From Easter Justice To Wider Justice

There has long been speculation that the Easter bombing of April 2019 had a relationship to Sri Lankan politics. The near simultaneous bombings of three Christian churches and three luxury hotels, with a death toll of 270 and over 500 injured, by Muslim suicide bombers made no sense in Sri Lanka where there has been no history of conflict between the two religions. But a political motivation was suspected on the basis of who would be the beneficiary of an otherwise senseless crime. The bombing immediately discredited the government in power at that time, saw the nomination of the opposition presidential candidate soon after, and paved the way for the crushing defeat of the government at the national elections that followed in a few months.

In Parliament last week, Leader of the House Bimal Ratnayake revealed a political strategy to create the conditions for the change of government that took place. His remarks corresponded to suspicions that the attack was not just a failure of intelligence, but the result of deliberate manipulation by those in the political sphere. What is new is that these suspicions are now being stated clearly and officially at the highest level of government. Minister Ratnayake said, “They started this in 2013 by creating and maintaining Sinhala and Muslim extremist groups through intelligence agencies. The culmination of this was similar to the Cambridge Analytica incident.”

The Cambridge Analytica scandal involved the unauthorized harvesting of personal data from millions of Facebook users to build psychological profiles and micro-target voters for political purposes. The data harvested by Cambridge Analytica was used primarily to influence the 2016 U.S. presidential election in favour of Donald Trump and the 2016 Brexit referendum in the UK. The company also allegedly worked on elections in Kenya, Nigeria, India, Trinidad and Tobago, and several other countries, using psychographic profiling and targeted digital ads to manipulate voter behaviour.

Cardinal’s Consistency

If the allegations about the Easter attacks prove true, they would constitute one of the most unprincipled examples of violence being used for political purposes in Sri Lanka’s post-war period. To use fear, death, and destruction to pave the way for a political return is totally unacceptable and without conscience. What makes the current moment different from earlier efforts to deal with such unacceptable actions is that there now appears to be political will. There is a sense that the present government is committed to follow through with investigations, even if the implications reach to the highest levels of power.

It is significant that the government has taken the controversial step of reappointing retired officers Shani Abeysekera and Ravi Seneviratne, both of whom were known to be top class police investigators who were removed from the investigation process by previous governments, to once again lead the investigations. They are both controversial in that they briefly joined the government side’s political stage during the last presidential election campaign. Minister Ratnayake justified their reappointment on the grounds that Cardinal Malcolm Ranjith made the request. It is in this context that the current government’s willingness to act gains it credibility with the Catholic community, which bore the brunt of the attacks.

The role of the Catholic Church and Cardinal Malcolm Ranjith in consistently pushing for accountability in the Easter Sunday case is commendable. From the outset, the Cardinal was a vocal advocate for justice for the victims of the bombing. His calls for transparency, a credible investigation, and the identification of those truly responsible have been persistent and unwavering. Over the years, previous government leaders made promises to find the culprits and masterminds in response to this pressure which the Cardinal publicly welcomed. But those assurances, like many others before them, did not materialise in the form of tangible outcomes.

Ending Impunity

Progress in the investigation of the Easter bombings comes at a time when the government has already made forward movement in pursuing economic accountability. High-profile arrests and legal actions against formerly powerful politicians for corruption are being carried out in a way never witnessed before. For many decades, impunity has been the practice in government at the highest levels. Economic crimes and political violence in which the protagonists were suspected to be of government-origin were pursued only half-heartedly in the past. Charges were often framed, suspects were taken into custody, but invariably the process broke down mid-way and the suspects were released. This time around those who have been charged have had their cases taken to court where they have been given exemplary sentences.

In the case of the Easter bombing, the testimony of survivors and the documentation of intelligence failures are now being brought back into the spotlight. Investigations into key actors, including the alleged role of former paramilitaries turned politicians like Pillayan show that this is no longer a nominal exercise. The challenge for the government is to ensure that this momentum does not wane. The legal and institutional frameworks need to be allowed to function without interference. No matter how politically sensitive, the Sri Lankan people need answers, and more importantly, justice.

Sri Lanka has suffered for decades from a culture of impunity that has bred cynicism and mistrust. The present government has taken early steps to reverse that trend. It is too early to say whether this will lead to full justice. There are indications that the government is sequencing its priorities: first, economic crimes and now political crimes like the Easter attacks; later, possibly, war crimes. The wounds of the war years are deep and divisive. Pursuing accountability for wartime abuses may demand more political capital than the government currently possesses or wishes to expend, and it is likely that such steps will be undertaken more cautiously—and later.

In the case of the Chemmani mass graves the government seems to be allowing the judicial investigations to proceed independently, unlike in the case of the Mannar and Matale mass graves by previous governments. Permitting the Chemmani probe to proceed signals that the era of blanket impunity might finally be drawing to a close and the integrity of Sri Lanka’s democratic institutions is being secured. If a crime like the Easter bombing, which has defied a satisfactory conclusion for over six years is successfully investigated and prosecuted, it may open the space for deeper scrutiny of the past, including the war years. It is up to the independent institutions, judiciary and civil society to push this process forward.

              New rules and regulations pertaining to severe patients and the acquisition of medications for them have been put into place.

              The conditions of the emergency patients should be reflected in the regulations.

              The Ministry of Health doesn’t appear to think things through before asking them to wait to fill out forms before purchasing them.
              Even beach boys wandering the west coast would have had better systems than Nalinda Jayathissa or similar men whose profiles were exaggerated by the country’s abusive media.

          Mr. Ranil is no match to Dr. Mathir who is a man of his very own. Unlike the former, latter is a rational thinker with a radical progressive mind. IMF is a profit based business entity. It is a dominant factor behind IMF thinking. Rail;s mindset is highly limited. He chose to flow down the stream with the current. JVP/NPP was vehemently opposed to that strategy. They have now done a complete reversal and following the footsteps of the former with religious faith. The misled voters have to rethink.

            You might be correct, but we cannot have any other leaders with RW’s level of expertise. We are also unable to grant a contract to produce genetically modified leaders.
            Real TALENTED leaders with real potential lost their lives in the thirty-year civil war.             HP. The IMF “Deal” was made LAW of the land by the Parliament. Remember how the then Parliament and the then President approved the “Agreement” and subsequently “Imposed” all the financial criteria to be achieved. That commitment was made a Law of the land. What else could the NPP do, other than to comply?

            If anyone (who supports Ranil W’s IMF deal) says AKD is implementing what Ranil W has earmarked, shouldn’t they be happy? Of course, the NPP said that it would redefine the terms of the agreement. The NPP didn’t estimate the “TRAP” properly, and they are caught in it.

            Any suggestions to abrogate the IMF deal?

              In my opinion, HP is objective and analytical, which allows him to see things more clearly than you do, Douglas. You believed that after “89-92-barbarians” were your FUHRERS, all dreams would come true: Nothing appears to be going well as of right now. Faux pas fall behind one another because they lack the fundamental knowledge necessary to take any action, much less make significant changes. They are far from fulfilling the promises they made during the pre-election phase. Today, people wonder why no other governments have kept the most important pacts and agreements signed and completed with as much secrecy as the AKD administration: Whether you like it or not, you must accept the facts of the day. Today, not even 0.8 million of their 6.8 million people support them.
              By the way, my friend, Dr. Dewasiri seems to be strongly opposed to his former colleague, who is currently the country’s premier. He is very clear in saying that he cannot accept Dr. Aamarasooriya’s performance as education minister.               To say that the IMF agreement is the law of the land is not correct. It is not an agreement between two States, but an agreement between a bank and a borrower, with conditions on how the borrower spends the money, because the bank wants its money back.
              Sri Lanka can withdraw from the agreement any time. But it will immediately lose all credibility with the rating agencies. There is no reason why it can’t withdraw, when even the Police powers in the Indo-Sri Lanka agreement aren’t granted.
              The NPP should not have used rash promises to win the election. They said clearly that they have alternative policies. Where are these policies now? Do you, Douglas, know exactly what these policies were? Would they have worked?
              There is no harm in admitting you were fooled.
              I for one am happy that the NPP is going the way it is.

The JVP itself bears a lot of responsibility because it opposed reforms to State-owned Enterprises all along. It opposed reform of the CEB, the CPC, and Srilankan. It opposed reforms in the Railway. It opposed Education reforms. So, how can one honestly expect the JVP to solve problems that it was very much part of? Even now it is propping up Srilankan with public money.

Before the go-elected government, salt production was thought to be a cake-eating activity. What happened to it?

                    All those who disagreed with AKD, which makes up 58% of the population, should have the opportunity to support the reforms or new ideas being proposed for changes in school education, not just NPP supporters. But now it’s in front of their eyes.

                    Why does the leadership not think about that situation? A nation’s economy is comparable to the healthy flow of blood in our bodies. We can’t feel it if it doesn’t ciculate correctly. Similarly, the economy’s growth rate would drop from 5% to 3.1% per year. How would we handle the situation in 2028, when we are under pressure to fulfill our debt repayment obligations?

                    Today’s ministers, including AKD, have come under fire for going too far in accusing everyone else of being a thief and claiming that they are the only ones with the ability to save this country. But today, the same audience is asking loudly what alternative options the AKD-led team had at the time, and they put their scale above that. None of them understand shamelessness either. They continue to blame others for their failures, one after the other. Ultimately, whether they realize it or not, people in this nation are going through a very difficult period.

Read through the Audit Reports in detail and you will find “HOW” and “WHO” made those State entities make such colossal losses. You refer to Sri Lankan Airlines. One time it was making profits and paid taxes to the Government. You know how it was brought under the Chairmanship of the Brother-in-Law of MR and what happened to it. Now he is charged with some mismanagement affairs. But, I don’t know why he is not charged for much more bigger frauds together with Kapila Chandrasena – CEO.
                    You refuse to watch the drama unfolding at the COPE meetings these days. Why? Because you would be ashamed to see how these State entities have been robbed by both the “Heads” appointed by the Rajapakse/Ranil regimes and their goons. Wait for the next Audit of these SOCs under NPP administration to see how those are recovering slowly.

              Dear Douglas. Ranil never received a mandate from the people. He was a people’s reject. Therefore, he did not command the wishes of the people. Gotabaya on AWOL used him as a loin cloth to cover his nudity. AKD/JVP/NPP rightly and vehemently opposed his moves.           I am sure that I share some DNA with Charles, however his is mostly German, Russian, Danish and Greek. Most of the European Royals interbred and are all related to one another.
          As I said before one of my distant relations gave Charles’ Ancestor Victoria a “good seeing to”. The Royals have a reputation for” playing away from home”.                 I wouldn’t go that far with audio. I just listen to what sounds good to me. Since I haven’t heard the original performance, (and can’t afford to do so) I assume it’s close enough.
                The guy with his own transformer is a bit over the top. It’s still connected to the noisy grid. A battery-powered setup would be guaranteed noise-free 🙂

                  The Guy with the separate Transformer would still have problems if it supplies all of his House. Every time the Fridge Compressor kicks in or the Washing Machine is operated he will have Harmonics and Noise passed to his Amp.
                  I used to think that the Grid was pretty clean in the UK until I did some 24 Hour Testing using a Fluke 434 three-phase Power Quality Analyser. We were having trouble with Glitches shutting down some Computers. When I expressed some surprise about the noisiness to the Local Energy Supplier Engineers they said it was quite normal. The Glitch problem turned out to be Swans hitting the overhead line crossing the Severn River.

        The average person in SL, in my opinion, makes assumptions that don’t apply to us. Is our country a civilized one? Not in my opinion. High crime rates continue to rise even after the Civil War has ended. Two weeks ago, two young people were killed by police who thought they were actual criminals, but they weren’t, according to one of my Kaluthara friends. The number of domestic crimes is also rising quickly. The worst crimes are those committed by police. Therefore, even though 6.8 million people in this country elected the most promising lawmakers, justice is still the same and nothing has changed. Shame-Lanka, in my opinion, is still the same under the current leadership, which was put in place to bring about significant change.

          Here in Central Province my Nephews (all properly licensed Drivers) call the Traffic Police “Tax Collectors”. Poverty doesn’t seem to be getting any better. Possibly one of the contributory factors towards the Crime Rate. Back in the UK, my Sister reckons that there is a direct link between Poverty and Domestic Violence.

            You are absolutely right when you say that poverty and crime rates are closely related.
            This is the reason why some CT commenters, including myself, believed that the AKD leadership would significantly slow down the implementation of ongoing recommendations that the short-lived previous government had put in place. But they argued that the RW-led previous government and its smaller cabinet of all the powerful ministers were not legitimate.
            The saying “cat is suitable if she catches the mice” is part of the Sinhala vernacular. Similarly, putting aside all party ideologies, all of the strong and capable ministers with years of experience ought to have united to partially restore the economy.

            Following that, voters could have chosen the leaders they wanted.

            While travelling to Frankfurt am Main for last weekend, I just so happened to talk about the current state of affairs with a GOOD FRIEND. He also believed that although change is occurring, it is happening very slowly. Can we currently afford to take a “snail-walk”? It would have been the behaviour of puberty-affected teenagers to label everyone else as thieves without obtaining a sufficient source of evidence, but JEPPOs did so in order to seize power. They are now lagging and unable to fix even minor problems.

But given the economy’s decline from 5% to 3.1%, how can the state afford to give them raises?Given the dire circumstances, the incumbent president and others should be extremely clear about the priorities.

    All mass killings in Sri Lanka had political objectives. It started with the project of making the estate workers statelesss and then went onto the Sinhala chauvinism of Bandaranaike and others. The JVP uprisings and the sequels to it also involved political violence. The only way to preventing repetitions of such violence is to ensure accountability. The idea that those who killed people at Chemmani and other places are
    war heroes is not one that should be perpetuated. They are war criminals who should be tried. It is the only way of ending the historical falsehoods and ethnic fictions on which our politics of hatred has been built up over the years. The international community must have a role in ensuring that justice is ensured.

    I don’t know how many in SL are aware of the sting operation carried out by Channel 4 investigative team which led to the criminal charges against CA & their eventual demise. C4 team used a ‘SL representative of a powerful political family keen to get back into power’ in their sting operation &, obviously,, CA would do their homework prior to the meeting, therefore, C4 had to provide a credible ‘candidate’ & the ‘client’ appears to be very similar to the Rajapakses. At the meeting, which was secretly filmed, the boss of CA boasted how they had ensured the election victory for their clients in various African countries by using subtle intimidation, discrediting the opposition with fake news & even blackmail. Considering how GR came to prominence from total obscurity, the CA bag of tricks seems very plausible in his victory too. If such a dirty tricks campaign was carried out, the scandal would shake the entire political establishment in SL which is probably why successive govts. have been soft peddling the investigation. Will the present govt. have the guts to investigate despite the possibility of opening a can of worms?

Later Muslims was used as “muslim “oorkaval padai” called as village security force during the period of war against Tamils in the East along with the Tamil militants who joined the Sinhalese military against Tamils. Until 2001 LTTE was powerful in the East but in the East Muslim politicians and Muslim militant groups were helping Sinhalese military or Sinhalese governments. Sinhalese politics wanted to create a division within LTTE and they were successfully divided LTTE by using regional division buy giving ministerial roles and other benefits including a special passport to travel uk. They were used to make murders of Tamils.
