My Mother Chief Justice Will Not Back Down From Anything

My Mother Is The Chief Justice Of This Country And She Will Not Back Down From Anything

By Shaveen Bandaranayake

Shaveen Bandaranayake

My mother is the 43rd Chief justice of this country. She is also the 1st female Chief Justice in this country’s 200+ year history. She is an academic, one who possessed a PhD in Law before it went on sale. She is also a loving sister, mother and a wife. She is a hardworking woman who loves her country dearly and wishes to preserve its seemingly flailing integrity.

She is not a politician. She is not the kind of person who expects to do something and expect something in return. She is also not the kind of person who would waver or change under pressure or intimidation. She is not going to change her conscience on a whim. There have been many occasions in which she could have given in and been rewarded lavishly.

Most people are unaware of who my mother really is. Until recently, seldom would anyone have heard anything from her or about her. She has always believed that as a judge and as the Chief Justice, she must not socialize or be seen to favour any party. It is not that she is not a sociable person. It is purely because she feels it’s a burden she must carry in order to uphold the integrity of the august position which she holds. Is that incapacity? Is that misbehaviour? The powers that be claim the impending impeachment to be one to uphold democracy and the concept of separation of powers. Frankly, in my humble opinion, it is one of vengeance. It is one of spite and pure hatred.

There have been many people in support of my mother’s cause and I am both humbled and strengthened by it. Those who stand with us today, I feel, stand not just for my mother. They stand for the independence of the judiciary and a democratic society. My mother believes in this country and it’s people. She has been a citizen of this proud country for 54 years and have dedicated almost 32 years in various capacities for this country. The country has not betrayed her. It’s people have not betrayed her. Those who govern have betrayed the country it governs and the people who elected them.

My mother will not back down from anything and if I personally have a ounce of her courage, I consider myself fortunate. She has always fought for what is right and will do so until her last breath. An individual can live his/her life seeing the injustice around them, show a blind eye and die a forgotten entity. Or, you can stand up against tyranny and make a stand. The Chief Justice of the democratic socialist republic of Sri Lanka is making a stand. Which side you, the citizen takes, defines who we are as Sri Lankans!

This young man should galvanize the youth and younger generation through Facebook and other internet media to come out on the streets and protest the Rajapassa dictatorship.

Gota the goon and his brothers need to be shipped off to the Hague for a War Crimes trial rather than impeaching the first woman CJ of Lanka!

Better late than never! After hitting the snooze button a couple of times her ladyship has awoken to strong scent of Kopi Luwak. “Which side you, the citizen takes, defines who we are as Sri Lankans” says Shaveen. Most Sri Lanakans are on the side of Justice. Not sure is justice is on the side of Shiranee Bandaranaayke. Shaveen seems to think so but then again she is his mother. Is this a female version Ifthikar Choudrey in the making?

Well, don’t wish to discourage a son who wants to stand for his mother. That human affection is respected and encouraged. That said, let me remind Shaveen, we are not discussing the issue of a good mother, good sister, good wife and a good academic. We are here discussing the independance of the judiciary in relation to its functions and in relation to the Executive of the country.
Shiranee Bandaranayake DID NOT enter the official bar through the normal recruiting process. Her appointment to the Bench was a purely POLITICAL appointment. Therefore she begins her career as a judge with politics. Thereafter she may have been on her own to the extent that CJ Sarath Silva and the other succeeding CJs were on their own. BUT certainly not what Judge Mark Fernando was.
Judge Bandaranayake proved she was with the Rajapaksa regime in 2010 August, when she presided over the petitions on the 18th Amendment that was shrouded in mystery and was publicly known that even the Cabinet of Ministers was not given time to study it, before giving consent. When she knew there was NO URGENCY for that Bill, as the President was going to take oaths for his second term, only in November. BUT she does not dissent in her determination and agrees for ONLY 2/3rds, majority in parliament knowing very well, the President had secured that much through numerous ways. That TRUST with the regime was what secured her the CJs appointment in May 2011.
It was also that close affinity which prompted her to throw her independence away, ridicule the independence of the Judiciary and insult the aspirations of the people in having an independent judiciary, that made her to pose smilingly for a family photograph of the Rajapaksas, after Namal was sworn in as a lawyer. That broke all tradition and all ethics.
It was also such trust the Rajapaksas had in Siranee Bandaranayake that gave Kariyawasam top level appointments not only at the NSB but even before at the Insurance Corp.
SO, how that bond of loyalty and trust between Rajapaksas and this Bandaranayake suddenly broke down is still not known to any one in the public.
But it has broken and the big fight has now become public. That is where we as public, has got an opportunity to forge a new alliance that may give an independent judiciary another chance. This accidental, but lets try to use it to the advantage of the people in securing some independence. Let us also not forget these personally driven independence of the judiciary often does not work the right way, as we saw in how CJ Silva behaved after breaking off from MR.
In real politics, we need a complete overhaul of the system. These are only intervals. But let’s have the interval too.

        Kusa:
My sentiments exactly. It seems like the biter got bit in this instance.
Maybe, those of us who believe that all is still not lost in the matter of democracy in Sri Lanka can use this opportunity to start the process of returning this land to ethics, decency and legality.

        Kusal Perera,

“..SO, how that bond of loyalty and trust between Rajapaksas and this Bandaranayake suddenly broke down is still not known to any one in the public..”

You systematically recalled the memory when CJ was weighing sugar for the regime. But that was what everybody saw in the open and public. What was hidden behind each and every happy honeymoon with the MARA pimp is the interesting thing! One can get a clear idea of who this MR buggar is if his past IRC criminal record is analyzed-he kills his own child, throws one of his raped girls alive to a lime kiln, kills the boyfriend of the 1st lady and then kills the Chandi Malli who killed the former etc. etc. This man is no human; he is a devil in human form! He uses condom theory to whoever who happens to associate with him. He uses people and then discards them! When he appointed Shirani and her husband to the conflicting posts, he had premeditated this whole scheme of intrigue! He schemes incidents in such a way that people unwittingly fall prey to his traps and then he utilizes those weakness to his advantage. How MARA broke with Shirani is very simple-MARA appointed CJ’s husband to NSB solely for robbing its money but when things got leaked and the whole country went into a commotion regarding the incident he just passed the ball to NSB Chairman and washed his hands. But Shirani wanted to see to it that her husband gets completely absolved from any guilt and future legal actions which did not happen due to MARA looking away. As a legal expert she knows very well the consequences under a future administration both to her name and her husband including the blemish and shame that would befall on her entire family. With this came realization of truth on her and she tried to act as if an impartial judge would act. Unfortunately as Kusal has already stated she had already been privy to 90% of the crimes MARA wanted her to commit and this is what most people do not see because it requires close and critical observation of the incidents and accidents that are happening every day! The same rule applies to those who are unfoundedly criticizing Ranil as though this whole Rajapaksha fiasco is a result of poor UNP leadership but it is not because this whole drama contains very subtle intricacies and implications which the ordinary critique cannot comprehend which if one can unravel he can become a very good political social behavioral analyst!

Quite right! BUT BETTER LATE THAN NEVER!
Shiranee B has indeed played ball with Rajapassa and justice, and now that hubby is in trouble with the regime and is taking a stand! Still she should be supported NOW in order to roll back the damage that she has done to Lanka, because the next appointment as CJ will be worse – you can bet on it!
But, Why has the decision on the Divineguma bill not been release to the people of Lanka who have the first right to INFORMATION?

CJ and three other judges attended an event where they congratulated a newly pased out lawyer and one who took oaths in front of them in court.
He happens to the president’s son.
    This has never happened before.

Not only the mentioned incident- how many of the similar are seen today- people are either fed up or used to see them as no efforts can bring anything – So they dont care even if the family ones are met with injustice. See the Mervin ^s activities ? See the Keheliyas abuses ? See the Airline chairman^s frauds ? let alone, what happened to the case raised against Mervin^s ransom extortions in Kelaniya area ? Were their any regulations him to allow those collections to the manner Ltter MONEY collectors chased after poor tamil refugees in some european countries ?

I fully agree with what PresiDuncebean has added to this BELOW – People of the country should finally open their eyes.If the opposition is almost dead – now people HAVE NO OTHER CHOICE than follow Tunesia, Yeman, Egypt and Lybia. So called people loving JVPers too stay mum today AS NEVER BEFORE- not only UNP.

Yep, this instant lawyer son by virtue of being given a certificate that he passed the final exam, another instant Naval Officer son, who was fraudulently made a Naval Officer and another instant Space Engineer trying to send a communication satellite are a different category phenomena and cannot be compared with Shaveen who is a full fleshed degree holder in Computer Science in multimedia has his own business is proud of his Mom who holds a Phd in Law and a Judge of supreme Court and it is better for any body to refrain from washing dirty linen.
Please note that the CJ has the capacity to become the President of the Country, but does MaRa or any others in the parliament DO NOT HAVE the capacity to become a CJ ?

I agree. We haven’t seen that integrity and honesty when her husband and this guy’s dad accepted a government job. Everything was going according to the plan up until one point. The predecessor is also telling now that he did something wrong in tsunami verdict. The same story in both cases!

I like Dr Shirani Bandaranayake and she is a fine lady. However, I would encourage everyone, especially her young son, not to jump into comment on matters that they know nothing about. This is far from a done deal. The government got the numbers to make or brake. There are those who like to wash dirty linen of others in public. This said, What the government is doing is perfectly legal and constitutionally available, and many of the windbags that now jump into safe guard the judiciary have done the worst thing to judges. So my advice to Mr Shevan: I know we all love our mothers and fathers, but this is not something you should write about and asks “Which side you, the citizen takes, defines who we are as Sri Lankans!” Because this is not a matter for you to judge on that basis.

When a sOn jumps his gun and write in support of his parent, it is usually assumed that the story is coming from the parent. Let the constitution and the laws of the country take its course…then we will get more details about the issue in hand.
The people can then decide which side they are in. Just because one is an academic, it does not qualify him/her to be above law and constitution. Even in countries like US the appointment to the supreme court is scrutinized and vetted by the executive.

What a bunch of total bull shit is this so-called advice! The Rajapassas want to threaten the CJ so she will go back to the good old days of giving all the judgements in their favour as with the 18th Amendment.
Time for this dirty racked to end and the people including this young man, Shaveen, take to the streets for regime change and a war crimes trial of the Rajapassa brothers in the Hague!

I think the impeachment will be a success in a backhanded way. First of all the diabolical nature of the Rajapaksha’s are put on display again. The legal fraternity will be forced to wake up and stop being anti UNP as they have been for many years delivering biased judgments against the UNP while all the sundry laughed knowingly justifying such actions on the accusation the JR had harassed Neville Samarakoon the then chief justice. Well now that incident pales into insignificance does it not? The supreme court in recent times is responsible for many biased judgements beginning with Sarath Silva. It is high time for a course correction.

Hat off to brave son! People’s faith in her was a bit shaken when she posed for a picture with the President’s son.People are sure to stand by her as long as she stands by the people. May the people emerge victorious from this sordid affair! Let that victory also mark the end of the political career of the political eunuch who is leading the impotent main political opposition in the country!

All of the comments and the article by Shaveen itself make very interesting reading.
It is obviously a case of chickens coming home to roost because, to suggest that Shirani Bandaranayake was above the Rajapaksa gang and not a part of it for a while at least, would be pushing the bounds of credibility!
This is going to be interesting as it unfolds, though, I suspect, it will do even more damage for what is left of the vestiges of democratic practice in Sri Lanka.

Most individuals living in Sri Lanka show a blind eye when they see injustice happening around them. The only time their mouths open is during cricket matches and after the war victory when they screamed what a great lion race they were and how every other country is beneath them. I call this the Muhammad Ali Syndrome aka “We are the greatest” syndrome. At all other times when there is rape, murder, abductions, thuggery, hijacking of democracy, limiting of press freedom etc, most individuals are deaf, dumb and blind. Their attitude is that if they and their families are safe and whatever happens does not affect their lives…then all is fine in the Utopian Paradise of Sri RajaPakistan. People will turn a blind eye to what happens to the Chief Justice. Can you expect anything else from a bunch of people who remained silent when the 18th amendment was passed? People are still grateful to Rajapaksa for the war victory, and the state media has brainwashed them into thinking that if the Rajapaksas’ lose the Tamils and the Tamil Diaspora and the suddhas will win… and like puppets they will dance to the Rajapaksa tune for a few years more. For the moment, the bad guys are winning.

      Fully agree with you.

People are the ones who need to react – not just waiting UNP or JVP to react

Having no rule of law is the root cause for all these. Having listened to a video further realized that almost every thing is in a mess today.

It is high time old royalists to react:

      http://www.youtube.com/watch?v=Ujh1JawYTFU

Drawing a red herring across the track is their nature. So long general public are passive observers, it will be easy for them to fool the nation.

Kindness is in our power, even when fondness is not. Vengeance is an act of justice while crimes are avenged and injuries are revenged.

Suffice to say it was a political appointment where in the executive just hires and fires therefore a wise lady kept away. Of course undoubtedly, the ladder of success is best climbed by stepping on the rungs of opportunity.

However, loyalty of the law-making power to the executive power was one of the dangers the political fathers of democracy foretold.

There is no liberty, if the power of judging be not separated from the legislative and executive powers. Henry Middleton

A wiser intellect lady did not accept the position and even withdrew from sitting in Namal case bearing no. FR223/2011. Her husband brilliant commercial lawyer PC and she would also withdraw from cases he handled too and she was known to be brighter than him. She is Tamil and he Sinhalese what a beauty to have (we would never have had troubles today)

I think what Shaveen is doing is perfectly legit. When people slander his mother under the cover of parlimentary immunity in the most despicable way, what do you do? Wait for them to get their act together?

So the Govt and Pres want to impeach the CJ. For what? An anonymous letter which should have been thrown into the WPB? Not surprising given their record.

Why not impeach the CB govenor who has squandered millions? What about the other crooks and fraudsters collecting commissions. What about the DS with his unofficial floating armouries?
This is cuckoo land not wonder of asia.

As a student of the university of Colombo during the late 1980’s and early 1990’s who engage in various discusions with university administration on student affairs, I realized that Dr. Bandaranayaka is a unbiased, impartial, and objective academist. Based this experience, I beleive that what shaveen is saying true. On the otherhand, I also beleive that Shaveen has pure right to stand for his mother not only as a son but also as a citizen of the country. As a student, I still admire her impartial, unbiased, and objective decission making capabilities that I have not seen from any university professionals during my 14 years academic career in the Sri Lankan university system. I have still no sufficient information to provide comments on the present crisis.

In any event, I wish you all the best, success, and encourgement for you and your family in this difficult situation.

One could, with the benefit of hindsight, express similar sentiments about GL Peiris, who is now quite comfortably defending tyranny. I think Kusal’s comments are spot on, and our response to the unfolding crisis ought to be a defence of the institution of the CJ (and the independence of the judiciary) rather than a defence of the current incumbent.

Dr. Bandaranayake should go down in Glory by giving a just Verdict in the Goldenkey Case which is a pending her judgement and dragging on for last 04 years . 14 people committed suicide and 9496 families are suffering . Word coming the grape vine is Dr. Kotalawela gave the Goldenkey Depositors money for MR & Company to run their election campaign . This is the biggest white collar crime and it deserves a brilliant verdict from the FAIR LADY !! Amen

We still can remember the way she got her appointment. She used her political affiliations with G.L.Peiris to obtain the appointment as a judge of the supreme court in a very wrong way and entered the judiciary through the back door. We can still remember how the so called lawyers for democracy went on processions against her appointment. We still can remember the way she deprived the opportunities of many deserving judges of their promotions and the opportunity of becoming the cj.
Dear son, we all Sri lankans use our fathers surname as ours. But you use your mother’s maiden name as your surname. After getting all the undue favours from politicians don’t expect us to stand with you when things go wrong.

I feel really conflicted about this situation. I am keenly conscious about the need to support efforts to defend judicial integrity and independence, as well as the fact that this is yet another Rajapaksa political appointee, who wakes up to their principles at the height of their careers when they have little to lose by defying their masters.
Sarath N. Silva all over again.

It is not the issue of the CJ being politically attacked in her personal capacity as Shirani Bandaranayake but it is the issue of attacking the CHIEF JUSTICE THE HEAD OF THE JUDICIARY to achieve political ends. This must be challenged by all freedom loving citizens.

    Shaveen,
No argument, your article is a scathing attack on the ‘regime’ indeed. But is it realistic; I wonder?

I remember, Apsara Fonseka writing similar letters to various blogs and even to the US president, Obama believing he would get her father out of prison. Were they successful? No. To tell the truth, a judgement by your mother sealed the fate of Apsara’s father. How? In a controversial judgement your mother concluded that military court judgments are equal to a judgement in civil courts.

At that time, your mother was branded as if she is carrying out a government agenda. All these guys who are praising your mother an angel now had denounced her like mad dogs. Young man, that’s realpolitik. If you think hecklers like robber barons and money sharks of LeD, and vultures of NGO, fraction ridden UNPers and foreign based commentators here would save her, you are sadly mistaken. All those guys only hope is to topple the ‘regime’. By design or by own choosing your mother has now become a pawn in their game.

Just take a leaf from Sarath Fonseka if you like. The man is no one’s hero today. Besides, your mother had never been heroes like Fonseka not even a one like ex-CJ, Sarath Silva.

I have no qualm that your mother is a hard working lady. Then again, aren’t we all hard working people; many of us who has Ph.D, earned it hard way not in Mervin style. However, one need not have a Ph.D to be a hardworking mother or be an outstanding Chief Justice. Question that begs here is whether your mother aspired to be a judge? No. Your mother crept into apex court using muscle of another executive president. Did your mother not push aside many judges who worked lifetime hoping to reach the top by gate crashing to be the first in line for the CJ’s job at 53.

Sure, there may be tempting accusations against the President Rajapakse for a foul mouthed and an egoistic man like SF to open up an avenue and temporarily head some cranks in the opposition. But your mother is no Fonseka; she should have relied on her own wisdom to guide her than pundit friends in pseudo law circles and NGO rabble-rouses. She should have known such people have a different agenda. Unlike ideas that her pundit friends in law circles may well have put into her psyche, CJ should have known that Sri Lanka is no Pakistan and she has no chance against the President, all powerful executive and the most popular figure in the country in a no hold bar fight that you are anticipating.

We have seen that many earlier CJs have become controversial figures because they have dished out bold decisions; some backing the then government, others the opposition. For whatever reason, your mother now appears to have trekked towards the opposition. What more proof than the very people heckle in her favor now had been the ones screamed against her as a MR stooge earlier. When and why she changed course is anybody’s guess.

For one thing, your mother could have rolled out judgments based purely on law books had she started it that way from the very beginning, and if she has been abide by laws and procedures to the letter from the beginning, and if your father has had a moral boosting track record, and if he hadn’t accepted plum jobs in the government for which he is least qualified, and he has stayed lily white. Then impeachment of kind couldn’t have been this simple. But that’s not the case, is it?

So, calm down and use your head without resorting to empty rhetoric

Leela, do you have any evidence to prove what v been insisting here ?
Are the folks that stupid to forget the war victory ?

      Quoted from you below:

“Just take a leaf from Sarath Fonseka if you like. The man is no one’s hero today”

Do you think that the rest of the volk would see it the way you see them ?
Great the way you feel it towards SRILANKEN nation

I totally agree with Leela. This was exactly how I thought when I read Sheven’s writings about his mother and his attack on Rajapakse. It shows how much the current political situation in Sri Lanka has been influenced by the outside forces that most people seem to dismiss as sheer imaginations. There is a concerted, and very carefully organized anti-Rajapakse strategy is at work in the country. As Leela points out this was exactly what happened to Fonseka, and this is going to end in the same manner as it did in the Fonseke’s case. They carefully select these potential flash points with people who have very high egos, and ready to ignite the fire against the Rajapakse government. I see Sheven’s writing that he is already playing to the UNP/NGO/Outside bidders. Sadly, he is naive and making Mother’s life more difficult.

So Kaputa, I have to laugh from the end when reading this

if you are in the opinion that CJ`s son is that naive making the situation become worst – why cant the folks and/or rulers can consider it in that way ?

I personally believe, young man just wants to say the truth about his mother. She has been a good judge in many cases according her carrer history.

Besides, no way the views that you guys feel about the SF´s can be common to ones who respected him and his political intentions. See, even not having rights, he still opens his mouth while many senior politicians stay mum even if some low level ministers in ruling coalition continue destroying the party.
But he was the hero to deserve credit for leberating the coutnry from LTTERs, this will remain as this even if MR or any other tried to drag it for their selfish achievements. People are not fools, they can judge it by their own. If not not, they will realize this in the near future.

OH! This poor Leela. She butts in every where with her racist snout to bray for the Rajapaksa regime. She had in an earlier post in CT asked about other people’s character certificates to ridicule them in her own racist way. When she was asked to first give her own profile, she vanished. Now she appears here again.
I wish people with sanity will leave her alone.

Re Leela’s comment and I quote “Then again, aren’t we all hard working people; many of us who has Ph.D, earned it hard way not in Mervin style”
        .
Amarnath, we agree with you a 100%. Mervin Silva is at least honest to say that he bought his PhD. Wondering how Leela got hers given her intellect?

M Y Foote, Leela got her PhD in the ’70s through the black market, when the Exchange Control Laws were in operation.

It is not nice to attack Leela for her UGATHKAMA/ Education, she is just killing her time not knowing how to reintegrate with the folks once she thought were intelligent, thoughtful. Thanks go to Current rulers, there is no such people among the majority of the country today. From what she always adds to this or that threads, I realize – she just does so not knowing the ground realities. Nor has she got adequate reference to prove anything. Even grannies could explain me far more constructive views about the today ´s situation than she does.

Poor Leela has to defence her and her friends in the regime by any means. This will for sure be a struggle in the months to come :((

Perhaps, she could have been awarded that from Pettah ” Manning Market”.. who knows.. hi hi while the Mervin´s should have from Butchers.

XXX Leela, the yellow robed terrorist you have once again brought out a classic sleeping pill which exhibits an I.Q. below 70

Perhaps it is so because you are addicted to race, religion and rajapak-istan tyrant politics.

Go jump in the river first then do some serious self-searching with pseudo doctor white the katadiya.

        Pook the Troll,

Why are you attacking Leela, now? Are you so insecure about your intellect that you feel the need to tell everyone their “IQ” is “less than 70” whenever they show themselves to be smarter than you? That was a rhetorical question – of course you are.

You show your manifold prejudices, racism and mindless hatred against the people of Sri Lanka with virtually every comment you make. Apart from your difficulty grasping the subtleties of the English language and even the basics of civility and politeness.

Why do you behave in this way?

      Leela, you lying [Edited out],

“..In a controversial judgement your mother concluded that military court judgments are equal to a judgement in civil courts..”

In which brothel did you pick up this argument? I suppose from there where you slept last night! Which country on earth accepts Anomas or X, Y, Z’s interpretation as to what is a civil court judgment and what is a court martial judgment?

“.., and if he hadn’t accepted plum jobs in the government for which he is least qualified, and he has stayed lily white. Then impeachment of kind couldn’t have been this simple. But that’s not the case, is it?..”

Your broken English notwithstanding, hadn’t MARA as the Executive President of this country acted in this totally irresponsible, illegal, contradictory and tradition contravening way by appointing Pradeep Kariyawasam to a post involving conflict of interests would this problem involving his appointment have ever raised and therefore isn’t the President the first culprit and what is the punishment you propose to him and mustn’t the world set a precedent by creating a new international law and custom by impeaching the President for wrong doing or irresponsible behaviour?

These are hard days for MR with bad weather, any Port Hole in a Storm, now that Shirane also has refused and that Kunanayakam woman also discarded, Why not your Uncle?

    Dear Son,
Your mother worked for Rajapakse clan and we saw how well she served the master during Gen.Fonseka’s trials.Don’t come out and tell how impartial she is.She should have asked your father to give up his position in the Insurence coop,as it was not correct to accept such a post when the mother is the CJ.When thing goes well it is ok.All of you who sleep with dogs will get up with ticks.I am waiting to see who is the next inline for the chop

Gone are the good days where we had some measure of fair play, sanity, humanity and a sense of justice and same being seen done. Some criticize JR as the cause of this entire executive problem. But he is not but the very judiciary is! JR created this post to facilitate a revolutionary socio-economic change take place in the country and as a safety guarantee for the unobstructed implementation of the liberal economy along the way. His sole purpose was not to enjoy unqualified power and impunity but to enable the vast majority of citizens of the country who had been hitherto languishing under UPFA/coalition governments reap the benefits of the newly introduced open economy. He did not undermine the overall power of legislature and the judiciary. The various commissions like Elections Commission, Police Commission etc. ensured that the Executive’s power did not go out of control and untethered. So then how did this present perverted deformed and putrid state of the law and governance come about? When Madamoolana thugs came to power they had only a marginal majority in the parliament and there was always the danger of a failure and defeat in the coming elections. So what did these rogues do? They began to abuse the power vested in the Executive and forced and threatened the perpetrators and culprits under the COPE to cross over to the government lest they would be prosecuted against for their wrong doing. As an incentive to promote further cross overs Rajapakshas granted them massive amounts of public money as ransom to the pole vaulters. And this whole illegal episode was legalized by the then CJ Sarath N Silva. If there is one person and his notorious actions that did most harm to the justice system in the country during its 200-year history it was this CJ buggar. After this bad precedent there were many judges and lawyers that followed suit and acted in an extremely undemocratic, illegal, unethical, and erosional manner. Today’s impeachment boomerang is the culmination of this whole bad practice of the judiciary that did laundry operations for the regime. The majority stupid masses in the country too are responsible for this because they sent these crooks to the parliament by misplacing their sovereignty. Son, we feel sorry for you because you had to face all these unpleasant happenings. But the bitter truth is always out there like one’s shadow. The husband of CJ oughtn’t have accepted the Chairmanship of NSB because it involves conflicts of interests and breach of hitherto customs. When the synthetic lawyer took his oaths you all approved and accepted the injustice and irregularity involved. When mararized judges gave biased judgments against UNP no one had an iota of concern that when their turn comes there won’t be an opposition party to save them. This is irony of fate and in Buddhist terms “dittadhammavedaniyakarma”! Because of the short-sighted, irresponsible, cowardly and ill-fated actions of those holding responsible positions in the country they have committed an irredeemable and irreparable damage to the justice system and democracy in the country; you have created a juggernaut, opened the Pandora’s box and let loose the devil which is Rajapaksha despot! He has now forgotten the issuers of his birth certificate and he is going to devour you all one by one and amass too! The longer he stays in despotic power the greater will be the subjugation, despair, degradation and destruction among the oppressed. The legal professionals have made a terrible mistake and it is they who can rectify it too. But this time they alone cannot do it. They have to resort to the very forces they contributed to destroy, the UNP, for support. There will have to be international backing too. But the international would not support you in any meaningful way if there is no prospect of a new democratic government in the offing. I do not know why you wrote this article but being a father I know how a son would feel. Use your efforts and energy in a meaningful way, aim for the regime change, aim for a democratic government under Ranil, be part of the radical policy of UNP that would definitely delivers you to safety, freedom and happiness. Mobilize and organize the legal fraternity against the regime, come to the streets and the professors did and walk with and among the common man, smell the odor of sweat of common man! If you can find out have a look at a photograph of Mrs. Pradeep Eknaligoda and his two children, the pain sorrow the untold story in their faces, and also see the determination, fighting spirit and responsibility in their soul!!!! Get a cue from them! The people of this country and the international HR bodies have an obligatory duty, a sacrosanct obligation to answer them. You legal fraternity start your own fight and there will be a huge support for you!

I completely agree with Silva. MR is the only president in the world who stole the tsunami funds sent by international donors to the poorest of the poor people who lost everything. MR will never give a penny to anybody without expecting much from them. THE CROOK bribed everybody beginning VP, to crossed over politicians to clergy, foreign lawyers and media companies and many others and pocketed out commission, drug money, black money, fake projects and acquiring poor peoples lands to keep his dynasty going. With all the requests made by FUTA for students, not a single demand was fulfilled. Therefore don’t expect anything to get from MR without a FIGHT. It is time for everybody like doctors, lawyers, teachers, public and private sector employees, farmers and laborers to get to street and fight for their rights and DEMANDS before the country go bankrupt with fraudulent heading gamble, Greece bond, IMF loans, loss making corporations and trade deficits etc.

Silva, as you say everyone should put aside their false pride and line up behind RW, the only Option available at the moment. Even the Professionals and the Judiciary should back RW as there is no one else, having a track record of Honesty, Integrity, Commitment and Vission. Even for those who do not like or who hate RW, have no other option other than supporting RW to get out of the present mess. Obviously RW cannot and will not be there forever and ever, as Nature will not permit him considering his age. Let us consider him as the lessor of the evil. If not we will all sink with the Rajapaksas. The choice is yours.

Bravo Shaveen, you must defend your mother with all your might. I want you also to reflect if she defended us the people with honesty when she sat in judgement. After all wasn’t she appointed for that very purpose?

    Regards
    Nabil

This person, Leela, always rushes in to hold a brief for the present regime. Well, that’s her right. But the sweeping statements he/she makes betrays how presumptuous and opinionated he/she is. For example, he/she says: “Just take a leaf from Sarath Fonseka. The man is no one’s hero today.” How does he/she know that SF is nobody’s hero today? On what basis does he/she say that? I am no fan of SF. But it is unfair to refer to him contemptuously as “no one’s hero”. There can be millions in the country who look on SF as the hero who won the war for the country. There can be hundreds of soldiers who respect him for the exemplary leadership given by him. Of course, you have to throw the sense of fairness and norms of elementary decency once you enter the dirty game of stooging!

I wish her all the best. I admire her courage. Sri lanka has become a nation where if you are honest, or speak the truth or ask for justice you are in serious trouble. I blame the Sinhala people for this predicament. When the Tamils were and are pulverised they all keep quite for whatever reason best known to them, mostly due to racial bias, but when the turns come to them, some time it is too late. 1989 insurrection is one such example. Sadly we never learn. Unless we learn to be fair and look at issues with the same eyes these type of tragedies are inevitable. At least this time around let the Sinhalese open their eyes and see the tragedy unfolding.

Shirani Bandaranayake entered the highest court of Sri Lanka through the backdoor. She is a political appointee who pushed out many senior judges who deserved to be promoted to the Supreme Court. I would have protested if a good judge who interpreted the law according to the true tenet of law is targeted. Here the politicians are targeting a politically appointed judge. They are attacking her using a weapon the constitutional law permits. How can you complain about that. The impeachment motion is perfectly legal. NGOs like the one led by Pakiyasothy are bank rolled by the West and will always bark against what ever is done by the government in power, be it Mahinda’s, Chandrika’s or Ranil’s. I agree with many commentators that Shirani slept with the dogs and is now getting up with fleas. Good luck to Shirani.
