Is The Sri Lankan Graveyard Best Venue For A Commonwealth Meeting?

The London Declaration of 26 April 1949 has two important provisions. It renamed the “British Commonwealth” (Imperial British Empire) as the “Commonwealth of Nations” and it allows member countries with no colonial links to Britain to join, including monarchies and republics.

The sixty-three-years-old voluntary association of the Commonwealth is headed by Her Majesty Queen Elizabeth. The membership, grown from 8 countries in 1949 to presently to 54, covers all six regions – Africa (19), South Pacific (11), the Caribbean (10), Asia (8), the Americas (3) and Europe (3).

Mozambique became the first member country without any colonial links to Britain. There is also long-term Francophone Cameroon. Both became members in 1995.

In 1965, the Commonwealth Secretariat was established in London-UK, headed by a Secretary-General and appointed by heads of state. The first Secretary-General of the Commonwealth was Arnold Smith of Canada who held this position untill 1975.

At the 1993 Commonwealth Heads of Government Meeting (CHOGM) in Cyprus, it was decided that the Secretary-General would serve a maximum of two 4-year terms. Presently Mr. Kamalesh Sharma of India is the Secretary-General.

Every two years, CHOGM meets in one of the member countries. There is no voting in the Commonwealth, all decisions are reached by consensus.

It was announced that the next CHOGM will be held in Sri Lanka in November 2013. This is a disappointment to certain countries, inter-governmental bodies and to members of civil society who are the eyes and ears of the monitoring bodies for good governance, democracy, rule of law and human rights.

Commonwealth Declarations

CHOGM has a good track record regarding its policies and working methods. Several declarations are very well maintained not only on paper, but also in action.

For example, the Harare Commonwealth Declaration of 20 October 1991 and the Declaration of Commonwealth Principles – Singapore on 22 January 1971.

The Harare Commonwealth Declaration, paragraph 4 reads as follows:

Its members also share a commitment to certain fundamental principles. These were set out in a Declaration of Commonwealth Principles agreed by our predecessors at their Meeting in Singapore in 1971. Those principles have stood the test of time, and we reaffirm our full and continuing commitment to them today. In particular, no less today than 20 years ago:

we believe that international peace and order, global economic development and the rule of international law are essential to the security and prosperity of mankind;

we believe in the liberty of the individual under the law, in equal rights for all citizens regardless of gender, race, colour, creed or political belief, and in the individual’s inalienable right to participate by means of free and democratic political processes in framing the society in which he or she lives;

we recognise racial prejudice and intolerance as a dangerous sickness and a threat to healthy development, and racial discrimination as an unmitigated evil;

we oppose all forms of racial oppression, and we are committed to the principles of human dignity and equality;

we recognise the importance and urgency of economic and social development to satisfy the basic needs and aspirations of the vast majority of the peoples of the world, and seek the progressive removal of the wide disparities in living standards amongst our members. (Excerpt)

The Declaration of Commonwealth Principles 1971 states;

6. We believe in the liberty of the individual, in equal rights for all citizens regardless of race, colour, creed or political belief, and in their inalienable right to participate by means of free and democratic political processes in framing the society in which they live. We therefore strive to promote in each of our countries those representative institutions and guarantees for personal freedom under the law that are our common heritage.

7. We recognise racial prejudice as a dangerous sickness threatening the healthy development of the human race and racial discrimination as an unmitigated evil of society. Each of us will vigorously combat this evil within our own nation. No country will afford to regimes which practice racial discrimination assistance which in its own judgment directly contributes to the pursuit or consolidation of this evil policy.

8. We oppose all forms of colonial domination and racial oppression and are committed to the principles of human dignity and equality. We will therefore use all our efforts to foster human equality and dignity everywhere, and to further the principles of self-determination and non-racialism. (Excerpt)

Considering these Commonwealth declarations and CHOGM’s strong action in the past on Fiji, Nigeria, Pakistan, Sierra Leone, South Africa and Zimbabwe; we can presume that CHOGM will have second thoughts about holding its prestigious meeting in Sri Lanka next November.

Here I do not have to go into details about the track record of Sri Lanka on human rights, democracy, the rule of law, and good governance.

Track record of Sri Lanka

More than two decades of UN reports on Sri Lanka’s human rights situation; the report of the UN Secretary General’s Panel of experts on Accountability in Sri Lanka; UN Secretary General’s Internal Review Panel report – action in  Sri Lanka; the resolution in the UN Human rights council on Sri Lanka last March; the Universal Periodic Review – UPR sessions on Sri Lanka that took place last month and the press release of the Commonwealth on 15 November 2012; all pose serious questions to CHOGM as to whether Sri Lanka is qualified to host their meeting next year.

It is well known to the global community that the President and the government of Sri Lanka violates the liberty of individuals, denies equal rights for all citizens, practices vicious racial discrimination, rejects genuine and honest political negotiations and practices nepotism.

Already, certain head of governments, campaigners, International organisations and Nobel Laureates have raised their concerns to the Commonwealth.

I presume that more detailed briefing and lobbying is needed to bring this matter to the attention of all the members of the Commonwealth, especially by members of civil society and victims of Sri Lanka.  Also the head of the Commonwealth, Her Majestic Queen Elizabeth should be alerted.

The Presidential Candidate in the last election, former Army Commander and former Member of Parliament Sarath Fonseka claims in his interview on 24 November 2012, that he won the last Presidential election, but the government manipulated the ballots and Rajapaksa claimed victory.

  “…..Around 11.00 o’clock, we got the reports from all over and as per to our people who were monitoring it, we were leading by 400,000 thousands……… they altered the results……. one sided results that is not valid……. election result overall is not valid.”(Excerpt – 22:30 to 25:00 minute)

Soon after the Presidential election the Presidential Candidate Sarath Fonseka was arrested and sentenced to jail.

Meantime, the politically motivated impeachment motion against Sri Lanka’s first female Chief Justice is underway. The most humiliating affair is that eleven Members of Parliament from Parliamentary Select Committee (PSC) have been appointed to prove the charges against the Chief justice. In fact some of them are uneducated and unqualified politicians.

Many cabinet Ministers and deputy ministers are either corrupt or involved in criminal activities. Also there are cabinet members who are accused of recruiting child soldiers and carrying out abductions and assassinations but are never brought to justice.

Nearly 15,000 political have detainees spent decades in the prisons without any hope of justice; thousands have been disappeared and arbitrary killed; women tortured raped and hacked to death. There have been no independent hearings nor have the culprits been brought to justice. Impunity has prevailed for decades in Sri Lanka. It cuts deeper and deeper wounds.

Presently almost all the newspapers are either owned by the government or out of fear never raise their voice against the authorities. Many electronic Medias which are critical of the government have been blocked for years.

Since the present President and the government came into power, 4 Parliamentarians and 16 journalists have been killed or disappeared. There have been no independent inquiries into these killings due to the obvious reason that the government was the accused. Some Journalists have escaped and sought asylum in foreign countries.

In such a situation, the Commonwealth has an important duty to compare Sri Lanka’s present situation to the countries which were suspended in the past.

Were those countries’ situations equal or worse to what has happened and is happening in Sri Lanka?

Obvious partiality

Sri Lanka’s allies China, Russia, Cuba and a few other human rights violators are not part of CHOGM. Even though Pakistan is a member of CHOGM, as it was suspended several times in the past, its voice is valued less in the CHOGM. Therefore, there is no excuse for any country which is for human rights, democracy, the rule of law, and good governance not to look genuinely at the track record of Sri Lanka.

When Sri Lanka violates international human rights and humanitarian law including Commonwealth declarations and refuses to take meaningful action, will CHOGM turn a blind eye to Sri Lanka and hold their meeting there? If so, it will be equal to having a Royal wedding in a graveyard. Would CHOGM want to earn this insult for obvious partiality?

This is food for thought for all the Heads of Government of CHOGM.

I hope the Commonwealth Secretary General will not be accused, like the UN Secretary General has been of failing in his action to discipline Sri Lanka, for failing to apply the internationally accepted principles and standards of human rights, democracy, the rule of law, and good governance.

However, thanks to the current leadership of the country the Tamil Terrorists were eliminated, and the commonwealth has rewarded for that contribution to the global peace. Now some Tamil terrorists supporters who could not stomach this defeat will go around the world asking asylums and engaging in various criminal activities such as drug dealing, credit card stealing, money laundering, bribing politicians, etc. etc. will condemn Sri Lanka knowing fully that is the only way they can fool the gullible foreigners. They know that now the Tamils are very happy that their children are not used as suicide bombers and cannon fodders by the Tamil Terrorists and they want to destroy the lives of innocent Tamils living happily in Sri Lanka in order for these overseas Tamil terror supporters to raise funds and stay as asylum seekers.

        Where were this intellectuals when LTTE about to loose the battle? When they asked to put down the weapons and let the civilians go free by government, they rejected the offer. Instead, they kept innocent civilians as cannon fodder. Today those who are involved and minor LTTE members are freed and living peacefully in north and east. A large number of LTTE members are already working with government for peace and harmony of the country (some are in parliament).
        Sri Lanka is graveyard to the die hard LTTE and its sympathisers. not for any one who wants to lead a peaceful life. If commonwealth wants to see the truth, they can come and see. Commonwealth days are coming to end as united kingdom is getting bankrupted day by day and its members such as India, Malaysia,South Africa getting more prominent than puppet queen in UK. Nevertheless The opportunity can be used to show the true situation of the country as lot of media will be in Colombo, if some one does not come, it will get more attention and more news. End of the day the one who not attended is only an empty chair which no one bothers. World stage Asia is getting stronger and stronger our country is part of it while LTTE and those behind its tale are in graveyard as said by S.V. Kirubaharan. Why we bother?

        Super Luxury Buses run daily from Wellawatta to Jaffna.

        Semi luxury ones run to Jaffna from Kataragama. Kurunagala and so many other distant places.

        Galle to Katunayaka will be only 90 minutes soon and Mattala perhaps 30 minutes.

        That is if one insists on catching the return flight from BIA after enjoying the marvellous Southern holiday resorts.

        Trinco Golf Course next to Marble beach ,Many fantastic resorts coming up in Passikuda, Kalpitiya and several others will make the North East and North West as good as the South.

        Is this the “position ” that Mr Fernando refers to as Srilankans in today?.

    Sri Lanka being a British Colony, known as Ceylon then, after receiving Independence the Political Power was handled by the Majority Community the Sinhalese. They not only changed the name of the Island but the demography as well. In order to appease the majority, for the vote, pride of place was given to the Sinhalese overlooking the rest. This resulted not only the Tamils who held Govt. Office, but even the Malays and the Burghers to migrate as they were shown the door starting the late ’50s. We had enough Crows in the Country to scavenge. Today thanks to such Crows, the Country is a Grave Yard as the writer puts it across. The Tamil Diaspora does not need more graves to remain wherever as they are, as they are financially and socilly better placed than the ubiquitous Crows here.

    I fully endorse the living saint, Mr S. V. Kirubaharan’s call to change the venue for the forthcoming CHOGM meeting. It should be moved to the central graveyard in Paris where Nadarajah Mathinthiran, alias Colonel Parithi of the Paris branch of the LTTE lies in peaceful slumber awaiting Eelam.

        What exactly is Kirubaharan’s argument? It’s just a recitation of the usual whines by defeated Eelamists, He wants the UN to “discipline” SL for having defeated the LTTE, albeit with heavy civilian casualties?

        Where have I said or implied that the living saint and human rights God, Mr S. V. Kirubaharan (who is unable to tell the world why he didn’t he move to Eelam to check on human rights) would be the next target of a assassination by elements in the LTTE factions?

      The self-proclaimed human rights activist and living saint, Mr S. V. Kirubaharan lacks moral courage and is a Grade A hypocrite.

      He never went to live in VP’s Eelam when it existed.
      He never criticised the LTTE for holding its ‘own’ people as human shields.

      Read his weasel words in his own report called “Rights of the Child” on the LTTE”s recruitment of chid soldiers where he tries hide the LTTE’s continuing child abuse.

      “.. the non-state party (i.e. the LTTE) to the conflict recruiting those of the same age has been repeatedly and strongly raised by the international community, as a child soldier issue. Credible reports have announced that the recruiting has been stopped.

      Child soldier recruitment by the LTTE never stopped.

        We never found anywhere Mr S. V. Kirubaharan claimed himself as human rights activist. Of course he is working in this field for more than two decades.

        It is the UN report said he is a human rights defender.

        If he is a Singhalese today he would have been one of the VIPs.

        He would have done much better job than any of these Ambassadors.

          He calls himself the General Secretary of the Tamil Centre for Human Rights (TCHR) in Paris. He visits lots of countries but hdan’t managed to visit the Vanni during the paradise years of Prabha’s rule. His minions however did in 2003, and my favourite bit from their report is this: “Tamil Eelam Police are not permitted to hit or assault anyone and are given intensive human rights training.” The torturing and kidnapping was done by VP’s own special units, no? Ha ha ha..

    First I thank CT for bringing these news to us all readers.

    Both Gon 9th grade rowdy kelawaddas Wimal Gonwansa and Dilan who were languishing in streets looking for work before were turned into politics for their own survival.
    They have no right to insult the chief Justice who should file a case against them for SEXUAL HARASSMENT AND FOR INSULTING HER IN PUBLIC.

    Who is this pi.p Wimal who think he is to call an educated, cultured and respectable CJ to call her ‘Baby’ and ‘Nona’.
    He can find a ‘baby’ at night after 9 pm in Kelaniya or Thotalanga Junction….or call his friend Mervin to find one.

    CJ should immediately file a case against both on Sexual Harassment charges both Local and International courts, with the help of Supreme courts.

    Second what CT must do is to collaborate with Supreme Court to work with International Judiciary, Commonwealth Jurists, Asian Human Rights Association, US and UK courts to file a case against Govt. of Sri Lanka for not giving her rights to proceed with this Impeachment case along with the sexual harassment she had to face during the last PSA hearing.

    They could implement a Travel Ban to all Govt. members if the Govt. did not give a satisfactory reason for abandoning the trial.

    Third what CT must do is to collaborate with Supreme Court to work with International Judiciary, Commonwealth Jurists, Asian Human Rights Association and with Interpol to get all the information relating to local and foreign investments, both financial, real estate and others …like land, farms , shares, bonds ets that are owned by all the ruling family, parliament members and their family members and friends, in and out of Sri Lanka.

    This is a MUST and URGENT which CT along with Sri Lanka Bar Association, Supreme Court and the CJ that could initiate this with the help of International Courts, Interpol, and the Sri Lankan Diaspora.

    Fourth CT should work with SC and other law enforcement departments to give additional protection to CJ, her family and her Lawyers. THIS IS A MUST.

    I hope CT and the Judiciary will help Sri Lankan citizens by protecting CJ and to trace these Black money which actually belong to them and could bring justice to all of them.

    This is absolutely the best place!! If anything the commonwealth should intensify it’s engagement with Sri Lanka. When a member country is going hard times it would be nice/useful if the commonwealth closes ranks and assist the its member states instead of standing in judgement.

    In the past, the practice of suspending members when things are going badly wrong is, in my opinion, a bad strategy. These suspensions never had any positive effect. Pakistan and Zimbabwe are cases in point. It exposes the commonwealth as irrelevant. It would be better for the commonwealth itself, if officials from commonwealth countries go to troubles spots and helps with governance issues such as SL giving the commonwealth relevance. Adopting a holier than thou attitude helps no one.

    There is wide consensus that the British did a piss poor job when they granted independence without giver proper consideration to historical, ethnic, religious complexities in SL. They left a largely feudal society with trappings of democracy to its own devices and now cry foul. Their is fair amount of blame that is theirs. So it is incumbent on them to help not to criticize and penalize.

        Firstly you are a Sinhala Modayiah to write about S.V.Kirubaharan and his wife.

        They both are going to be very popular among the diaspora and especially among new generation of Tamils.

        However if what you write here is true, why they were not arrested and put in the prison like it happend to many others in Europe.

        What is happening on the reverse.

        When SL pro-government newspapers published a news that Kirubaharan wanted by the Interpol.

        UN representatives made an investigation and found that it was not true, and they made a statement about Kirubaharan.

        This was very well published in the Colombo media in all three languages.

        Therefore there are things you are exagerating for unknown reasons.

        Tell the truth, others will believe.
