“Liar, Liar! Sarong On Fire”: Sri Lankan President & Prime Minister Caught Lying To Cover Their Inaction

The buck must ALWAYS passed FROM here” must be the sign on top of President Maithripala Sirisena’s table. It must also be on the tables of several Ministers of the Government including the Prime Minister. In fact it must have been there on the tables when they got to the respective offices. Their predecessors too must have had it when they got there too. It is a hallmark of Sri Lankan politics to pass the buck. 

However passing the buck in the magnitude we have seen in the last 5 days is unprecedented. The President, Prime Minister and the State Minister of Defense all have dodged their responsibilities. The blame has conveniently been shifted to the Inspector General of Police and the Defense Secretary who are being forced to resign in the aftermath. 

The President, during a discussion with religious leaders on 26th April 2019 said, inter alia  that there are no laws that allow for the banning of the NTJ. The Prime Minister in an interview with SkyNews (UK) said that there are no laws in place to arrest returning ex-ISIS fighters as joining a foreign terrorist group is not a crime. 

Both these comments by the President and the Prime Minister are highly irresponsible and erroneous and makes Sri Lanka look like a primitive nation whose laws have not caught up with the 21st century. In fact both statements are outright lies. Although it is true to an extent, that our Parliament has not legislated to catch up with the advancements of the world, we do have the necessary legal framework to cover both situations which were referred to by the President and the Prime Minister. 

National Defense and Maintenance of Public Security 

It is a basic concept that we, the sovereign citizens, waive “our natural rights in favor of the State, which by its protection, reconcile equality and freedom”.[1] This is considered as the social contract of a  functioning democracy. Therefore in exchange for protection, equality and freedom, we abdicate our sovereign rights in favour of the State. 

Article 4(b) of the Constitution of the Republic enacts that “the executive power of the People, including the defence of Sri Lanka, shall be exercised by the President of the Republic elected by the People”. Thus there is a direct obligation on the incumbent President to ensure the defence of the Republic both from internal and external aggressions. Further, the President has the sole discretion to declare war and peace, and that discretion is the only discretion exercised by the President which is not subject to judicial review by the Supreme Court[2] in any Fundamental Rights application.[3] 

For the maintenance of good order and peace of any democratic Republic, laws that provide for exigencies and emergencies are essential. Although in ordinary course, the Legislature must make laws that applies for situations, in emergency situation where ordinary public life is in danger, the executive must have the power to make laws that takes back control of the situation. In Sri Lanka this aspect is covered by the Public Security Ordinance.

Article 155 of the Constitution gives legal validity to the Public Security Ordinance. It enacts inter alia  that any regulations, made under the Public Security Ordinance has the legal effect to override, amend or suspend the operation of any law or Statue of the Provincial Councils, except the provisions of the Constitution. – This is an important safeguard in the Constitution. It ensures that an eccentric President cannot suspend the operation of the Constitution and declare himself king, by proclaiming that there is an emergency. There are further safeguards that are placed in the Constitution to ensure that an overzealous President does not arrogate unimaginable powers unto himself. Any proclamation of emergency must be forthwith be communicated with the Parliament, and approved by Parliament within 14 days of being issued. Emergency declared by  Proclamation is valid for a period of 30 days only, and must be extended by the President every 30 days and all such extensions must be approved by Parliament and if Parliament does not approve such proclamation, the proclamation of emergency shall immediately cease to be valid. These important constitutional safeguards and prominence is given to the Public Security because the President is expected to react swiftly and diligently to emergencies only and not to abuse the powers entrusted with him. 

State of Emergency and Emergency Regulations 

It is in this background the Public Security Ordinance must be assessed. In terms of Section 2 of the Public Security Ordinance, the President in his absolute discretion may declare that an emergency situation has arisen and bring Part II of the Ordinance into operation. Until such Order is issued, Part II of the Public Security Ordinance remains inoperative. Although the calamitous events took place on Sunday 21st April 2019, since the President was overseas, Emergency could not be declared until a day later.[4] 

By the aforesaid Order, Part II of the Public Security Ordinance was brought into force, no regulations in terms of Section 5 were issued immediately thereafter. Originally the Government Printer’s website indicated that the Emergency Regulations were to be published under Gazette Extraordinary No. 2120/04. However, it was only available on 24rd April 2019 at 7AM under Gazette Extraordinary No. 2020/05 giving a strong indication that the Emergency Regulations were in fact not actually published on 22nd April 2019 as indicated in the Order. Adding further to the mystery the Gazette Extraordinary No. 2120/04 was published on 23rd April 2019 calling the Tri-Forces to maintain public Order. In fact it was only on 23rd April 2019, a whole 2 days later that the tri-forces were deployed to maintain public security. Although the changes and delays in publishing the Gazettes seems so trivial in the larger scheme of things, it clearly demonstrates that the President nor his public officials had any preparedness to respond to any form of emergency. 

Insofar as the President is concerned, he is now empowered to legislate during the emergency period overriding the laws enacted by parliament. Therefore his argument that there are no laws that could be used to proscribe the NTJ[5] is factually false. The first option available to him is to promulgate an Emergency Regulation to proscribe the NTJ. Given that it is an urgent matter, this is the very purpose of Emergency Regulations – to urgently make regulations that could cover situations of the nature we are faced with. In fact, in 1998 after the bombing of the Sri Dalada Maligawa, the then President Kumaratunga proscribed the LTTE by way of an Emergency Regulation.[6] Thus there is precedence of such immediate action being taken in the aftermath of grave tragedies. Similar steps could have been taken by the President, if he so desired and/or if he was duly advised by the eminent counsel who advise him. 

The second option available to the President is to proscribe the NTJ under the Prevention of Terrorism Act. This aspect would be considered subsequently. 

Prevention of Terrorism Act No. 48 of 1979

In the aftermath of threatened and actual violence by the LTTE, in 1978 the National State Assembly enacted “The Proscribing of Liberation Tigers of Tamil Eelam and Other Similar Organizations Law, No. 16 of 1978”, which was in operation for a period of 2 years. In the meantime, repealing the said law, the Parliament in 1979, enacted a temporary legislation – until a better law is drafted – the Prevention of Terrorism (Temporary Provisions) Act No. 48 of 1979 with the view of the said temporary provisions being in force for 3 year from date of commencement.[7] Thereafter, in 1982, the said time limit of the Prevention of Terrorism (Temporary Provisions) Act was repealed by an amendment[8] making the Prevention of Terrorism (Temporary Provisions) Act indefinite in its operation. 

Section 27 of the Prevention of Terrorism (Temporary Provisions) Act provides that the Minister of Defense may make regulations under the Act for the purposes of carrying out or giving effect to the purposes and provisions of the Act. In 2011, when the Government decided to lift the State of Emergency which existed, the question arose as to how the LTTE could be continued to be proscribed as the proscription has happened by way of Emergency Regulations in terms of the Public Security Ordinance. Therefore, the then Minister of Defence promulgated new regulations[9] under the Prevention of Terrorism Act.   

Thus it appears that what is needed to proscribe the NTJ is a set of Regulations promulgated by the President. He need not even draft the regulations afresh as he could simply copy, paste and modify the existing regulations which prohibit the LTTE. Subsequently if there are any shortfalls, additional regulations may be brought into effect. 

Therefore the claim by President that there are no laws are in existence to proscribe the NTJ or any other terrorist organizations is grossly false and erroneous. In fact, it is an outright lie. It is nothing more than attempting to shift blame to others for the incompetence of the incumbent. It also appears that the President has no genuine interest in proscribing the NTJ or any other fundamentalist or terrorist groups operating in Sri Lanka. 

Meanwhile speaking to SkyNews, UK, the Prime Minister stated that Sri Lanka has no laws that could have been used to arrest returning ISIS fighters.[10] This too is an outright lie. In fact, the Prime Minister, was part of the legislature back in 1978 when the Prevention of Terrorism Act was enacted, which is one of the laws which could have been used to arrest and prosecute returning ISIS fighters. Someone on Facebook had quite cheekily asked “we have laws to arrest a bunch of boys for showing their asses on top of pidurangala, but no laws to arrest an ISIS terrorist when entering the Country?”. Though the question is an oversimplification of the issue, that is the sentiment shared by the vast majority of the online community. 

For argument’s sake, let us assume the Prime Minister was correct. Even then, have the intelligence community interrogated them on their return to the Country? Have they been put on a terror watchlist? Were their activities after return to the country monitored to see if they engage in illegal activities?  These are the answers the Prime Minister must provide. Instead, the Prime Minister makes such unwise an ill-advised comments to overseas media making the entire nation the laughingstock of the world. 

The Prevention of Terrorism Act defines “unlawful activities”[11]  to cover acts done within or outside of Sri Lanka which would be an offence under the Prevention of Terrorism Act. In fact, many have been arguing for many years that the reach of the Prevention of Terrorism Act is too wide and draconian. The retuning ISIS fighters could have been arrested under the provisions of the Prevention of Terrorism Act if the government was so inclined. Citizens have been arrested and detained under these provisions for much less in the past and it is well documented.

Another aspect that has slipped the minds of the legal luminaries who advise the Prime Minister and the Prime Minister himself is the provisions of the Penal Code. It is a basic principle of law that laws are territorial unless specific extraterritorial jurisdiction is conferred by the legislature. 

The Penal Code in its original form only envisaged the punishment of offenders for offences committed within the territory of Sri Lanka. However, by way of the Penal Code (Amendment) Act No. 32 of 1991 the applicability of the Penal Code was extended to offences committed by Sri Lankan Diplomats residing overseas. Thereafter, in 2006 by a further amendment, the Penal Code was made applicable to offences committed by all Sri Lankans in overseas territories.[12] Therefore if the former ISIS fighters had engaged in any activity that violated any provision of the Penal Code, they may have been arrested and prosecuted if the Government so desired.  The Judicature Act provides that the High Court has the jurisdiction to hear such cases.[13]

It is thus evident that the failure to Ban the NTJ or ISIS in Sri Lanka or to arrest returning ex-ISIS fighters were not due to any legislative lacuna but the lack of competence of the government to make use of the available legal provisions to do so. 

Therefore, the narrative extended by the President that there are no laws in place to proscribe the NTJ and the narrative by the Prime Minister that it is not illegal to join an overseas terrorist organization are outright lies. As the two most powerful persons of the Republic, they should not be so callous or ignorant with their words at this juncture. They should be reassuring the public that every step is taken forthwith and not procrastinated. Sadly the reverse has happened over the entire last week. 

Mr. President, Mr. Prime Minister, you two should hear yourselves on media. You two have been providing nothing more than comic relief in this time of grief. Either you two get your act together. Illegally blocking access to some websites and communication applications does not resolve all problems of the Country. Plasters don’t work when one needs surgery. The public have caught on to your lies.

    Well said. If there is a will, there is a way. Government wanted to soft paddle on ISIS returnees so as to keep the goodwill of the Muslim Community and some Islamic countries. How was Foreign Minister Kadirgamar able to get LTTE Banned in many countries which ultimately helped to decimate LTTE. Is Kadirgamar a super Foreign Minister? He did what is expected of a Foreign Minister. For Ranil it is a surival game from the day the Bond issue came to light, and he has no time to think on governance.

      Sirisena excluded everyone else and hogged the defense ministry for another future illegal power-grab. Can anyone counter that?

      This is a clear dereliction of duty of the entire freeloading political establishment.

      Replacing the current with another former is not the answer.

      Need to get rid of the entire lot of scumbags and start anew.


      This not an excuse …….. but for the record even the USA failed to heed the clear warnings when warned that some Arab/middle-Eastern pilot-trainees were only interested in learning taking-off and not landing aircraft.

      Lapses happen …….. but no one should be allowed to get away with excuses without facing the consequences.

        According to intelligence officers, not only Siriena and Ranil but also Mahinda and Gota knew about the impending attack by Muslim extremists. They did not take any action because it was told to them it will be a minor one where tourist hotels and churches will be targeted probably in eastern province where the casualties will be foreigners and Tamils. They all wanted this to happen for the government to subvert democracy and for opposition to come back to power. Unfortunately for all of them it was beyond their expectation with tourism industry affected and large number of Sinhalese killed. Now they are trying to blame each other. Even now only lower rank persons are being arrested and not king pin Muslim politicians, businessmen and professionals. Few years ago when 40 Muslim youths were arrested by navy in Vanathivillu for undergoing military training, they were released by the government on the intervention of Hisbullah. Also test explosion carried out on 16/04 was done in the land owned by Hisbullah, who cannot feign ignorance of his property being used for terrorism. Rishard Badurdeen is accused of giving lands to these terrorists in Puttalam area and having connection with the Muslim businessman arrested. Now a municipal councillor from UNP and deputy mayor of Negombo from Mahinda faction have been arrested. Both present and past governments since 2009 turned a blind eye on Muslim terror unleashed on Tamils in eastern province and Mannar for political gains, which has led to the current situation and are both guilty of abetting Islamic extremism.

            This is in Tamil Media. It is unlikely to be a rumour.

            The news also mentions that Rajapaksas did not attend Easter prayers.

            However, I suspect Sri Lankan intelligence have turned blind eye or something similar attitude, because all adverse and side effect would be predominantly on Tamils and in their eyes would be 100% beneficial.

      So, the problem has been identified. The solution is to separate the liars from the general population, just like separate the terrorists from the Muslims and others, and deal with them appropriately.

      People like to believe there have been super heroes in and around the world. The fact of the matter was the Twin Tower attack took place in 2001 however LTTE was banned by USA in 2007 and Brits banned it in 2001 and EU in 2005.

      Its says a lot about coincidence, accident, ………….

      By the way this bombing is a major incident in the history of Muslims in this island. Why is it that we do not seem to hear from many Muslims in this forum and elsewhere? Unusually a few or none at all have appeared expressing their honest opinion like the Tamils during the reign of LTTE or the Sinhalese during JVP’s glorious rule.

        This week, the Horn of the Satan showed its ugly head.

        Close to 50 percent of the ISIS fighters were from Wahhabi Saudi Arabia, and the rest of the idiots from elsewhere , including quite a few from the Land of Native Veddah Aethho.

        The World View of the Muslims , that it is a religion of peace, was shattered by the Satan following Wahhabi-Salafi terrorists. While many Muslims, especially the Sufis, Shia and Ahmedia have pointed this out, the Saudi petrodollars have bought many Muslims and the politicians

        As long as Muslim allow or accept that the Wahhabi-Salafies and clones are Muslims, there will be terrorism , deaths of many innocents, and many Muslims who would have ended up in heaven, if it is there, will end up in Hell, if it us there as well.

    There is little point in banning organisations when its suicide bombers that are involved. If they do not care about their own lives will they care about a pesky law that bans them?

    According to the Dailymirror a group of about 150 with similar ideas is formed. They discuss the ideal time for an attack. Some think it’s not the correct time. Obviously the narrative tipped towards an attack along the way.

    These kinds of orgniasations are always infiltrated by the likes of RAW, CIA and Mossad etc. What if an operative of this kind tipped the conversation in favour of an attack. No one would know.

    In a globalised world with many agenda these kinds of organisations get easily used for other ends. It’s the innocent Moslem civilians that will have to face the music when that happens.

    The Moslem politicians are responsible for not getting a handle on things. Groups like the BBS takes to the road in crude and ugly way when the politicians, the media and the secular civil society do not handle things with much more finesse.

        I made that observation because Indian intelligence had prior knowledge of the attack. So they must have infiltrated the group somehow.

        Agree with you on this. No law prevented the GoSL from taking action, and existing law would have been more than adequate to preempt the kind of terror that we saw.

        But there is something that doesn’t seem to have gained enough attention. It is that there were a lot of Muslim men in the armed forces as well as the intelligence services who helped the GoSL in its war against the LTTE. Some of them could easily have been lured by the Islamist radicals to join and train them, and others might have soft pedaled the radicalism in their communities, wittingly or unwittingly. It is hard to imagine that people without any previous experience in handling weapons and explosives could have pulled off a terror operation of the scale and complexity seen on Easter Sunday. The Muslim politicians at high level positions, such as cabinet ministers and governors, might also have soft pedaled it unwittingly.

        That, along with the confusion created by Sirisena’s attempted October coup, might explain why clear intelligence warnings were not heeded and acted upon.

Wickremesinghe says there are not enough powers in the PTA. What bunkum. He is simply not competent to use the law to put an end to this nonsense. Gotabhaya is no answer. He will sink the country in more bloodshed of his own making, demolishing all those who do not accept the will of the Rajapakse. It is time to sweep the deck clear of these old rascals and think of a new group of leaders. Sooner said than done but it is so essential.     No doubt the president was caught napping. If the report in Anidda is believed, the President was briefed on attacks but did nothing – which is worse.
    As for the PM statement, what specific offence under the penal code was alleged to be committed to arrest returning fighters? Was there any complaint?

    People should not be getting into these pointless emotion – fuelled debates at this stage though. It serves no purpose.

    As pointed out in other comments it seems RW was trying hard to modernise counter terrorism laws.

    Also seems like president kept defence and law and order matters close to his chest after the coup.

    We should investigate that after the situation is under control. Should also investigate the pseudo patriots who caused communal disharmony by propping up the BBS etc in the first place

      Whatever the school that one studied in, once a person enters politics and finds himself ensconced in a position of power and influence, his character an personality change.     Both have to go & the government too but smooth transfer of power in democratic way, not pulling the country to further chaos is vital.

    Parliamentary election 1st & presidential 2nd.

    In case presidential held 1st racism may become excessively deciding factor & again instability.

    A fresh parliament can start & guide the journey back to pre 78 era.

    Elections commission should do procedural changes to assure perfect elections. It must see the possibility of discouraging contesting of parties that can’t stand alone for elections without making alliances.

    Grouping after elections is OK but if 2 or many parties come together as a party for the elections; their previous entities must become null & void.

    In other words, If UNP forms a new party called UNF, all the participating parties must lose it’s previous identity. (UNP, MC, TNA etc.)

    Likewise for the SLFP.

    There’s no public demand for constitutional changes in 70s but pressurized people under SB govt. gave landslide 5/6 victory for JRJ

    JRJ miscalculated it & went for constitutional changes causing present havoc to the country.

    All your legal arguments, and case references a part, there are are three fundamental issues that needs to be addressed:
    The social contact theory, initially conceptualized by Boobs in 1651, and late argued by Rousseau in The Social Contract (1762), addresses these social contracts as a moral and/or political obligation by the citizens of a democracy thus not a binding commitment.
    Also these theories put forward, and argued later ONLY fit the societal structure of that era, and does not hold fort in the web of social interactions that from the culture of a society in today’s context.

    with all the entangled references in your article, the real essence of you argument is that both Sirisena and Ranil either do not comprehend the level of their executive authority, or are back-peddling in making the right decisions.

    I am of the opinion that is the latter, and not the forth, given the timing of this dreadful event.

    My final request to you is: Do make your articles more reader-friendly, by leaving out the jargon ( to impress).
    The readership will gain benefit from your knowledge and your journalistic abilities, if you were more down-to-earth and simplistic.     Sira tried to hang onto power. Ranil tried to fortify his authority in UNP to become Prez in 2020. MR tried to rob power at every given opportunity. these three crooks were very busy on their their targets. meanwhile every institution, every boss, every military officer in the country took one of the three sides. professionals weren’t an exception. country became lawless, headless & desperate. people saw no leader, no credibility, no government in the country. an absolute joke & anarchy. we’re paying the ultimate price for it.

      There was sedition in that the guys wanted to establish a caliphate in Sri Lanka, there was abetment of murder as they encouraged each other to kill. If you are mindful, there are any number of offences for which they could have been detained. It is just that there was a dereliction of duty by PM and President, not a lack of laws.

    If the President and the PM were not advised of the reports from Indian Intelligence, as the two gentleman claim, there has clearly been a serious Security lapse. I imagine most of us will have received their protests of ‘innocence’ with suitable reservation. And, for my part, I find myself also asking whether, if they had been briefed, it would have been made a difference anyway! And now we have the President dragging in the red herring about the present government weakening the security apparatus by dealing with errant officers in those ranks. The President would have us believe that anyone in the Services, who had some role in bringing the conflict with the LTTE to an end, is a war hero – what an abuse of that term – and must be treated as some sacred cow immune to prosecution for any wrong-doing. The excuse that the suspects could not have been apprehended under existing legislation does not wash. If the potential threat of terror attacks was taken seriously enough, you could have surely found a way to do so. The fact is that the parties concerned were incredibly inept.

    MP Piyal Nishantha of Pohottuwa says 11 Army men were killed at the Kalmune incident.
    Piyal Nishantha’s statement should be condemned vehemently as it is clear that his motive is to INCITE Sinhalese.
    The Police has denied any deaths of Police or security forces.
    I urge Sinhalese, even if people died, PLEASE DO NOT RESORT TO RACE RIOTS which will allow American forces who are already in Hambantota to take over the country.
    Piyal Nishantha, who is a strong stalwart of Basil Rajapaksa clearly had a hidden agenda when he made these utterances.
    It is now clear that Pohottuwa is also playing a part here.
    I WISH TO SINCERELY REQUEST Sinhalese, our Army is carrying out search operations right now which is overwhelmingly supported by Sinhalese, Tamils and Muslims.
    Therefore, please don’t do anything to hamper such operations which are carried out in search of terrorists.
    A large number of weapons of all sorts have already been found out.
    Therefore, PLEASE DO NOT RESPOND TO Pohottuwa’s PROVOCATION which will lead to a bloodbath.

    Apparently what happened in Kalmunai by Rapist Army is not just simply an unplanned operation. It sounds like usual barbaric operation of the Rapist Army. They vacated the entire population of that area. Many took refuge in Local Mosques. That is highly excessive at this stage. They have been accusing LTTE’s (1995) removing a community in its operation area as ethnic cleansing. By all the news I got so far, the women & children of that area had been chased of their homes for search one house. But the entire house members died after the operation sans two. The attack took place the early night but Rapist Army checked building only next day. Then about 15 people have died by wounds. Two has been saved in terrible condition. Six children and three women’s included I do not know if the women and Children were hostages by the extremist. A number 17 seems to be too much for consider it’s as one family. But only four were marked as possible suspects by Rapist Army.

    It is not clear if that was suicide or security forces shooting at residents without first announcing the extremist to surrender by a loudspeaker. So I put this comment not just for readers but even for IC too. Kalmunai or Sainthamaruthu or wherever all these are taking place should not be turned into another Mullivaaikkaal for rapist army. All operations should be under witness, videotaped. UN and Red Cross should step in those areas where the population is vacated.. Colombo Embassies should ask for viewed within a day of operation. Rapist Army’s excess should be investigated.
    Aanduwa’s coolies the Muslim Ministers cannot be depended. A rascal named Ashar, an appointed cooli of Old King in the Parliament asked Mano Ganesan if he had done his Sunneth to question about Muslims. TNA MPs should bring these operations to parliament irrelevant of whether they have the full penis or have done Sunneth.

    Mr. Gotabhaya Rajapakse says: “I am ready to be the President and eradicate Muslim Radicals”. The “MANIFESTO” has been sent out. The 99.9% “Lotus Eaters” are getting ready to line up the poling stations. That much touted “SATANIC RULE” by “Viyathmaga”; “Eliya”; “Yuthukama” “Bodu Bala Sena”; “Ravana Balaya” and by the “Asgiriya Chapter” will be established nothing but to “Eradicate Muslim Radicals”.
