MMDA Reforms: Ulema Insists Women Must Play Second Fiddle 

All Ceylon Jamiyyathul Ulema (ACJU) in its latest submission to the Muslim Personal Law Reforms Committee Chaired by Former Justice Saleem Marsoof, rejected any key changes to the Muslim Marriage and Divorce Act of 1951 (MMDA) instead bringing in strong theological support to the first report which came into severe criticism from the Muslim intelligentsia.

The new 37 page document, outlines the position of the ACJU with regard to the proposed changes, all of which have been rejected on the grounds of non-conformity with Sharia.

The ACJU is an unelected body with its head Mufthi Rizwe holding the post of chairman for over a decade. The submission by the ACJU renounces all theological and interpretational advances made in Islamic jurisprudence and instead used pre medieval comprehension to assert its view, again.

Rizwe in repeated Jumma sermons had insisted that females should wear the Nikab and has been a strong opponent of any reform to the MMDA Insisting on ideals such as marriage at the age of 6 being permissible.

Rejecting the need to introduce females as Quazi’s (judges) into the Quazi Court System, the ACJU is of the view that as per all major Islamic schools of thought “it is not permissible for a woman to be appointed as a judge, and if she is appointed, the one who appointed her is sinning, and her appointment is invalid, and her judgements carry no weight, no matter what ruling she passes.

They further quote the hadith “No people will ever prosper who appoint a woman in charge of their affairs,” which according to the ACJU is general in meaning and applies to all positions of public authority. So it is not permissible to appoint a woman, because the word ‘affairs’ is general in meaning and includes all the public affairs of the Muslims.”

Rejecting the appointment of females to be appointed as marriage registrars, the ACJU expresses that the appointment of a woman would lead to compromise on important “shari’ah concerns” since marriages are recommended to be held at Mosques and are conducted in the presence of males. The document does not specify the “Shariah aspects”. The document further notes that in the case of a marriage happening outside a mosque “the traveling of women alone, the mingling of women with non-mahram men and processing the registration will no doubt have practical and Shari’ah concerns.” Mahram male is one who falls within the prohibited degrees of marriage for a woman as per Islam

Further, according to these submissions, for a valid marriage to happen, Islam requires four people, none of which includes the bride herself. The four accordingly are the guardian of the bride referred to as the wali (usually father, uncle, or brother of the bride)the bridegroom, and two Muslim male witnesses who are familiar with the two contracting parties.

Unlike the rest of the country where the bride herself signs her marriage form signifying consent, the MMDA requires the guardian of the bride to sign for and on behalf of her. Women’s groups have been demanding for the right to be given to the bride herself, however, the ACJU in its document recommends the brides signature in addition to her guardians signature stating “in no circumstance it should indicate that without the consent of Wali, a bride on her own free will, can proceed with her marriage.

 The requirement is in line with pre medieval practices in which women were betrothed by men who believed they were chattel of men.

The ACJU further notes “the father is generally the Wali of the bride, and he may marry her off without her consent, if she is a virgin, provided certain conditions are met. It is, however, Mustahab (recommended) to acquire the consent of the bride prior to marriage.

The MMDA unlike the General Marriage Law of the Country does not recognize 18 as the minimum age of marriage. Under the MMDA a girl below 12 years can be wedded off with the authorization of the Quazi. This practice has been criticized at various forums for not being in line with international standards. The ACJU in their submissions recommends the minimum age to be raised to 18, however lays out that approval should be obtained from a Quazi for marriages between age 16-18. It further states that marriage below 16 if occurred, should not be invalidated under the MMDA. Thereby stating that the status quo of child marriage should remain intact. 

Rejecting that limitations should be placed on entering into polygamous marriages the ACJU opines that a proper reading of the Quranic verses on polygamy permits the practice without exceptions of circumstance. The ACJU sees no reason to place restrictions on such practice “due to few unfortunate situations that arise in polygamous marriages”. Some Muslim countries have banned this practice as outdated and women’s groups have been lobbying for the same in Sri Lanka. 

The ACJU further states that the equal treatment of wives as prescribed in the Quran is limited to what is  under mans control and that “love and the tilt of the heart are something out of man’s controlProgressive interpretations of Quranic verses has accepted that the stringent requirement of treating women equally in effect was a move towards restricting polygamous marriages and setting the standards for monogamous unions.

The document further states that according to Islamic Jurisprudence there is no requirement that Talaq should be only pronounced in the presence of the Quazi and if pronounced in the absence of the Quazi, the Talaq is invalid. Talaq is the divorce option of divorce a man is entitled, which is a unilateral form of divorce, which does not require the statement of reasons and is recognized under the MMDA. 

The MPL Reform committee was appointed in 2009 by the then Justice Ministry and includes two members from the All Ceylon Jamiyyathul UlamaAsh Sheikh Rizwe Mufthi, Chairman and Ash Sheikh M.M. Mubarak, Secretary. The ACJU has strong political backing and resources and is the main barrier to reform the Muslim Marriage and Divorce Act.

    If muslim women are subjected to inhuman treatment, let SL law protect them. Practice religious activities within the legal framework of Sri Lanka. If not any other practices should be regarded as non conforming to SL laws.

    Human beings should be treated as human beings, not sub-human. Women play a very important role in the society, different to that of men. It is the responsibility of men to recognize and protect them. Men alone cannot reproduce.

So to comment on real truth not only you should be an Islamic scholar. A web mania cannot do this because there are lot of Shia’s, Anti-Islam’s, Ahmadi’s and other sect’s sites. Prophet Muhammad said you should believe 100% what is revealed in Quran and follow his Sunnah. A Sunni whether Wahhabi or not follow this. Shias, Ahmadis, Sufis and other sect do not follow it 100%. They had brought lot of innovations to true Islam. Najd doesn’t point to a place but refers to groups of people bringing FITNA (innovation). Islam gave women their rights 1400 years ago. Only very recently Western countries followed that by giving property rights, marriage rights etc. Prophet Muhammad lived with his first wife for 20 years and all his other wives were widows when he married. Only with Ayesha nikah performed when she was 9 and marriage consummated when she was around 18 years old. All his daughters he gave in marriage when they were over 18 years. If Mufthi Rizwe believe in Sunna, this alone will enough for him to bring changes to age limits.

            If so, you should come up with the data and statistics, and say that, yes MMDA should be reformed, because it serves no purpose. Why is that the Ulama are very reluctant to reform if so? There is more ti it than you claim, that MMDA is harmless.

            You are not the 12 -year old school girl who was put on the throne in the evening, and legally raped at midnight by the groom, to whom she been transacted by her guardian, Wali, as chattel, despite here protests, she had not seen before midnight, and the girl had not even signed the marriage certificate.

            Do you know that Wahhabies , Salafies and clones will end up in hell-fire along with Satan, as per Hadith of Najd and the Islamic theology? Ignorance is not an excuse. At least you know that now.

              Amarasiri, it is you who should get statistic from Registrar because you are saying Muslim girls below 15 were given in marriage. I am Muslim, I know the age of our ( mine, brothers, sisters, cousins, friends) daughters were given in marriage, over 200. All of them were over 18 when they were given in marriage. Both my daughters were 24 years when they were given in marriage. I am 100% sure all Muslims unless they were uneducated villagers first think of education to their daughters. No Muslim give their daughters at 12 years or below. That is why I am asking you to give names and places of such marriages or get it from Registrar. In the past about 100 years back two or three years after they attain puberty given in marriage. Even Sinhalese do that. According to Kandyan law boys below 18 years and girls below 16 years have to get parents’ permission to get married. That is if parents give permission for their 12 years and 14 years they can marry. What interest the non-Muslims have here to comment on Muslims affairs? Their only interest is Islam bashing and their knowledge were from rogue anti-Muslim website. Chattel means possession so your parents are your chattel. Wali has to be a father, brother, girls brother, uncle, grandparents in that order of succession and if she have nobody then the guardians or Qazi in which case she too has to sign the declaration. Prophet Mohammad never mentioned Najd but said horn of satan will arise from east, west,and north in gesture. Muslim have all rights to meet Mufthi Rezwe and demand changes.

                Ralli Ameen, it is your duty to correct ant errors by getting the appropriate data, just like Copernicus, Galileo, Kepler and Newton did. After all, Sri Lankan Muslim women are your mothers, sisters, daughters, aunts and grandmothers, who are being abused by MMDA.

It is just the MMDA law he is following and sticking to it although there are enough provision to bring changes which are not anti-Islamic. If all the Muslim in Sri Lanka give their daughters below the age 16 years in marriage then you can say they are strictly following MMDA instructions but it is other way about. If MMDA is in conflict with Sri Lankan Constitution and citizen’s rights it is up to government, Muslim politicians and lawyers to negotiate and settle it. Day by day Muslims women are getting educated, had achieved high positions in society and enjoying all the rights.                 Sentinel, I may say here you do not believe and have 100% strong faith in what Prophet Muhammad gave you that is Quran and his Sunna. The most important saying of Prophet was, “Oh believers, whatever sufferings or obstacles that you come across you must always pray and ask Allah for his blessing to alleviate your sufferings” he further said, “those who seek help from any others committing fitna and they become sinners”. He did not even say to ask from him. You say ‘revere’ but you know what people are doing by going to ziaram (tomb) of supposed saints in Ajmeer, Nagore, Devatgaha mosque etc….. Such tombs custodian’s people will be there for an amount to pray and get the blessing of that saint. There will be a till for you to put an amount and you seek blessing of saint. If only revering mean any time after your prayers you can ask Allah to bless whoever the saint you want and to give him Jannathul Firdaws. So open your brain and don’t try to defend that. This was what our Prophet said and Wahhabi said that after 1300 years. At that time Saudis were resorting all sort of such things to make money. Many innovation they brought and if unheeded today Saudi will have hundreds of saint and even idols, pictures of Prophet and even relics. So Wahhabi brought reforms back to true Islam. Any Muslim strongly following Quran and Sunna will say same and he need not be a Wahhabi.

In Saudi Arabia the government had made it a law that man first has to buy a house as dowry to girl before marrying. First wife’ permission is compulsory to marry again but permission nod needed to sleep with any one of his wife. Non-Muslims have only one wife but sleep with keeps, prostitute or wherever they can poke on the sly. Idiot speak what is correct.

So many of our Sri Lankan Muslim sisters have been through so much trauma because they were married very young, divorced with no reason or warning, forced to be in polygamous marriages, and mistreated at the Quazi courts because the judges favored their husbands. Instead of encouraging compassion and harmony, the MMDA has become one of the main reasons for marital breakdowns among Muslims, who have a very high divorce rate in Sri Lanka.

    With so much Islamophobia around, I guess none of us would want to complicate matters further, and it would be best if the Muslim community were to solve it themselves. We’ve seen good and decent Muslims, both women and men, writing on this subject, and I have said a few things. There have been other articles by unreasonable Muslim men which I tend to ignore.

    However, if a man like this “Rizwe Mufthi” is making life impossible for Muslim women, I think that our government must take a stand on this, present legislation (hopefully sponsored by a few Muslim Members of Parliament), get it passed, and implement the law. The government should not abdicate its responsibilities.

      Please, be guided by these 3 principle and make you opinion; then others will benefit by those comments.

      1. The constitution has to release all men and women to practice any religion they like. Nothing should have non special status or Special status.
      2. Constitution should not vest authority with anybody (Including the elected parliamentarians, recognized specially as Muslims Parliamentarians) to issue justice over anyone of practicing any religion in any way. Under State’s secular rules, any religion should have all available freedom to assemble any customs and practices to formulate their religion. None of these will violate, IC and UN standards, and any non-included, but found logical under local natural law. UN’s humans rights upholding is normally a Central issue in Federal structures.
      3.Constitution should recognize the organized features of Western religions to interfere into human rights and should recognize the temptation of Hinduism and Buddhism attempting to get into a shadowy organizations(Like Sanga or Athenam) to controls individual’s rights, impressions women in temples to prostitution, using child labor as volunteerism etc. etc,…… Law should not be passed for racketeering commission from importing elephants from Myanmar or exporting Halal to His Majesty, the New Colonial Master of Lankawe, the King Abdulazeez. So Buddhist temples should not have authority of enslaving children with the name of Monk-ering them. All Children must go 12 years of compulsory, UN, UNESCO recognized formal education. The education system normally decentralized in Federal Structures.

      The broader view of that ITAK’s 1957 act is, but yet to be passed in Lankawe encompassing all faiths, is ” No Individual can claim that any part of the Constitution is recognizing his/her Individual rights has a part that allow him/her to discriminate aginst another individual. However, you have had the courage to state boldly that all of us who are citizens of this country must insist that no girl belonging to this country is ill-treated just because she was born in to a harshly illiberal family. Parents may biologically create children, but they should not be allowed to destroy their progeny.           It is dangerous for anybody to imagine that he is so right that he must force upon others what he believes must be done. When said like that, it will seem high-handedness, but if one terms it as “having the courage of one’s convictions” it sounds laudable! I think that on this subject, we’ve got to mobilise, apart from opinion in our country, WORLD OPINION, and bear down hard on the fanatics who believe that religion can sanction cruelty by men, towards women – even if the likes of “Fathima” are brain-washed in to accepting their exploitation. Values are so subjective they may seem arbitrary.

          Very definitely there are Muslims who really, really believe that this thing called “Sharia” is God’s will. Their concept of “Allah” himself is sublime – more so than the gods of any other religion. Yet in practice, I must confess that I find much that Islam stands for among the fanatical is distasteful. Again what I say may not seem to make sense.

          However, in practical terms, I think that the likes of Rizwe Mufthi, must be stopped in their tracks. He is obviously been born a Sri Lankan, so we cannot kick him out. The only course of action that is feasible is to enact legislation that allows us to actually imprison people who talk the way that he does – and hope that after the first experience of jail he comes to his senses.

    In Sri Lanka, Muslim women are very rarely examined by male medical practitioners as the husbands do not allow such examinations and procedures such as radiograms, mammograms, ultrasound examinations of various parts of their anatomy; pregnant females rarely undergo monthly examinations and urine/blood lab examinations; family planning & birth control procedures are rarely allowed, untrained midwives attend most childbirths, & mothers rarely attend well-baby clinics with babies.
    On the whole, Muslim women rarely enjoy all benefits of the free state medical/ health care services.

    I was surprised to learn that the ACJU has stated that a Muslim father could marry off his virgin daughter (even an adult) sans her consent. This contradicts both the Qur’an and the ahadith (sayings of the Prophet). It seems the ACJU under Rizwe Mufti is taking a turn for the worse and going against Islamic teachings itself. They also assert a Muslim woman has no right to contract a marriage at her own discretion, which again contradicts both Qur’an and Sunnah, which gives women this right.       I am sad to state this but Muslim women have no choice, either they live as chattels or marry under the normal law of the country. I don’t like advising Muslim women to take this drastic move, but what is the alternative. They can do a private nika, but register under the general law saying that you are a non Muslim. This doesn’t mean that she leaves Islam, but for legal purposes and because of Rizvi Mufthi , she does it. When Muslims go abroad, they register their marriage under their law. If it is Australia, they these couples register under the Australian law. So why not here. Overall Islam preaches justice and Rizvi’s long harangue preaches injustice.

      Best alternative for the govt to do is to ensure and enable Muslims can register their marriage under the general law of the country

    Soon after independence in 1948 it was clear that the majority was bent on disempowering the minorities. In 1949 Illankai Tamil Arasu Kachchi was formed. Lankan Muslims were in this. One of the carrots used to entice the Muslims away from ITAK was the MMDA1951.
    It has taken about 70 years for some progressive Muslims to tell the rest of Lankans how abhorrent MMDA is. The clerics have such a strong hold that no Muslim MP dare show dissent. MMDA subscribes outmoded ideas which violate human rights.

    The MMDA is perfect. It was prepared by people who fully comprehended the infallible Quran. The Quran is the Word of Almighty Allah, is timeless, hence any matter extracted from it is perfectly suitable for human consumption and definitely supercedes all human understanding of worldly affairs which are independent of it. The work of people of ancient times still lead modern day humans by leaps and bounds because all modern developments to date are not and cannot be independent of the work of the former. All forms of engineering are in one way or another connected to work of old and today’s success is only because of yesterday’s.

    Today people want to change God’s guidance as is found in the MMDA. It clearly indicates a massive level of ignorance of Divine guidance. The clamor for change of the MMDA is only because they are uneducated. They are not of the educated when their knowledge of supreme Divine law and guidance is absent.

    While every Muslim believes that the Quran, being the Word of the Almighty, is error-free and therefore perfect, can the same be said of a man-made MMDA ?
    Islamic laws are derived from the Quran, through the lens of the Sunnah, by individuals.
    Whatever be the scholastic achievements of such individuals, as mere humans they are prone to error.
    The errors could stem from the lack of specialised knowledge required to interpret specific aspects of the Quran.
    Or, from such individuals stubbornly sticking to pre-conceived notions and refusing to even listen to alternative scenarios proffered by other scholars.
    Or, from such individuals refusing to take cognisance of the contextual factors in their interpretations.
    Or, from the many more possible ways in which they, as human beings, could have been adversely affected in their attempts to produce the MMDA.
    It is reported that the basic outline of the MMDA of 1951 was not produced by Muslim Sri Lankans. It was imported from Indonesia. It was amended to include some local customs.
    If this is indeed the case, it raises two important questions :
    Firstly, is it appropriate to sanctify this man-made document by perceiving it as being perfect for all-time ?
    Secondly, would it not be more meaningful to ensure that the terms of this legal document are compatible with the evolving life-styles of Muslim Sri Lankans, rather than that of Muslims in Saudi Arabia ? After all, does one have to eat, drink, dress, marry, divorce and have sex like the Arabs if one is to be a pious Muslim ?
    Before praise is showered on the ACJU’s final statement, please exercise caution. It blatantly offers conclusions which directly contradict Sahih Hadith. The ACJU filled with a bloated sense of self-importance has yet again attempted to throw dust on the eyes of the Ummah.
