Four Army Personnel Found Guilty Of Raping Woman Killinochchi

Four Army personnel, found guilty of raping one woman and molesting another in Killinochchi in the north, were sentenced to 25 years imprisonment by Jaffna high court today.

army lankaThe four were accused and charged of raping one woman and molesting another in 2010.

The Jaffna High court further ordered the accused to pay one of the women who was raped Rs. 500,000 as compensation and in the event of the accused failing to pay the sum ordered to add another 5 years to their sentence.

One of the accused in the rape is still absconding and the case was heard without his presence.

“One and only case where a Tamil woman survived the military rape and pointed at her rapists in court.” a women’s rights activist told Colombo Telegraph.

    This is absolutely scandalous. The war heroes should never have been brought to court. They were innocent of this heinous crime. They always carried the human rights manual wherever they went. I am absolutely sure they will be released and their good names restored on appeal. This is an important example why the UNHRC investigation must be opposed by all sinalese patriots.

    Gomin Dayasiri, the saviour of all “unjustly” accused war heroes, please come to their rescue. Wimal Weerawansa must start a fast unto death and demand the release of the war heroes.

      The government made a big mistake of having this case heard in Jaffna courts under a Tamil judge, where witnesses were able to attend courts and testify without any fear or inconvenience.In principle offences committed in a paticular area must be tried in the courts which is exercising jurisdiction over the area.

      It should have been heard in Colombo courts under a Sinhala judge with a pan Sinhala jury, where the case would have been taken ex-parte as the witnesses would have found it difficult to attend due to cost and due to fear of repercussions. Under these circumstances then one could imagine what the verdict would have been.

      In my experience as a medico-legal officer working in war zone,I have found that the entire judicial mechanism in Srilnaka is institutionaly racist, where Tamil victims cannot get justice. In all the cases I had attended Sinhala perpetrators were unashamedly discharged by judges, despite incriminating eveidence against them.

        Those who have made negative comments on my posting, please note that women who had been subjected to sexual violence in Mannar have written to the president about their case which happened in 2001 where the suspects are from the Police and the Navy. The case was heard in Anuradhapura court under a Sinhala judge, where one of the complainant has gone missing probably killed by agents of the government, while another had gone abroad due to threats of murder. The judge without proceeding with the case had put it down saying that some of the complainants are now missing. This the justice that Tamils will recieve under Sinhala jurisdiction.

        Even among Tamil judges only a few brave ones
        will act fearlessly. There are others who will be worried about
        the SLA and their security, physical as well as career related.
        There were judges who felt they had to toe the line of thugs like
        Devananda.

      If they were really Heroes, they should not have tarnished the good name of the Armed Forces and the Country.

      If they cared about the Armed Forces and the Country, they would NOT have committed those crimes.

      Are they war Heroes, Criminals or Traitors?

      They are criminals and Traitors to the Armed Forces and the country.

      Punish them for their crimes, if found guilty.

      So you approve what the soldiers did? So you agree the Sri Lankan judicial system never impart justice and so the Tamil victims are right when they demanded foreign judges having lost faith in the Sri Lankan judicial process. Why don’t you too to demand foreign judges to inquire your war ‘heroes’?

      If you are really mean what you have written here and you were sober when you wrote, and which has come on print now, what opinion are all the readers around the world would have about the mindset of the people like you? I do not know who you are and what religion you practice and I feel your religious sermons are written in toilet paper.

          So even in your crooked thinking the Sri Lankan judiciary had failed and so you are with me and lets join hands and support an international investigation comprising of foreign judges and so all could get justice including the ‘war heroes’ whom you think had miscarriage of justice. If that is so then I truly apologize.

    A young mother Anita Annalingam of Kokkuvil was raped, murdered and her body dumped in a disuse house in Kottady, Jaffna. The senior Muslim member of the army who is said to be still working in army without any investigations being carried out against him. The family of Anita is said to have been threatened by the army not to go public about the murder.

    This is positive, but more needs to be done. This woman and her family were continually harassed by the security forces through the trial. Who was the commander of those forces? What action will be taken against him for intimidation and harassment of a victim.

    Where is Sumenasekera – he will enlighten us. I am sure he will prove that these soldiers were convicted as a result of the machination of the Tamil Diaspora conjoined by Western powers who want to discredit Sri Lankan war heroes who always went to war with a rifle in one hand and the human rights manual on the other.

It will be pretty hard for the judiciary to function properly without the help of the media. The media has a responsibility to orient the opinion of the population in a matured manner.

    Anyway this is all to hoodwink the international community into believing that srilanka has a justice system that can investigate itself and does not need foreign intervention.The timing of the first and only case so far since the war began speaks for itself.Also read jayadevan’s comment about the muslim officer.

    All decent military personal will support criminal action against rapist who were found guilty after due process. Don’t think in terms of ethnic or religious paradigm. Go in front a mirror and ask what your reaction would have been if these four persons had raped your mother/wife/sister or your daughter.Will you pardon them because they are servicemen?

    Rape or any serious crimes must be condoned and criminals must be punished by the court of law regardless of whether perpetrator is Tamil, Sinhala or Muslim. Criminals must not be glorified. But it’s very encouraging to see the positive developments in restoring civil and military justice after bloody 26 years of war.

    It’s deeply saddening to accuse all Military or Security forces and Tmail rebels as all evil with political motivation. Although Tamil, I had the previllege to live and share with GoSL Military officers at length, and they were undoubtedly best of friends, great mates, professional soldiers during thick and thin times in hostile environment.

    So let’s please differentiate evil from good humans, and ideology and democracy from hatred filled by third grade politicians for their power and wealth.

    If we demonstrate such maturity, Sri Lanka, I call it Ceylon will beat Singapore in ten years.

      This kind of attitude to such heinous crimes gave impunity to perpetrators of such crimes not only to commit crimes again and again but also encouraged others also. With the demise of the Rajapaksa regime I hope more re of these criminals will be brought to justice.

              I condemn the crimes of both the LTTE and the government soldiers. The LTTE commited many heinous crimes similar to the government military’s but the LTTE never committed rapes – a far worse abominable crime against a vulnerable and weaker human beings – women.The men who commit these crimes should be punished by castration not just jailed!

    What a load of rubbish. Rape does happen in war time & getaway with it because there are usually no witness & it is said that the Japanese provided Korean / Chinese ‘comfort women’ for their solders in WW2 but it’s a crime in the 21st Century.

    This goes to show where the accusations can be proven using real evidence, the perpetrators are found and brought to justice in Sri Lanka regardless of who they are, unlike the claims made by We Thamizh.

    Unfortunately that part about proving accusations using real evidence is going to be a problem for We Thamizh, unless We Thamizh can come up with evidence to prove fairy tales :D Another nail in the coffin of the Demezh Eezham project :D

      The same way the state prosecuted the criminal masterminds of the various pogroms in 1958, 1977 and 1983? Or during the second JVP insurrection in the late 1980’s?

      This particular rape incident happened a few years after the end of the war and some evidence could be presented in a court. The crimes that were committed during the long years of war require an altogether different approach.

      Ex-SLA soldiers–especially one with the Western name David Blacker under a Tamil Brahmin alias–can hardly expect anyone to take them seriously when it comes to investigating ghastly crimes of the very institution they belonged to.
