of this country’s economy. This is not the end. Perhaps due to the nature of the proceeding in the Supreme Court, that is what the court has held. But I’m sure, now must start a recovery process from those who have been held responsible by the Supreme Court. And every citizen of this country is entitled to make that claim, to ask them to bring the money back and make this economy stand back again.

      Up to now, all comments here in CT and elsewhere on news papers seem to fully agree with the judiciary decision. Yet, if there is an election anytime soon, most who have been found guilty will sure get elected. ( Rajapaksas, Pissu Sirisena, RW , Easter master minds ……….. ) . It’s SB politics and nothing to do with ethics or morality. Those who elect deserve what they wished for, unfortunately they take down the country and the rest , with their race / religion politics. Current minister , Wijedasa Rajapaksa , himself is a number 1 crook. Waiting for politician / cardinal Ranjith’s response ???

        Paragon, at last politician Ranjith came out with his statement requesting Australian govt to help finding the Easter master minds. A Rajapaksa lackeye , who told international media ” there is no human rights violation in SB Lanka” , is now a born again human rights activist saying ” there is no free speech, no independent judiciary alleging human right violations including disappearance, during and after war, our fathers are illegally monitored by the govt, ministers and intelligence officers were behind derailing Easter probe………. Typical pseudo right activist like many who are vocal today like this author, Tamils who’s only purpose is to portray MS negative, when no politician dared to criticize Rajapaksas , on their face, during parliament session. MS was threatened from the day he joined politics by his own community, SB and even few Muslims.

      Former govt sabotaged Easter Sunday attacks probe says former head of investigation, retired senior DIG Mr. Weerasinghe. For the first time he spoke to media claiming political interference derailing probe . Former DIG Ravi Seneviratne has already submitted an affidavit to the SC last year, claiming that his lead investigator and the whole team, taken off without explanation, immediately after Gotha took office six months after the attack. At the time not even a PM or cabinet was appointed, Over months not only 22 more officers were removed from the investigation, a travel ban was imposed on more than 700 CID officers, with intention of intimidating and preventing them from investigating allies of Rajapaksas. Many officers got scared and sought transfers. He further added ” investigations hit a road block when they found some intelligence officers had links with the Islamic group. They prevented police from questioning some of the associates of the the suicide bombers claiming they were involved in national security operations “.

      Ajith: Ranil W will be questioned and indicted in the same way in SC when he leaves (soon it will happen – the maximum time being 10 months) his office. Please be patient.

      I firmly trust “Natural Justice”, proved in the latest SC verdict. Now it is a question of “Punishment”. It is sure to emerge from the “Nature’s Law”. Will that “Natural Law” these “CRIMINALS” to breathe their last in “PEACE”? NO

    The author has raised a reasonable question about Sri Lanka’s judiciary. The former President Srisena and few others were asked to pay compensation within a particular time period but we understand that they paid some so far 15 or 20 million rupees out of more than 100 million rupees. But now the whole country was lost billions by Rajapaksas but they were asked not to pay anything. In fact, now we know who are the real culprits of Easter Bombing but Ranil controls the Judiciary. He needs Rajapaksas but he does n’t want to Rajapaksas to be a threat to his dream but he needs Rajapaksa supporters votes. Both Ranil and Rajapaksas used poor Srisena who has no brain to use it tactfully.

    When Hitler exterminate Jews in mass scale Most of the Germans was staying silent for petty dislike of Jews and did not protest.
    Similarly when Rajapakse brothers were looting the country majority of his supporters knew about it and actively supported them to loot so that they can get some left overs.
    As for now, trend is changing political and days are numbered for the corrupt lot, ever lethargic supreme court gave a rare decision and found them corrupt and responsible for bankruptcy of the country.
    We now have a president who took his position by the support of the Rajapakse clan and doing his best to protect them and still giving them state sponsored perks.
    Next government should charge Rajapkse brothers and Ranil Rajapakse for crime against the country and case should be heard by impartial supreme court.

    It is very immature for Sri Lankans to get excited about this judgment which really is a trick , the economic disaster the country faced is equated to Rs.150,000 from so called respondents.

    I don’t see any indisputable evidence produced , nor can judges question policy matters of elected representatives. Judges cannot give political opinions nor economic analysis. In that case we must ask SWRD family to pay billions for ruining the county for ever with his Sinhala only policy.

    We can see that our judges are good at attacking leaders when they are on the way out, but not when they are in power. When the Rajapaksa family were in power these same judges went behind them and gave unfair judgments to win their favour-Sarath Fonseka, PB Jayasundera reinstatement etc.

    Once Sirisena was out of power, they said he was negligent on the Easter bombing and imposed a huge fine. When he was in power a Supreme Court judge held an inquiry but no such finding. Now they are whacking the Rajapaksa family who are politically weak now.

    The low quality of these men can be assessed from the long list of judges who have polluted their office- Sarath Silva, Mohan Peiris, Asoka Silva, Abrew( Ranjan Ramanayake), Mrs Wijesundera, Upali Abeyratne Bandula Karunaratne etc .

    People are so terrorised by these judges, every minute they feel compelled to mutter-‘We respect the Honourable Courts…”-sure sign of criminal intimidation !

    None of these judges have protected the people against those in power. However when a man is out of power, our judges become lions.

    So don’t get excited. This is business as usual- just a lucrative career for these mediocre Sri Lankan lawyers.

    The Highest Court in Sri Lanka (SC) in the decision by a majority (only one Judge dissenting) has decided who was “Responsible” for the collapse of the country’s economy and that directly impacted the welfare and well-being of the people.

    Now what is next? All those found “Responsible” and “Accountable” must be brought to book. In an investigation further, it would be found that there are scores of others connected with these named “Crimes and Criminal.”. The present Government of Ranil W must move swiftly in bringing these CRIMINALS to Justice. In that pursuit (1) Bring a Motion in Parliament to SUSPEND the named “Criminals”. (2) Give ORDERS to CID to investigate and take these “Criminals” to custody under ICCPR (3) Bring a Motion in Parliament to withdraw all CIVIL RIGHTS of these named “Criminals” and any others who were associated in committing the crimes.

    I hope “Leelage Malli” will not classify me in that list of “IDIOTS” (mentioned in his comment) who criticize Ranil W, because I am helping RW to rise above all the “IDIOTS” with whom he is associated and assisted with in Governing the country.

        My Dear LM: Thank you. I know you never called or will call me an “Idiot”. I made that sarcastic remark on your telling “Idiots call Ranil…” I join all others who call Ranil W an idiot. Ranil W must also, ONE DAY be taken to task for protecting these “CRIMINALS”.

        On that “Neutral” matter, there is no time to be neutral. The country is in real danger of collapse. All of us have to make a decision to go this or that way and we have to decide “ONE” way, for good or bad. Even if that way is wrong nothing worse could happen. But let us go for a complete “CHANGE” – a simple COMMON SENSE change that would eliminate corruption, mismanagement, and punishment for those responsible for this collapse and RECOVER the loot.

      Well what is the guarantee the decision of the court would not be reversed on Appeal given that in the past three years courts have dismissed cases against members of the clan and their ***** carriers?

      It is too soon to count on courts and the politicians, (I scratch your back you scratch mine) ……

        NV: In S/L anything and everything is possible. MR visited Temple of the Tooth in the morning and to a question by a journalist said: ” I accept the decision”.

        But in the afternoon when another journalist posed the same question, he said: ” I don’t accept the decision”. A “Cameleon” by birth and brought up to be a “Criminal”.

        I am sure, his “Synthetic Lawyer” son would have instructed the father that a “Revision” application would be made.

    Now, the people of Sri Lanka, particularly Sinhalese people has to make a concrete decision based on the information available about your so called patriotic leaders of your community have done to the country and people. Since 2009, there was no LTTE Terrorism, NO JVP terrorism or extremism and no barriers for economic development. In 2009, whole world including USA, China, Russia, Europe, India and UN were in your side supporting you ignoring whatever you did to the Tamils.
    The country was ruled by Rajapaksa family with your full support for five years, then Srisena-Ranil good governance for four years and then again Rajapaksa family again Gota as head with the full support.
    You gave all the powers to your leaders but I don’t know what was your intention but you kept them above the God, but it is now proven undoubtedly that all of them robbed your money and it is they who was behind the corruption or robbery. Mahinda Rajapaksa , Ranil Wickremasinhe, Gotabaya, Basil Rajapaksa together brought the country to bankruptcy. Do you want them to continue?

    The Sinhalese will never punish them, as most Sinhalese are racist to the core and brainwashed by the Mahavamsa myth, that the land only belongs to them, and they are truly indigenous, despite the glaring historical fact, proved by genetic studies that the vast majority of the present-day Sinhalese are descended from Indian immigrants and invaders, from ancient to recent and the vast majority of these immigrants and invaders are from the then Tamil country in South India, with a minority from the northern parts of India. Also prior to arrival of European colonizers, especially the British, large parts of the island from ancient times was continuously inhabited by the Tamils and ruled by them and many of the so-called Sinhalese dynasties and kings were from South Indian Tamil dynasties and origins.

      To them the Rajapakse’s are great war heroes who with international help, especially from India, had decimated the LTTE, killed and destroyed thousands of Tamils and laid siege to their ancient homeland, by large scale colonization schemes and building Buddhist temples and shrines, using the occupying racist Sinhalese armed forces and police. This is the only thing that matters to most of them. They can loot the country, steal billions of dollars, starve the population, ruin and bankrupt the land. All these do not matter to them, as long as the Tamils are destroyed, everything will be fine, and the Rajapakse’s will be largely forgiven and be their heroes and they will keep on voting for them, and the Rajapakse’s like all Sinhalese politicians and rulers know this and keep on playing the anti-Tamil Sinhalese Buddhist card to get what they want from the largely racist gullible Sinhalese people. You can see this from many of the comments from even so-called educated Sinhalese living in the west. Trivializing what happened to the Tamils what was done to them but hypocritically crying about the plight of the Palestinian Arabs, as it is fashionable to do so and it does not affect them, the same thing happened to the island’s Tamils, but it is a non-issue to them, and they seek all sorts of explanations to justify this.

    There was a time when contenders for the privilege of being a Member of Parliament were men of standing. They were asking for that privilege of being our representatives.
    They were able to provide for themselves, for their transport and accommodation, and the expenses necessary to carry out their responsibilities without being a burden to the society.
    Who changed all that?
    The thieves who wanted to rob the society. The sycophants who could not sustain their own lives thru education and hard work.

      JR! ………. JR heralded in the culture of big-time corruption: shamelessly bribing MPs. JR had no shame and expertly helped to get rid of shame that “elite” might have felt.

      “Sinhala-Buddhism” is a cancer that has afflicted society …….. the old-timers still wallow in it: that’s the only avenue of survival they have/know. They are too old to change their ways. ………. But there are encouraging signs that the young don’t buy it wholesale as the older generations did.
