Keeping Promises – Fooling The UN Is A Lot Tougher Than Fooling Sri Lankans

Commitment to the People

After the war and the massacres of civilians by the army, promises were made to the world, including to the Tamil people at the UNHRC. While some seem to think that Mr. Ranil Wickremesinghe and the UNP sealed the deal by themselves, diplomatic circles are very clear that President Maithripala Sirisena was fully briefed and agreed to cosponsoring Resolution 30/1 at UNHRC.

However, President Sirisena is, according reports, going to Geneva seeking to renegotiate Resolution 30/1. The expectation, says Jehan Perera, is that he will fail. The world will not brook heads of state playing games with them, promising one thing one day and asking to be excused the next.

Review of the Commitments

Three years after 30/1, it is good to recall what we promised and where things are. Succinctly

Para 1: Encourages implementing measures for truth-seeking, justice, reparations and guarantees of non-recurrence. (In contrast, the President keeps calling murdering soldiers national heroes and promises that they will never be charged. It is a promise of impunity to those who murder Tamils, inviting recurrence).

Para 2: Encourages exploring appropriate forms of international support for and participation in Sri Lankan processes seeking truth and justice. (What truth and justice when our leaders are in denial?)

Para 3: Strengthen processes of truth-seeking, justice, reparations and guarantees of non-recurrence by engaging in broad national consultations drawing on international expertise, assistance and best practices. (There are no national consultations. There is paranoia about international expertise).

Para 4: Establish a commission for truth, justice, reconciliation and non-recurrence, an office of missing persons and an office for reparations. (The OMP has happened at long last, but the President made his mala fides clear by not appointing persons for long even after the law was passed, and not appointing some good nominees proposed by the CC).

Para 5: Recognize the need for a process of accountability and reconciliation for the violations and abuses committed by the Liberation Tigers of Tamil Eelam. (Contrary to how we treat Sinhalese murderers, Tiger suspects against whom there is no evidence languish in prison).

Para 6: Establish a judicial mechanism with a special counsel to investigate allegations of violations and abuses of human rights and violations of international humanitarian law, and affirm that a credible justice process should include independent judicial and prosecutorial institutions, and the importance of participation in a Sri Lankan judicial mechanism, including the special counsel’s office, of Commonwealth and other foreign judges, defence lawyers and authorized prosecutors and investigators. (No action but a lot of hysteria).

Para 7: Implement the LLRC Report, as well as the recommendations of the report of the Office of the High Commissioner, including by allowing for the trial and punishment of those most responsible for the full range of crimes during the period covered by the LLRC. (The President promises to protect them).

Para 8: Also encourage the Government of Sri Lanka to introduce effective security sector reforms and ensure that no scope exists for retention in or recruitment into the security forces of anyone credibly implicated in serious crimes involving human rights violations  or violations of international humanitarian law. (Instead murderers are rewarded and are made our Ambassadors).

Para 9: Passage of an updated witness and victim protection law and  commitment to review the law, and strengthen specific accommodations to protect witnesses and victims, investigators, prosecutors and judges. (Some progress that is undone by obstructing and threatening those going to Geneva to give evidence).

Para 10: To accelerate the return of land to its rightful civilian owners, and to end  military involvement in civilian activities, the resumption of livelihoods and the restoration of normality to civilian life. (Settlements are increasing as shown below. The army has asked for powers to tackle gang violence in Jaffna for which there is evidence that the Police are behind the sword wielding Aava gangs whose activities in the first 20 days of September are shown in Table 1.

Para 11: To investigate all alleged attacks by individuals and groups on journalists, human rights defenders, members of religious minority groups and other members of civil society, as well as places of worship, and to hold perpetrators of such attacks to account. (Government reluctance to punish Gnanasara Thero, giving him the comforts of hospital after he is convicted  and calls for his pardon show sympathy for his activities and that there are powerful forces supporting him).

Para 12: Welcomes the commitment of the Government of Sri Lanka to review the Public Security Ordinance Act and to review and repeal the Prevention of Terrorism Act, and to replace it with anti-terrorism legislation in accordance with contemporary international best practices.  (This has not happened and the PTA is the very instrument that  puts us Tamils in constant danger from the police and army).

Challenge of Genocide – Compounded by a Gullible People

The nonkeeping of the above solemn promises to the world indicates the intention of the government to erase Tamil presence in Sri Lanka – the ultimate in genocide.

President Sirisena may be excused for promising a red carpet welcome to returning exiles and doing nothing about it. However, the government is responsible for far bigger untruths on every one of the 12 paragraphs of 30/1. The tendency for our leaders to lie – whether over red carpet welcomes for returnees or to the UNHRC shows how easily we may be manipulated – Tamils in 2015 through the promise of reconciliation and the Sinhalese by catering to their sense of racial megalomania and by covering up mass scale murders to buy votes.

Mahaweli Colonization – More Lies

Sinhalasisation is now coming to the North in full force. We have been softened so much with blows that Tamil officials under decentralization can be trusted to play government stooge. 

On 25 Aug. there was a development meeting of Northern MPs and administrative officials at the Presidential Secretariat. TNA MPs alleged ongoing Sinhalese settlements in the North. The President in front of those present called up Mahaweli officials who denied any settlement in recent times.  The President announced that the accusations were false. Tamil officials like the GAs who know that settlements are being expanded, kept quiet as to be expected of those who are insecure and fear transfers.

However, as the top part of the land alienation deed pictured here shows, somebody is lying. It is dated “2018.08.06,” almost 3 weeks before the President’s denial. There are at least 7 other deeds like this of recent days, in addition to 25 acres to the sister of Minister Nimal Siripala de Silva which was gifted earlier.

Colonisation is ongoing apace. East of A9 at Muruhandy where the LTTE settled its people, Sinhalese now live in comfort and no Tamil is allowed nearby. 

That is our government!  How do we trust it? The President’s broken promise of a red carpet welcome to returnees pales into insignificance when the promise of good governance especially with respect to reconciliation is breached so shamelessly through lie after lie against the Tamil people. The only way out for a Tamil seems to be to agree to Sinhalasization and satisfy the government’s appetite for genocide without a single Tamil left on the island. Sadly, that may be the only Tamil response that is safe for us.

Gullible Fools?

Consider the ethnic cleansing in 2009 which by UN figures saw 40,000 individuals massacred. President Rajapakse is on record saying there was no casualty during the war as soldiers advanced with the human rights charter in their hand. Then, the government agreed to war crime trials with foreign judges but many insisted that there were no war crimes. Now President Sirisena wants to renegotiate its agreements under Resolution 30/1 at the UNHRC. 

Then, army commander Mahesh Senanayke said there were some crimes for which the soldiers need to be prosecuted. The faithful continued to insist there were no massacres. This week Minister Champika Ranawake brilliantly suggested amnesty for both sides – that is, amnesty for those soldiers who murdered thousands of Tamils (and against whom there is a mountain of evidence in Geneva) and a few Tamils in prison without any credible case against them and are locked up out of hatred for them. 

After all these flip flops, do the Sinhalese really believe there was no mass-scale murder of Tamils? We may be a nation of gullible nationalist fools, but the President and our southern brethren must understand that the people in Geneva are no fools. The President will return empty handed, but win over some gullible nationalists to his side at great cost to Sri Lanka as a nation.

    Yes but he has been doing this from the day one.
    Not much is achieved and how could he achieve it while hehimself being supportive former men than his coalition constitutents ?

    Almost many investigations on the crimes reported on the former high men brought final decisions them to be charged, but incumbent president stood on the way not allowing LAW BOUND authorities to do the job.
    Followings are few examples
    1). Thadjudeen murder – this was not a murder but an accident prior to 2015.; However facts proved it to be a murder.
    Then former Prez s wife was caught by her involvment – to have provided the vehicle for the criminals to abuse in terms of the alleged murder.
    Not even former first lady was yet investigated, each time law bount authorities were about to do the job, President s invomvent blocked it…

    2) Yoshita Rajapkashe should long have beeen jailed for the same reasons, evidnece proved that the boy had businessses runing on while him being part of Navy…. if the law in the same country had been active putting former War won Army commander – that way keeping him 3 years long in prison, why Yoshita or any other cirminals should not have been.
    Here – we need to check Gotbaya went abov ethe law in term of the verdict given to SF – then GR too should be put in jail for that big blunder even if Avandgarde is complex issue

    3) All these have been blocked not by PM, but by CURRENT president.
    4). Navy leaders say soldiers cant be heroes if they commited crimes…
    Heroes cant be soldiers if soliders commited crimes.
    All in all…. the political men in high positions stand on the way- even former FCID chief removing from its position, PRESIDENT should be blamed…. he has fully forogtten forwhat purpose he has been elected

      Hindus and Buddhists both believe in Karma , or cause and effect. In the US – they call it ” the butterfly effect or string theory – a mathematically provable fact. But here is the question ? If the Sinhala Buddhists are so bad ; why have the Tamils from India failed to conquer their so -called Ancestral land since the days of Dutugamaunu ( 337 BC ) ? Even Rama failed to covert the inhabitants of Lanka to the racist Hindu Brhamnical caste system
      Conclusion : Tamils need to be led by Hindus not low-class Portuguese slave converts. Also please learn either Elu, Pali, Sanskrit or Sinhala instead re-writing Tamil Nadu Fiction as History. ( and killing people based on it )

        I hear you pain Rajan, but since Nikki Haley called UNHRC a Cesspit and the US is funding the Sri Lanka Navy and Army to occupy land in northeast and militarizing Lanka in its War Games with China in the Indian Ocean, and more over it is US Citizen Gota Jarapassa that has command responsibility for war crimes, but is hanging around in Colombo to become next Prez with assistance from the US Embassy in Colombo,; accountability for war crimes is a lost cause!

        Much better to pursue the financial criminals and put Gota and Bondscam Ranil who is protecting Mahinda and family all in the same Prison Cell for looting Lanka.

    If Sira didn’t put Dr Ranil’s Royal Buddy’s SIL behind bars, Sira would n’t have been in this position today.

    Now Sira is totally dependent on the Navy and the Army for protection. That is what Sira’s mate and ex Heavy hitting Yahapalana Minister SB Dissa said the other day.
    Just imagine if Sira went the UN and agreed to hand over 26 thousand Disabled ex Soldiers and their brave Commanders to the UN Judges.
    Sira would have had to ask Atul Kessup to get him a Protection Visa from Uncle Sam…

    There are many, not few Tamils in the diaspora who are guilty of murdering, providing of material and financial support to murder Sinhala civilians. They should be brought to face the International Panel of judges before Sri Lanka prosecute any military men. International community is intelligent and not gullible as the writer rightly says and, they know enough of Tamil Terrorism not to be fooled by the losers of Terror who lost the war they they started. And, it was a humiliating defeat they suffered. Got what they deserved!

      There is no such thing as “Tamil terrorism” is something the world knows. The LTTE claim the loss of Sinhala lives during their time was in the co.urse of the “War” where civilian deaths sometime becomes inevitable. This is different to State armed forces deliberately targeting non-combatant civilians – from land, air and sea. Now it is revealed the high-ups in the Navy were abducting unconnected, innocent Tamil youth, even in Colombo, for ransom.
      Many of these children have been sadistically killed – for absolutely no reason. This happened in the Police, the army and other uniformed forces during the “War” UN agencies and the world reportedly know some of the details. Mr. Sirisena has to conduct himself as President of all the people – not of the Sinhalese only. I am aware he has to save his skin too – in and out of office. If those judicial officials in The Hague mean business the fate of Bosnia’s Rodovan Karadzic and Liberia’s Charles Taylor may well visit some of our own too. That is, if UN agencies have teeth and are universally effective.

      The only so called Sinhalese civilians killed by the LTTE were not civilians at all but thugs,criminals, murderers and ex convicts who were settled on ethnically cleansed Tamil lands in places like Manal Aru ( no called Welioya) to terrorise the Tamil population in the neighbouring villages, so that they may leave and run and more Sinhalese can be settled in these ethnically cleansed lands. They either ran away in fear of the LTTE or they LTTE killed them, as they were deliberately committing acts of rape killing looting on the local Tamil population with weapons provided by the Sri Lankan state. Just like what happened in the east where Muslim militias were used by the government to commit atrocities on the Tamil civilian population . The Sri Lankan government, the army and Sinhalese racists like you , know the truth but want to portray to the world that these a innocent helpless Sinhalese civilians who became victims to LTTE atrocities. Innocent my foot. All hardened criminals, murders ,thugs and ex convicts deliberately sent to Tamil areas to create chaos and mayhem. Just like they are doing now sending all the Sinhalese extremists/dregs to the colonise Tamil areas and create trouble. Ordinary law abiding Sinhalese will not be going to these areas. We also know that the Sri Lankan STF deliberately bombed a bus and killed Sinhalese civilians in remote areas and then laid the blame in the LTTE. The maximum number of so called Sinhalese/Muslim civilians( sic) killed at the hands of the LTTE was around 3000. Compare this to the more than 300000 Tamil civilians killed by the Sri Lankan state and more than a million chased away from the land . A government that is supposed to protect all its citizens irrespective of language ethnicity or religion was deliberately targeting the Tamils from the time of independence.       Totally agree. There may be a way out with UN. Since UN is asking for foreign Judges participation. SL Govt through UN can ask those LTTE supporters who are living abroad to be Judged by Foreign Judges. If UN refuses, it cannot ask SL Govt to investigate locals as well. One stone two birds.

    The people of Srilanka should realise the truth about our political leadership in Sri Lanka and the islands economic, cultural, political status of this country since independence. Did we ever had a peace in this country? How many bloodsheds happened in this island and how many innocent civilians (Tamils, Sinhalese, Muslims) killed in this country unlawfully and any one was brought under justice system? I am not talking about Tamils but also Sinhalese as well. In fact, more Sinhalese were killed unlawfully and no one was brought under justice. Why should we have laws and justice system if we don’t respect them. We continue to ignore those crimes and criminals and they continue to cheat dividing us. Basically two or three families cheat over 20 million people. They divide us Tamils, Sinhalese and Muslims. They divide us Hindus, Christians, Muslims and Buddhists. They divide us SLFP, UNP and TNA. Can’t we get together and ask for justice to all 20 million?

    Fooling the UN is so easy. We cosponsored a resolution so that the weight of the resolution will not be shifted against us, and we successfully violated the resolution which we sponsored in the first place. Every time the high commissioner changes, they have different agenda, and all we have to do is keep promising to the Council that we are still working towards it. ta da. when the government changes then we will blame the previous government. If we can drag it for 10 to 15 years, no body want to remember this anymore. Fooling Hr council is easy as stealing a candy from a child.

    Thank you Professor Hoole for exposing the hypocrisy of Sira and Ranil Yahapalanaya and their failed attempt to cover up the war crimes of MaRa and Gota including the massacre of over 40,000 innocent civilians while protecting actual LTTE hard cores.

    All of these crooks like SiRa, Ranil, corrupted Mara and uneducated idiotic GoTa can gullible Sinhala Buddhists, but they cannot fool the international community.

    What has the UN achieved in the interest of the world’s oppressed?

    The Third World has been constantly fooled by the UN on behalf of the US, which dictates terms to the UN to protect the world’s biggest war criminals and violators of human rights like Israel and now Saudi Arabia, alongside the US itself.
    War criminals like Paul Kegame of Rwanda not only walk free but also rule unchallenged because they are clients of the US, while the UN has kept silent on the foul murder of Saddam Hussain and Muammer Gadaffi.

    Tamils are naturally violent. Who are thuggies. I heard the British govt slaughtered about two million thuggies. So, these attacks are and killing each other is very normal. In tour report it is just fist fights with small weapons. Why did not you mention about Tamil raping inncent girls or infatn girls and the politician coering up them. Even before the war, Tamils sliced Tamils because they were of low castes. UN visit is necessasary. Juat check whether the whole ROyal family going to be there and whether they will gt the Royal suite for accomodation, how many are the entourage. Is it 95 people including the security detail. Here, I see they are moving but not much grandure, very normal.

    UNHCR is a joke. Because of what Mangala, UNHCR’s PArent and THE SOLE SPONSER – Organuuzation HAD TO QUIT UNHCR. Because Sri lanka became a co-sponser. Now, UN is known to destabilize countries too. Recently in Nicaragua, there were constant anti-govt protests for months and killed polimen as well as protestors. Very smart president Ortega was silent ans was watching it. By the side, A UN Panel was investigating this for human rights, democrazy, transparency etc., etc.,. IT is very amazing, the govt had noticed as soon as the UN Panel submitted their report to the media, the protests had stopped. I heard now the same thing is beginning in PHILLIPINES because IUTARTAE is pro-Chinese and was talking against the Chinese involvement in south china sea and began war ganes with the world’s police.

    The real situation is that president has an obligation to listen to & make happy the majority, that’s an aspect of democracy.

    But that doesn’t mean that the minority can be given injustice to make the majority happy & fulfil a requirement of democracy.

    Both these majority & minority are citizens of one country.

    Now time has come to both majority & minority to come to agreement to punish each other without foreign or UN or its bodies participation to settle matters because UN & its; arms like UNHRC are partial & can’t be trusted as they’re instruments of super powers.

    Together we have to make our country a peaceful one for all of us to live together.

    We are excessively talking about inequality and injustice caused by world
    powers and International orgs like UN while doing nothing at home to do
    things to escape hardships . My thought is , it is beyond our capacity to bark
    (sorry I use this word) at the caravan knowing well , it won’t stop ! You see ,
    the powers you are talking about waited 42 years to finally get rid of him from
    the world politics in which he made it sure that he never miss an opportunity
    to lambaste the UN and other world powers for their role in International
    affairs .specially the middle East an Africa . And it is same with Saddam ! They
    believed in their powers beyond their capacity , they made it their politics to
    play to the gallery and survive and all they had was oil , nothing but oil and a
    Muslim history of conquering some parts of the world including some parts of
    Europe all of which were collapsed . Now I wonder why we take a leaf from that
    mighty falls ? What is our capacity ? Who are we ? Let us just focus on a good
    cup of tea we produce but don’t even know nothing but Tea-Dust is what we
    drink calling it a KAHATA which , the real Tea is not really KAHATA !

    There was this MR-team. One wonders why their murmurs (if any) was hardly audible. The impression was that the MR-team also supported the resolution.
    MR saw an election winner here. He created this nebulous SLPP. The language/religion-divide together with the resolution is a winner………
    ………- and so he thought. The PCoI findings on SriLankan Airlines is a bit too bitter.

    Haven’t you understood the direction your Country had been going from for the last 70 years? Are you still not convinced? Are you all under siege by the murderers?
    High time you get your dignity and return to developing for your future generation. Never again allow your LEADERS TO SHOW THEIR WEAKNESS AND ULTERIOR MOTIVES TO THE INTERNATIONAL COMMUNITY IN THE UN!       I carry knowledge in abundance but I am a village man a farmer. So I am going to talk to you like a farmer so you can understand and realize why your resolution 30/1 had a still birth.

      If a farmer puts potatoes he gets potatoes!
      If he puts tomatoes he gets tomatoes.
      You knew I was a key person in the last govt and a loyal member of Rajapaksa’s inner circle. You also knew that in the last Presidents absence I was the defense minister in charge. So while drawing the resolution you knew or should have known that I am guilty of most of the crimes you accuse the military of.
      I could be a village farmer but not a village idiot you think I am to incriminate myself by allowing transparency or men that are actually qualified to do the job.
      So with respect I request you to withdraw your resolution.

    Totally agree. There may be a way out with UN. Since UN is asking for foreign Judges participation. SL Govt through UN can ask those LTTE supporters who are living abroad to be Judged by Foreign Judges. If UN refuses, it cannot ask SL Govt to investigate locals as well. One stone two birds.

    Every Sri Lankan should learn to treat every other Sri Lankan as a “Sri Lankan”. It does not matter what religion, language, race or cast the other person belongs to all are Sri Lankans. This should start with Buddhist Mahanayakes/Priests, Catholic Cardinal, Other Christian Leaders, Muslim and Hindu Priests, Politicians of all parties, and civilians. There should be a special court with Senior Judges appointed who should have the legal right to punish all those who do not treat the others as Sri Lankans. Those who are found fault should have to serve 5 years in prison. Another important move should be to ensure all students should learn all three languages up to Grade 10.

      I agree with you, absolutely. Your condemnations start with clergy of all these religions, who try to manipulate their flocks.

      Let us also underline the fact that we allow ourselves to be stuck with the same old politicians for ever and ever. It is never easy for some new face to get known – it can cost a great deal to acquire the necessary profile, and then the guys steal to make good their expenses.
      .
      This is the dilemma that we face. How to replace current crooks!
      .
      Education is a greater mess than many of us realise. By emphasising exams the way we do, we encourage people to know only what is in the syllabi. We shouldn’t penalise those who don’t know the three languages. It isn’t easy to learn a language. However, acquiring the ability to use all three languages should be encouraged.
      .
      There’s only one place to start: hold all these lying and corrupt politicians accountable!

      How can this be practical in an island dominated by extremists ?

      Mahanayake themselves either keep quiet or behave with SLOTH behavour when it comes to the racial issues. They dont have guts to name which leader who went wrong in terms of racial violences in the coutnry today. THey are alright whenever even brutal leaders go to them and kneel down before them.
      Gotabaya Rajakashe is NOT buddhist – but a multi murdererer with much higher potentional to kill or harm own folks – and behave lanken context – a vegitarian a d buddhist of high starndard. Either definintion of BUDDHIST should be changed or have to change the definition of multi murderer.

      In today s context, we have all freedom being given to the poeople to protest and do anything but police investgations move though with snail nature.
      These were not the case even if anyone would have been attacked under previous so called MUGABE style rule.

      I believe, while doing all what the STATE can do in terms of improve reconcilation, school zylabusses should be included DISIPLINE and ANTIRACISM and HISTORY.
      All these are very important. If these govt to achieve their primary goals.

    UNHRC IS JOKE. It is a another branch of USA and west. as long as we are with west every thing will be ok. There are so many crimes committed by west(US , Uk , Israel, etc) last 20 years. Where was UNHRC .It is all about politics. Mr Hoole is day dreamer. Keep dreaming for Elam. In another 15 months time will be all over.

    The actions and inactions of Sinhala government vis-a-vis the Un resolution are not new Eelam Tamils.We have witnessed and experienced this since British left the Island handing over Tamil Kingdoms, which existed when the British took over the Island from the other European colonialist.The present pathetic dilemma of Eelam Tamils is due to the part played by india-which non wants to mention here for their own convenience.From the day one of our freedom struggle India didn’t want the Eelam Tamils to regain the country they lost to European colonialits and to the sinhalese since 1948.Indra Gahandhi’s private secretary Parthasarathy told the PLOTE leader Tharmalingam Sitharthan in New Delhi in December 1983 -few months after Black July-that neither India nor Indra would allow the formation of independent THAMILEELAM.So from the word go of our freedom struggle India was against our birth right and aspiration of regaining the independence which we lost to the European colonialists along with sinhalese but the sinhalese were fortunate enough to regain it.We have to admit even our freedom movements did not recognise India’s intention and paid a heavy price for the deception.India’s role after waris even worse to say the least.They watered down the Un resolution after failing in their attempt to prevent it being accepted.Now they have succeeded in making the Eelam Tamil’s leadership to become the pawn of sinhala government.Eelam Tails are political orphans now..For the first time since 1948 eelam Tamil’s leadership is not with them-thanks to India.This is the predicament we Eeam Tamil’s are facing now.Will Eelam Tamils see the light at the end of the tunnel,remains to be seen.
