Nation Destroyed Beyond Redemption

It is beyond belief why my fellow countrymen still have faith in this absolutely failed state (both ruling party and the opposition). The biggest threat to the Nation is the hopeless attitude of the so-called intelligentsia that benefits from the failed system. It is extremely sad that they deceive constituents, inducing them to have faith in the corrupt system that made this beautiful island nation a FAILED STATE.

As a responsible citizen I can say with confidence that the governance is dishonest and immoral and the Judiciary is sidelined. Those who occupy office in the other two organs are threatening it. Recently PM Ranil Wickremesinghe launched a stringent attack on the Judiciary, claiming that the Judiciary does not have the judicial power and the Judiciary is trying to hijack Parliament’s judicial power. This is absolutely false and irresponsible statement that no prime minister of any democracy should make.

Please understand the power conferred in you, the people, under the Constitution. In this country supremacy over all organs is in YOU, the constituents, and not  in any body else. This power is called ‘sovereignty’ and it includes legislative power, executive power, judicial power, franchise and fundamental rights. And this power cannot be taken away unless YOU surrender it to somebody, which can only be done with a mandate given by the people at a referendum.

When the Legislature and Executive corrupt there is no hope

The former President Mahinda Rajapaksa should be held with the full responsibility for destroying the rule of law in this country and for undermining the integrity and independence of the judiciary. Introducing, a draconian law 18A, he took the judiciary under his direct control and appointed his subservient servants to the highest office in it simply according to his whims and fancies.

Those who blame the UN, those who want to have a firm grip in the Constitutional Council that recommend appointment of judges to the Court of Appeal and the Supreme Court, thereby causing a tremendous damage to the independence of the Judiciary, should realise that there is no point blaming the government now for co-sponsoring resolutions in Geneva. Because it is the people, who lost trust and confidence in the Judiciary, complained to UN Human Rights Council. It only reduced people’s viewpoint in the resolution exposing the lacks any accountability in the justice system in Sri Lanka.

Robbing the Nation by the two organs and encouraging others to follow

The MP tax-free car permit abuse is not just another case exposing govt corruption. It is a case of paramount importance for a reason. People should understand that when the lawmakers themselves become criminals, such a country is bound to fail.

The relevant law allowing tax relief says that tax exceptions can be granted having regard to the economic development of the country, another words in the pubic interest. And nowhere the law says that the exemptions could be abused to defraud tax and to share the same with third parties. Most people holding public office in the Legislature and the Executive just did that and the irrefutable evidence was filed in the Supreme Court.

Excise special provision Law Section 3CHowever, with no regard or respect to the law governing tax exemption, on 01st June 2017 the Yahapalanaya regime, introduced another Circular with a clear stipulation that those who are granted tax exemptions to import motorcars are free to defraud the government revenue as they please (extract of the law and the regulation reproduced below). Who are the beneficiaries of this sham tax exemption offered to public officers under the new permit scheme; it is the motorcar import dealer network in this country with a bribe offered to the public officer who sells the permit for 2.2 million rupees.

The stipulation as provided in the relevant Treasury Circular dated 01st June 2017 is reproduced below:

The people of this country who hold the sovereign rights over all three organs are entitled to question the government as to how this abuse helps the National Development, when the permit holder is permitted to share the tax-revenue with fraudster car dealer.

I wish to throw an open challenge at Eran Wickramaratne and Harsha De Silva, the guys who claimed to be the cleanest of the clean. You talk about morality in politics but did everything without your limit to defend the dishonest MPs who had sold their permits to import motorcar traders, defrauding over 7 billions of government tax-revenue. And then you guys inform the people that the government has regularised the car permit systems, leaving no room for corruption.

Get me 2.25 million rupees (for each permit) and I undertake to get you any number of permits that your government issued under the new circular to the senior public officials holding high profile public offices, which are being used to import expensive vehicles liable to pay tax at the rate of 300% if not these illegal permits.

I know that you both may say that ‘we don’t cheat or steal because we believe the harm it does to society and that you are not sociopaths.

But the truth remains completely the opposite. I have some regard for Ranjan Ramanayake MP who had some degree of self-respect and courage to come and talk to me; to accept the liability for the wrong committed against people who had placed trust in him and his willingness to have his name cleaned by reimbursing the tax component defrauded on the vehicle imported on the permit issued to him.

But I know that you stopped him from doing that demonstrating your true colours to the people.

    Nagananda should gather some like-minded individuals to form a viable opposition to these outdated, corrupt politicians who haven’t a clue about decency and/or good governance and whose only desire to gain a position in government is to accumulate wealth and power for themselves, their families and hangers-on.

      Civil society must take charge. Forget both UNP & SLFP. Those are corrupt and criminal infested organisastions. 70 years of utter mismanagement of this land of opportunity should be enough for all to realize that fact. Yahapalanaya clowns have now clearly forgotten how they arrived in corridors of power. They have betrayed the revolution. People need to get in the driving seat now.         I respect your posts always, but do you think it is easy to work for a quick change in lanken society.

        People are highly corrupted and pro corruption as is the case with their representatives so called politicians.

        I tihnk only way out would be to introduce rigorous laws. But then again, so called buddhists would call it poverty levels would not allow them to charge that way.
        We need leaders that have mixed charactors – able men like Duterte in Philiphines.

The fact, that we have long resigned ourselves to, is that 80% + of the body politic in Sri Lanka is rotten to the core and unfit for purpose. Incompetent self-servers, shysters, thugs and crooks occupy the higher ground. To cap it all, the forces of law and order, and the judiciary, who should be our guardians, are running scared, taking orders from the bastards who are responsible for ruining the country. WE the People shall overcome, but not just yet. The struggle will be long and hard.

    thank you nagananda.You are a lone voice indeed while all the civil society groups including even chandra fernando have gone to bed with the yahapalanaya.Until this man ranil is kicked out again the UNP will lose.He is a born loser who never learns by his mistakes and keeps repeating them.UNP’ers will all breathe a sigh of relief if he goes.Who is to take over.I think karu should be a stop gap leader until the people get to know the others and their achievements and then the UNP rank and file should be allowed to vote to choose their leader.Slowly but surely because of ranil ,the JO is making a comeback and this is borne out by the fact that the LG elections have been unnecessarily postponed.If the government is sure of victory they would have quickly had it.

    Every letter in this article require esteem praise. The problem is that the politicians are exercising too much undeniable power by means of periodically usurped by way of passing by-laws. Today Executive is the most corrupt. It is because of his silence MR and WR and all others committing crimes and frauds.

    Best option is to introduce a new constitution, not by the politicians, but by intelligentsia, where the administrative powers be vested in regulatory authorities run with professionals with adequate regulations and audits while having a parliament of less than 30 MP’s just to pass policy matters into law, once the professionals analyze the need for them.

    Present system drains the blood from all the citizens by means of fraud and crimes. Ranil’s proposed constitution is just a rotting cabbage.

    Nagananda is a courageous man. We have had a succession of rogues rule us. They camouflage the real issues by creating religious and racial tensions and steal the wealth of the people while the fires burn. This has been the story of Sri Lanka since the Ape Anduwa times of Bandaranaike to Mrs.B to JR to Chandrika to MR to Ranil and My3. They were all a bunch of crooks who made the judges and the public servants crooks as well. The prospect of change does not seem anywhere close. I pray that Nagananda is kept safe so that he can disclose such misdeeds though it may have little impact on a population which has become deadened to these misdeeds and joins in as long as some buriyani packets come their way. So, people’s sovereignty is a remote idea in this country where it probably resides in some yellow robed thug, or a mulla like Muslim or a Tamil nationalist to rouse up the people to violence all the while stealing their wealth. It is a great game. People join in without realising the folly that they are engaged in.

    There is no question that every MP who sold their tax-free car permit and misappropriated public funds, the government’s tax revenue of over 33 million rupees, has committed a criminal offense that attracts a jail term of 10 years, provided the Rule of Law prevails in Sri Lanka and the constitutional norm that every person shall be equal before law is duly recognized and practiced in this island nation.

    Yet, in this case, in my view, RRs conduct demonstrated in this case, compared to other criminals, deserves treat him differently.

    According to RR he is the only MP who has refused to accept the additional allowance of Rs 100,000.00 given to MPs.Even JVP MPs claims this additional allowance. And he is the only one who has declined to accept the attendance allowance given to MPs. And also he is the only MP who has refused to abuse 15 million additional grant given annually to MP under the cover of decentralized budget allocation. And he does not possess any liquor shop or petrol station that gives other MPs a advantage to make a huge profit, which should’t have allowed in the first place.

    I had the opportunity to witness the two permits issued to him by MR and RK. MR’s permit contained some conditions against sale or disposal, whereas RK’s one was a open cheque given to MPs to use it as they please to rob govt’s tax revenue.

    In my view, RR, although had committed the wrongdoing, should be treated differently.

    And no other person involved in this day light robbery of public funds had the courage to accept the liability straightaway. Even in the Court of Law when an accused accepts the liability straightaway without wasting the valuable time of the Court, the Court show some degree of leniency.

      (sorry mister, this may be not relevant to the topic being addressed but I have been keeping in mind to raise this for such a long time)

      are u currently you located in Sl or Australia ? I always agree with your comments. I raised myself the question lately, who are the burgher/Euroasian representatives in our parliament ? Even if the community may be less than 50 000 across the island, there should be their political voice too in the parliament right ?

      They all talk about minorities, but who talk about euroasians and burgher communities in the country ? I think it is really unfair looking back.

      Where I live in Switzerland for the last 15 years, they are representatives to even tiny community groups.

    Without doing your homework, just for the sake of doing please don’t make unfounded allegations.

    I have made my stand very clear on this Central Bank scam expressed elsewhere. The utter waste of time of two respected judges of the Supreme Court appointed to this commission with no penal power but make recommendation to the Yahapalana Group of Companies.

    I am one of the victims suffer for denying these judges of their Supreme Court duty.

    There is a very important public interest litigation case (part heard) that is postponed from February last year for want of judges. Every concerned citizen knows that this RW + MS affair is just a eye wash, and not worth talking.

    The results of the 08 January 2015 election was what the silent majority of Lankans wanted but we are disappointed. The corrupt structure which evolved, is as robust as ever – the Suren Ratwatte exposure in CT is yet another case in point. Yesterday “The Daily Mirror” reported that 900,000 kg (yes 900,000) of narcotics was detected last year. Several fold is “undetected”.
    Nagananda is understating the gravity in “The biggest threat to the Nation is the hopeless attitude of the so-called intelligentsia that benefits from the failed system”. It must be reworded “The biggest threat to the Nation is the group of fraudsters that benefits from the failed system”. The judiciary cannot function without proper prosecution. Unfortunately the prosecutors are controlled by the fraudsters.
    We the silent majority, share your concerns Nagananda. Bernie Sanders made an indelible mark. Jeremy Corbyn was written off but he did not relent.
    Nagananda’s endeavor is noble. We need a few more Naganandas to raise their hands.

    NK is to be commended, for devoting his energy for justice, for at least trying.
    What if some well known and respected personalities also decided to speak out against corrupt politicians, hate mongering clergy etc? Wouldn’t that at least help to stir the public into action, from their current passive state?

    It might be inappropriate to say this, but I’m thinking of respected individuals like Kumar Sangakkara, who I’d presume is principled and can lend some weight to the efforts of people like NK.
    People of such standing can do a great deal if they are up for it..How else to fight this cancer, other than by a public uprising..

      Bangladesh went through a similar crisis not long ago. They too suffer this curse of political football where two old ladies have been sharing the spoils of yet another tottering virtually failed State for decades fooling a near ignorant electorate. The legal and academic community came with the via media of an administration of eminent persons as an initial solution. I believe this arrangement worked to some satisfaction for a while. The composition ideally should be former senior administrators, senior judicial officers, men from the academic community – all of impeachable and neutral reputation.

    The issues Naganda raises are quite valid. He has been campaigning very hard and all right thinking should thank him for it and support him.

    However he displays dishonesty on his part when he rushes to lay all blame on Mahinda Rajapakse. By doing it he exonerates all other rogue bastards (from Dharmishta and beyond)….

      does not look at it from a parliamentary right to make rules that come
      within Policy based Democratic means, to get economic benefits they
      are entitled to? The tax income is hypothetical and those figures make Voters look aghast! This arrangement has gone on for decades, but NK
      has also an axe to grind only under GG after his return from UK. Carry
      on Sir, whilst there are more day to day issues that need more real
      action.

    Mr Kodituwakku hats off for the write up. MS and MR do not know where the country stands at present. Both are acting deaf and dumb. The country is like a volcano and people are really suffering from all corners. COL,total mismanagement,corruption at the highest levels including the two rulers , so called ministers doing nothing but trying to impress their leaders making comments at media etc. They live in luxury while the poor has become poorest. Is it a curse fallen on our motherland.

    I know you well during our tenure at the airport and I know how honest and disciplined you were. Wish you the very best in your battle against injustice and corruption.

    I just read with amusement the signing of the contract to build the World Capital Centre WCC in in the heart of Colombo. While the country is burning these fellows are playing the fiddle. What a joke. They did not mention about the kick back
