Gota’s Inadvertent Admission Of Complicity In The ‘White Flag Massacre’

When asked “Do you really believe the proposed judicial mechanism can help address accountability issues?” former Defence Secretary, Gotabaya Rajapaksa (GR), has started talking about “one of the major accusations directed against the army” – the “execution of surrendering LTTE cadres during the last phase of the offensive on the Vanni east front.”

I am quoting his own words published by Shamindra Ferdinando in ‘The Island’ (7 October 2015). The interview is titled ‘War crimes probe Gotabhaya speaks out.’ As a teacher, I am well aware that there are people who fail to answer questions directly and sometimes we call them ‘rigmaroles’ or malle polls. However, there are other psychological reasons why people become obsessed with something, even when something else is asked. The possible reasons can be ‘guilt’ or ‘over enthusiasm.’

However, it should be admired that GR has been straight forward and bold in giving this interview particularly at this juncture. As the interviewer has stated “the former Defence Secretary now faces the prospect of a no holds barred judicial investigation never held in this part of the world.” He may also be believing that he has done ‘nothing wrong’ according to his ‘limited knowledge and beliefs.’

It is interesting note that he has not disputed the validity of the now proposed ‘judicial mechanism’ whereas he has been apparently opposing purely an ‘international investigation’ before. Even he has suggested that the “The proposed court [could] call the then Norwegian Ambassador in Colombo Tore Hattrem (present State Secretary at the Norwegian Ministry of Foreign Affairs) to verify accusations.” The interviewer however has noted, that in the past, “The Gajaba Regiment veteran strongly opposed an external investigation into Sri Lanka’s war which he quite rightly believed was an internal matter.”

GR has admitted that the “Widely dubbed the white flags killings, the allegation brought the Sri Lankan Army to disrepute.” However, according to him, the army hasn’t done anything wrong because “There had never been an agreement or an understanding between the government and the LTTE for the latter’s surrender though various interested parties alleged execution of surrendering persons.”

But for surrender, there is no need for an agreement or understanding between two parties and in this case ‘between the government and the LTTE.’ Of course the Ceasefire Agreement (CFA) was now defunct and abrogated. According to Jan Romer (Killing in a Grey Area between Humanitarian Law and Human Rights) the customary international humanitarian law (IHL) pertaining to non-international armed conflicts rules the following.

“Attacking persons who are recognized a horse de combat is prohibited. A person horse de combat is:

(a) Anyone who is in the power of an adverse party;

(b) Anyone who is defenceless because of unconsciousness, ship wreck, wounded or sick; or

(c) Anyone who clearly expresses an intention to surrender; provided he or she abstains from any hostile act and does not attempt to escape.” (p.74).

One difference is that in this case the matter is not about ‘attacking’ as Romer said, but alleged killing or massacre. More pertinently, what should have applied in this case is the principle C, the protection of ‘anyone who clearly expresses an intention to surrender.’ Romer further says,

“Surrender requires that attacked person to discontinue his/her participation in hostilities, in particular, by resisting or defending him or herself. Surrender is not bound by strict formalities. In general, a soldier surrenders by laying down his or her weapons, raising his/her hands, or waving a white flag.” (p. 77, with my emphasis).

The surrender does not require strict formalities. Does not require an agreement between the two parties to the conflict or war. And in this case, did not require the dictates or ruling from GR who was in Colombo (I may add in an air conditioned room!). It was a simple procedure, of course with caution, which should have been followed by the commanders or whoever in charge on the ground.

The following is the narration that GR has given about his part on the saga which might not be the full story.

“On the night of May 16th, 2009, Hattrem visited me at my official residence, Baudhaloka Mawatha, where he claimed that LTTEer Pulithevan had offered to surrender along with some other cadres and their families as all senior leaders were dead by then. Hattrem had been in touch with Pulithevan over the phone. However, arrangements couldn’t be made for the surrender as Hattrem failed to get in touch with Pulithevan to know the identities of those willing to surrender. Primary objective of an investigative judicial mechanism is to verify accusations made by various parties.”

Note that ‘all senior leaders were dead by then.’ It is commendable that GR has accepted the objective of ‘investigative judicial mechanism to verify accusations made by various parties.’ There is no question that there can be some questions that Hattrem has to answer as well.

However, there cannot be any dispute that GR was placing unnecessary preconditions or one might say obstacles from Colombo for the purported surrender. Of course there can be some reasons why he was doing that, and he has explained some of the matters in his interview. However, those are not necessary under the international humanitarian law and what were at stake in this instance were lives, not only one or two but of several.

We at least know or have credible evidence that at least the lives of Pulidevan and Nadesen (and their families) were involved. For some people, those lives might not be worth, but those are not the premises of the international humanitarian law or our civilized human conscience. Killing of those who surrender is barbaric. What we have lost is also valuable information to know the ‘truth’ from the LTTE side.

This is not the first time that such things have happened in Sri Lanka. We know that a similar fate happened to Rohana Wijeweera (the JVP leader), who was under state custody, whatever the crimes he himself had committed. The impunity has continued. That is another reason why these incidents should be investigated and investigated thoroughly.

GR has said, ‘for the failure of the surrender arrangements,’ passing the buck to Hattrem, “However, arrangements couldn’t be made for the surrender as Hattrem failed to get in touch with Pulithevan to know the identities of those willing to surrender.

It is a strange order to rule that ‘the identities of those willing to surrender’ should be known or revealed before the acceptance of surrender. This was 16th of May 2009 evening, two days before the body of the LTTE leader Prabhakaran was found. This was a period of extreme uncertainties. However, the demise of the LTTE was exceedingly clear. It is not revealed in what form the identities of those who wanted to surrender was required. The decisions were taken in Colombo. Verifications were obviously problematic and communications were exceedingly difficult with those who wanted to surrender. GR was asking for the impossible.

The interviewer has very clearly asked, “Q: Who wanted to establish the identities of those wanting to surrender?

The answer given is also very clear, “A: That decision was mine.”

It is apparent that the decision was given over and above the international humanitarian law and in violation of international humanitarian concerns. The alleged ‘massacre’ was the result, extent of which has to be determined.

Smith responded to a query directed by Maj. Gen. Metha to Maj. Gen. Shavendra Silva at the inaugural defence seminar on June 1, 2011. The proposed war crimes court should the former US Defence Attache here to explain his position. The former Norwegian ambassador Tore Hattrem, too, should be ‘invited.’ The Norwegian can explain whether there had been any other offer on behalf of the LTTE to surrender other than the move made through Hattrem. Lt. Col. Smith knew what he was talking about TWO YEARS after the war. The US worked very closely with the previous government to defeat the LTTE. The Pacific Command made available intelligence required to hunt down four LTTE ships…..

      Mr. Ferdinando,

      Well, invite Vijay Nambiar and other personnel of the UN who were privy to the efforts, Palitha Kohona, Basil and Gotabhaya Rajapaksa, and the son of Chandraneru who was then a TNA MP and says he acted as an intermediary between the surrendering LTTE and Basil.

      By the way, can you tell us why, when and how you started making the Island a willing propaganda tool of GR? Were you under white van threat, threat from the owning family ( Kumara Welgama?) or did you act of your own volition to carry baloney from GR as front page news?

      Dear Shamindra,
      There is no point in trying to cover up things. It is well known that order to kill the surrendering LTTE officials was given by Gotabaya with the concurrence of Mahinda. Shavendra Silva who was entrusted with this job, got his trusted men in his battalion to carry it out. No one is blaming Sarath Fonseka for this, but he must speak the truth and if he says that he does not know anything about it, he ia a liar.
      There may be other field commanders involved in this, but the truth must be told, especially when people like the Christian priest who was in the group who has no involvement in LTTE had also been murdered. Not only those with command responsibilty, but all thise who carried it out must be brought to justice. I have worked as a medico-legal officer in war zone in early part of the conflict and been a medical witness to the atrocities commited by armed forces on non-combatant Tamils. None of these perpetrators were punished. In some instances, cases were heard in Colombo under Sinhala judges who without any shame declared them as either justifiable homicide or collateral damage when there was incriminating eveidence to convict them. I can remember you as a journaist in Island newspaper, taking trouble to whitewash these dastardly crimes and praise these criminals as heroes. From my past experience I will state that Tamils will never get justice under the present Srilankan judicial system as it is institutionally racist.

        Among the same gossips who told us that there was an attempted coup soon after the Jan 8th election ? Speculation cannot and does not substitute for evidence. I wonder what your ‘intelligence’ is to say that Fonseka is lying, as you allege. The Colombo gossips again, (known as OMIs in other circles) ?

        I agreed with what I read of the beginning of your comment, but I cannot agree with the last two sentences.

        I don’t know “shamindra ferdinando” but yes, I’ve read lots of what he’s written, I’m sure, without paying much attention to his consistency or otherwise. The fact is that we had a horrible war, and we didn’t know how to end the thing. I am running out of time.

        The problem with you (and you are essentially a good man) is that “past experience” is more important to you than present reality.

          Sarath Fonseka has already told lies that he was out of the country during the last few days of the war and does not know what happened despite the fact that there is evidence that he was briefed about the ground situation while abroad. He has started singing a new tune that since the present government has so far not proved any wrong doing by Mahinda Rajapakse, he is taking his side. Is this not sheer hypocrisy and opportunism. Do you ever expect this dishonourable person to tell the truth. The crimes committed by these individuals as mentioned is not a gossip but was documented in the UNHCR report, but subsequently removed at the behest of Srilanka. Secondly my past experience about Sinhala injustice to Tamils will continue unless there is intervention by international community and thus present reality is the same as the past. Look at what the government told in the UNHCR and what they are telling now to please the Sinhala masses. They will try to hood wink the international community under the pretext of Rajapakse coming back to power and military upsrising if members of securiry forcec are punished. This will be a sham trial and nothing tangible will come out of it. The opinion of the Sinhala people is that the inquiry should be solely internal and that no member of the security forces to be punished. Please be patient and let events unfold without finding fault with me.

            Your comment implied that you had evidence to what you alleged. Yet you have produced none but inanities and a list of allegations from UNHRC – a list put together by ‘interested parties’. Therefore your allegation still remains an allegation – baseless.

              UNHRC has produced the report with evidence implicating top people in the government and armed services. That is why Srilanka wanted the names suppressed. If you are honest why not request UNHRC in the name of jutice to release the un-edited report. Sinkalese are frightened to face an independant international panel and are demanding a local court to cover up the crimes.

                Why not request the UN to release its classified report on the Vanni battle? Darusman report admitted that particular UN report which dealt with situation in the Vanni during Aug 2008-May 13, 2009 placed the number of dead at 7,721. The Amnesty International in Sept 2011 estimated 10,000 died. UK Parliament was told on Sept 15, 2011 100,000 died during Jan-May 19 2009. Various interested parties are ‘playing’ with numbers. Anyone care to now the number of Tigers killed by the Army?

                  I assume you are journalist and hope you comply by Journalistic Dharma (standards) and be a role model to aspiring young men and women.

                  As a journalist you have a duty to unearth truth. It is not too late to investigate, find truth, help serve justice, …..

                  Glorifying war criminals will only encourage them to commit more crimes where they live.

                    Yes, it is YOU whom I wish particularly to address. You have said,

                    I don’t know who exactly a “Sinhalese” is. For me, all of us are “human beings” pure and simple. I have called myself “Sinhala_Man” to get a message across to about 5% of the population of Sri Lanka who are obsessed by something called “ethnicity”. And you guys, “Tamils” as well as “Sinhalese” have managed to get another 90% of Sri Lankan citizens in to a tangle as a result of the nonsense that you spout. I’m also a guy full of failings, but I try to be rational and objective. Given the fact that I, and all those closely related to me, speak only two languages (some only one, actually), and those languages being Sinhalese and English, AND my definitely not being a Caucasian, I’m always classified as a “Sinhalese”. When, in daily life, I try to assert the sort of thing that I have put on the web here, people get angry with me, thinking that I’m being frivolous.

                    When YOU get cornered I find that you demand the identity of the guy who disagreed with you. You did that to me, and I gave you even my e-mail address, but I haven’t heard from you yet. You also said that you would check with our mutual friend Nirmalan, since you doubted my credentials.

                    Well, Prof. Mahesh Nirmalan of Manchester University has written to me as follows on September 17th.

                    “As I am not there in person, I think it is wrong for me to comment on affairs related to the running of the School except in very general terms…….I am sure you would understand the reasons for such a non-committal approach.”

                    What he has said to me is confidential and I have quoted only a bit that you will find inoffensive; but let me tell you this much. The subject of that e-mail is Y0U! He does have sympathetic things to say about you, but basically he wants me to excuse your occasional lapses in to lunacy on the grounds that you have, on some occasions, been treated unfairly.

                    Now Nirmalan is one of the 5% of “Sri Lankans” who are sane. Actually, I’m not sure what his citizenship now is: very probably “British”, like yours, I guess. So, it’s easy for you to spout things from Old Blighty, but I’m here in rural Sri Lanka, with lots of terribly underprivileged “Estate Tamils” around me. And I can tell you this: my family and I have probably suffered much more than you guys have: just check with Nirmalan. All the badges we give ourselves mean little when talking about the issues now at hand.

                    At the end of the day, it seems increasingly true to say that we are all ignorant beings who take ourselves far too seriously:

          The army paid a very heavy price to bring the war to a successful conclusion. Nearly 6,000 officers and men killed and missing in action during eelam war IV (Aug 2006-May 2009).Thanks to the military, forcible conscription of Tamil speaking children stopped on May 19, 2009. No more suicide cadres, end to explosive devices in buses and trains, claymore mine attacks on buses and political assassinations. Tamil speaking people are free.

            Since you seem to keep a meticulous record on death of armed forces could we now invite you to give body count of unarmed civilian who were brutally killed by both armed forces and terrorist since 5th April 1971.

            In all your response you have shown deep emotional connection to armed forces some or all of them had committed war crimes and crime against humanity. Will you now show some sympathy towards the unarmed civilian, both in the North as well as in the south who were unnecessarily killed, maimed or made to disappear over the past 44 years?

            It takes moral courage to accept, own up, say sorry, beg mercy, and move on, what had really happened to those hapless people. In that process journalists have a moral responsibility to unearth truth. Well Ronald Lee Ridenhour, Seymour Hersh, John Pilger, and … others have had the moral courage to report the My Lai massacre and other atrocities committed by US in Vietnam and elsewhere.

            However it appears almost all “Popular” journalists who reported the war need counselling for traumatic stress disorders not for witnessing a brutal war but for excessive celebration of war criminals and under reporting the crimes.

        Many influential Tamil people never opposed the LTTE. They remained silent as long as they felt the LTTE could achieve eelam. If not for the former President, the LTTE would have succeeded in its despicable objective. Did any Tamil condemn Amirthalingam’s assassination? (I visited his residence soon after the multiple killings. Tigers killed Vettivelu Yogeswaran, too) The assassins used peace talks with President Premadasa to trap political veteran).Years later, Tigers killed Yogeswaran’s wife in Jaffna. Tamils feared to talk in public.Tamils should be grateful and appreciate the previous government’s efforts against terrorism.You should seek an explanation from the Tamil media and those who had secured funds from various embassies and INGOs to propagate lies. They influenced decision makers. A list can be posted courtesy the Norwegian embassy.

          How many of the influential Sinhala/Buddhists oppose the war crimes committed by the state and JVP, or the white van saga?

          In fact a few who exposed the the clan’s atrocities were made to disappear. Iqbal Athas who exposed corruption in war enterprise was forced to leave the country.

          Oh gosh here we go again.

          If not for Hindia and thirty other countries the armed forces would still be fighting the LTTE. The final war footing was initiated by the Hindians in early 2005. Even both MR and Gota on the record stated that if not for Hindia they would not have won the war.

          The veteran journalists need moral courage to accept facts as they are, however much they try they will never be able to hide truth.

        AhHa – We cannot give any credence to what you say until it has been declared it true – very unlikely though – by someone of the calibre of for example – Professor Mikel Robertts who devotes his expertise to exposing Tamil falsehoods. He knows people like you inside out and how you all suppress the vast generosity of the Sinhalese towards you.

    Remember, former US Secretary of State Hillary Clinton’s accusation that the then government used rape as a weapon during eelam war IV. The widely reported claim was made in Sept. 2009 at the UN Security Council. Thanks to US State Department decision to release her emails recently, including those pertaining the rape allegation, we now know Clinton made a mistake. The US State Department admitted its mistake six years after the original claim. None of those demanding accountability on the part of the previous government remained mum as long as they felt the LTTE could somehow overwhelm the army. They remained confident of Prabhakaran’s capabilities even after the army seized Kilinochchi. They remained silent when Prabhakaran and the four-party Tamil National Alliance in Nov 2005 deprived northern Tamils an opportunity to vote. They engineered Ranil Wickremesinghe’s defeat, believing Mahinda Rajapaksa could be militarily destroyed. Please seek an explanation from Sampanthan. Sampanthan called a media briefing in Kilinochchi about a week before Nov 17, 2005 presidential poll to announce LTTE-TNA ban.

      Issue at hand here is infamous “white flag case” ; hence no need to repeat the stuff what we already know i.e How brutal LTTE was , how many army casualties and civilian causalities, bus bombing etc .
      you been another “C.A Chandraprema , Rohan Gunaratana , David blacker , Dayan Jayathilaka ” type biased writer , what else one can expect from you ? haven’t you had an exclusive access to Gotabaya during and after the war ? what was the real reason for that special relationship which you maintained with GR ? weren’t you part of the GR’s propaganda machinery ? all most all of your reporting were biased , in fact you were yet another torch bearer for GR , remember how Basil and the lot described the 2009 war victory ? they were of the view that USA is jealous of out right victory , what a dumb argument ! like all the other spin doctors you also try to high light few dodgy characters’s quotes (Lt. Col. Smith) to add more weight to your arguments , mind you that Lt. Col. Smith’s assertion was purely personal , why pick and choose only favourable quotes ? what about hundreds of other well articulated opinions ? remember Marie colvin ? oh i know , she was a LTTE supporter , right ? what about the Tamil MP who liaised with MR during the surrender , oh yes, he is also a LTTEr right ? then what about Paltha Kohona and Vijaya Nambiar , i know they deny it now ,then what about those who actually witnessed the massacre , oh i see , they are LTTE rs right ? now we are left with Gota’s and his pals’ version , if any one dare to challenge Gota’s version , that person automatically falls on to LTTE or an NGO , right Shamindra ? we the silence masses of this island had been patiently watching and listening to your version since Nov 19 2005 , it’s over now , we want the truth , doesn’t matter who committed the crimes , real culprits must be brought to justice , period !

      PS: By the way Shamindra , why your boss is so reluctant to have an enquiry ? remember MR announcing , ” our foot soldiers fought the war with the human right charter in one hand ” baloney ? then what about that zero civilian causality policy outrageous claim ? FM Sarath F is willing to take the full responsibility for the ground battle , why on earth is he hiding behind women now ? is that because American soldiers hadn’t been punished for their countless crimes all over the world ? it’s a done deal Shamindra , truth is going to come out very soon . mind you , our very own soldiers going to testify against the real culprits !

        In early 2007, Dr. Rohan G asserted SLA couldn’t finish off the LTTE. Subsequently, he changed his position. I always believed the LTTE should be destroyed.Never changed my position. All of want to know the truth. Do away with 20 year confidentiality clause and produce those eyewitness before proposed war crimes court…prove MR, GR guilty. Strangely, some of those demanding accountability backed war winning army chief Gen. Sarath Fonseka’s candidature at Jan. 2010 presidential polls. The TNA led Fonseka’s campaign in the Northern region.Perhaps, they hadn’t heard anything bad about the army by Jan, 201o polls. The same lot backed Maithripala Sirisena’s candidature at Jan 2015 presidential poll in spite of him being the wartime SLFP General Secretary and acting Defence Minister.

          After the war possibly TNA wanted a fresh start, participating in the national politics. Are you against TNA participating in the national politics and contributing constructively to the country?

          It was not Gota’s war but Hindia’s war.

          It only shows the magnanimity of TNA leadership while you are dwelling on parochial politics.

            Don’t forget the LTTE resumed hostilities in 2006. The previous government had no option but to fight back. The LTTE quit the negotiating table in April 2003 and set the stage for eelam war IV. The LTTE move facilitated CBK taking over three ministries, including defence and calling for general election in April 2004.None of those shedding crocodile tears for civilians bothered to request the LTTE not to leave the negotiating table. Having declared the LTTE as the sole representative of the Tamil speaking people, the TNA remained mum..Those receiving millions from embassies, too, remained silent. Norway alleged in Sept 2011 Dr. Kumar Rupesinghe received $ 6mn from Norway during 2001-2004 period.

          With regards to your so called defence expert aka Dr Rohan G, who has zero credibility ,had lost the plot . who would read or listen to Rohan G , Dayan J , C.A chandraperuma et al now ? if any one listens or reads any of their stuff , that person urgently needs some professional help !

          As to your usual accusation of TNA being a LTTE proxy , the proposed enquiry would deal with them , we the general public would like to know the truth , if TNA had directly supported LTTE terrorism , our intelligence services would have gathered enough material evidence to convince the jury , so let’s play the game .

          As to your “20 year confidentiality clause ” accusation , MR is solely responsible for it ,in fact he had asked for it , it’s his baby now , had he implemented the much talked LLRC recommendation earlier , IC wouldn’t have so strict on us, we could have negotiated with them , on the contrary , how did MR and Gota behave before the international community ? remember Gota’s silly finger waging BBC interview ,where he threatened to hang Gen SF for his willingness to give evidence against the culprits ? then what about our Maha Rajano’s solemn promise to the nation , that he would even go to 1000 s of electric chairs to save the mother land ? taking all in to considerations , Maha Rajanos and his gang must come forward and face the music as real men to clear the good name of the country and her armed forces.

          Shamindra , i have seen your TV interviews , tell you the truth , there is no any difference between you and the rest of MR’s spin doctors assertion of the war victory , every single pundit tries to convince us that MahaRajano saved the country ; hence, please be great-full to them for ever and the same time don’t bother to ask unnecessary, uneasy , compromising questions , just swallow our version of the story , if anyone dares to go against their wish , that person would automatically be a LTTE supporter or an NGO , we have had it for the last 10 odd years , now it’s time for us to speak up , as i said before , whoever committed war crimes on behalf of the former ruling junta , would have to face the music now ,mind you ,few of our very own senior Army officers had gone against their own bosses and testified ,will see how this drama going to unfold , this needs to be sorted out once and for all , we must move on as a nation , Sri Lanka is a country not a person or a family ;thus ,no one can deprive our sovereignty !

              So what Shamindra ? what does it got to with us ? Suren S had been very consistent in his answers , whereas you had tried to use your usual selective quotes to get the upper hand , quite rightly, he had rejected your one sided quotes .
              you haven’t answered my question , what was the secret behind your close association with Gota ? why did he always grant exclusive access for you to conduct one sided interviews ? were you happened to be one of the lucky ones ?

                No secret. Those who believed the LTTE could eventually take the upper hand never bothered to contact former Defence Secretary Gotabhaya Rajapaksa or the then Army Commander Lt. Gen. Sarath Fonseka. They remained confident until the SLA crushed the LTTE in Kilinochchi during the last week of Dec, 2008. Prabhakaran’s earth bunds couldn’t stop SLA advance….some didn’t want to report the LTTE’s defeat.

                  Its very easy for you to say there is no secret , please back your assertion with some convincing evidence , as far as i concern you are just another C.A Chandraprema or Rohan Gunaratna type character, who were busy getting maximum benefit by exploiting the vulnerable situation . i’m still waiting for your answer to my simple question though , that was , why did Gota give you exclusive access for you to conduct one sided interviews ? weren’t you benefited from Gota ?
