CJ’s Passport Was Impounded, Hundreds Of Lawyers Were Seen In Tears

Over 300 lawyers gathered outside the Chief Magistrate Court today to welcome the De Jure Chief Justice, when she came to the court answering summons. The Bribery Commission had instituted action against her on the basis that she had not disclosed two bank accounts in her asset declarations. Counsel for the Chief Justice pointed out that those two accounts didnot have any funds and therefore were not assets. It was also pointed out that the Chief Justice, who was controversially removed has been charged for an offence that brings with it a fine of only only Rs.1000 (less than US$10) and the entire prosecution is malicious. Over 100 lawyers, from all parts of the country, appeared for her. Her passport was impounded but the Judge indicated that the court permission will have to be obtained if she wants to go out of the country. No other bail conditions were imposed.

When her name was called,  CJ Shirani Bandaranayake came up and she was requested to wait outside the Accused Stand (BOX) but she politely declined the offer and get into the Box like any other criminal, stating that she does not seek special privileges. The packed court house was deeply moved when for the first time in the history of Sri Lanka judiciary an unlawfully removed chief justice was prosecuted in a vicious manner. CJ Bandaranayake had previously openly challenged the biased conduct of two of the members of the Bribery Commission. Hundreds of lawyers were seen in tears when she came out of the Court House.

Addressing the media, the President of the Bar Association said that all the lawyers in the country and outside wanted the Bar Association to observe the proceedings to ensure justice for the lawful Chief Justice of the country. Attorney at law J.C. Weliamuna, the convener of the Lawyers’ Collective stated that they were closely observing the proceedings.

The CJ has declared all other assets unlike the politicians who haven’t declared their billions of ill-gotten monies! 2) How can she unlawfully “accepting-no-demanding a RANSOM from Golden Key Owners” – From whom? Mr. Kotelawala? or from the share-holders, depositors or the ex-directors? – unless she has demanded from the Rajapakses who wanted Deshamanya Kotelawala to be ousted to grab all his properties and wealth. The non-declaration of the two “0” balance accounts seem to be the ONLY FRAUD of this VERY HONEST SRI LANKAN LADY as all the brains of all those support Rajapakses including yours were utilized to the maximum since her childhood to frame charges against her to justify the illegal removal. I have no doubts at all that she is the MOST HONEST LADY in Sri Lanka and the MOST HONEST SRI LANKAN living anywhere in the world. If everything fails for this rogue regime in discouraging her to be a potential Presidential Candidate, they will do what they did to Lasantha and many other Opposition supporters and unlimited investigations is the only excuse for them.     I am glad that Justice Shiranee Bandaranayke has not taken to politics. She must fight her own battle against an injustice done to her and establish the credibility of the Justice System. So many are now trying to ruin her life by suggesting that she should take to politics. So far she has held her head high and wish and hope a ruinous path will not be carved out by her or anyone else. She should learn from Gen. Sarath Fonseka’s life after retirement. If in the worse scenario of putting her behind bars, she should walk into her “jail cell” with her head held high and showing the world how a woman can bear and laugh at “Imposed Injustices”.

    I seems we have the tendency to utter whatever useless thought that comes to our minds, forgetting what we are responding to. To haul the former CJ in front of bribery courts for omitting two accounts is malicious and very obviously harassment. This is a simple matter for the Inland Revenue Dept.
    If the objective is the harass her, then they are on the right track.
    But, it the objective is the send a message about her husbands business dealings – that is a another story. The judiciary must not only BE HONEST, it must also APPEAR TO BE HONEST. On that front, she is very vulnerable. My fellow posters might disagree, and if you do, be civil and be forthcoming with a useful and comprehensible argument.
    The fact that her impeachment was screwed up on many levels, does not and should not absolve any responsibility of her’s on other prosecutable matters. Pleading I did not know does not fly if you enjoyed the fruits of such dealings.
    We like to mix up things and cause confusion. And this is a clear case of just that.

    The Rajapakses are very good at intimidation politics. Just ask Hakeem, Jayasuriya, Alles, Samaraweera et al. Remember the old story of Basil having files on everyone, essentially guaranteeing their cooperation? Well now, its just zip drives and cloud memory!

      Sure you are a pol buruwa. I cannot understand a substandard academician who had never practiced law who was pushed to supreme court in 1997 due to her Bandaranaike name. Though she married a Kariyawasam held on to Bandaranaike for petty gain. At the time of her appointment most other members of the supreme court objected. But when she was pushed to the CJ by Rajapaksa same feelings came up in the legal circuit. However, when she started unbecoming of a CJ and eventually had to be removed from office she became a darling of all opposition to Rajapaksa. One should understand she was not a lawyer who was defending for oppressed in the ground level as Navaneethan Pillay has done. You may be right the western countries opposing Sri Lanka government may do things the way you are forecasting. But that is not justice.

        If he is polburuwa, people would not have words to call you as I see what you added here. If she was not a lawyer as you say- lawyers collective would not back her right ? The main problem that I see here is she just let MR to abuse her. This was the case with senior diplomats too. DJ and TK were good assets to lanken external affairs, but none of them are in today. People with qualifications are excluded under MR rule. It is just he cant get on with those people.

        You should have person grudge against the grand lady Dr. SB. It is her right to keep her name as Bandaranayeka even after being married to Kariyawasam. That should be her right. My sister did the same. CBK has kept both. So who are u to criticise these rights ? U guys seem to be supportive any idiots to harm general public. Y day my 6 year old nephew raised a few questions about the prevailing law and order in the country. SO I was helpless being unable to respond him with better answers. We are now in a country where rascals promote their jungle laws – as also seen by Ms Pillay lately. I wish we could have RIGOROUS LAWS as is the case in Germany, Malaysia and Singapore. Our people should not be given free room to go against laws. Perhaps, even chinese laws could help taming our people. It is the people who let MR type of thugs to do whatever they want in the country. Enough is enough.

    People have short memories. I am not a supporter of govt but I cannot absolve her from all evils either. First , she should have remaind in the University system as she rose to the position of associate professor . She did not have necessary skills or knowledge to qualify for Supreme Court when she was appointed. Being a professor is not a qualification to supreme court . Almost all her judgments were in the field of Human Rights and rarely dealt with issues of practice either civil or criminal law. So, when the government appoints such a person they also expect something in retrun . She should have refused or declined the position when it was offered if she was independent and forthright, instead even her husband was appointed to two of the biggest government institutions (again without necessary skill or knowledge in the respective fields- as far as I know he was neither qualified in insurance nor in banking) These dubious appointments to top positions in govt institutions on partisan grounds speaks volumes of what the govt expect them to do. Certainly, any person with a right mind would not accept such high positions without necessary skill or knowledge unless you want to favour them.
    Read her judgments and then comment. Do not rely on one judgment or one decision. First she agreed with other judges to remove restrictions on the tenure of the president, then she also agreed to give the president an extension of service(which his predecessor was disallowed by Supreme Court decision). So, who was she favouring the masses or the President(MR). When the elevation the helm was done by MR, wide publicity was given that it was given for a fixed term, which again is totally againt the constitution, but she remained silent and a when this was raised a close associate of her also confirmed that even she confirmed that the appointment was for a fixed term. Indicating, that she had agreed with the president for a fixed term which is a violation of constitution!
    She appointed 25th person in the line of seniority to the sectetary of JSC and her answer to that allegation is that about 10 of those who are above were recommended to High Court appointment, when there was not a single vacancy in High Corut. The constitution is clear that secretary to the JSC should be a senior judicial officer.
    How many times she had visited President’s Residence apart from taking oath and this would show how clean or straightforward she was. Do not judge by one deed or one act . See the total behavior and I cannot but feel sorry , not because she asked for it, but because such an intellectual was burned herself being getting closer to power and corruption.
    As to the charges against her let that be proved, and until such time she is presumed to be innocent.

      As one who left the country for Europe long ago, I thought we have a good educational system as boasted to us in late 80ties.
      It is the local media that misguide the nation. You are right saying about the appointments that dont meet qualifications fully should be rejected by met ones. But this should be valid to all appointees not only to Dr. SB. How many of the appointees of the external affairs are far beyond the required qualifications today ? How many of the former army or navy personnels are in diplomatic fields today, just because of them being closely known to Rajapaskses. Latter is the key qualification for them to get the appointment if not they are NOT Rajapakshe relatives. Lately, one of my friends in the US raised the questions – the credentials of the incumbent SRILANKEN Ambassador to the US. Are his academic qualifications and experience close to the predecessors of the position ? This is the sad reality of lanken context today. Whom to be blamed if not for the ABUSIVE president and his administration ?

      Dr.Shirani Bandaranayake is the only Sri Lankan Chief Justice who has a PHD from university of London.

      She has all the qualifications to be a CJ in Sri Lanka.

      Also she is the only CJ who refused Duty Free Car Permits.

      Also she is the only CJ who never took vacation or Personal Leave and serverd the country 100% during her stay as CJ.

      Also she is the only CJ who never travelled abroad (on official or personal trips) on Tax payer money saving valuable foreign exchange to our country.

      Many other Ex.CJ’s including Sarath N.Silva are crooks while letting Rajapakses off the hook from Tsunami scandal while obtaining mega Santhosams and having fun time with Female Law apprantice near Diyawanna Oya.

      Therefore it is time for all the country loving true patriots to safeguard Honest, hardworking and brave lady like Dr.Shirani Bandaranayake who are very scarce to find.

    Well, well, well, lawyers in tears. All so suddenly all CT readers are is sympathy with lawyers, going by the comments here.

    Usually it is the hapless citizen who ends up in tears at the hands of the lawyers when they are presented with the bills.

    The lawyers do not have a good reputation in Sri Lanka. They all make a lot of money through the misery of others. They do backroom deals not only with the counsel opposing but are quite well known to do deals with judges as well; all so often at the expense of the hapless victim that they are representing.

    With regards to CJ Bandaranaika, one can say she dug her own grave. A CJ of all people should not play politics but stick to the job she was appointed for. If she plays politics then she has to face the wrath of politicians who she intended to slight.

    And to all those CJ commenters who are have made derogatory remarks about President Rajapaksa please do take a little bit of time to reflect. President Rajapaksa has got a very tough juggling act to do to balance competing powerful forces within his government and the Tamil Diaspora who are screaming for blood. Politically speaking President Rajapaksa has no choice but to do what he got to do. He even has to harbour close relationships with people such as Duminda and Mervin though such relationships brings his credibility to question.

    All you people who are screaming for a change of government. I ask you what alternative do you propose.
    The UNP? Be serious please, UNP is a spent force.
    JVP? Do you want a Pol Pot or Stalin era to descend in Sri Lanka.
    TNA? Well they seem to still want a separate state.
    Any one else? Speak up please.

    So in the absence of a viable alternative it is better to dance with the devil we know than with an imaginary angel, and get the best outcome we can within the system.

      Alternatives are not seen to many because they are blind. State media are on their biased work – to manipulate the guilliable innocent people again and again. Even if young boys were killed by govt forces for no reason, you and alike ones would never say, that it was wrong.. and people should stand against to them.

      If you were to tell me that it also applies in Criminal Cases in Sinhala Lanka man it is shocking and frightening. In criminal cases it is called PLEA BARGAINING.

      Courts can work so long people^s leaders respect them. In an environments where the leaders themselves stay mum against unacceptable biased convictions made by courts – what cannot go wrong ? I am focusing on the crime investigation of Duminda Silva – there president and their men just ignored but supported killers side even wasting taxpayers funds for the benefit to protect one another HIGH PROFILE DRUG DEALER/RAPIST/high criminal.

        Alone going through the CRIME INVESTIGATION mentioned above, Rajapakshe is a high criminal to my eye whoever the others will go supporting him hell bent.     Controversy had arisen over the refusal by the Commonwealth Secretariat to make public a damning report on the impeachment of former Chief Justice Shirani Banadaranayake.

    Britain’s ‘The Sunday Times’ quoted Canada’s special envoy to the Commonwealth as saying Canada was “deeply troubled” over the decision by the Commonwealth Secretariat not to release the Lanka report to the Commonwealth member states.

    “When you have an opinion from a former Chief Justice that is so categorical and so devastating, the notion that the Commonwealth just looks the other way and pretends it never happened is deeply problematic,” the newspaper quoted him as saying.

    If you want to see how Sri Lankan Judiciary collapse go to Kesbawa Magistrate court. Lawyers are using mobiles while court in session and laugh very loudly and it is like Pettah (Colombo 1) fish market. No discipline and it is a utter hell and we can imagine its decisions. No one to reestablish law and order in Kesbawa Magistrate court.

      There is no place to discipline under his governance. The least minority that behave politely in the parliament are being looked down upon to the very same manner, they attacked the former CJ, Dr SB calling in their abusive language. I thought this come only by the mouth pieces of the those uneducated ministers. I was wrong there until I happened to watch a you tube in which MR himself is used to use the most abusive langauage on the stage speeches. Can you imagine ? This is SRILANKA under those idiots.
      I think their family bonds have made all fences so that opposition cannot react adequately. Now this has come to the level – NO GO. Arab style spring could help us the dissidents.

    I feel very sorry for my motherland. there are still people to talk about good of MR who is a Well known rouge, criminal, murderer and a manipulator we can go on……..bring anything all those fit to him as he is in to all of them. Poor masses are the one who get misled all the time and vote for them & bring them to power 65% of the total population in Sri Lanka is in poverty line and have no basic understanding about politics or about what is right. So others should expect this situation. All other political parties have been divided in to pieces where there is no unity among the party seniors in this scenario there is no one to challenge that rogue

    Why CJ De Jure is indicted in this manner is due to the fact of the up coming CHOGM. Otherwise the CHOGM might want the CJ De Jure reinstated as the Latimer Principles have been violated. Now MR can take up the position that there is a case against the CJ De Jure therefore he is unable to do any thing. Similarly the CHOGM also cannot request for a reappointment with a case in Courts. When the matter is next called again in February 26th 2014, MR will allow the issue to die down as otherwise MR will be exposed equally of corrupt practices. But what MR does not know is what is in store for him in 2014. Ohoma Yang, Ohoma Yang.

    Gamini, can you tell me why Ranil is not out and about talking to the masses, telling them there IS an alternative, explaining his policies etc? I can understand him staying silent when MR was at the height of his popularity, but that has now changed and the UNP should be making use of the present situation. If he does not exert himself 2014 will be no different to 2013 with MR and GR running rings around everyone.

    She is getting what she deserves. She had ruined the judiciary with her biased rulings in favour of Ex President Chandrika Bandaranayake and her government. She was doing the same thing at the beginning of Mahinda’s regime. The turning point was when her husband who was the chairperson of the National Savings Bank was arrested for an alleged mishandling of bank investment while being its chairman. Before that he was also a Mahinda’s man. The people who are crying for justice these days were criticizing her and her husband at that time. See the double standard of these people.
