Court Issues Interim Order Preventing MR And Purported Govt From Functioning As PM And Cabinet

Issuing a historic order, the Court of Appeal today prevented former President Mahinda Rajapaksa and members of his purported government from functioning as the Prime Minister, Cabinet and deputy ministers.

Court of Appeal gives its order on Writ of Quo Warranto filed by 122 MPs challenging former President Mahinda Rajapaksa and his purported government’s continuation in office. The Court of Appeal also issued notice on respondents and directs them to show by what authority they hold office.

      According to various opinions on him he has always allowed the various institutions to do their jobs without interference. This was characteristic of his governance style for all of the decades he has held authority.

        This is only partially true. The AG’s department has been very reluctant to press charges against the MR regime and its cronies, and the actors behind the bond scam. It would defy common sense to believe there was no political interference behind these delays.

        Yes it is an interim order. No Court will issue an Interim order if there is no substantial material in the petitions. Now Udaya Gommanpila and Thummulle Wimale can argue that Parliament is superior and Judiciary can’t challenge or give orders over Parliament affairs. Mahinda Rajapaksha refused to comply appellate court stay order given in favor of former CJ Shirani Bandaranayaka’s impeachment saga. Just remind Dr. Rajapaksha that his time is gone.

          it is a mere judicial formality- technality, that the SC court goes back to the first set of circumstances before judgement is pronounced in about a weeks time. Anyway, President” orders are superior over SC. Country chose President; President chose SC.

            Do you think that Lawyers challenged the legitimacy of fake PM and gone before the Appellate Court are babies? They haven’t gone against Executive Action. That matter is already before the SC and that is about dissolution of Parliament violating the Constitution.

              Na….they haven’t challenged anything. They are only dealing with complaints and challenges made by the UNP which they have to honor. If they do come to the formal decision in a week’s time of judging Ranil to be the fake, democratic justice would have been served. Remember article 33(2)(c) ??? How can any good lawyer get away from that resounding truth about the executive presidency? That the President is executive supersedes all other bogus articles sneakily placed in and around the constitution. Any other judgement, and it will be due to the fake executive former PM giving buddy lawyers appointments to the SC.

            Machan Gonhami for sure this decision is not against Executive action. It is about the Legislature. Legislature has announced with affidavits of 122 Parliament members that fake PM, Mahinda Rajapaksha doesn’t command the majority in the Parliament and therefore there is no legal Govt. They were defeated several times and fake PM and Cabinet of Ministers are no longer exists. Executive action has already being challenged in the proper forum. I am not a legal “Lunimiris” like “Ada Da Rena” Dilka Samanmali or “Kudu Nalika” Sudesh Hettiarachchi, but let us see. I will tell you something machan Gonhami that Rajapaksha’s Gon parts are over now.

      You may say that we have an idiotic President, and we thought that we can make him do stupid and unconstitutional things, as many have claimed that Sirisena is a Traitor, Sevelaya, Mala-Perethaya, Patholaya and Pachaya, and we told him, and we got the authority from him. So, he announced and did Gazette notifications to that affect.

          You are right. not even any single candidate would be a match to tame extremists/facists dominated srilanka. Nor will Nagananda with zero exp in lanken politics. Politics is not just hunting for criminals. Then JVPrs should have already won the hearts and mind of the people. The reason why JVPrs have failed to achieve is not to have improved any new methodologies to win the average mindset (rotten with corruption and uncivilized nature) of SRILANKA.

          Perhaps. let s ask Genetic Modified Organisms (GMO expert) Monsanto to produce one for rascals dominated SRILANKA.

    The proto-fascists may defy the Court and try to continue as the government. I am not sure because they must now be weighing up the risks of open confrontation with the public and the Judiciary. But nothing is impossible in the prevailing state of anarchy created by MS and MR.

        He was never the lawful PM.

        There was no removal of Ranil, legally. But it was UNP (Ranil) authorized him to function as PM. This is not Ranil’s case either. (UNP, JVP, TNA, SLNC, ACMC & TPA- Mano). Probably Ranil may have been stopped from escaping by this case initiators from contributing to this case.

        They all (UNP & SLFP) know every legal and constitutional provision they break. They both are doing that because they have to protect each other from both their crimes.

    Since this issue as well as dissolution of Parliament are sub judice, I loathe to comment on them. I just wish to say, ‘stay orders’ are only partial victories for those who made the appeals to courts in that the Legal Counsel of the respondents would have invariably asked that these plaints be dismissed without further hearings, on one ground or another and those pleas have been refused / dismissed by the Courts and so the issues will be heard further. I only hope and wish the learned Judges will be impartial and give verdicts that are fair, justified and correct under the prevailing laws of the land. It is imperative, ALL decisions relating to Governance of the Land be be made in accordance with Constitution. If there are different schools of thought regarding its interpretation, it is upto the Judiciary to provide the right verdicts on those issues that are brought before the Courts.

    People have highest respect for judiciary

    It was unexpected from MR to comment on constitutional provisions very recently when the case is pending in the Supreme Court.

    It’s wise & reasonable for media to press MR to give reasons for making that comment. (there might be justifiable reasons)

    However as the population is literate & reasonably educated there’s a possibility for people to take law into their hands in case ………………………………………………. .

    But let me stress that RW’s stay as the PM without a fresh mandate after SLFP MPs withdrew its support for the government, is the root cause of this everything. He had lost credibility through bond scam, displayed wide difference in attitudes in political & economic matters when the 2 had been given mandate to be together for gg, which people believe a total flop.

    The MP content in the parliament doesn’t reflect the actual interests of the people, that compelled the president to act in such a way to be seen as controversial.

    This must be an eye opener for every body that when victory by hook or crook motto such common candidate making may worsen the situation.

    Whatever court says, end of the day it is the people of Sri Lanka will decide. 07th December 2018 decision is favourable or not to the President, referendum on the issue to the people of Sri Lanka will decide whether dissolution of parliament is right or wrong.

      What the court says is very important. There are large number of people still in the dark without knowing the truth. Most of the people understand that the move by President Sirisena and fomer President Rajapakse are illegal and they had private deals to manipulate the elections in favour of them. However, the group involved in this political coup try to manipulate the people with lies and false infotmation and stir violence. Truth will expose the crimininality of both Mahinda & Sirisena. Yes, the election for both President and Parliament should be held according to the schedule in 2020 and people have to decide whether they need a democratic government or illegal govt.

    Within a very short period of three and a half years, Ranil and the Yahapalana Government have transformed Sri Lanka from a party related bias Judiciary to an independent Judiciary. If SL has not achieved anything else, the democracy which is recognized by the civilians and the independent acts of the Judiciary alone proves that Sri Lanka has achieved greatly during this short period. Democracy is live and active in Sri Lanka.

    I am a aTamil and living in USA for 46!years and my parents all friends are singalese. I stop attending Tamil functions because it is dominated by the LTT E and I never gave a penny to the LTTE. But I strongly believe it is very difficut to co exist with the southernes.
