Mangala In Geneva: Backstabbing The Armed Forces

He has proposed to visit us at the end of this month. We also look forward to receiving the Working Group on Involuntary and Enforced Disappearances…”–Mangala Samaraweera (Text of the statement delivered at the High Level segment of the UNHRC, March 2, 2015, Geneva.)

Mr. Mangala Samaraweera, the Minister of Foreign Affairs of the unelected (and therefore, less than legitimate) Government of Prime Minister Ranil Wickremesinghe, has just done the equivalent of Jihadi John on the Sri Lankan armed forces. Jihadi John is the ISIS executioner who stands behind captives, makes a speech and cuts their throats in full view of the world’s YouTube watchers and (by extension) TV audiences. Mangala Samaraweera has just done the same to the Sri Lankan armed forces. His speech at the High Level Segment of the 28th session of the United Nations Human Rights Council appears at first glance, unobjectionable, moderate and reasonable and close to pitch-perfect. But that’s only at first glance. The entire speech is clever camouflage. Hidden in it is a deadly ambush laid for the Sri Lankan armed forces. The Foreign Minister has not only welcomed the UN Special Rapporteur on Truth and Justice, he promises to welcome the UN Working Group on Involuntary and Enforced Disappearances. This latter is a dangerous and dastardly move.

Sri Lanka has always cooperated with UN Special Procedures and permitted Special Rapporteurs, Working Groups etc. to visit, even during the war. However, like every sovereign state, Sri Lanka has deliberated carefully, in the National Security Council, about which ones would be allowed in, when that might be, and which ones not. One Working Group we were very wary about allowing in prematurely was the UN Working Group on Involuntary and Enforced Disappearances.

While it is hardly the case that the Sri Lankan armed forces were never at fault, it was through no fault of the Sri Lankan armed forces that they had to fight several internal wars, in South and North, over the past few decades. The politicians, including the administrations in which Ranil Wickremesinghe and Mangala Samaraweera served previously though separately, were primarily responsible for those wars, and were certainly far more responsible than the armed forces, for their causation.

We must understand the odds that the Sri Lankan armed forces were up against. Firstly, the internal wars fought by the Sri Lankan armed forces were far from purely internal. The North–Eastern war was for many years, and at least in part, one of the biggest cross-border covert or not so covert operations in the world at the time. Even after the relevant state sponsors turned against the Tigers, the external nature of the terrorist war continued because of the Diaspora-based global logistical network the Tigers had built up.

Secondly, the Sri Lankan military was fighting over the last several decades, two enemies, the LTTE in the Northeast and the JVP in the South, which were conspicuously marked by the barbaric character of the violence that they deployed. The proportionality of soft to hard targets was quite high in their armed campaign. The LTTE and JVP were also characterized by their politically fundamentalist and fanatical character. These weren’t the guerrilla movements of Latin America which fused romantic rebellion and realism and always strove to maintain the moral high ground.

The LTTE is particular was marked by its use of suicide bombers, which according to US estimates, was higher than all the Middle Eastern Islamist movements put together. What this means is that the armed forces had to root out suicide bomber networks, often in the aftermath of horrific attacks on civilians and in a race against time to pre-empt more such attacks. The lives of loved ones and school kids were on the line. There was a clock ticking.

It was not only in urban clandestine warfare that the stakes were high. During the wretched Ceasefire Agreement of Ranil Wickremesinghe, the tigers in the North built up a huge network of “civilian” combatants through their “Pongu Thamil” activities and front organizations. These recruits were part of an insurrectionary strategy to surround and overrun the armed forces camps. This was part of the challenge that Gen Sarath Fonseka had to face.

Let’s be utterly frank about this. The stakes were not merely tactical but strategic. The pro-Tiger Tamil intellectual and columnist DP Sivaram, better known as ‘Taraki’, often wrote that what would prevent the Sri Lankan armed forces from launching a decisive offensive to defeat the Tigers in the North-East was the LTTE’s deterrent capacity to launch devastating strikes against targets throughout the South, crippling the capital in particular. Thus there were multiple and urgent imperatives for the Sri Lankan armed forces to uproot the clandestine Tiger network primarily in the towns and cities, from Jaffna to Colombo. It was a bitter war; a war of the most bitter sort, fought in the shadows, against a fascist, fanatical foe.

The legitimate armed forces of the democratic state prevailed. Were there excesses? Almost certainly! Must they be brought to light someday? Perhaps, though many democracies, from Spain to the Philippines and Indonesia have chosen, prudently, not to do so. In any case that’s entirely a decision for the legislatures of the countries in question. Mangala Samaraweera has no mandate; no right, to make that decision.

Mangala Samaraweera looks forward to welcoming the UN Working group on Involuntary and Enforced Disappearances. This would mean not only the disappearance, entirely involuntary and enforced, to be sure, of Tiger suicide cadres who would have blown up our families on board buses and trains, but also imaginary disappearances which the Northern Provincial Council, the TNA and Northern ‘civil society’ organizations and church groups, would come up with.

One has to be a bigger fool than Mr. Samaraweera seems to be, to think that the Northern politicians having passed an 11 page resolution claiming Genocide, would not do everything possible to make that claim stick, by producing “testimony” and “evidence”. After all, one did notice on the television news, that Chief Minister Wigneswaran handed over to the visiting UN official Mr. Feltman, a copy of the Genocide Resolution passed by the Northern Provincial Council.

Mr. Samaraweera’s green-light in Geneva for the UN Working Group on Involuntary and Enforced Disappearances is a betrayal of the Sri Lankan military which saved us from the fascist suicide terrorism of the Tigers. Mangala’s pledge in Geneva made with gay abandon is a Millennium City Athurugirya betrayal on much larger, institution-wide scale. Taken together with the ‘genocide’ resolution (whose legitimacy it will facilitate), it is proof that at the forthcoming parliamentary election, Sri Lanka needs once again, to elect a government with a backbone, instead of one which back-stabs.

          We all know what LTTE did and did not do during its Pol Pottista regime.

          The Investigation initiated by UNHRC clearly has identified LTTE as the other perpetrator of war crimes, if you had the patience to read the entire report.

          On my part I have always asked for an investigation into all war crimes and crime against humanity perpetrated by all parties to conflict covering the period from 5th April 1971 to date. Such investigation would help us exorcise all demons that have been haunting our people for more than nearly 44 years as I have stated in this forum and elsewhere that I have had the misfortune of meeting of victims or their kith and kin from all communities. I volunteered to meet them therefore I have no regrets meeting them. In fact these meetings have thought me lot about silently suffering people and how they have been let to rot on their own without any support from the state or community.

          If you have issues with VP or LTTE you can deal with them through proper channels, all you have to do is to collect cases and evidence and submit to the investigators.

          As I have mentioned in my various comments, Truth, Justice, confession, pardon, reconciliation, and move on.

          Many, irrespective of their race, region or religion would agree with me.

          Remember the timeline is 5th April 1971.

        What is Dayan’s game must be the question on the lips of most serious writers and contributors to these pages. There he was, for years, pretending to be an unattached political commentator-analyst – and, whatever, trying to be neutral in the political divide. But he transgressed everywhere in the political landscape – Northern militancy, the UNP aligned to the Premadasa-Sirisena Cooray faction, later identified with Mahinda’s regime. Like Stevie Wonder’s part-time lover he was part-time academic,
        Part-time diplomat and whatever that comes in between. Surely not much consistency there to impress the pretention of a character of integrity.

        But the next one must be the Big One. Here he attempts to make an enemy of Foreign Minister Mangala S in the eyes of the armed forces. We remember Lasantha W was brutally savaged by a group of suspected armed forces men (from the Unit Eka?) when a story was floated the journo was then in the habit of nocturnal visits to the homes of Indian intelligence officials. That must have been enough for those “patriotic warriors” in brand new motorbikes to violently snuff out Lasantha’s skull and report the success of the Mission to their Commanding whoever. BTW, Is DJ in the process also of trying to fill the void created by the absence of Security “Expert” Rohan Guneratne – often referred to as the Darling of the Sri Lankan Army. One notices Guneratne is hardly mentioned nowadays.

        DJ frantically comes to the rescue of the Lankan armed forces and almost insisted they are absolutely free of all charges of wrong-doing. Reminds one of the infamous “Zero casualties” by our Defence bosses, later to be quickly retracted when the ludicrous claim was trashed globally.

        The UN, for its own legitimacy, has a duty to see who in the Sri Lankan caused the many bombing sorties “on their own people” in the North. Enquiring into civilian casualties of more than a hundred thousand certainly calls for serious UN Inquiry.

        DJ refers to the Lankan armed forces fighting insurgents both in the South and the North. But how come the forces did not bomb villages, towns, schools, Hospitals, places of worship in the Sinhala South in trying to flush out insurgents. What was the great enthusiasm in carrying out the carnage from air, land and sea in the Tamil North. The Tamils, it will be argued, have a right to know who was behind these acts of genocide against them.

        Mangala S might take the position if we have nothing to hide – as Sarath Fonseka and other men in uniform frequently claim – why not subject this to an independent enquiry outside the framework of the baduwath hamdurunge naduwath hamdurunge comedy.

        On the other hand, if DJ, influenced by his intellectual twin Rajiva W, is planning an entry into Parliament via the National List of the Rajapakse clique, by jove, he is on course.

            Dear Native V,

            Sirisena got more votes than MR than what the official records suggest and vice versa. His Cabinet, with Ranil as PM, is legitimate. Or else the other SLFP-ers – all rogues, I hasten to add – in the House would have created merry hell.

            The truth is the 25% Tamils and Muslims and a larger portion of the Sinhala voters wanted this uncaring, profligate Rajapakse family down in the dumps. MR is trying frantically now to keep his head above water. But the money bags are deserting him. And, that can be pretty tragic in our kind of politics.

            But, in addition to the local voters, he has and continues to
            quarrel with the international community. He still refers to them provocatively. As you know, these days and in there here parts that entails a heavy price. At worse, it is the road to The Hague for the crooked and low IQ Rajapakses. So be it.

      SL armed forced acted tough when it need to act tough. They have killed people who needs to be killed. Every nation’s military will do that to protect its national and especially security interests.

      SLA waged a war against a terrorist outfit dangerous than ISIS. We faced internal war and cross border terrorism. Canada funded terrorism in SL by allowing 2 million $ a month.

      No nation can tackle these without killing.

        By reading the comments from readers it appears that many readers are placing great hopes on the present government: Of course it is better than the previous one.

        The paradox will become clear in April. The present regime is not doing things that they promised to do in 100 days and will make those who voted for it get disillusioned. Why are they not going after the well known political culprits in various crimes and corrupt practices? Does this mean that they themselves (present rulers) are also implicated in the past crimes? On top of that there are pipers like the diabolical Dayan doing his bit to get Mara back.

        Mahinda has still not entered the ring: If and when he does, tables will be turned: Dayan is providing Mara with ideas as to which cards to use. Don’t forget the time tested trump card that I hate to name!

        Time will tell, but I am not in the business of predicting: What happened in Egypt can happen here too. It is only a probability I am talking about it.

    If DJ wants to call Foreign Minister, Mangala Samaraweera, a fool why can’t we call DJ a fool by himself. As seen in his frequent communal based articles in the CT he makes himself obviously
    to lead the Fools.

    What is wrong with the interaction by our Foreign Minister with the UN agencies and get their cooperation, know how, etc.

    DJ also states that the appointment of Foreign Minister is less legitimate because he is unelected. Does DJ know the Foreign Minister and the entire government was appointed by the newly elected President in accordance with the powers vested on him under the constitution of SriLanka.

    Just because DJ is jobless he cannot mutter anything which he can do if he finds a place in ……at Angoda.

    He woukd have been happy if MR was reelected which miserably failed and these shock must have

      Mahinda Jarapaksa was an executioner… but had people do it for him…. Mangala tho is trying to save MR from being taken to the Hague… IF MS, RW and Mangala wants to send MR to the Gallows they could tell the UNHCR to come over now that Mahinda is NOT in power and give them MR’s head on a golden platter… BUT they are still wanting an internal investigation..

    These brave soldiers protected children, mums and dads from suicide bombers who visited even schools and places of worship of the great majority.

    A president who calls himself a devout Buddhist , and worships even Bo Trees, allows a poofter to betray these soldiers to the LTTE mates in the West who seek revenge under the guise of Human Rights.

    Wonder whether Vernerable Rathne and Sobitha tied a Prith Nula on the FM before he left to lick the backsides and agree to hand over the soldiers.

      Was the 70,000 SINHALESE murdered/butchered by the sacrificial SL armed forces in 1970s a part of that treat too? The “rules of the game” has no problem going after the terrorists, be it LTTE or otherwise. The issue is with their Human Charter in one hand and the Gun in the other murder of civilians. Go after the ruthless terrorists – that is an even ball game but it now appears they did not behave as armed forces are supposed to – they became sadists and murderers and these acts have caught up with them.       If you really care for those that sacrificed their life to protect a country as you say you should be in the forefront to bring the war criminals to justice.

      People in SL and the world over cannot see the sacrifice because of the war crimes committed slaughtering women and children and raping even old women.

Do you agree we have all lost in the 30 year old debacle that could have been avoided only if political decisions were taken by wise, experienced, sane heads free of racial prejudices.

    Dear Dr. Dayan J. I think you must take a moderate line on our foreign policy, I have listened to your speeches/ your interviews on Youtube, your interviews on Sirasa. You have spoken well against the Former Regime. You have written and reviled the previous foreign policy. What would you have done differently. I know you have an issue with Minister Mangala thats why you did not join the Maithripala Team. Just tone down your writings and give the new government some time to undo what the previous regime has done.

    The victory of the people over a despotic regime has really got under his skin.     So Dayan J let the cat out of the bag. Now he admits ‘genocide’ did take place but it should not be known outside or to UN. He managed to sponsor a resolution at UN HRC knowing that excesses or ‘genocide’ was committed.

    How could he managed to be elected to be a vice president of UN Human Rights Council?

    He wants to protect the armed forces that is understandable.

    But what about hundreds of innocent Sri Lankan citizens – they may be ethnic minorities or dissidents – who were kidnapped by white vans organised by Gotabaya and EPDP after the war? Are they not humans? Many innocent citizens were shot dead like mad dogs. Don’t they need justice? Why were they hunted down?

    Most Tamils are not interested in witch hunting the armed forces or even Rajapakse brothers. All they want a reasonable solution that enable them to be treated on par with the rest of the Sri Lankans. Rajapaksas tried their dirty tricks of arousing another pogrom even during and just after the election. Mahinda claimed it was because of Tamils that he lost. Mithripala got 6,217,162 votes whereas total Tamil population makes up of only 12%. How on earth Mahinda claimed he lost because of Tamils except that his motive was heinous.

    Observant readers will note that he is also orchestrating lots of ‘dislikes’ to the comments against him which follow the trash that he writes. Even sadder.

    Dayan as usual you are applying double standards. You always write against LTTE and want action taken against not only LTTE, but also against Justice Wigneswaran for the Genocide Resolution, although Wigneswaran is not an LTTE member. If you are so keen in applying the rule of law against the above mentioned, why not apply the rule of law against the soldiers if it is proved that they have violated human rights and broken any laws? Why should there be double standards?

      Human rights are bound to be violated in war. That is why it is called war. There are different international rules that applies to law and SL has acted within that rule most of the time.

      SL waged a ‘just war’ in its full definition. SL is not a normal country. SL had been a country of a complex nature with an internal conflict, terrorism, and cross border terrorism. Countries in such drastic situations need drastic measures. Every country in such situations act like that. You can see it in India, China, Mid east, Israel, USA…

      National security and national interests are above what is considered HR. Look at how gover defeated JVP terrorism. Difficult periods need difficult actions.

      There is nothing right and wrong in them…bringing the country back to normalcy is the requirement and government will have to do anything for that.
