Imprisonment Of 5 Years For Non-Arrest Of A Suspect – A Good Example To Emulate

The sentencing of a former Senior Deputy Inspector General of Police for giving illegal orders not to arrest a suspect.

The reported sentencing of former Senior Deputy Inspector General of Police, Lalith Jayasinghe, for giving illegal orders to prevent the arrest of a person allegedly involved in the shooting which resulted in the death of some persons, was a sentence of five years in prison, by the High Court Judge of Ratnapura. While the particular case may be of interest from a political point of view due to the Member of the Parliament who was later arrested and convicted and later acquitted by the Court of Appeal, this case is of enormous importance from another point of view. This is one of the unique cases in which a very senior Police officer who has held the rank of a Senior Deputy Inspector General of Police has been held guilty of giving illegal orders to an Officer-In-Charge of a Police station who was carrying out an inquiry into the relevant shootings and murders.

The importance lies in the fact that the complaints about the interferences of higher Police officers into the workings of the Police investigators who are investigating into crimes, is a complaint that is being heard so very frequently. In fact, it is no exaggeration to say that such interferences have reached epidemic levels. This instance where the investigating Officer-In-Charge of the Police had the courage to complain about this incident and pursue the complaint over a period of almost eight years till a conviction has been reached should set an example for others who are facing similar situations throughout the country.

The importance of this case lies in the fact of the key role played by the Officers-In-Charge of the Police who according to the Criminal Procedure Code of Sri Lanka have the duty to conduct inquiries into all crimes which are being reported in their respective jurisdictions. It is the function of the Officers-in-Charge of the Police to ensure investigations into all crimes that keep the security of the society and also to provide security to the people. People can walk on the roads peacefully and conduct their daily affairs such as small businesses and many other transactions and also conduct their neighbourhood relationships peacefully, only due to the fact that the legal system of Sri Lanka has provided like it has also provided in almost all countries for the function of the Police to intervene into any kind of criminal interference into the freedoms of the people by exercising the powers given to them as investigators into crimes.

Perhaps, the one issue that may be of general interest to all families throughout Sri Lanka today is the duty of the Police to investigate into various crimes relating to the drug trade as this overwhelming problem has emerged in this society affecting families, schools, neighbourhood relationships and also many other factors which cause social unrest and its instability due to the failures of those criminal investigators who have failed to bring this widespread crime under control.

When inquiries are being made into by some of the Police officers, many of them frankly tell that they have tried their best and are in fact trying their best to get this situation under control but that they are prevented from acting because of the orders that are coming down to them from their higher authorities. When a higher ranking Police officer interfere with the investigations into crimes, they are in fact acting criminally as the instructions they give to the local Police stations to prevent them from doing investigations itself becomes a source of the increase of crimes.

Thus, Sri Lanka must today deal with the issue of higher ranking Police officers themselves being part of a criminal enterprise directly or indirectly by the manner in which they obstruct the investigations of crimes by the Officers-In-Charge of the Police who exercise their powers under the Criminal Procedure Code of Sri Lanka. In fact, the kingpin of crime control is the Officers-In-Charge of the Police. If their work is interfered with by a higher officer, this is a very serious crime and also an action against social stability.

The sabotage of criminal investigations 

There is a need for a strategy to stop the sabotage of investigation of crimes by higher ranking Police officers.

A section of higher ranking officers has become a formidable obstacle for crime investigation in Sri Lanka. Had it not been for this, much of the very serious crimes including those relating to the drug trade can be stopped overnight.

These officers in fact offer a greater threat to social stability, peace and the psychological well-being of people including family stability than any other section of society. Thus, they are by now a national security threat, because a crime ridden society threatens every aspect of society.

These officers may argue that they are a creation of bad politicians. However, this is no excuse and not a defence. Besides, as it had happened in this case, politicians will not come to rescue these officers when they face criminal charges in courts.

            Nimal , I believe the present government headed by RW is responsible for this situation. There was plenty time to take action and ensure safety. But what the government did was to lower security. Just giving orders will not stop a fanatic mob. Dispute could have been settled by courts and commissions. But no judge should be threatened , intimidated or prevented from doing their job. RW , WR , AG , Law fraternity, security and the rest concerned are answerable.

              Judge leaving country because of death threats happened under RW’s watch. He is answerable. I didn’t even hear a murmur otherthan Tamil MP’s raising the issue inside parliament. SW and monks unhindered continued with their racist agenda. BASL made a statment or two. Media in general ignored as though it’s trivial. (except for few like TG ) .Ranil’s only action was to fire the Archeology head thinking it’s sufficient to take care of SB goons. Most of our retarded are not even aware of such incident because the judge involved is a Tamil.. In a country like Pakistan two most powerful heads were eventually chased out when they tried arm twisting the Supreme court and CJ. Country like no other.

                LOL, just read Today’s news. President orders probe into judge’s resignation. Further it states “the judge didn’t lodge a complaint either to the Lankan police or the judiciary service commission”. Guess RW, Minister WR, and judiciary service commission were waiting for the judge to leave to initiate probe. Will any right minded person go to Lankan police, especially after what happened to Gajendran and Gajendrakumar, who said “when police came looking , he feared for his life “. Didn’t SW make the threat in the very parliament ?? Did Ranil try reining SW or those monks ??? The letter is dated 23 rd , and I believe the judge left after. What was the JSC doing ??? Why did Ranil fire archaeological head ??? If The judge filed a complaint , will he be able to leave country (pending probe / case ) ?? will he he be alive to tell his story ??? Haven’t we seen and heard enough of our Lankan BS ????

    Who knows what kind of political revenge this is? The politician involved in this was capable of having his shackle cut by CoA. Why is the Buffoon de Silva not arrested by the police? Impunity King, Evil said in Parliament that he is aware of Old Rowdy Kings murders, especially Kadirgamar. RavanaLE courts punished a schoolgirl stealing coconut to pay school fees by putting in for 8 years. A government officer was given 20 years for accepting Rs 25,000. Did these verdicts stop any crimes in Langkang? In fact these types of cases only train the criminals to murder the witnesses and whistleblowers, learning from the Royal Family, Evil Family etc…. One past president ordered the IGP to protect his son from the arrest of “Brawl in the Night Club Clique”. Pujitha said publicly that he would be getting exceptions from White Flag Murderer because of saving his son as per the request of Dada. Pujitha was framed on 4/21, by the president himself, who was one of the masterminds in that Jihadi war. Are this mid-level or high level police officers writing the laws like CTA or PTA so the police officers can witness their own murders in the 4th floor?

    This is a very rare incidence of meeting our Justice. How many such cases have been overlooked and passed on without giving any recognition and sometimes with contempt both by the Judiciary and other Law Enforcement agencies? This particular “Unformed Vagabond” is also the man who assisted the murderer of the Vindya – (an underage girl from the North) to escape arrest. I think that case is still pending. For how long now? Who speaks of it?

    Then what happened to another “Powerful” Senior DIG of the Western Province who directly gave instructions to the OIC of Colombo Fort to hand over the “Million” odd money found by the “Aragalaya” participants in the Gotabaya’s “Bed Room, to State Minister Thiran Alles? That “Direction” was well recorded in the books at the Police Station. What did the Judge do in that case?

    What did the “AG” and the “Bribery Commission” do in “Withdrawing” as many as “47” cases out of “60” odd cases that were brought before courts? Were they (AG & Briber Commission Members and Officials) brought to book for “Dereliction” and “Negligence” of their “Official Responsibilities and Duties? What happened to the “Judge” and the “Saffron Clohed Buddhist vagabond” who held Elephants in private custody without obtaining licenses as required by the Law? Did the “Judges” who heard such cases deliver “Justice”?

    It is too early to be “Jubilant” about this decision to imprison the DIG Jayasinghe for a 5-year jail term.

    Please remember the man this DIG wanted help was sentenced to “Life” on the conviction of murder. Later he appealed the verdict and was “Discharged”. That is how he is sitting in Parliament on a “Promotion” to the post of a Junior Minister.

    This DIG would also appeal against the verdict and I am certain that he too would be acquitted.

    In that event, he (DIG Jayasinghe) would be appointed to the Police Commission or even as IGP.

    Why Not? If Premalal could become a “Junior Minister”, why not DIG Jayasinghe be the IGP? After all this DIG was “CORRECT” in directing the OIC not to arrest Premlal (Choka Malli) one would argue.
    He decided that before the “Appeal Court” that heard “Coka Malli’s” case.

      Douglas, after what happened to the judge , do you think any right minded judge will go against such criminal / crooks/ murderers ???? Remember Vasantha . K who was convicted by courts was pardoned and promoted. Gotha put whole CID on red alert, closed more than 40 cases, and worse made the judges answerable to criminals, under pretext of political victimization. So much so the guy who looted treasury Mahindananda , now a Chairman of oversight committee , came up with the report stating 500 Billion is lost annually , due to corruption and inefficiency ( sure this will help in releasing IMF loans). Further stating 85 % of tax is collected from just 465 clients whereas Inland Revenue Dept has more than 2500 staff.

      Paragon , the mere fact the judge cited the reason for his resignation is a sign of Lanka’s low and odor. RR went to prison for alleged court violation , whereas fhe judge resigned because of threats made by SW. He told in parliament this is SB country and this judge has no place. Lets see what action to follow from BASL, juficiary, WR , RW ……… Good that IMF did not proceed with the loans.

    After years of dragging their feet at last Justice has been served. However, imagine in the near future one of the two DIGs who are accused of serious neglect of their duties and who paved the way for the Easter Attack and the Aragalaya attack is appointed as the next IGP!

    Wake up citizens.
