ICJ Ruling On Israeli Genocide In Gaza; Stopped Short Of Ordering A Ceasefire

On Friday 26 January 2024, the International Court of Justice, ICJ, United Nation’s highest judicial organ, ordered Israel to take steps to prevent acts of genocide in Gaza, but stopped short of ordering a ceasefire.

This ruling was not something unexpected as the  ICJ, based in the Dutch city of Hague, was established by US, British, European imperial powers to serve their interests.Thus one cannot expect ICJ to issue a verdict against Israel-a settler colonial entity planted by US European imperialism in the heart of Middle East to destabilize the region.

The ICJ ruling  ordered six provisional measures including for Israel to refrain from acts under the Genocide Convention, prevent and punish the direct and public incitement to genocide, and take immediate and effective measures to ensure the provision of humanitarian assistance to civilians in Gaza. The court has also ordered Israel to preserve evidence of genocide and to submit a report to it, within one month, of all measures taken in line with its order.

South Africa, a predominantly a non Muslims country, took up the genocide of Palestinians with the ICJ while Arab dictators, sided with Israel in its genocide of Palestinian civilians.

It was clear, soon after the court’s American president Joan Donoghue began speaking, that the urgency of Gaza’s plight was uppermost in the court’s mind and that Israel had not succeeded in its bid to have the entire case thrown out.

Since early October, Israel’s sea, air and land attacks on Gaza have resulted in the displacement of around 85% of Gaza’s 2.3 million population. Those who flee the fighting seeking refuge in squalid, overcrowded shelters, with dwindling healthcare and grossly inadequate humanitarian supplies.

Judge Donoghue delivered a bleak summary of the suffering being experienced by Palestinians in the Gaza Strip. She said the plight of children was “especially heartbreaking”. Measures called for today are designed to offer the Palestinians of Gaza some measure of protection. Donoghue said the court deemed the threat of “irreparable harm” to Gazans real and concluded that emergency measures were necessary to protect the Palestinian population from genocide.

“This is a crucial moment in history to finally holding Israel accountable,” the U.S. Campaign for Palestinian Rights said in response to the decision. “One thing has been made clear on the world stage: There is vastly documented evidence that Israel is committing genocide against Palestinians.”

Commenting on the order Balkees Jarrah, associate international justice director at Human Rights Watch had this state;

The World Court’s landmark decision puts Israel and its allies on notice that immediate action is needed to prevent genocide and further atrocities against Palestinians in Gaza. Lives hang in the balance, and governments need to urgently use their leverage to ensure that the order is enforced. The scale and gravity of civilian suffering in Gaza driven by Israeli war crimes demands nothing less. 

The ICJ’s speedy ruling is recognition of the dire situation in Gaza, where civilians face starvation and are being killed daily at levels unprecedented in the recent history of Israel and Palestine. The court’s clear and binding orders raise the stakes for Israel’s allies to back up their stated commitment to a global rules-based order by helping ensure compliance with this watershed ruling, said Balkees.

“However, the ICJ decision alone cannot put an end to the atrocities and devastation Gazans are witnessing. Alarming signs of genocide in Gaza, and Israel’s flagrant disregard for international law highlight the urgent need for effective, unified pressure on Israel to stop its onslaught against Palestinians. An immediate ceasefire by all parties remains essential and – although not ordered by the Court – is the most effective condition to implement the provisional measures and end unprecedented civilian suffering.”

As expected Israel dismissed the ICJ ruling and continued its killing of Palestinians. The ICJ’s rulings are binding, but there’s no enforcement mechanism.

Friday’s ruling from the United Nations’ highest court was seen as a huge blow to the Israeli government and its top arms supplier, the United States, which called South Africa’s case “meritless.”

“This ruling from the ICJ is a massive legal defeat for Israel and its premiere defenders, the U.S. and Germany,” The Intercept’s Jeremy Scahill wrote Friday. “The question now is enforceability and whether the U.S. will openly trample international law in an effort to continue aiding Israeli crimes against Palestinians.”

Columnist Jake Johonson said “One thing has been made clear on the world stage: There is vastly documented evidence that Israel is committing genocide against Palestinians,” said the U.S. Campaign for Palestinian Rights.

The European Commission said in a statement.“Orders of the International Court of Justice are binding on the parties and they must comply with them,”. ‘The European Union expects their full, immediate and effective implementation’.

Agnes Callamard, Amnesty’s secretary general, says the interim ruling “sends a clear message that the world will not stand by in silence as Israel pursues a ruthless military campaign to decimate the population of the Gaza Strip and unleash death, horror and suffering against Palestinians on an unprecedented scale”.

BBC Diplomatic Correspondent Paul Adams said “This was not a complete victory for South Africa, or the Palestinians. The ICJ did not order Israel to halt its military campaign – an implied recognition of Israel’s right to self defence in the wake of the Hamas attacks on 7 October last year.But the UN’s highest legal body has recognised that the situation in Gaza is catastrophic”.

Crucially, it said that situation was “at serious risk of deteriorating further” before the court delivers its final verdict on the charge of genocide, a process that could take years. As a result, it made several demands of Israel, broadly in line with most of the nine “provisional measures” demanded by South Africa.

By large majorities the court’s 17 judges ruled that Israel should do everything in its power to avoid killing Palestinians, causing them serious bodily or mental harm, creating intolerable living conditions in Gaza, or deliberately preventing Palestinian births.

Geoffrey Nice, a British human rights lawyer, said the order places Israel in a very difficult position.Nice, who was the lead prosecutor in Slobodan Milosevic trial at the international tribunal for the former Yugoslavia in The Hague, pointed out that a complete refusal to comply with the orders that have been given will “draw hatred from all sorts of places and add to what may seem to be a public sentiment that favours Palestinians”.

    This may be true. But have the other countries come up with any better systems: judicial, givernance or otherwise; mechanisms, institutes that are comparatively more virtuous?
    .
    The irony is the former colonialists and their newer companions in crime, like the US still holds the moral high ground in the matters of such nature despite their agendas and partialities.

    There sadly are no alternatives. It will be long before the global South comes up with anything remotely similar.

      The ICJ’s preliminary rulings clearly indicate the Israelis are on the road to genocide. It called for the country to take certain corrective steps while the court continues to investigate if the charge of genocide is applicable. The ICJ’s initial declarations were immediately and insidiously manipulated by the Anglo-Saxon world, the self-proclaimed “civilized world”, so-called “defenders of human rights”, to scream out loud that the ICJ didn’t call for the war to be stopped. They were saying in other words that the ICJ wanted the war to continue.

      The ICJ did not have a mandate to order Israel’s massacre of Palestinians to be stopped. The South African lawsuit required the ICJ to investigate if “Genocide” is being pursued in Gaza. The pursuit of genocide is obvious to any sentient impartial observer. But not to Israel’s backers, the so-called “civilized world”, and “human-rights defenders”.

        The ICJ’s initial findings are a rebuke and insult to all of Israel’s supporters. Therefore, the immediate need to distort and slant its call for corrective measure to be undertaken.

        The manipulated headline was given extensive global exposure. We in the Third World stupidly follow the dictates of the Anglo-Saxon world. Our editors and reporters lack the powers of reasoning, or the intelligence, to know what the ICJ lawsuit was all about.

        Latheef Farook should be commended for highlighting moral and ethical issues through his writing. But I observe many commentator resort to insulting him and his religion. That must mean that some who read these columns have one-tack minds that are also limited in reasoning power. When you cannot intelligently debate, then hoist your sarong up and yell insults. Shame!

          I don’t mean to insult Islam or Mr Farook, nor am I in the habit of raising my sarong or even hooting but I can’t stand hypocrisy. Would you feel the same if the LTTE kidnapped & murdered border villages & the SL military followed the Israel strategy to find the hostages? I can’t remember Mr F or others highly vocal on the plight of Palestinians sharing the same sympathy for the tamils caught up in the crossfire or the govt. handling of the refugees when the SL military decimated the LTTE. Nobody talks about the Hamas killing innocent civilians in cold blood, rape & dehumanising of young women & kidnapping of old people, even small children, the fate of some still unknown. Palestinians in Gaza spat at kidnapped civilians being paraded semi naked & rejoiced at the killings, provided terrorists with refuge, even voted for them alienating the Palestinian Authority from Gaza. What happens in Palestinian territories is tragic but there is always 2 sides, so, I think it is more productive to talk about our own problems than protesting against international problems which are beyond our control.

ICJ ruling is non-binding, so nothing is going to stop Israel. Fact is that majority of Muslims want to destroy Israel, and this is their fourth attempt to do so, headed by Iran. War was started by Hamas by killing 1000 non combatants and taking hostages. War will stop if Hamas surrenders, and Muslims agree to concede Biblical lands to Jews who are the rightful owners. Divine help will come to Jews to vanquish their enemies. If you go through the ICJ determination, Srilanka has committed genocide on Tamils, and need to be punished. Worst racists in the world are Muslims and the worst racism in Srilanka is Muslim claim to eastern province, where they went as refugees 500 years ago. Muslims have committed crimes against Tamils. Please put your house in order before pointing finger at others.

    The Court Order delivered by the International Court of Justice on 26 January, 2024 on the Application of the Convention on the Prevention and Punishment of the Crime of Genocide (“the Genocide Convention”) in the Gaza Strip (South Africa v. Israel) is a historic and decisive victory for South Africa and Palestine in particular, and also for the peace loving people in the entire world who helplessly watched Israel’s genocide in Gaza for 110 days.
    Given the fact that the case is still at the preliminary measures stage, the ICJ ruling, which has binding effect, has presented not one, but several victories. And, also some of the words used in the Court Order carry a lot of weight that can be used in support of Palestine’s long term struggle to be recognized as an independent state.
    First of all, I sincerely thank President of the International Court of Justice Madame Joan Donoghue for the impressive speed in which she delivered an “injunctive relief” to Palestinians in the Gaza Strip.

      Now, I will list the victories.
      1. The International Court of Justice (ICJ) rejected Israel’s request to dismiss the genocide case against them. Instead, the Court maintained that the genocidal allegations against Israel have merit, and, therefore, decided to proceed to hearing. That means, starting from 26 January, Israel is under ICJ’s direct scrutiny. This decision has landed a knockout punch to the Biden Administration, in particular, to its State Secretary who categorically denied the genocide case against Israel. This is a major victory to Palestine. On the other hand, this decision has positively and precisely confirmed the Court’s impartiality.
      2. In its 29-paged Order document, under paragraph 45 of page 15, the Court has recognized Palestinians as a “protected group” within the meaning of Article II of the Genocide Convention and that Palestinians in the Gaza Strip form a substantial part of the protected group. This is a very important statement.
      3. Under paragraph 42 of page 15, the Court has listed acts that are prohibited by the Convention. Complicity in genocide is one such act. That means, not only individuals and States, but also social media companies could be complicit in inciting, aiding and abetting genocide in the Gaza Strip.

        4. Under paragraph 13 of page 7 of the Order document, the Court has made it very clear that it is acutely aware of the extent of the human tragedy that is unfolding in the region and that it is deeply concerned about the continuing loss of life and human suffering in the Gaza Strip.
        Citing the latest OCHA report, under paragraph 46 of page 15, the Court has given a breakdown of the casualty figures, massive destruction to homes, forcible displacement of Palestinians and extensive damage to civilian infrastructure in the Gaza Strip.
        5. Under paragraphs 47, 48 and 49 of page 16, paragraph 50 of page 17, paragraph 53 of page 18 and paragraphs 67, 68 and 69 of page 21 & 22, the Court has reproduced statements made by the United Nations Under-Secretary-General for Humanitarian Affairs and Emergency Relief Coordinator, the World Health Organization, the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) and the Secretary-General of the United Nations to rationalize the urgency for provincial measures in the Gaza Strip. Under paragraph 70 of page 22, the Court has accepted that the civilian population in the Gaza Strip remains extremely vulnerable.

          6. In addition to that, under paragraph 52 and 53 of page 17 & 18 and paragraph 70 of page 22, the Court has reproduced excerpts from statements made by several Israeli Ministers and the Israeli President and the Prime Minister that demonstrated their genocidal intent against Palestinians.
          7. All of the above reasons have finally contributed to the Court’s conclusion that the ongoing Israeli military operation by air, sea and land in the Gaza Strip will cause irreparable prejudice to the rights of the Palestinian people before the Court issues its final decision. I would like to congratulate South Africa for presenting an extremely strong case against Israel at the ICJ.
          8. In this context, the Court has ordered Israel to take the following measures immediately and on an urgent basis:-
          a) Stop killing the members of the protected group, i.e. Palestinians (25,700 people have been killed so far. STOP NOW!)
          b) Stop causing bodily or mental harm to the members of the protected group (63,000 injuries have been reported so far. STOP NOW!)

            c) Stop deliberately destroying living conditions of the members of the protected group (360,000 housing units, 26 hospitals and over 200 schools have been destroyed. STOP NOW! 1.7 million people have been forcibly displaced. STOP NOW!)
            d) Stop imposing measures intended to prevent births within the protected group.
            e) STOP ALL MILITARY ACTIONS that will cause irreparable prejudice to the rights of Palestinians in the Gaza Strip WITH IMMEDIATE EFFECT. (Please see paragraph 78 of page 23 of the Court Order.)
            f) Further, the Court has ordered Israel to prevent and punish the direct and public incitement to commit genocide in relation to members of the Palestinian group in the Gaza Strip. (The names of the culprits were already given. Please see 5 above.)
            g) Take immediate and effective measures to provide urgently needed basic services and humanitarian assistance to the Palestinians in the Gaza Strip.
            h) Do not destroy evidence related to genocidal allegations.
            i) And, finally submit a report within a month with evidence that (you/your country) complied with the Court’s order.

              9. I want to stress the point that the Court has very clearly ordered Israel to stop killing and causing injuries to Palestinians and stop destroying houses and forcible displacements. In other words, the Court has ordered Israel to impose a ceasefire in the Gaza Strip with immediate effect. This is further elaborated under the paragraph 77 of page 23 which states;
              Quote:
              “77. In the present case, having considered the terms of the provisional measures requested by South Africa and the circumstances of the case, the Court finds that the measures to be indicated NEED NOT BE IDENTICAL to those requested.” Unquote.
              10. Israel has absolutely no choice other than calling a ceasefire on its own volition. Because every military action conducted by Israel in the Gaza Strip after January 26 will strengthen South Africa’s genocide case at the ICJ.
              11. A ceasefire in the Gaza Strip will bring both Israeli hostages and Palestinian prisoners home, the Red Sea will be safe for shipping and the newly appointed United Nations Humanitarian and Reconstruction Coordinator to the Gaza Strip will also be able to visit Gaza and commence her work. The Universe will support Palestine. This bloodshed in the Holy Land should be stopped. I hope for the best!

                This is what you said on Nov 27th 2023, after the ceasefire had been declared – “The battle is over, folks! I mean, the Israel-Gaza war IS OVER!!!!.”

                My reply to you on the 28th Nov was this – “Hello Champa,
                I hope you are right, but I don’t have your optimism regarding the ceasefire being permanent. I am afraid that after the end of the Hostage Releases, even if there are extensions for another few days or a week, the Israelis will continue the carpet bombing in the North of Gaza and then start to clear the South”
                I don’t think that you have taken into consideration the deep racialism that exists in Israel against the Palestinians. This has been covered up and even supported by the USA and others over the last 75 years or so. Even after the ICJ ruling the Israelis intend to keep going with their objectives. Notice the distraction about UNWRA personnel, reported by Israel, and the immediate suspension of aid to the Palestinians.
                The ICJ ruling will be ignored as far as possible by the US, UK and other western countries.

    Israel creates and deliver the monetary equation to the West, and the West goes only along what is offered to them. Israel can just as easily dismantle their Zionist madness and holocaust phobia and integrate the Palestinians of whom their lands they occupy, with a better monetary equation.
    Most Israelis desire this. But the bloody despotic Nethanyahu on top is reveling in his power as a white man over the Palestinians. As for the rest of the Arabs – quite the useless race of people. Each one trying to trip the other up. See what happened in Iraq because silly Qatar?       Israelis occupying Palestinian lands is Muslim propaganda. Archaeologically Palestine belong to Cannanites. So both Jews and Arabs are occupiers. Arabs were nomadic tribes who learnt civilization from Coptics and Sumerians. It is said in the Bible that Moses led his people from Egypt into Jerusalem. This was several years before Arabs came there. Jerusalem is birth place of Judaism and quite rightly has to go tho the Jews. It is the Muslims who are denying this right by making up a story that Mohamed went to heaven in a chariot from Jerusalem. In this modern world can anyone with sane mind accept this. Building of Al-Agsa mosque on Jewish holy land is an act of aggression and provocation, which should be demolished. Jews must follow the Hindus in correcting this historical crime. Egypt belong to Coptics and Arabs have pushed them to the south occupying their lands and keeping them under suppression. Is this not genocide and apartheid committed by Muslims.

    This is all fine, but it is also hypocritical of a people who go around the world crying that their facing genocide and ethnic cleaning at the hands of Israel and wanting world sympathy, then conferring the highest Palestinian honours and accolades and even to name a street after an alleged war criminal, who is accused of large-scale killings, ethnic cleansing and systematic structural genocide and dispossession of the Eezham Thamizh in their own land. Mahendran Rajapussy. The news is that they are even now going to name a street after him. This is the height of hypocrisy and double standards. You go around the world wanting sympathy with regards to what Israel is doing to your own people and cry genocide and ethnic cleansing, whilst many of your fellow Arab Muslim states are colluding with the very same Israel but honour and confer your highest accolades on an alleged war criminal who is accused of war crimes, structural genocide, ethnic cleansing, human rights abuses of another people and large-scale looting of national funds. So, the genocide and ethnic cleaning and war crimes committed on the island’s Thamizh is fine and they will honour and support the perpetrator but not for themselves.

    Several lawsuits are being compiled against Biden, Blinken and the black army chief (slave Austin) for aiding and abetting genocide and crimes against humanity, not to mention war crimes, which the US has always engaged in. Israel stands alone with Big Brother whose short and curlies are always pulled by God’s chosen people in the land that God bequeathed to them by deed of title. Now, the world has to side with powerful progressive nations and strengthen the noble cause that the Resistance groups are engaging in. More tunnels to and from Egypt must channel arms and food for the valiant fighters the world owes for starting the end of tyranny in the Mid East and by extension, the welfare of the world’s poor.     Just an allegation by Israel resulted in its Anglo-Saxon collaborators entering into direct asymmetrical warfare against the Gaza Palestinians by cutting off funding to the U.N. refugee agency for Palestinians (UNRWA).

    The Anglo-Saxon are the self-proclaimed “civilized world”, so-called “defenders of human rights”.

    The allegation is that 12 Palestinians took part in the October 7 Hamas incursion into Israeli territory.

    No proof has been forthcoming. That will come after Israel has tortured a few Palestinians.

    In a statement the Secretary-General of the United Nations, António Guterres noted that the UNRWA employs thousands of men and women in its humanitarian efforts. He said 2 million civilians in Gaza depend on the aid to survive.

    Israel was established by the Anglo-Saxons as a citadel in the resource rich Middle East.

    The plight of Palestinians in the Gaza Strip has taken the center stage of world politics. I do not think Mr. Biden is much bothered by his winning or losing at the upcoming Presidential election later this year. The main worry for the Democratic Party is whether it is ready to face witch-hunting in the event a Republican candidate wins the election. There is a high chance that “karma” will come in a different light and all those who supported Israel’s war will face the wrath of a future Republican government and receive punishment for their actions that have nothing to do with the war.
    Mr. Biden received a significant number of votes of people of colour at the last election. The appalling situation in Palestine and the US complicity in Israel’s war against Palestinians may disturb his voter base if some voters decide to boycott the election.
    It is the US that blocks a permanent ceasefire in the Gaza Strip. Therefore, it is not surprising that the US tries to cut a deal with Hamas to get hostages released without a permanent ceasefire which will be a major boost for Mr. Biden’s election campaign.

      What I tried to say was, this is the first time after 75 years, the Palestine Question has become a world issue. Also, this is the first time after 75 years, Israel’s “genocidal intent in the occupied Palestinian territory” came under the scrutiny of the highest court on earth. The United States’ weak response to the Israel’s genocidal war against Palestinians in the Gaza Strip proves that the US will never be great again.

        The ICJ has a limited scope as South Africa’s case against Israel was filed under the Geneva Convention. Court cases against Israel under the International Humanitarian Law, the International Human Rights Law and War Crimes Laws are yet to be filed. Therefore, Palestinians should not jeopardize their ultimate goal of establishing an independent Palestinian state. In order to achieve it, the first step is a permanent ceasefire in the Gaza Strip.
        Arab and Muslim countries should try to bring a resolution at the UNSC demanding an immediate ceasefire in the Gaza Strip based on ICJ’s interim ruling. I couldn’t find the resolution they tried to table at the UNSC after ICJ’s ruling on 9 July 2004. But, what they must realize is that they are now in a stronger position than they were in 2004. Therefore, they should use their political and economical power to establish peace and stability in the West Asian region.

          Most Arab countries are led by hereditary dictatorships with the present-day sheikhs, kings and royals all tyrants. Their militaries are trained and supplied by the west and provided western arms, only so they can brutally suppress internal dissent and ensure the dictatorships continue. [Remember the Saudi journalist, Jamal Khashoggi?] All these Arab countries are devotedly supported by the handful of western countries who derive benefits in terms of oil and other resources.

          Look at Bahrain, an Arab country led by a supposed sheikh. It is home to large US and British bases, once again in support of the tyrant sheikh and the surrounding Arab dictatorships but under the pretence of defending them against Iran. Unsurprisingly, Bahrain and its sheikh is one of only a piddle of countries who have joined the US and UK against the Houthis, brave fighters who have blockaded the Red Sea and Suez Canal in support of the brutalized Gaza Palestinians. The Houthis do so against the mighty western world with nothing but their spirits and principles.

            Remember that Egypt, Syria and Iraq overthrew their monarchs followed by Libya.
            The Gulf states have a historical burden, but things are changing but slowly.
            Saudi Arabia has already explicitly expressed dissent with the US on several issues.
            North Africa is a different story.
            The US chose the wrong moment to provoke Russia and then screw up in Palestine.
            Let us wait and see, not for long I hope.
